All right, the acceptance of tonight's agenda. 00:01:22
So moved. 00:01:26
2nd I have a motion and a second for the agenda. Any discussion before we get started? 00:01:28
All in favor say aye. Any opposed? 00:01:33
That carries. 00:01:37
We're going to open a public hearing for. 00:01:40
The adoption of the *** cap development. 00:01:42
Levy and tax rate. 00:01:46
This is the Commission. 00:01:51
Nurse Cap. 00:01:52
It's a requirement from the DLGF. 00:01:58
This was a. 00:02:00
How do you want to explain it, Diana? I'd be happy to. 00:02:02
So the way that the DLGS website gateway works is once we put in the advertised rates for taxing, those are supposed to all auto 00:02:07
populate onto our form B. 00:02:11
4B and form fours which are the. 00:02:16
Forms that we utilize to adopt our budgets through their system and filing. 00:02:19
On the 29th of December, I received our first 1782 notice for the county. 00:02:25
And while reviewing all of the approved budgets, specifically for our levy rate budgets, I encountered an adjustment that I was 00:02:31
not expecting, which was an adjustment. 00:02:35
To the CCD budget as published. 00:02:40
And it cut it in nearly in half. 00:02:42
Which was my massive red flag because I knew that the income for that fund. 00:02:46
Was not. 00:02:51
Nearly that small. 00:02:52
Considering what it's being utilized for. So I immediately went to Gateway to see what had occurred. 00:02:54
Was able to research that it was in fact on our form 3. We did in fact advertise it. There was a glitch inside the system where it 00:03:01
didn't translate to the 4B or form 4. 00:03:05
So the 1782 notice hit my inbox at 7:00 AM. By 8:15, I had reached out to both the DLGF and Baker Tilly. 00:03:10
To find a resolution to the issue. 00:03:17
They reached back out to me and according to IC6-1 point 1-17-16 subsection I, there is an exception where a rate has been 00:03:20
advertised, but for some reason there was a glitch in their nifty little system that. 00:03:27
Failed to populate it on our adoption paperwork. 00:03:35
So it does lessen our income of that fund. 00:03:39
By equal or lesser to 5% of the levy increase or $100,000. And since the 5% of the levy increase is actually 84805, that is the 00:03:44
penalty that will be receiving on income for that fund. But what it does by readopting this rate that was in fact advertised and 00:03:50
should have been on the official adoption paperwork. 00:03:56
It supports the budget that the County Council adopted for that fund. 00:04:02
Allowing us to meet. 00:04:07
Our actual obligations with that fund so. 00:04:09
The DLGF requires that a public hearing take place. 00:04:12
To allow the public to comment on this rate adoption that should have occurred back in October. 00:04:16
And then once the public hearing is closed. 00:04:22
The next item of business is to just vote to re adopt the rate that had actually been intended to be on those adoption paperworks. 00:04:26
So this rate was presented to the council and. 00:04:31
Processed through all of the budget season last year and was just missing off of the final documentation and that was a glitch due 00:04:38
to the DLGF website. 00:04:42
And this is the full right? 00:04:48
Correct. 00:04:49
All right. Is there any discussion among? 00:04:52
Counsel. 00:04:54
Is there any the pub? 00:04:57
I was going to say the public hearing on this. 00:04:59
All right, seeing none, we will. 00:05:03
Adjourn the public hearing. 00:05:05
What about the A? What about the adoption rate for? 00:05:07
The levy. 00:05:13
That that was OK. 00:05:16
Right. It was just that that's what we're taking up right now you guys are about to vote on That was the one that was wrong. 00:05:19
That's the levy rate for the CD. 00:05:23
So it was correct on our ad. 00:05:29
It was correct through all of our budget season when we printed our final form for for everyone to sign, it had glitched inside 00:05:32
gateway and not. 00:05:36
Copied over into the adoption column. Seems like there's two rates here, one for the CD and one for our. 00:05:40
Levy, the CCD is part of your levy. It's, it's inside the levy, inside the levy that's inside the point. This is how, this is how 00:05:47
the DLGF. So this doesn't change any of our budget numbers or anything. That's just actually fixes what we submitted. I did not 00:05:54
understand that. My apologies if I didn't explain it well enough, right. 00:06:01
Inside it's inside it. 00:06:07
Rolled up, right. So what was our rate last year? 00:06:10
Do you know that half of this? 00:06:13
So 167. 00:06:14
Is that right? No, I know that for the for the CCD, right. I know. But for the total levy, right. 00:06:16
I don't have that information in front of me, but I'd be happy to. 00:06:22
I would look it up for you. I don't have that off the top of my head today. I apologize. 00:06:25
OK, it's fine. 00:06:29
All right, any other discussion? 00:06:31
We will now adjourn the public hearing. 00:06:35
I am one of. 00:06:38
New businesses re adoption of the Floyd County tax levy and tax rate. 00:06:39
Specific to the CCD. 00:06:43
Specific to the QMC CAPS Development Fund. 00:06:45
Is there a motion for a new business #1? 00:06:49
I'll make a motion to approve. 00:06:54
New business #1. 00:06:56
2nd. 00:06:57
All right, we have a motion in a second. 00:06:58
Any discussion before we vote? 00:07:00
Yeah, I'd just say I didn't feel there was enough justification for doubling that rate, so. 00:07:03
I'm opposed to it. 00:07:07
Any other discussion? 00:07:11
All in favor say aye. 00:07:13
Any opposed? 00:07:16
Aye, that carries. 00:07:16
All right. We will now open a public hearing for our additional appropriations for tonight. 00:07:23
Is there any public comment on? 00:07:28
What we're going to do in this meeting for additional appropriations. 00:07:31
Seeing none, we will adjourn the poll. 00:07:36
Now move to approval of minutes for our December 9th, 2025 meeting. 00:07:39
So moved second. 00:07:44
There's a motion second for approval of minutes. Any discussion? 00:07:47
All in favor say aye. 00:07:51
Aye, any opposed? 00:07:53
That carries. 00:07:55
Item number 2. 00:07:56
Mr. Stanhope. 00:07:58
Thank you and welcome to 2026. 00:08:05
I'd like to start out by saying a couple of things about the number of items that I have here with regards to just having come out 00:08:10
of the budget process. 00:08:14
As you know, I was fairly new to the position we were taking over the funds we had a lot of. 00:08:19
I had a lot of growing pains during the process. I met with Danny and Jim. We went through the budgets. 00:08:25
Thought that they were fairly straightforward at the time. 00:08:31
But in the air of trying to make everything much more transparent, we were consolidating what was at the time. 00:08:35
Department lies. 00:08:43
Departmentalization in within the funds. 00:08:45
It led to convoluted ability to clearly see the financial picture on a lot of these funds. 00:08:49
So, umm. 00:08:55
With that and was saying that. 00:08:56
We tried to bring all of that into light. I was also creating what I felt was a. 00:08:58
Pathway for success with the all of other bonds that the county. 00:09:03
Currently holds all the debt. 00:09:08
Obligations that we hold. 00:09:11
And identifying where they were located, where they were being paid from. 00:09:13
I hope that wasn't me in in. 00:09:17
Bringing all that together. 00:09:22
Now what was asked of us was to put the budget together. 00:09:23
While all this was in a moving part process. 00:09:27
We're also dealing with the Teamsters Union. 00:09:31
Well, and what the outcome of that was going to be we. 00:09:33
Kind of knew, but we didn't have it in writing so we couldn't technically budget for that. 00:09:38
So in saying a couple of these things, what I'd like to ask is that. 00:09:43
You understand the reasoning for having so many items on the agenda this evening. 00:09:48
Oh, and one last thing I would like to just share with you is that. 00:09:54
You know, I'm pretty good at 4:00. I like to think I'm pretty good at forecasting. I try to do the best I can. I was building. 00:09:58
Forecast on data that I wasn't 100% assured of. 00:10:03
And, umm. 00:10:09
As I moved into this position step by step after the budget adoption. 00:10:10
There were some identified gaps. 00:10:15
And my promise and commitment to you, the Council, was that I wouldn't be here every evening with a through Double Z asking for 00:10:18
additional or. 00:10:22
Adjustments to current budgets. I'm trying to get these squared away. 00:10:27
Here night one, there still may be a few blips throughout the year. 00:10:31
I'd like to say that I. 00:10:36
There wouldn't be but, but we never know what challenges are going to lie ahead of us. 00:10:38
So with that being said. 00:10:43
I'd be glad to We could start going through each of these independently and and I'll answer any. 00:10:46
Concerns or questions that you might have. 00:10:51
OK. Thank you. 00:10:53
1A I guess our 2A is this is actually just the 2026 gold bind. 00:10:56
These are the services that have been provided by all of the administrative functions currently. 00:11:02
Pending the The fund is 4801. 00:11:09
Or not. I'm not sure what you're going to do, as council and commissioners are going to do with the balance of the funds. 00:11:12
But we do have obligation, financial obligations that need. 00:11:17
Excuse me, need to be paid. 00:11:20
So the professional services are maker Tilly. 00:11:22
I think. Let's see. 00:11:26
Orange and Thornburg, I think our own local attorney, the Fox Law Offices. So it's all wrapped up in. 00:11:28
In a lot of these professional services, requests for. 00:11:34
For this first item that go bomb. 00:11:37
Do you want to do these independently or all together? Or let's do. 00:11:41
If we can, let's do A&B together, yeah. 00:11:45
The 2nd 2B is the Bridgend. 00:11:49
These also we know that. 00:11:52
In my learning experience and in conversation with law. Fox Law Offices. 00:11:55
They've also educated me a little bit more about I don't have to wait until. 00:12:00
The money is in the fund, the appropriations are set and we can go ahead and try to square this away. 00:12:04
With Council knowing what our obligations are going to be based on the outcome of the. 00:12:09
Are the implementation of the receipt of the monies themselves so? 00:12:14
At the December meeting, I think the bridge bond. 00:12:20
Fund was created. 00:12:22
I don't think there were any appropriations at that point set. So what I'm asking is that we can make sure and set appropriations 00:12:25
for. 00:12:28
The professional services. 00:12:31
And then just setting the. 00:12:33
The Bridge Project fund. 00:12:35
Lying in place so that as we get the expenses. 00:12:38
Associated. 00:12:42
From uh. 00:12:43
These projects. 00:12:44
We're ready to move forward with paying our vendors timely. 00:12:45
So I have a couple questions on on 2B. 00:12:50
The four million that you've got in the bid? 00:12:54
Bridge project is that our portion of the this that that doesn't include the Q. 00:12:57
Not the Kim Cap, the. 00:13:04
The grant part of it. 00:13:07
Of the reimbursement points. 00:13:09
No, this is our obligation. 00:13:10
This is what the bridge, the bridge bond is going to generate. 00:13:13
To $4.2 million. 00:13:16
So. 00:13:19
Our obligation for Bridge 51 is 1.6. 00:13:20
I think $1.67 million. 00:13:23
This does not include the $8 million federal funding. 00:13:26
Yes ma'am. This also includes Bridge 27 as well. Those were the 2 bridge projects that were identified in the request for the 00:13:33
bridge bond. 00:13:36
I have one more question the. 00:13:44
The GO bond, the fund balance says 4,000,001 Eighty 749430. 00:13:46
Is that the total bond that? 00:13:52
And we? 00:13:55
If I remember right, that was split. 00:13:56
Half and half between. 00:13:58
I believe that was the initial discussions. I don't know if there's been anything solid. 00:14:01
So there was an ordinance that was passed. It wasn't OK. 00:14:05
Yeah, and it split half and half, right? 00:14:09
So. 00:14:13
Are there going to be two lines in that fund? 00:14:14
You should actually. I believe they're further on in the agenda underneath. 00:14:18
Oh, OK, we'll get there then. 00:14:21
OK. Thank you. 00:14:23
Is there a motion for 2A and B? 00:14:26
Move to approve as advertised. 00:14:31
What's happening? We have a motion and a second for 2A and B any further? 00:14:34
Questions or discussion now the professional services that for engineering and. 00:14:39
Yes, yes. 00:14:43
Legal and engineering. 00:14:45
And and you just want to. 00:14:47
Bill pay the bills when they come due, yes. 00:14:49
At the end of the bridge project that may wind up being 157 or 167. You at this point you don't really know. Yes, Sir. 00:14:51
Any further discussion? 00:15:01
All in favor of 2A and B say aye. 00:15:04
Aye, any opposed? 00:15:06
That was scary. 00:15:08
2C is the MVH restricted fund so. 00:15:10
One of the things that. 00:15:15
In discussion with the Commissioners and operations as we wanted to take all of the salaries out of 1173, move them into 1176, the 00:15:17
unrestricted portion. 00:15:22
Were eligible to pay the bond out of 1173 because of the. 00:15:27
Link of the bond itself. 00:15:32
To the project. 00:15:33
Umbrella of allowable expenses so. 00:15:35
We're asking to allocate the bond payments, which I didn't know prior to the budget process. 00:15:38
Contractual services. 00:15:44
In paving, I've left it just a little bit short because. 00:15:46
There were still some salaries linked to the 1173 fund initially when I did the budget, but as we grew and we decided we wanted to 00:15:51
move those out of the restricted fund into just a regular. 00:15:56
MVH Fund. 00:16:02
It allowed us to push that paving up to $1,000,000. 00:16:03
That also, since we didn't have the wheel tax, gives us our million dollar Match for Community Crossings grant. 00:16:08
That we can now. We now know that we have that committed. 00:16:14
So we will also be eligible for the full amount of the Community Crossings grant as well. 00:16:18
How much is the community concentrance? 00:16:23
It, I think last time I talked to Nick, it was, it was just at $1,000,000 as well. It's like 900 and. 00:16:25
Some other thousand and that's going to be used for roads. That's paving, yes. Paving for roads and bridge paving, Yes ma'am. 00:16:32
And then the last three projects the. 00:16:42
Bridge 58 about. 00:16:45
Baylor, Weissman Road and the Highway 150 break. 00:16:47
Those are ones that I have presented to you back in November of 25. 00:16:50
The projects didn't get taken off in time. 00:16:55
This is also a most. These all three are 8020 matches which we are going to. 00:16:58
80% or 20% of this can be paid from 1173, the restricted MVH fund, we're going to transfer that money over into the. 00:17:05
9124 fund to follow the guidelines for grant reimbursements. 00:17:13
After consulting with the honors office to keep this nice and clean. 00:17:18
But this is just a reintroduction of these two. 00:17:22
These two are these three projects. 00:17:25
Which didn't get off the ground in 2025. 00:17:28
But will definitely be. 00:17:30
Underway here in 2026. 00:17:33
Is there a motion for two? 00:17:38
Motion for 2C as advertised. 00:17:41
Second motion and a second for 2C. Any further discussion? 00:17:43
Diane, how much money is in that fund? 00:17:48
You don't say usually they say how much is in the front. 00:17:51
NBA restricted, yes, 600 and they've covered what we're appropriating here. Well, they they just sent down, I think. 00:17:53
The dollar amount so it would. 00:18:01
They're off. Diana's office will do is they'll take the. 00:18:02
I think it's the total is like. 00:18:05
Yes, split equally between the two. Yeah, because of our. 00:18:09
The income projected for this fund supports the budget he is currently requesting. OK, OK. 00:18:13
To be perfectly honest, at this point we wouldn't let them come forward and ask about it. That's not going to be supported by the 00:18:18
fund because. 00:18:21
Clean up too many of those the last couple years. 00:18:24
And I'm not going to spend more money than what I have. 00:18:27
Any further discussion? 00:18:31
All in favor of 2C say aye. 00:18:34
Aye, any opposed? 00:18:36
That carries. 00:18:38
On 2D this is the edit fund. Just some adjustments. Again, these are more like. 00:18:39
Some cleanup things that. 00:18:44
That maybe I've missed because I also built a complete pay schedule. 00:18:46
For employee salaries. 00:18:51
Once we got through. 00:18:54
All of the salaries lined out. 00:18:55
It I had seen where I had over appropriated the other employees salaries. 00:18:57
So want to reduce that down contractual services. 00:19:02
That line, apparently I missed that line completely, so we wanted to actually get that back in here. Same with utilities. 00:19:06
I'm not sure why I missed it, but I did and I'm just asking that it gets added back in here. 00:19:13
And then the redevelopment behind that just brings that up to? 00:19:19
Let's see, the bond itself is 304,000. I think I've only requested 30,000 at the time again. 00:19:24
While I was building the bond structure. 00:19:30
It opened my eyes a lot. To where? 00:19:33
Where all these bots being paid from? 00:19:35
And this one actually had some. 00:19:37
Possibly been designated in the. 00:19:40
Legal paperwork to be paid from the end of funds so. 00:19:43
It's now being paid from yet a fund. 00:19:46
And then the. 00:19:49
We have that 400. 00:19:50
$420,000 purchase that we placed an order with the state for. 00:19:52
The salt line. 00:19:57
Just trying to fit salt in wherever I can with whatever funding I've got. So that's why I sell it's here. 00:19:59
And then the last part of the system transfers. 00:20:05
The transfer to another fund isn't allowed on the edit fund. It was for some election. 00:20:08
It was just for some election. 00:20:15
Contractual services. 00:20:18
And then again the parts behind. 00:20:20
Just transferred the parks bond down to try to get that back to. 00:20:22
We're asked to be able to. 00:20:26
That's the payment for 2026. 00:20:27
Motion to Approve 2 and E. 00:20:30
2nd we have a motion and a second for. 00:20:33
To D&E. 00:20:36
Any discussion or questions for Stan? 00:20:38
All in favor say aye. 00:20:43
Aye, any opposed? 00:20:44
Both those carried 2F is just I'm sorry, just a question. 00:20:46
Do we really want to go through each one of these line by line? 00:20:51
You can always make a motion for all of them if you would like. 00:20:57
Stan, how far down do you go? Do you go to? 00:21:01
And every benefit is clean up like what you. 00:21:05
Already seen at this point. 00:21:10
And we're on F right now. 00:21:14
I'll make a motion to approve afterm. 00:21:16
2nd. 00:21:19
There's a motion a second. 00:21:20
For items 2F through M. 00:21:22
For budget cleanup. 00:21:25
Any discussion on any of these? 00:21:27
Agenda items. 00:21:30
Seeing none, all in favor say aye. 00:21:34
Aye, any opposed? 00:21:37
All those car. 00:21:38
Thank you very much. Just like to make a comment no matter who stands at that podium. 00:21:40
It's either freezing in this room or it's hot in this room. 00:21:45
You had Donnie Hair sitting in this office, I mean in this meeting room the other day. Not one person made that comment. 00:21:48
But if I may say Donnie's doing a spectacular job, management facilities and hopefully our meetings here will be short lived Will. 00:21:55
We're moving on to bigger and better things in the very near future. 00:22:03
Or can you give us just a little bit more on there? We're down to Item 33. 00:22:09
Stainless is still used. They can. 00:22:15
Yes, Sir. OK, go right here. 00:22:17
Just to give you a really brief we lost our planner and. 00:22:19
Gabrielle also has decided to leave, so Nick's had to take on a few additional responsibilities. 00:22:24
So I'm going to. 00:22:30
Try and pull my part as well to help Nick. 00:22:32
Through some of the issues that. 00:22:34
May arise. 00:22:36
If I leave any information out or I'm not able to answer your questions, I will certainly gather all of it and have it to you. 00:22:38
First thing tomorrow morning. 00:22:44
These two items, and I'm kind of lump them together if I may, because they're somewhat cold. 00:22:47
Correlated are all payments obligations from the the Revolving Loan Fund. 00:22:52
Fund, 4938. 00:22:58
There's 100. Actually there's $164,676 in. 00:23:01
30-4 cents currently. 00:23:05
In that fun. 00:23:07
The fund hasn't been utilized. 00:23:09
Probably in over a decade. 00:23:11
So in saying that, the first the FCRLR loan agreement is with Red Wire? 00:23:13
There is a signed agreement that was handed to Nick and I that stipulated that in the first period of red wire taking occupancy. 00:23:21
Of their new facility that they would be granted a $312,000. 00:23:30
Loan A forgivable loan. 00:23:37
From Floyd County from the. 00:23:39
The uh. 00:23:42
Revolving loan fund. 00:23:44
There are stipulate their economic stipulations attached to that. I could read those to you or I could have them sent out to you. 00:23:46
For your evaluation if need be. 00:23:53
This has to be vetted by both the commissioners and the council. It was presented to the commissioners and through last night. 00:23:56
Just for your information. 00:24:02
I but. 00:24:04
Janus has also gone through redevelopment as well. Yes Sir, thank you. 00:24:07
Yeah, Yeah. Actually redevelopment started in when? 00:24:11
They approved it, allowed it to go to the commissioners. 00:24:14
Which I approved it and it just would need a signature from. 00:24:17
The Council President, with the Council's approval tonight. 00:24:21
Tim, the second part of this is. 00:24:27
If Tim Tweet was here from proper pilots. 00:24:30
They are another organization that has taken Occupancy and Innovation Park. 00:24:34
They won the award, They won several awards. That's why we still was here to explain to you what that program is all about. But 00:24:39
it's a very innovative program. 00:24:44
Which is. 00:24:48
The epitome of what Innovation Parks. 00:24:50
Core mission is. 00:24:53
And that is to encourage new business, innovative new business to take occupancy in. 00:24:55
Floyd County. 00:25:01
In saying that. 00:25:02
Proper pilots have also. 00:25:05
Been granted the opportunity for a $50,000 loan. 00:25:08
First payments 25,000. 00:25:12
Again, this is A and then the second payment in three years. 00:25:14
Once he meets additional economic requirements. 00:25:17
And then this is also a forgivable loan. 00:25:22
But it's to help buy equipment or real property in both of these situations. 00:25:26
That. 00:25:31
Currently you're taxed. 00:25:33
We're not sure what the impacts are going to be moving forward so. 00:25:35
I think that was the intent of as to why these were given in the form that they were, because we were recouping. 00:25:39
Portion of this and the taxing portion of. 00:25:45
Our process anyway. 00:25:48
So what is the balance in the fund? 00:25:50
Where these would be paid from? It's A16467634 and how much? 00:25:53
Are we going to be paying out by the end of this year? 00:26:00
The end of this year we'll have the just the 25,000 to proper pilots and the 312,500 to. 00:26:03
Red wire, so it's. 00:26:11
500. 00:26:15
But if there's only 167 there, where's the rest of the money come from? 00:26:18
I have some suggestions, but I. 00:26:25
Think we can discuss this? 00:26:28
This was the the 312 five was handed to us obviously from previous. 00:26:31
Administrations, but. 00:26:37
In that I don't think the fund even had that money in that at that time. 00:26:39
Regardless. 00:26:43
Our obligation is to move forward. 00:26:44
My suggestion would be. 00:26:46
Will exhaust the non reviling loan fund. 00:26:48
But I think it needs to come from an economic development. 00:26:51
Fund. I've got an economic development line in the edit fund that could carry the balance. 00:26:54
For the first payment of 100. 00:27:00
72,800 and. 00:27:02
$24.00 so. 00:27:04
So you've already got a line in at it. 00:27:05
That would cover the remaining balance. 00:27:08
OK. 00:27:11
Stan, I understand that the red wire we're contractually obligated, but are we obligated as well? 00:27:12
On the second one, proper pilots. 00:27:19
No, I I don't. 00:27:24
Think that we're under an obligation other than the. 00:27:26
We're we're, we're the last stop in the obligation. It's gone through redevelopment and it's gone through the commissioners. So 00:27:29
we're we're the last stop. 00:27:33
And, and like Stan said, there are. 00:27:38
Benchmarks to meet. 00:27:41
Along the way. 00:27:43
For, for this as far as so when you say forgivable loan, they're going to pay it back, there's going to be an interest is that. 00:27:45
Or is it totally we're just giving them the money? 00:27:52
Yeah, so I'm just picking winners and losers. 00:27:54
How do you just pick two businesses and provide them with money and not these other businesses so it's not a loan? 00:27:57
To be fair. 00:28:02
We've opened up. 00:28:04
The. 00:28:05
The RFP process for. 00:28:07
All businesses too. 00:28:09
To inquire about. 00:28:11
Proper Pilots has employment and production metrics included in their loan. 00:28:13
That they're required to meet. 00:28:19
For it to remain a forgivable loan. Is that accurate? Well, their first installment. 00:28:21
Has no stipulations their second installment. 00:28:26
They have to have three full time employees making over $60,000 or they have to have a gross revenue base of $180,000. 00:28:29
And they have to have their office. 00:28:36
And the Noble Park. 00:28:38
Right now they're operating out of. 00:28:40
It's gotta be a NOLA party. Yes man. Noah Park. 00:28:42
Right now, because they won the award, they are housed in the whistle stop through the end of 26 I think. 00:28:45
Right to conduct their business. 00:28:50
MRI Does Nova Park have its own text? Its district now would not approve so. 00:28:54
They're not. It's not even going to general fund either. 00:28:58
They they have a TIF district. Is that what you're talking about? Yeah. 00:29:02
But it doesn't generate enough money yet. 00:29:09
To pay these. 00:29:12
Saying we're pulling money out of the county. 00:29:14
We're going to, we're going. It's going to have to come out of the edit. 00:29:16
Because any to be honest with you. 00:29:20
As I'm looking through the bond payments the the bond for Innovation Park. 00:29:22
I was hoping to use a portion of the any tip money that may be generated. 00:29:28
To pay the bond. 00:29:33
Which would reduce the the need to gather for money from elsewhere. 00:29:35
I'm going to confess I did not read the agreements word for word, not seeing that they were in there, but. 00:29:38
Does the agreement specifically say it comes out of the? 00:29:44
The the fund that you were talking about earlier. 00:29:49
Revolving revolving loan not revolving loan fund. 00:29:52
I I have a problem with that. 00:29:55
I don't. 00:29:57
Really have a problem incentives incentivizing, but I think the documentation needs to. 00:29:58
Say what we're going to do, and right now there's not enough money in there to pay even the first payment. 00:30:03
Out of that fund. 00:30:10
So I'm not a fan of signing these agreements without it saying exactly where that money is going to come from. 00:30:11
I'm not saying I won't. 00:30:19
Sign off on the incentive. 00:30:22
Incentivizing me. 00:30:24
I probably will, but the documentation needs to be called. 00:30:26
Correct, that's where I'm at with this. 00:30:30
Are you committing to paying it out of that economic Development Fund? 00:30:35
Are the commissioners need to approve that? 00:30:40
Part or it needs to say it in the agreement. 00:30:43
I don't know. Yeah. I was gonna say, is there a deadline for this? 00:30:50
That I understand what you're saying. 00:30:55
The red wire part worked contractually obligated. 00:31:00
So there will be money moved into this. 00:31:02
Fund agreement. 00:31:05
For that. 00:31:07
Now some type of economic development funds. 00:31:08
We need to know where. I mean, we need to know. 00:31:12
Yeah, I agree. 00:31:15
That's going to be up to the commissioners to say. 00:31:17
Fools from. 00:31:19
What can we table this until they have discussion on this? 00:31:21
I don't think I. 00:31:25
I think either the agreement needs to be. 00:31:28
Revised. 00:31:32
Or. 00:31:33
The money needs to be put in that fund to pay it. 00:31:34
One or the other. 00:31:36
Before I would agree to. 00:31:37
To vote on this, that one or the other there were. Those two things needs to happen. 00:31:40
With the agreement with red bar is a sign sound degree that that's OK. 00:31:44
Kind of taken that off of the table, OK. 00:31:48
The proper pilots we can pay from this fund. 00:31:51
Right. And then, then the balance of that money's then we could find a, an additional economic Development Fund or funding source. 00:31:53
To pay for the red. 00:32:02
And I think so. They're saying we really don't need to vote on a. 00:32:05
No, I think, I think we need to vote. 00:32:09
I think a is a sort of. 00:32:11
We have to vote on it. I mean, I think that's improper pilots is a. 00:32:12
It's a program. Maybe they're dependent upon this. I I haven't talked a lot with Tim. 00:32:17
I think they presented the redevelopment they did, but. 00:32:22
That I did, yeah. And I want to support the business. I'm just saying we need to make sure we have the money. I think your 00:32:25
conversation, if I may, is, is. 00:32:29
That that's a conversation for. 00:32:33
Why would we ever get into an agreement when we don't have it in in place? 00:32:35
I think if we evaluate these in reverse order here, we look at proper pilots first. 00:32:39
They we know that we can manage that. 00:32:45
If we took took the red wire. 00:32:47
We can't. 00:32:49
Man, it's either one of. 00:32:51
We can manage proper pilots from the number of revolving loan fund. 00:32:52
Move forward with that program. 00:32:56
Because it's a very innovative program. 00:32:58
Positive for what innovation Partner Park stands for. 00:33:00
Red wire is a contract that. 00:33:04
We just cannot enter into. 00:33:06
Moving forward. 00:33:09
Without having vetted all the funding. So when is that? 00:33:10
Payment due to red wire. 00:33:14
I've got the claim ready to go. It's it's. 00:33:18
Have they taken? Have they taken occupancy? 00:33:20
Yes. Umm. 00:33:22
I don't know. 00:33:23
They officially well. 00:33:25
I think they're in there. The grand opening is probably several weeks away and I think they still have a couple of experiments 00:33:27
they're still doing out at the 150 location, so. 00:33:31
They can't. 00:33:36
Physically move those those those experiments just yet. 00:33:37
To to get everything out of that location. So if we table a. 00:33:40
Well, that's my, that's my issue, right? Is if we're voting on 8 tonight, we need to know where the funds are coming from. 00:33:46
I understand what we're contractually obligated, but we need to figure out and have a funding source for. 00:33:51
Yeah. 00:33:56
When is the? Is the contract dated and? 00:33:58
The daily move in They're expecting 312,000. 00:34:01
There I do know that in a recent conversation they were anticipating payment for the 312. 00:34:04
So the go ahead. 00:34:11
The contract says the county warrants that will make every. 00:34:15
It will make every effort to make the funds referenced in 3D the 312,000. 00:34:18
Available for disbursement to the borrower in a timely manner. 00:34:24
I don't know what timely means. 00:34:27
In every effort. I'm not sure what every effort means. 00:34:30
I just I have a problem voting on something. We don't know where the funds are. The funds are there, but. 00:34:33
I mean. 00:34:37
I'd like to specify where we're. 00:34:38
I don't. I don't disagree at all. 00:34:41
I agree with you 100%. 00:34:43
But keep in mind this is. 00:34:45
The commissioners that are going to be moving money around. 00:34:49
To to pay this, it's not going to be the council side we're. 00:34:52
We're blessing the process basically and but if we want to table, we table that's. I have no objection to that. That's I just want 00:34:56
to. 00:35:00
Be clear that. 00:35:04
The commissioners will be moving money out of. 00:35:05
And economic Development Fund into this revolving loan fund. 00:35:08
To to shore it up. 00:35:12
Or it will be paid directly from the Economic Development Fund, depending on because we've recently learned so nifty new laws. 00:35:13
1st please we can't move money out of it so it would be paid directly from. 00:35:21
Economic. 00:35:28
Is there all would be paid after so? 00:35:29
Is there a joint meeting coming up in January? I believe it's on the 16th, but that does not leave us. 00:35:34
Enough money for an advertisement of additional appropriations. So it would require a line transfer at that point if you can find 00:35:41
the monies to move. 00:35:44
And then we could do a follow up, additional appropriation if needed to shore up wherever you moved it from. 00:35:49
Is that appropriate? 00:35:55
Acceptable. 00:35:58
I can make that happen, that's for sure. I will happily help Stan make that happen. 00:36:00
And we meet our obligation. But I think the the point being. 00:36:06
Is contracts can't be signed. 00:36:10
Commitments can't be made with financial obligations of funds that don't exist and. 00:36:14
There should be a. 00:36:18
Conversation moving forward. 00:36:20
On any commitments, I agree. 00:36:24
Yeah, yeah, because and they clear, concise. 00:36:27
Funding source should be identified. 00:36:30
Regardless, do we know how much that fun started out with and how it was dispersed? 00:36:33
You talk about the revolving loan fund. Yeah. 00:36:38
I'm on redevelopment and I. 00:36:42
All of 2025 and from the conversations that were had there. 00:36:44
It hasn't been utilized. 00:36:48
It hasn't been anything issued out of the revolving loans in almost a decade. It's been at that, It's been at that. 00:36:50
Amount so I guess why did we sign it contract if we knew there was my thoughts are they were going to pay it out of. 00:36:56
Edit Edit Yeah. 00:37:02
And and now they're. 00:37:04
Now they're wanting to split it. OK. 00:37:05
Or you know. 00:37:07
Having and I think the only the only reference to that Mister Joy is the fact that it was identified in the contract itself. It. 00:37:08
It's specifically stated non revolving loan fund if if I'm if I'm reading it right. 00:37:14
But if it does also allow us the latitude to find. 00:37:19
It doesn't say the doesn't. 00:37:23
Tied 100%. I don't know that I don't think it requires, no, I agree with you. I don't think it requires that it has to come out of 00:37:26
that. 00:37:30
So I think. 00:37:34
You got to make every effort to figure out a way to pay. It is basically what it comes down South if we table to the joint 00:37:36
meeting. 00:37:38
Yes, A. 00:37:41
Yes, and take up B tonight. 00:37:43
Yes, we can do all of those things. 00:37:45
You good with that? 00:37:47
Absolutely. OK. 00:37:48
I mean it. 00:37:51
The issue I guess. 00:37:53
The bottom line is we're obligated to pay based on the contractual. 00:37:55
Signing that's been passed out, give me a line transfer that covers it tomorrow when the Council be comfortable with us going 00:37:59
ahead and issuing it knowing that a line transfer is coming forth to cover. 00:38:04
And then I think at the joint meeting we could. 00:38:10
This could be a. 00:38:12
Point of discussion. 00:38:13
Stating that. 00:38:15
These things need to be vetted financially before all contracts or. 00:38:16
Put together and committed to. 00:38:21
That way we don't. 00:38:23
We don't delay our payment to our. 00:38:25
A great organization or vendor who has been committed to Kennedy. 00:38:27
But. 00:38:31
All right, so there's. 00:38:34
There's our options. We can. 00:38:36
Table A to the joint meeting or we can authorize. 00:38:37
Transfer. Well, no, you can still table it. 00:38:41
But if he gets me the line paper, the line transfer documentation tomorrow. 00:38:43
Knowing that it's coming down the line, the council. 00:38:47
Knowing that there is going to be a transfer. 00:38:50
To cover this this payment. 00:38:53
Comfortable with that's going ahead and processing it so that our commitment is met they can wait another two weeks I mean they 00:38:56
can wait another week I. 00:39:00
I think they can. 00:39:05
I was just checking. 00:39:06
As per Steve's conversation, there's another date certain on there, right? I think we should wait. 00:39:09
I'll, I'll leave it up to, to you all to make the motion and. 00:39:15
And I'll make a motion that we table 3A to the. 00:39:18
Joint meeting on the 16th and we take this up with the commissioners about how they want to fund that. 00:39:26
Do you want to include the? OK, sorry, go ahead. 00:39:31
I'll just let's just keep that clean and let's just do 2A. 00:39:35
Just try it. 00:39:38
Is there a second 38? Is there a second for tabling 3/8 to the joint meeting? 00:39:39
I'll second that. 00:39:43
We have a motion and a second for tabling. 3A. Any further discussion? 00:39:44
All in favor say aye aye. Any opposed? 00:39:49
All right, we'll take that up at the joint meeting. I'll make a motion to approve 3. 00:39:53
As advertised. 00:39:58
Is there a second? 00:40:02
I'll second it. 00:40:07
For discussion. 00:40:10
What do you all got? 00:40:12
I'm still. 00:40:14
My apologies. 00:40:17
But uh. 00:40:18
This contract has not been signed, correct? 00:40:19
For three. 00:40:23
I talked in the Dickson I. 00:40:26
Yeah. So how binding is it been signed? 00:40:30
I'm sorry, Sir, how binding is it if it hadn't been signed the Commissioner? 00:40:32
They signed it last night. 00:40:36
Right. 00:40:38
What you have is documents that was sent to you prior to those meetings, so your backup documentation doesn't have the signatures 00:40:49
like the garden. Since then there was a meeting last night with proper pilots were signed off on by the commissioners. We have the 00:40:54
original document for signature 29. 00:40:58
OK. So it has in fact been signed? 00:41:06
OK. 00:41:09
And if I can just speak to please. 00:41:11
To the company a little bit. 00:41:14
It's it's a startup company that's gaining a lot of traction. 00:41:17
I don't know what the growth. 00:41:21
Potential is. 00:41:23
But the. 00:41:26
Owner of the company. 00:41:29
As a Floyd County resident. 00:41:30
And he wanted to keep it in Floyd County, and I believe that. 00:41:31
Louisville offered him. 00:41:34
He's been enticed by the women, right? He is. 00:41:36
And uh. 00:41:39
And not only does you want to stay here, he's. 00:41:40
Telling other people in the industry about Nova Park. 00:41:43
So he's a, he's a good ambassador for for Nova Park. 00:41:48
I just wanted to get that out there, that. 00:41:52
And honestly, I agree with all that and I think we need business. We've invested quite a bit in Nova Park. We need to get. 00:41:56
People in Nova Park. 00:42:03
Permanently. 00:42:05
To me, my heartburn is more on the process of how this is. 00:42:06
Unfolding. 00:42:11
I understand. 00:42:12
The funds are in. 00:42:13
That line item. 00:42:15
And we can do it, I guess my. 00:42:17
Only point is how we proceed with more of these because we're going to need to do more of these to fill up that. 00:42:19
Park possibly, and we really can't until. 00:42:27
The the revolving loan fund. 00:42:30
Generates some money or is is funded by edit? 00:42:33
And eventually it could possibly the revolving loan. 00:42:39
Fun could be. 00:42:43
Funded by the TIF and that's something we need to think about. 00:42:45
And that it's something that commissioners need to think about now. You're right. And that's why I want to have this discussion 00:42:49
with the commissioners and not pay this. 00:42:53
We need to have a discussion about. 00:42:57
How that evolving loan? 00:43:00
Fine, gets some. 00:43:02
Revenue. 00:43:04
We're also exploring some grants. There's a lot of innovation grants that that exist. 00:43:07
Be just getting new into the game. It's like I'm still getting my feet wet, so I'm finding these things out. So these are all 00:43:13
pieces that are coming together. 00:43:17
And I don't disagree with any of the comments, it's just. 00:43:23
Do we make our? 00:43:28
Participants in Nova Park. 00:43:31
Wait while we workout. 00:43:33
The situational problems that we're. 00:43:35
You're realizing all the true real problems. You know the. 00:43:38
I believe in the fact that that we we have Innovation Park, we want good people, we've got great people. 00:43:43
2 great programs that. 00:43:49
Are the core mission of Noble Park. 00:43:51
We don't want to. 00:43:55
I would I would not like to see. 00:43:56
Proper pallets get away or would I like to see? 00:43:58
You know. 00:44:01
Red wire take a kick in the shin for any reason financially. 00:44:02
Not that that 25,000 or 312,500 is that kick. 00:44:06
We know we're obligated to pay. I think it's still. 00:44:12
If we if. 00:44:15
We paid. 00:44:17
We still need to fix our process for. 00:44:19
It's broken. And I think that's my whole point, Stan, I agree with you. I I think we need to help these companies out. 00:44:21
It's just the process that I'm having a hard time with tonight, so I'm. 00:44:28
I'm I'm ready. 00:44:31
And. 00:44:34
We said we. 00:44:37
We will always, the Council will always be the last stop. 00:44:38
These originate in redevelopment. 00:44:42
I know and then. 00:44:44
Then go to the commissioners. But that's why we have joint meetings and we should have brought, we should have been talking about 00:44:45
this in a joint meeting in the last two or maybe 3. 00:44:50
Joint meetings have been cancelled. 00:44:55
And these are exactly the things that need to be talked about. 00:44:58
And so that's my point. 00:45:03
We need to be in a joint meeting and we need to be having those and we need to be talking about these kinds of things. 00:45:06
And I absolutely agree. I think we we. 00:45:12
We're developing a lot of. 00:45:14
More of a cohesive team relationship lease on the operation side with council commissioners. 00:45:16
And trying to pull these little gaps. 00:45:21
So or identify the gaps, eliminate these gaps so that we can all move forward and be successful in everything we do so. 00:45:23
I echo your beliefs. Believe me. You know my heart. That's that's where I want. I don't want. 00:45:32
Just like I didn't want to have to come with 25 different things to council members, it's like these gaps need to. 00:45:37
We need to hash these out and arm these out before we. 00:45:43
Have to keep pushing them to the last hour. 00:45:47
Thank you, Sir. 00:45:51
Any further discussion on 3B? 00:45:52
All in favor say aye. 00:45:58
Aye. Any opposed? Aye. 00:45:59
Aye, thank. 00:46:01
That carries. Thank you very much. 00:46:04
Good. I think we're good. 00:46:07
I would like to, if I may, Sir, just one comment. I'd like to thank Diana Topping in the auditor staff with. 00:46:09
Teamsters Union getting. 00:46:15
Agreement getting. 00:46:16
Create a lot of extra work and effort on their part. 00:46:18
Her payroll person, Shelly Harden, did a magnificent job hammering through a lot of those aspects and. 00:46:22
I really appreciated her dedication and commitment. I know it cost her hours and time and labor and. 00:46:28
I really do appreciate everything that you guys did, so thank you very much. 00:46:33
Thank you. 00:46:38
All right, Diana, you are. 00:46:39
Just to hit the tail end of that. 00:46:44
Those things got done because my 83rd and my payroll clerk are very dedicated to their jobs. 00:46:47
I did not do any of that. 00:46:52
They did. I was cleaning up other messes. 00:46:54
But they were very determined that everybody get what was. 00:46:57
Owed to them as far as the. 00:47:01
We'll call it. It's not necessarily a signing bonus, but. 00:47:04
Hey, we finally figured out what we're going to do. 00:47:07
Kind of. 00:47:10
Buyout and then the adjusted rates for the new year, so both Shelley and Rhoda. 00:47:10
Absolutely knocked it out of the park. As far as taking care of the highway department, they did a really great job. 00:47:16
I'm incredibly lucky to have the staff that I have. 00:47:22
Hopefully my crazy doesn't change them up anytime soon. 00:47:25
I know it looks like a lot guys, but the reality is most of this kind of. 00:47:30
Goes with each other. SO4A and 4B are literally unappropriating Ema's budget from the general fund and appropriating it into the 00:47:35
public safety fund where you all decide and you wanted it but because we had not advertised enough for the PS lit. 00:47:42
During the budget advertisement portion. 00:47:50
It was agreed that we would do this cleanup at the first meeting of the new year. So that is what that represents. So A&B goes 00:47:53
together and they are unappropriating from the general and reappropriating into the 1170. 00:47:59
I moved to approve for A&B. 00:48:06
2nd, we have a motion, a second for 4A and B, any questions for Diana? 00:48:08
All in favor say aye. 00:48:15
Any opposed? 00:48:17
That carries. 00:48:18
CI think is missing an entire line. 00:48:21
Should have a $2,000,000 appropriation. 00:48:23
For capital improvements both for 0068 and 0061. 00:48:29
0068 representing the Commissioners and 0061 representing the Council. Those are your portions. 00:48:38
I Should we appropriate the money before we know what we're going to use the money for, All it does is put it in two spin lines I. 00:48:46
So that once you decide where you want to spend it. 00:48:56
It you can without having to wait an entire month's time to be able to do so. Except for we don't get the notice about how. 00:48:59
How it's being spent, it could be spent. You do. We would not. 00:49:07
I'm not going to let anything come out of your line that you haven't approved. Yeah, this just splits it up between, but the 00:49:11
commissioners would. 00:49:14
Could spend it on whatever they wanted. They could spend out of their line. 00:49:17
And we wouldn't know what it was on. 00:49:21
And they've identified 2. They've identified, I believe that Bond had a list of identified projects that. 00:49:23
I don't think we should incorporate these until they bring the projects in front of us. 00:49:29
That's the way I am. 00:49:33
Think. Think about it. 00:49:35
Did we miss advertising the other 2 million? 00:49:37
OK, OK. 00:49:43
OK, so we can either. 00:49:48
You can appropriate or not appropriate. We can appropriate it. We can table. 00:49:50
And do them both at the same time. 00:49:55
Or just. 00:49:58
What are we going to spend our 2,000,000 on? Do we now? 00:49:59
IT and. 00:50:03
Sheriff's vehicles. 00:50:04
OK. And the Sheriff's vehicles for this year are? 00:50:07
See that's what I would like to see in there share vehicles. So you want a specific. 00:50:12
Absolutely, for whatever projects we're spending it on so it can be tracked in the IT project. Well, if the council would like to 00:50:17
get a list of. 00:50:22
Appropriations to us, we would be happy to advertise those. 00:50:28
Am I wrong? I mean if I'm, if I'm, if I am. 00:50:35
The week we've talked about this. 00:50:39
For meeting after meeting about what the. 00:50:41
Projects are staying even identified just a. 00:50:43
But they need to be tracked. 00:50:46
And in a specific line items. 00:50:48
We were just tracking departmental specific, but if you would like to. 00:50:51
Have multiple lines within that fund under your department. I'm happy to create them. 00:50:56
I would. That's just me. 00:51:01
No, I think that's totally rational. 00:51:04
If you need, I'll be glad to bring the projects once the Commission is identifying by project by dollar amount. 00:51:07
If you rather than create all lies unless you want the lines, no, I'd rather have she wants the lines. 00:51:13
OK, because you can track them just by looking at a report. 00:51:19
Yeah, they're they're in. 00:51:22
All about everything, yeah. 00:51:24
They do break it down independently. Inside law, we can do a transaction report for a specific line and it shows every single 00:51:26
vendor that was paid and how much they were paid from that line. 00:51:29
So. But if you would like specific expense lines created for every single project that comes out of that fund, I am happy to do 00:51:34
so. 00:51:37
That's me. That's what I would like. 00:51:40
We can take that up. 00:51:43
Anytime. 00:51:45
Yeah. So motion to. 00:51:46
Table. 00:51:50
Do you want a table or disapprove? 00:51:52
Because if we table it, we're going to bring it back up in February exactly how it is. 00:51:53
Oh, I just wanted, I wanted to. You want it gone, right? Yeah. 00:51:57
OK. 00:52:01
Yep, table. I mean motion to. 00:52:02
Remote 4C. 00:52:06
I'll second that. All right, I have a motion and a second to remove item 4C from the agenda. Any further discussion? 00:52:08
This will likely come back as a. 00:52:15
AS 0068 and 0061. 00:52:17
At the next iteration. 00:52:20
With multiple lines. With multiple lines. 00:52:22
Any discussion? 00:52:25
On removal. 00:52:27
Well, when we talk about spending this and you talk about lines, is that going to give the? 00:52:28
I mean, what's the difference of? 00:52:32
When they come before us and we know how much we're going to take out of that. 00:52:34
Then putting lines in it now and given the opportunity maybe. 00:52:38
That we don't agree. 00:52:43
What they're asking for. 00:52:45
As far as office holders or talking about sheriff cars here, I mean, that's going to fluctuate because I don't know how many cars 00:52:46
he needs. 00:52:49
I don't know what he intends to They know how many cars they're gonna want to buy for this year. 00:52:53
For 2026, I mean they want to buy, but I don't know. I mean we're going to that's a discussion we should have when we appropriate 00:52:57
the money we're going to appropriate. 00:53:02
Oh no, that's exactly the same. We're saying exactly the same thing, I think. So this is where. 00:53:08
The Council does work and. 00:53:13
The sheriff's understanding that his portion of this. 00:53:15
General obligation bond is for. 00:53:18
Vehicles for the next three years, is what he identified. 00:53:20
Do you mind if I explain my reasoning behind just the two primary lines? Sure, sure. 00:53:23
No, it is much easier to track how much of your $2,000,000 you have spent. 00:53:27
If it's all coming out of one line than it is to track how many much of your $200 million you've spent than it is if it is out of 00:53:34
multiple. 00:53:38
Lines because at the end of the year, if there's not a contractual obligation. 00:53:42
For all of the lines that you have appropriated. 00:53:47
That it all goes back to cash and I get the fun job of figuring out how much of your $2,000,000 is left to spend. 00:53:52
But but Diana, that's why we have this other thing where the. 00:54:00
The third set of. 00:54:04
Numbers can be used. 00:54:07
To track. 00:54:09
That our our portion. 00:54:13
Versus the. 00:54:15
Like the actual line number. 00:54:16
Is that true? 00:54:18
Like a project? 00:54:19
No the. 00:54:21
Well, what are the third? 00:54:22
Set of numbers. That third set is a dead set. 00:54:24
Those three, those five zeros never change. 00:54:27
I never heard anything like that. Those five zeros are specific to school corporations, which is where Lao started. 00:54:32
They never changed their line structure when they moved into county government 25 years ago, and I thought that was a project. 00:54:39
No ma'am, those 5 numbers never change from 5 zeros. They stay that way forever. OK. 00:54:46
I still think we need to have. 00:54:51
Specific. 00:54:54
Appropriations for specific projects. 00:54:56
On each year. 00:54:59
My, that's my that. 00:55:02
What I think? 00:55:03
So OK, well the the motion is to remove this item motion and 2nd. 00:55:05
For tonight's meeting, is there any further discussion on removal? 00:55:09
All in favor of removing 4C from the agenda say aye. 00:55:14
Aye, any opposed? 00:55:18
That is. 00:55:20
OK. And you do raise your hand? 00:55:22
Yeah, can we show hands to remove? 00:55:23
Foresee from the agenda. 00:55:27
Let's remove it. We'll bring it back. 00:55:31
As a double. 00:55:33
Or or with projects. Whatever you all submit to us is what will come back. 00:55:38
Gosh, so sometime in the next. 00:55:43
What we have 14 days. 00:55:46
Prior to the meeting. 00:55:48
We can add there is a new advertisement scheduled, so sometime in the next two weeks I need a list of what you want to advertise. 00:55:50
And it needs to come. 00:55:59
From the County Council president. So the seven of you need to have that discussion. 00:56:00
However you choose to do that, whether it's you right now or. 00:56:05
After you complete your agenda prior to. 00:56:09
Closing or at a joint meeting. 00:56:12
However you choose to do that, I do have to have a list to advertise. 00:56:14
Even if it's just. 00:56:20
Advertising the whole amount getting appropriated in multiple different categories. 00:56:21
Would you all like to discuss this now? 00:56:27
I'm in favor. 00:56:32
Of the 068, the 061. 00:56:33
Because we know the projects, they're coming out of it. 00:56:38
That's how I would like to see it broke up. 00:56:41
I would like to see. 00:56:44
And I don't know, maybe we can structure it a little different where we could. 00:56:46
Instead of 0068, we put 0068 and then. 00:56:50
Two more numbers behind it do that. The programming doesn't allow for it. 00:56:55
OK, so can only be two numbers. 00:56:58
At the end of your budget code. Yes ma'am. So, so that you understand what you're looking at there. 00:57:00
The 4801 designates the fund. I understand 4000, so 40008. 00:57:06
Is the actual account coding, which in Harris terms would be the line number. Got it. 00:57:12
The five zeros is called the object and it's just days 5 zeros and then those last four. 00:57:17
Digits denote the department it belongs to. 00:57:24
But it can be 4 numbers. 00:57:28
Not if you wanted to be council or commissioner. No, it can only be two because the Council's DLGF code is 0061 and the 00:57:30
commissioners is 0068. 00:57:34
Where OK, So what we would do is do the 0068 out here and we would have different line numbers. So we would have that is a line 00:57:39
number and so for us we'd have three line numbers. 00:57:44
We'd have a line number for. 00:57:50
Sheriff cars and a line #4. 00:57:54
It is there anything else? 00:57:57
So just for point of clarification, are we going to? 00:57:59
Are we going to appropriate? 00:58:02
The full amount dedicated to both of those. 00:58:05
At the beginning of this year. 00:58:09
Only what we expect to spend. 00:58:11
For this year. 00:58:13
Which is not the full $2,000,000. 00:58:14
If you all make sure that you get it to us not more than 14 days. 00:58:19
I don't see the problem the way he said. Because we're not going to spend $2,000,000, we're going to appropriate 2 million and 00:58:27
we're not going to spend 2 million. 00:58:31
We're appropriating it into a fund, not appropriating it to spend. 00:58:35
It isn't an expense line, but it only gets spent if you tell me to spend it and then I am happy to provide a transaction. 00:58:40
Comprehension is just like a budget. 00:58:43
So we're going to budget monies. 00:58:48
For this year. 00:58:50
In a line item. 00:58:53
That we're not going to spend. 00:58:54
Are we going to move this money to the IT? 00:58:57
Fund before they spend it, are they going to spend it out of this fund? They're going to spend it from this fund. 00:59:00
No one. It can't be moved from this fund into another fund. It has to expense directly from this fund. 00:59:06
And a transaction report using. 00:59:12
480140080000000061. 00:59:15
Will show you exactly what gets spent out of that line and where it went and how much. The County Council. 00:59:22
With the County Council. 00:59:29
I don't. 00:59:31
Process anything from these departments without it being approved by the actual issuer. Hold it now we do not have does not have 00:59:31
to come back in front of us again. 00:59:37
To be approved before they spend this money. 00:59:42
Because it's already been appropriate. I'm not going to let the sheriff spend out of this line without the county council's 00:59:46
approval because of the county council's. 00:59:49
Department. The sheriff. It's not the Sheriff's Department. No you. 00:59:53
You could, I can't. We've appropriated. That would be like me spending. 00:59:57
The sheriff's budget. Am I allowed to? 01:00:02
Can I just send the sheriff's budget? Yeah. 01:00:04
Because he's a bigger venue than I do. Appropriated the money to the council's budget to the council. 01:00:06
That's what those last four numbers denote. 01:00:13
It will come in and say. 01:00:16
We've started. 01:00:17
They're going to come to the council and say. 01:00:19
And then we'll set up it. 01:00:23
Then you tell me. Hey, Diana. 01:00:25
Our key is allowed to spend this much money. 01:00:28
From the line that we've appropriated of our Go bond. 01:00:30
I'm not allowed to spend it for any other department without your all's permission because it's. 01:00:33
Coded 0061. 01:00:38
OK, that'd be like me paying Christy Fox out of Steve Langdon's line. 01:00:40
Don't do that. 01:00:44
It's council, it's council, it's council budget. 01:00:46
I can't spend anything for any other department out of council's budget without council's. 01:00:50
Approval. 01:00:54
I can't do that. 01:00:56
And I'm not going to let it happen. People don't get to submit things. 01:00:58
When I tell you that Rhoda Eubank is. 01:01:01
Flipping amazing when it comes to my AP department. It's insane. 01:01:04
If something came across her desk. 01:01:09
From a fund that she's never seen before. 01:01:11
And it happens. 01:01:13
She brings it straight to my desk and says what is this and who's allowed to use it? 01:01:14
OK, she has a list of things that if it gets submitted under any of those codes. 01:01:19
She doesn't touch it until I've seen it. 01:01:24
And she does an excellent job. 01:01:28
I don't know if you guys have ever met Rhoda, but the woman is on top of everything that crosses that desk. We'll never have to 01:01:29
worry about a Clarks County situation. Ever. 01:01:33
She catches everything. To be clear, this. 01:01:38
2,000,000 for us. 01:01:40
To maintain for the Commission. 01:01:42
Ma'am, you know that. 01:01:44
But for. 01:01:45
It's specific to the projects that you're saying though. 01:01:46
That money is already. 01:01:50
Those bombs have already been. 01:01:51
So we have this. 01:01:53
Somewhere it's already in the fund. It is not appropriated. 01:01:58
It's in that bond, Yeah, it was receded in that fund. 01:02:02
Before Christmas. 01:02:05
Before Christmas. 01:02:06
It's there. It lives there. 01:02:08
We need to. 01:02:12
Devita at our next meeting between. 01:02:13
Commissioners and Council, as we agreed to in an ordinance. 01:02:17
OK, OK. And I give you my word, nothing is going to get spent out of your line without you saying it should be sent out of your 01:02:22
line. 01:02:26
Because. 01:02:30
I don't want that headache. 01:02:31
I don't want seven people going. Diana, why did you do that? 01:02:33
We didn't say that was OK. 01:02:36
I already get that enough from everybody else. 01:02:39
OK, OK, everybody. So tabled. 01:02:42
Well removed. We're going to re advertise. 01:02:45
And bring it forth in February. 01:02:49
0068 and 0068, No 061. 01:02:50
Got it. Thank you. 01:02:54
D&E go together. 01:02:55
This what this is basically the. 01:02:57
Fruition of the agreement with the prosecutor that they would cover $10,000. 01:03:00
Of a portion of their salary out of their diversion funds. So this unappropriates. 01:03:05
$10,000 out of the general fund covering one of their prosecutors and appropriates it. I make a motion to approve DNA. 01:03:10
2nd we have a motion a second for 4D and E any discussion? 01:03:17
All in favor say aye aye. Any opposed? 01:03:23
That carries. 01:03:25
F is also. 01:03:27
The completion of the Council's word to Parks and Rec. 01:03:31
To make a motion to approve F. 01:03:35
2nd. 01:03:37
Motion a second for 4F any discussion. 01:03:38
All in favor say aye. Any opposed? 01:03:42
That carries. 01:03:45
G is the additional appropriation required in the judicial list to make up the difference. 01:03:47
In the agreed upon salaries. 01:03:53
With the prosecutor's office from. 01:03:56
Budgets here move to approve 4G. 01:03:58
2nd. 01:04:01
We have a motion and a second for 4G Any discussion? 01:04:02
All in favor say aye aye. 01:04:06
Aye, that's it for me folks. 01:04:09
All right, we're fully. 01:04:13
County Council business. 01:04:14
Ordinance 20/26/01 for end of 2025 transfers. 01:04:17
I'll make a motion for 5A. 01:04:24
Second with motion 2nd, 5A. Any discussion on those? 01:04:26
All in favor say aye aye. 01:04:31
5B is our ordinance for tonight 20/26/02 for our transfers this evening. 01:04:34
Move to 5B. 01:04:39
2nd, we have a motion and a second for 5B, any discussion on our transfers? 01:04:41
All in favor say aye aye. 01:04:46
And you posed. 01:04:50
Sorry, I was reading the head. 01:04:51
We have the same ordinance number for additional appropriations. 01:04:53
Ordinance 2026-03 for additional appropriations for tonight. 01:04:58
And I will make your changes since you didn't approve. 01:05:03
I will adjust it so the ordinance. 01:05:07
20/26/03 with adjustments. 01:05:11
So move second. 01:05:14
We have a motion in a second. Any discussion? 01:05:17
All in favor say aye. 01:05:20
Aye, any opposed? 01:05:22
Aye, those carried. 01:05:23
All right, we're on to public comment, Mr. Isaacs. 01:05:26
I'm sorry you had to sit through that. I didn't. 01:05:30
I'll stagger up here. 01:05:34
I saw him smiling for nothing immediately. 01:05:36
I know I'm only allowed a certain amount of time, but I want to make clear I don't want to waste your time by reading you this 01:05:39
thing. 01:05:42
It has been suggested that you are not going to have another vote. 01:05:46
On the situation. 01:05:51
Solid waste district. 01:05:52
I thought you had to have a first. 01:05:54
Vote in a second vote. 01:05:56
They had to be 180 days apart. 01:05:57
And commissioners have already done that. 01:06:00
But you guys have a say in this at all? 01:06:05
I don't think so at this point. 01:06:11
Serve on that board. I think Commissioner started it we. 01:06:13
Basically rubber stamp what they said and then. 01:06:16
It's their final decision. 01:06:19
At being the body. 01:06:21
So since they voted. 01:06:24
Yes, in their second vote. 01:06:26
It's done. 01:06:29
I don't recall they voted yes. They haven't done their second law. 01:06:30
They didn't have a second no yet. 01:06:34
Yeah, I think there's still a couple weeks left on that. I think it's the first. 01:06:38
February meeting. 01:06:41
I thought there's. I thought there was before yours. 01:06:43
OK, well they had a meeting last night, but it wasn't on their agenda. 01:06:47
They did not vote on that last night. 01:06:50
And just for a matter of point. 01:06:51
Too there is, was it 400,000 in the budget? 01:06:53
For solid waste. 01:06:56
I think it's 2:40, but. 01:06:59
No 420 is it 4? It's 4 something. 01:07:00
That's in the budget so that that would. 01:07:04
Indicate that it's going to continue at least. 01:07:07
This year. 01:07:09
We appropriated that in case it did continue. 01:07:11
OK on on whatever level. 01:07:14
Whether it's. 01:07:18
The same as it is now or it's. 01:07:19
Change somehow. 01:07:22
We did approve that in our budget. 01:07:23
I've timed this. I can do this in 2 minutes. 01:07:26
You go right ahead. 01:07:29
OK. 01:07:30
Having having suffered through the 1st, we've got 2 minutes for you. You go right. 01:07:32
We'll indulge, yes, OK. 01:07:39
Well, today will be 183 days for the meeting in which the Council first voted. 01:07:43
To dissolve the. 01:07:48
Solid waste district. 01:07:49
Since that meeting, there's been discussion of the solving the district. 01:07:50
Gradually. 01:07:54
I think this means that services would be gradually reduced. 01:07:55
Either because a commercial event sure has assumed them. 01:07:58
Because it's felt that they're no longer needed. 01:08:02
Statements have been made that the important thought is not that recycling should be done away with. 01:08:05
But rather, it should not be a governor punk. 01:08:10
Government bill function. 01:08:13
Or should be paid for by residents. 01:08:15
In November there was a discussion about recycling. 01:08:18
Being brought back into government. 01:08:21
However, there seems to be no motion. 01:08:23
Towards setting up a structure in the county government for that. 01:08:26
Is the plan to just let? 01:08:30
The District. 01:08:32
To keep it functioning as we strip away the flesh or leave the bare bones. 01:08:34
If that is the plan, do we really believe the current loyal employees will be willing to spend the rest? 01:08:39
Of the summer doing. 01:08:45
The quality job they have done, knowing that they will be removed at some point. 01:08:48
If we're going to adopt recycling into the government. 01:08:52
A plan needs to be in the works before we dissolve the district. 01:08:56
Either way, we should set a date for the district to cease functioning. 01:08:59
At the meeting in July, the voting was done. 01:09:03
By voice board, we're not talking about your vote. 01:09:06
I believe that is the correct term. 01:09:10
A request was then made to have an individual council member. 01:09:12
Hold that was quickly dismissed. 01:09:15
I believe we should be able to see. 01:09:19
Which council members voted which way? 01:09:21
That's it. 01:09:25
Now you're telling me you're not going to have another boat anyway? 01:09:26
I'm not certain a second vote is required by us. 01:09:32
And I saw your, I saw your letter in the paper today. I'm glad that you're here. 01:09:36
We the had a void as a joint. 01:09:44
Y'all voted as a joint meeting. 01:09:48
Everybody voted. 01:09:51
I thought I don't know if my problem was at a joint meeting. 01:09:52
Maybe not. 01:09:55
But you did have a vote. We did have a vote. 01:09:56
Yes. And I thought you had to have two votes. You had to have 180 days in between. 01:09:59
Commissioner, the Commissioners, Commissioners have to have a second vote. 01:10:04
I don't believe we do. It's their solid waste district. 01:10:08
Yeah, we we found what? What? No, there's. 01:10:11
We're not talking about the commissioners of it. You're saying the regular commissioners. 01:10:14
The three commissioners and Board of Commissioners waste. 01:10:19
Are in control of. 01:10:22
Of that, that is an executive function, that is. 01:10:24
That is their decision to. 01:10:28
Keep it, dissolve it, do what they want to with it. We provide funding, which we did. 01:10:31
So why did you all have a first vote? Because that was required states. That was required by state statute, but only a. 01:10:36
Only first. 01:10:42
Thank you. 01:10:44
Never mind. 01:10:46
You're fine. It, it, it, it gets confusing to us sometimes as well. We were uncertain why we even had to have a first vote, but it 01:10:48
is state statute, so. 01:10:52
Well, I believe there's a lot of us. 01:10:56
Floating around thinking that this is still up in the air. 01:10:58
When apparently it's not. 01:11:02
No, it is. No, it is still up in there. 01:11:04
You're safe because commissioners have not had a second vote, so I need to take this. 01:11:09
To the next Commissioner. 01:11:14
If that could be to join. 01:11:15
It will be at their, at their meeting, at their, at their next. 01:11:18
OK. I believe their next one or two. 01:11:23
Commissioners meeting is on the 20th. 01:11:26
OK. 01:11:28
Our talent meeting movie before there, Our joint meeting is on the 16th. Yeah, but I don't know that runs out the clock or not. 01:11:30
It's at 10 AM. 01:11:33
Here on the 16th. 01:11:37
And you're welcome to present to both boards again. 01:11:39
Well, while we're at it. 01:11:42
The 20th would also be the next day that we would have a solid waste baby. 01:11:45
Typically. 01:11:50
So it's not dead yet, right? 01:11:52
Not officially. 01:11:56
Well, actually, to be clear. 01:11:57
The vote for the commissioners and this body was to dissolve that board, the solid waste board. Never. It was never. 01:11:59
Implied in my mind. 01:12:07
That's recycling would go away. That board was going to. 01:12:09
The district. The district was the board, that solid waste board. 01:12:13
Was going to go away. 01:12:18
And that those duties would fall into. 01:12:20
Yes. 01:12:25
Which specifically the commissioners, we, we don't get that message. That's not the message the public. 01:12:26
The city, the public, gets the message. 01:12:31
When the solid waste district goes away. 01:12:33
Nobody is yet. 01:12:36
Go pick up a. 01:12:38
The ball and start running with it. 01:12:40
I I don't disagree that that might be the perception. 01:12:43
That's OK, yeah. 01:12:47
Don't disagree with you at all That that that. 01:12:50
Maybe the perception because I've. 01:12:52
I feel another letter coming. Fielded phone call. 01:12:54
Yeah, when I saw your letter today specifically addressing the Council, I was like. 01:12:56
You know, kind of like, you know, not our baby, so to speak. We just. 01:13:02
Pay for the formula in diapers. 01:13:06
I would check with. I checked with Daniel whether he had a problem with the. 01:13:08
Taking something he had published and reading it to you. 01:13:12
But I started it right. 01:13:15
OK. Thank you. I appreciate you coming. 01:13:19
The way you will have handled the. 01:13:22
The situation up here, I know what was not easy. 01:13:24
Appreciate you coming. 01:13:27
Thank you. 01:13:29
All right, any comments or anything from? 01:13:31
Mr. President, if I could just just one minute, I was contacted by the Board of Blessings in a backpack about a. 01:13:34
Packaging event. 01:13:42
And as some of us have done in the past, have participated and just wanted to see if there was any interest, they do have a spot 01:13:43
for us. 01:13:48
That members of the County Council would like to go and. 01:13:53
January the 22nd. 01:13:56
At Greenville Elementary School. 01:14:00
And what that would consist of would just be. 01:14:03
Packing the sleeves of food. 01:14:06
So the kids there at that school could have them. 01:14:08
3:00. 01:14:12
And didn't know if there was any interest. 01:14:14
Or it's about an hour. 01:14:17
You say Green Valley. 01:14:20
Greenville. 01:14:21
Greenville, Mm-hmm. 01:14:22
Last time it was Green Valley. Yeah, yeah, yeah. That's the last time we did it. 01:14:25
What time did you say again, 3:00? 01:14:30
For about an hour. 01:14:35
Yeah. If there, if there's interest, I can go ahead and let them know tomorrow that we'll take it just. 01:14:37
Probably 3 or 4, yeah. 01:14:44
I think last time we had to be interested. OK, great. 01:14:47
I am. 01:14:50
I can try to make that one OK. 01:14:51
All right. 01:14:53
Thank you. 01:14:54
Yeah, and maybe send out an e-mail reminder. 01:14:55
Sure, if you if you could, that would jar the memory. 01:14:58
That would be fantastic. Calendar invite or something that would be. 01:15:02
OK, even better. 01:15:08
Thank you any any further comments from. 01:15:11
Council move to adjourn Second. 01:15:13
Aldo aye. 01:15:17
Gloria, are we signing anything? 01:15:21

Understand. 01:15:23
