| Changes, edits, or corrections. | 00:00:00 | |
| Seeing none. | 00:00:04 | |
| I will entertain a motion to approve as presented. | 00:00:06 | |
| I so moved. We have a motion. Do we have second? | 00:00:08 | |
| I'll second. | 00:00:11 | |
| Motion and 2nd All those in favor signify by saying aye aye. | 00:00:12 | |
| Any opposed like son? I mean I can have both. | 00:00:15 | |
| OK, let the minutes state that Mister Unruh abstain because he was not at the last meeting. | 00:00:19 | |
| And we? | 00:00:26 | |
| We will approve those as presented. | 00:00:26 | |
| Moving right along. | 00:00:29 | |
| Before we get into the old business and commence with the meeting, I do want to make an announcement because the room is full and | 00:00:32 | |
| I suspect. | 00:00:35 | |
| Some of you in here this evening. | 00:00:38 | |
| Yes. | 00:00:40 | |
| Oh, we will. So we'll just wait and do that later. | 00:00:44 | |
| OK. | 00:00:47 | |
| Clearly, there's been a. | 00:00:48 | |
| Turn of events since before I walked into the room so. | 00:00:50 | |
| What do I know? I just chaired the meeting. | 00:00:53 | |
| Let's let's continue with the. | 00:00:57 | |
| The agenda? We'll start with business. | 00:00:59 | |
| And we will hear from staff. | 00:01:01 | |
| About. | 00:01:03 | |
| FC-01-206-01. | 00:01:05 | |
| Good evening. | 00:01:18 | |
| Name is Franklin, Walden County planner. | 00:01:20 | |
| We've got. | 00:01:22 | |
| Docket for petitioner Terry Elliott, located at 6370 Bluff Knob Rd. | 00:01:24 | |
| Elizabeth, Indiana. | 00:01:29 | |
| It's a development standards variance. | 00:01:31 | |
| For a minimum ground floor area. | 00:01:32 | |
| And it's owned agricultural residential. | 00:01:34 | |
| So the applicant is requesting a development standards variance from Section 4.09 for a manufactured home smaller than the minimum | 00:01:37 | |
| ground floor area requirement of 950 square feet. | 00:01:42 | |
| By 322 square feet. | 00:01:47 | |
| Located on .91 acres and the agricultural residential. | 00:01:49 | |
| AR zoning district. | 00:01:53 | |
| The new structure is 628 square feet and built within the footprint of the previous home. | 00:01:54 | |
| The lot is accessed by a drive connecting to Blanc Knob Rd. It is obscured by trees. | 00:01:59 | |
| When approached from the direction of Hwy. 11. | 00:02:05 | |
| Utility connections will remain the same, and the Health department has granted their approval for the septic system. | 00:02:07 | |
| Manufactured Home replaced a non conforming trailer home that was destroyed by a tree. | 00:02:12 | |
| The property to the West at 6391 problem. | 00:02:16 | |
| Blanc Knob Rd. is currently non conforming with the ground floor at roughly 900 square feet. | 00:02:20 | |
| While the property to the east is also currently non conforming with the ground floor at roughly 870 square feet. | 00:02:25 | |
| The approval will not be injurious to the public health, safety, morals and general welfare of the community. | 00:02:32 | |
| Staff comments. | 00:02:37 | |
| The minimum size does not affect the public health, safety, morals or general welfare of the community as it poses no risks or | 00:02:38 | |
| nuisance to neighboring properties and has been approved for septic. | 00:02:42 | |
| The character of this street has maintained two other non conforming structures on adjacent properties without a substantially | 00:02:47 | |
| adverse effect or impact and the. | 00:02:51 | |
| Manufactured home is replacing an older trailer. | 00:02:55 | |
| And the site has limited area for a septic system, causing practical difficulties for a larger building that would allow a greater | 00:02:57 | |
| occupancy. | 00:03:01 | |
| This area is not. | 00:03:06 | |
| Or there is not an airstrip in the vicinity. | 00:03:07 | |
| For staff recommendations, this does not 'cause adverse impacts. | 00:03:12 | |
| There's a practical difficulty on the property and policy objectives set forth in 2017. | 00:03:16 | |
| Comprehensive plan for Floyd County. | 00:03:21 | |
| With objectives #1 housing alternatives and options, supporting aging populations, and objective #3 Preserving rural character | 00:03:23 | |
| focus on sustainable development, which works to promote character in the community and preserve rural character. | 00:03:29 | |
| Is that him? | 00:03:39 | |
| OK, so we have heard from staff. Any questions? | 00:03:41 | |
| Steph, OK. Thank you, Frank. | 00:03:44 | |
| Is the applicant or representative of the applicant here this evening? | 00:03:48 | |
| If so, would you like to come forward and state your name and address for the record? | 00:03:51 | |
| Hello, my name is Terry Elliott, 6200 Pumping Station Rd. SE, Elizabeth, IN. | 00:03:59 | |
| All right, Mr. Elliot. | 00:04:03 | |
| Is there anything else you would like to add to what we've already heard this evening? | 00:04:05 | |
| No, you did a great job. | 00:04:07 | |
| Alright, thank you. Does the board have any questions for Mr. Elliott? | 00:04:09 | |
| No. | 00:04:14 | |
| All right, Mr. Ellie, thank you so much. | 00:04:15 | |
| Came first from the staff. | 00:04:19 | |
| And the applicant this evening. Is there anyone here this evening that would like to? | 00:04:20 | |
| Step forward and also speak in favor of this request. | 00:04:25 | |
| Seeing none, is there anyone who would like to come forward and speak in opposition? | 00:04:31 | |
| Easy enough. We will close the public comment section then. | 00:04:37 | |
| And move to a ballot. Do we have a ballot? | 00:04:41 | |
| This agenda item. | 00:04:43 | |
| I just said everybody else has one. | 00:04:47 | |
| Doctor FC 01. | 00:04:52 | |
| Dash 26-01. | 00:04:53 | |
| Petitioner Terry Elliott. | 00:04:56 | |
| Elliott. | 00:04:58 | |
| After careful review, the board finds that one approval, the variance, will not be interest to the public health safety. | 00:04:59 | |
| Morals and general welfare of the community because the minimum size does not affect. | 00:05:05 | |
| The public health, safety, morals or general welfare of the community. | 00:05:09 | |
| As it poses no risk or nuisance. | 00:05:12 | |
| Through neighboring properties and had been approved for septic. | 00:05:15 | |
| #2 the use and value. | 00:05:19 | |
| Of the area adjacent to the property included in the variance. | 00:05:21 | |
| Will not be effective stance or adverse manner because the character. | 00:05:24 | |
| Of this street has maintained two other non conforming structures on adjacent properties without. | 00:05:28 | |
| The substantial adverse. | 00:05:33 | |
| Effect in the manufactured home is replacing an odor trailer. | 00:05:35 | |
| #3. | 00:05:40 | |
| The strict application of the terms of the zoning ordinance. | 00:05:41 | |
| Will result in practical difficulties induce the product because the site. | 00:05:43 | |
| Has limited area for a septic system, causing practical difficulties for a larger building that would allow. | 00:05:48 | |
| A greater occupancy? | 00:05:54 | |
| #4 The variance does not involve a structure. | 00:05:56 | |
| That is near an airstrip or regulated under Indiana code 8-201-10. | 00:05:59 | |
| The Board of the Board of Zoning Appeals HIBRAG grants the. | 00:06:05 | |
| Petitioner variance at the meeting. | 00:06:08 | |
| Held on the 9th of March 2026. That completes my ballots. | 00:06:11 | |
| OK, we have a ballot. Do we have a second? | 00:06:15 | |
| I'll second. | 00:06:17 | |
| Balance in a second. | 00:06:18 | |
| Any other questions or comments from the board? | 00:06:19 | |
| All those in favor signify by saying aye aye. Any opposed like sign. | 00:06:22 | |
| That motion passes. | 00:06:26 | |
| Thank you, Shirley. | 00:06:28 | |
| OK. | 00:06:31 | |
| I would like to ask the board's permission. | 00:06:32 | |
| To go out of order. | 00:06:35 | |
| And address the issue I was going to address at the very beginning of the meeting. | 00:06:37 | |
| So. | 00:06:41 | |
| If if it's OK with the board. | 00:06:42 | |
| I would like to. | 00:06:44 | |
| Ask for. | 00:06:47 | |
| Representative of the farm. | 00:06:49 | |
| If they would. | 00:06:51 | |
| To come forward. | 00:06:52 | |
| If you will state your names. | 00:07:00 | |
| And address this for the record. | 00:07:01 | |
| Yes, Joe Cray 7209 Leafland Place, Prospect, KY. | 00:07:04 | |
| Thank you, Sir. Mark Phillips, 301 W Main St. Boonville, IN. | 00:07:09 | |
| Thank you gentlemen. I understand that because of an air. | 00:07:13 | |
| Made by staff with notification. Proper notification of. | 00:07:17 | |
| The neighbors. | 00:07:21 | |
| That. | 00:07:22 | |
| Tonight's agenda item that you guys had. | 00:07:23 | |
| Will need to be tabled until next month. | 00:07:26 | |
| But as a. | 00:07:28 | |
| As a courtesy to you guys, we want to give you a chance to speak and I think there were a couple of items you wanted to request. | 00:07:30 | |
| There are. | 00:07:37 | |
| Pet may address the Board. | 00:07:37 | |
| Yes, please. So thank you and I appreciate. | 00:07:39 | |
| Visiting with Miss Fox, obviously very frustrated. | 00:07:41 | |
| We all make mistakes. | 00:07:45 | |
| But this is the second. | 00:07:48 | |
| Issue that came up with respect to the possibility of taking this. | 00:07:49 | |
| A couple things that I'd like the board to know. | 00:07:53 | |
| Even though that the lead reclamation efforts we think are compliant with your previous orders. | 00:07:57 | |
| Arjun Van Buell, who's here to raise your cancer? | 00:08:02 | |
| I drove in from Atlanta. | 00:08:05 | |
| George, Russia. | 00:08:07 | |
| And then Charlie Hilton, who's a national NRA. | 00:08:08 | |
| A board member. | 00:08:13 | |
| Made himself available by phone. | 00:08:15 | |
| To address the things that I think have been addressed adequately. | 00:08:18 | |
| Obviously when you have questions and. | 00:08:21 | |
| It's my understanding that Mister Walden is a new staff member. | 00:08:23 | |
| It appeared there were some things that he was not aware of that I thought that that information might help. | 00:08:27 | |
| We have a attack event. | 00:08:32 | |
| That's scheduled for March the 27th, the 28th and 29th. | 00:08:35 | |
| And quite frankly. | 00:08:39 | |
| In reviewing the submission that we received. | 00:08:41 | |
| It is extremely frustrating to not be able to deal with this tonight. | 00:08:45 | |
| Because it continues to raise issues that you've already addressed. | 00:08:49 | |
| And it continues to. | 00:08:52 | |
| Create issues that that frankly, in our view, don't exist from a safety standpoint. | 00:08:54 | |
| And from a productivity standpoint, I'm going to ask you, the Board, consider doing two things. | 00:09:00 | |
| One, we'd like to relax the cap. | 00:09:05 | |
| On the number of visitors. | 00:09:09 | |
| What one of the things that that has been prominent in every conversation that we've had since I've been involved. | 00:09:12 | |
| Is the traffic control is is is something that the board wants to do? | 00:09:17 | |
| And. | 00:09:22 | |
| You know that we and ahead for you. | 00:09:23 | |
| A traffic study. | 00:09:26 | |
| Based on the information we had received. | 00:09:28 | |
| From the Floyd County. | 00:09:31 | |
| Sheriff's Department that Brook policy put together. | 00:09:32 | |
| That's really good. | 00:09:36 | |
| And it tells you for five years prior to. | 00:09:37 | |
| The farms initiation, The traffic patterns on 1/11. | 00:09:40 | |
| And it tells you what traffic patterns have been. | 00:09:45 | |
| Have been occurring since then and it's just astonishing. | 00:09:48 | |
| That there's absolutely nothing. | 00:09:52 | |
| That has occurred with respect to the farm and I know you're not here. | 00:09:54 | |
| To hear evidence, what we'd like to have a relaxation of that because. | 00:09:58 | |
| As I said to you before and as we've suggested the materials we've submitted. | 00:10:01 | |
| Our hope. | 00:10:06 | |
| Is that this economic development opportunity and the successful? | 00:10:07 | |
| Recruiting of national events. | 00:10:15 | |
| Continue. And our ability to do that is tied directly. | 00:10:17 | |
| On some of the restrictions that we thought we were going to be able to address tonight, now we had no idea whether or not. | 00:10:21 | |
| You would approve these, but we believe based on the information we had submitted. | 00:10:27 | |
| And a substantiation that we think supported our requests. | 00:10:30 | |
| That there would have been a strong argument that they were not unreasonable and reviewing Mr. Walden staff report. | 00:10:34 | |
| In large part, he agreed. | 00:10:39 | |
| I will tell you I also appreciated receiving some of the comprehensive plan. | 00:10:42 | |
| And the survey that was done, there were four specific items that the that the mission of the farm. | 00:10:46 | |
| Are supported by the vote of the the people that participated in the survey. | 00:10:53 | |
| So first of all, we're asking that you relax that we will still have traffic control. | 00:10:57 | |
| That will not be an issue. | 00:11:01 | |
| Secondly. | 00:11:02 | |
| The staff report, and I know you're not dealing with this tonight. | 00:11:04 | |
| Suggested that we would actually lose. | 00:11:06 | |
| Acreage that the buffer would be bigger than it already is. | 00:11:09 | |
| But. | 00:11:12 | |
| We don't ever shoot towards property. | 00:11:14 | |
| We don't ever shoot towards the rally residents if that happened. | 00:11:16 | |
| And. | 00:11:19 | |
| You know there was an attempt. | 00:11:20 | |
| Folks. | 00:11:25 | |
| Out of respect to the people that are presenting, please hold your comments until. | 00:11:27 | |
| We get. | 00:11:31 | |
| Such time that we may or may not hear. | 00:11:32 | |
| From the group this evening, especially if we're asking them to defer. | 00:11:34 | |
| Thank you. | 00:11:39 | |
| The the the arrow issue, the board determined the last time was without merit. | 00:11:40 | |
| So there was an attempt to raise that again, we're asking. | 00:11:45 | |
| That the area to the north of the primary property between. | 00:11:48 | |
| The house and the barns and the shooting club stations. | 00:11:53 | |
| That area be allowed to be used for archery. | 00:11:57 | |
| We're shooting in Word. It's primarily a practice area. | 00:12:01 | |
| And there's absolutely no detrimental effect. | 00:12:04 | |
| The course that's set up. | 00:12:07 | |
| Is set up in an area that never gets to them. | 00:12:09 | |
| And had we? | 00:12:12 | |
| Had we been able to present this on the merits tonight? | 00:12:13 | |
| We would have provided you with some additional information. | 00:12:16 | |
| To support that contention in addition to what we have in our packet so. | 00:12:20 | |
| I again, I appreciate talking to Miss Fox before the meeting. You know, she's done this a long time and I respect her opinion. And | 00:12:24 | |
| we, we disagree on one thing respectfully. | 00:12:29 | |
| But I also understand the need to be cautious. | 00:12:34 | |
| Because nobody wants to encourage litigation and obviously we don't want to be in a situation where. | 00:12:37 | |
| The request that we are making are somehow compromised. | 00:12:43 | |
| In a fashion that doesn't benefit either of us so. | 00:12:46 | |
| Understand that so appreciate you letting us speak. Some counties would not let me do that, but I'd ask that you consider. | 00:12:48 | |
| For this event only. | 00:12:56 | |
| Because this event and then I would encourage the people who are here to remonstrate. | 00:12:57 | |
| To come to this competition. | 00:13:02 | |
| And they can see where the marshals are, and they can see what the traffic control looks like, and they can see where the shooting | 00:13:04 | |
| stations are, and then they can see what isn't occurring. | 00:13:08 | |
| On that property. | 00:13:12 | |
| The other thing I would tell you is this. | 00:13:13 | |
| We have not marked that boundary yet. | 00:13:17 | |
| Because we we wanted to wait to see what you ruled today. | 00:13:20 | |
| And once you rule tonight, either you denied it or you granted it. | 00:13:23 | |
| We have an obligation before the 27th to mark that boundary, which is what we intend to do. | 00:13:27 | |
| Thank you. | 00:13:32 | |
| Thank you folks. | 00:13:34 | |
| So. | 00:13:36 | |
| Christy, I'd, I'd like to get your. | 00:13:37 | |
| Nick, come up here and give some feedback, but I guess my question would be. | 00:13:40 | |
| Are floating out there to you all that? | 00:13:45 | |
| Question number one that we had discussed in the hallway was a request and I think. | 00:13:48 | |
| It didn't directly come that way, but they have two experts in the room that have driven in from out of town. OK. | 00:13:52 | |
| So 1 available by phone, one that has come up here from Atlanta. I think one of the requests would be to allow that person or both | 00:14:00 | |
| of those parties to attend virtually for the next meeting. | 00:14:04 | |
| I don't see an issue with that. | 00:14:09 | |
| But I think that's a decision this board needs to make, not me. | 00:14:11 | |
| So if you guys are OK with their experts, those two experts they've identified attending either? | 00:14:15 | |
| By zoom which we can set up. | 00:14:20 | |
| Would probably be the best path so that you all can see them, interact with them, ask questions if you have those of those two | 00:14:22 | |
| experts for the next meeting. | 00:14:26 | |
| So that would be the first. | 00:14:29 | |
| Direct request. | 00:14:31 | |
| Does the board have any? | 00:14:33 | |
| Concerns with that. | 00:14:34 | |
| I don't have a problem. | 00:14:36 | |
| No less problem. | 00:14:37 | |
| Is there any reason you can present we can hear his opinion? | 00:14:39 | |
| I don't think so. | 00:14:43 | |
| We can't hear his opinion, right? Not if we're tabling for tonight, you mean? Yeah. | 00:14:44 | |
| No, no. | 00:14:48 | |
| I would not advise that. I would again let them appear remotely by Zoom at the next meeting. We can set that up ahead of time and | 00:14:50 | |
| circulate that to the applicant so they can share with their expert. | 00:14:55 | |
| So you you want to take a show of hands or yeah, I would vote on that to allow them. | 00:15:00 | |
| I'll entertain a motion to allow the. | 00:15:04 | |
| The petitioners expert to present. | 00:15:07 | |
| Via Zoom or whatever electronic medium. | 00:15:11 | |
| Works for them and us the next meeting. | 00:15:13 | |
| I'll make that motion. | 00:15:17 | |
| OK, I have a motion. Do I have a second? | 00:15:18 | |
| I'll second. | 00:15:20 | |
| All in favor signify by saying aye aye. | 00:15:20 | |
| And you pose like side. | 00:15:23 | |
| We will accommodate that. What else? OK. And then the next thing is kind of this whole concept of tabling, which you guys are. | 00:15:25 | |
| Have on the table right this moment to table this to the April 13th meeting at 5:00 PM. | 00:15:31 | |
| I think in consideration that they're requesting that you all accommodate an additional. Hopefully I'm not paraphrasing this | 00:15:38 | |
| incorrectly, but additional guests at the. | 00:15:43 | |
| Event that is March 27 through 29th. | 00:15:48 | |
| And whether or not you guys would allow for that so? | 00:15:51 | |
| Nick and Frank kind of leaning on you all if. | 00:15:54 | |
| You think that's a reasonable request for the one event? Or if that's. | 00:15:57 | |
| Not something that should be considered here this evening. | 00:16:00 | |
| Prior to tabling. | 00:16:04 | |
| The event cap. | 00:16:10 | |
| Is a condition. | 00:16:12 | |
| On their approval. | 00:16:14 | |
| I don't know that staff really has authority to override that. I think that would be something that the board would need to do. | 00:16:17 | |
| I agree do. | 00:16:24 | |
| I guess. | 00:16:25 | |
| From a staff perspective, if you think it's reasonable for one. | 00:16:26 | |
| Event. | 00:16:30 | |
| As a condition for tabling the. | 00:16:31 | |
| Event cap altogether, so we would be in support of that in line with this single temporary use until we hear it. | 00:16:35 | |
| Formally OK. | 00:16:45 | |
| So I think. | 00:16:47 | |
| Kind of back to you all with the fact that staff would be OK with a reasonable. | 00:16:48 | |
| One weekend. | 00:16:52 | |
| As a recommendation. | 00:16:54 | |
| With with the tabling of the event that is happening because. | 00:16:56 | |
| They were coming here to you all this evening prior to that March 27th event. | 00:17:00 | |
| It's my understanding that staff is making the recommendation to remove that. | 00:17:04 | |
| Going forward anyways. | 00:17:08 | |
| But that it be limited to just that weekend if you were. | 00:17:11 | |
| To contemplate it. | 00:17:14 | |
| And if you say no, I think that's. | 00:17:16 | |
| That is also reasonable. I'm not here to tell you which way to go. | 00:17:18 | |
| You're all you guys are considering tabling? | 00:17:21 | |
| And I think then you make the decision I'm willing to. | 00:17:24 | |
| For this one event. | 00:17:27 | |
| Drop the 500. | 00:17:28 | |
| Capacity. | 00:17:32 | |
| Thanks for this one event. | 00:17:34 | |
| Other board members Thoughts. | 00:17:38 | |
| I guess I'm wondering what are how many are you expecting? | 00:17:41 | |
| Approximately just an idea. I mean, even though we're thinking about removing it or you know, that's on there. | 00:17:44 | |
| What are you recently expecting for this crowd? | 00:17:49 | |
| That will be at this event. | 00:17:53 | |
| So. | 00:17:54 | |
| And I don't mean this to be. | 00:17:56 | |
| We hope there are a lot of people. | 00:17:59 | |
| Because we hope that this introduces Chip. | 00:18:01 | |
| We hope there's a lot of children. | 00:18:05 | |
| You know the archery explosion nationally? | 00:18:06 | |
| This this is a next level opportunity for them to see competitive shooting. | 00:18:09 | |
| Two things that that I just in answering your question. One, they now have to pass a safety class before they can participate in | 00:18:15 | |
| this competition. | 00:18:19 | |
| That's new. | 00:18:23 | |
| And then they have additional security measures that have nothing to do with the farm. | 00:18:24 | |
| That enable more people to be around the event. | 00:18:28 | |
| So it would be, I would be, I would be disingenuous if I told you a specific number because I really don't know. | 00:18:31 | |
| But it would be conditioned on. | 00:18:38 | |
| The traffic control that you've already required. | 00:18:40 | |
| We, we, we obviously will do that. | 00:18:43 | |
| You know, if there's only 200 people come, we're still going to do the traffic control like you've requested. | 00:18:46 | |
| Are you expecting more competitors or? | 00:18:50 | |
| Just a larger crowd to observe. What are you expecting? | 00:18:54 | |
| Really, there'd probably be slightly more competitors. | 00:18:58 | |
| But there's also a. | 00:19:04 | |
| Out of an exhibitor village set up where people are able to see equipment from different suppliers that. | 00:19:06 | |
| Don't usually. | 00:19:13 | |
| Come to this area. So we're expecting to see a decent number of people coming just to. | 00:19:14 | |
| Go through shop. | 00:19:19 | |
| And and talk to those folks as well. | 00:19:21 | |
| Other questions? | 00:19:27 | |
| From the board. | 00:19:28 | |
| Concerns. | 00:19:31 | |
| I just got a real. | 00:19:33 | |
| Bad feeling in my stomach right now. | 00:19:34 | |
| I'm saying. | 00:19:36 | |
| I don't know. You just don't feel right to me. I mean, I understand what they want. | 00:19:38 | |
| And so I think again, your old decision is table, not table if you're tabling. | 00:19:44 | |
| Do you allow any sort of? | 00:19:49 | |
| A reasonable accommodations or temporary changes. | 00:19:51 | |
| I feel like we don't have a choice on tabling given that we didn't do proper notice I I think. | 00:19:55 | |
| Our hands are tied. | 00:20:00 | |
| In that regard. | 00:20:02 | |
| So the question. | 00:20:03 | |
| Really the only question remaining. We'll vote on the Table I. | 00:20:05 | |
| After we. | 00:20:08 | |
| Address this question, I suppose. | 00:20:09 | |
| Is. | 00:20:12 | |
| I guess we could look at this sort as a test because. | 00:20:15 | |
| You know, we've allowed things and there's been problems and we set rules and there have been problems. | 00:20:18 | |
| This would sort of give them a chance to, well, let's see how you do that. | 00:20:25 | |
| Before we. | 00:20:29 | |
| Make something permanent so. | 00:20:31 | |
| We can look at it that way. I don't know. | 00:20:34 | |
| It's up to the board. | 00:20:41 | |
| Well, I'll make I'll make a motion for this. | 00:20:43 | |
| One event. | 00:20:45 | |
| We dropped the capacity as Britain. | 00:20:47 | |
| For this March 27th event. | 00:20:50 | |
| And then we'll reevaluate it. | 00:20:56 | |
| At our April meeting. | 00:20:58 | |
| Is your second to that motion. | 00:21:02 | |
| I'll second, but I've got a. | 00:21:08 | |
| Uh, condition that I'd like to. | 00:21:11 | |
| Proposed an amendment. What is that? I would like to see a report of. | 00:21:13 | |
| How many people did attend? | 00:21:19 | |
| Is it a foot pick session? | 00:21:21 | |
| Or is it? | 00:21:23 | |
| Are there 2 sessions morning, afternoon or is it all day? | 00:21:25 | |
| How does that? | 00:21:27 | |
| It's it's staggered, similar to tee times, the way they they arrange the start times. | 00:21:29 | |
| So there's multiple courses and then people have different starting times. | 00:21:34 | |
| OK, I would like to season a daily. | 00:21:38 | |
| Report of participants and spectators were there, including maximum. | 00:21:41 | |
| On the grounds at one time. | 00:21:46 | |
| Can you ask a question? Sure. You want to see us to get that to you before the April meeting, Not yes, at the next time, each day | 00:21:48 | |
| at the next meeting. Perfect. | 00:21:52 | |
| I think he's looking for a report after the event that you all put together. | 00:21:56 | |
| Yes, yes. | 00:22:00 | |
| Is this a one day or? | 00:22:02 | |
| It's a three day event. | 00:22:04 | |
| OK. And you expect the same amount of people every day or could be the same amount of people every day? | 00:22:06 | |
| It's hard to say right now, but I would say generally close to the same. It's Friday, Saturday, Sunday, so I would naturally | 00:22:13 | |
| assume Saturday would probably have the. | 00:22:17 | |
| The most people come out just by virtue of the words. | 00:22:21 | |
| I guess one of the problems that I have is that. | 00:22:24 | |
| Somehow another we're giving you a blank check. | 00:22:26 | |
| And I. | 00:22:30 | |
| I guess I'd like to know. | 00:22:32 | |
| A Max, you know, I'm saying. I mean, it's just. | 00:22:33 | |
| There's got to be, there's got to be something put on there. I mean, I. | 00:22:37 | |
| May I respond absolutely. So when you have other events. | 00:22:42 | |
| In in your county were you you. | 00:22:46 | |
| There's a fast. There were some things I saw. | 00:22:50 | |
| That you're trying to get as many people to those events as possible. | 00:22:52 | |
| And and the protections. | 00:22:56 | |
| That you've imposed. | 00:22:58 | |
| Or the assurance that we will pay for traffic control, which we've already done and we will continue to do. | 00:23:00 | |
| As long as you order. | 00:23:07 | |
| And so we we, we have assurances that nobody else has to have. | 00:23:08 | |
| Just in terms of ingress egress. | 00:23:14 | |
| And if it would help you to see. | 00:23:16 | |
| The traffic study that that I was going to give you. | 00:23:19 | |
| In advance the next meeting. | 00:23:22 | |
| I'm happy to share that with you. | 00:23:24 | |
| Because I think it bears the. | 00:23:26 | |
| Reality that this is not creating accidents. | 00:23:29 | |
| It's not creating. | 00:23:32 | |
| You know. | 00:23:34 | |
| This is let me say it this way. | 00:23:36 | |
| Ladies and gentlemen, this is not like a concert. | 00:23:37 | |
| Where everybody gets there at one time. | 00:23:40 | |
| You have an event. | 00:23:43 | |
| And then everybody leaves. | 00:23:44 | |
| So it is a competition. When people compete, then they lead. | 00:23:46 | |
| So it's a very. | 00:23:49 | |
| It's very much an in and out. | 00:23:51 | |
| All day kind of event. | 00:23:53 | |
| But we have traffic control in the event. | 00:23:55 | |
| That it it because of. | 00:23:58 | |
| Heavy traffic on 111 that people can't get out. Let me ask another question then. | 00:24:00 | |
| In regards to the. | 00:24:07 | |
| The buffer restrictions. | 00:24:08 | |
| Yes, Sir. | 00:24:10 | |
| I mean, obviously I think part of the agenda tonight was to. | 00:24:11 | |
| Address that, correct? | 00:24:16 | |
| Yes, Sir, So what? | 00:24:18 | |
| Are those limits going to stay? | 00:24:19 | |
| As the original condition has been written. | 00:24:22 | |
| We we, what we really love is to have. | 00:24:25 | |
| Maybe here's the thing it's got for me. It's got to be yes or no, OK for me, for that question, for me to understand. | 00:24:28 | |
| I need to know. | 00:24:36 | |
| If you're going to abide by their other conditions. | 00:24:37 | |
| But I don't think we're at at this meeting. I don't want to change every condition that we've made. OK, You've asked for one. | 00:24:40 | |
| And I need to know that the safety. | 00:24:45 | |
| And we talked about, you know, at one time we talked about marshals. | 00:24:48 | |
| Having some kind of marshals. | 00:24:52 | |
| If you're going to have that amount of people, what are you thinking about as far as how many? | 00:24:53 | |
| Control marshals, are you going to have? | 00:24:57 | |
| To be sure that people are safe and they are within the guidelines of the original conditions. | 00:24:59 | |
| That's what scares me. | 00:25:05 | |
| So. | 00:25:06 | |
| So let me let me say it this way. | 00:25:08 | |
| Oh, I'm sorry, just. | 00:25:10 | |
| Are we going to abide by the original conditions? Yes or no? We have no choice to avoid, all right. | 00:25:12 | |
| All right, so and then as far as. | 00:25:17 | |
| The number of people, are we going to have more marshals or how are we going to control these people? I think it'll depend on the | 00:25:20 | |
| number of people, but we will have them available to accommodate the people that that attend the the event. So if you don't know | 00:25:24 | |
| how many is going to be there? | 00:25:28 | |
| Yes, Sir. How will you have them lined up? | 00:25:33 | |
| Because we have people. | 00:25:35 | |
| Who are affiliated with the club? | 00:25:36 | |
| Who are they? Who are the safety people? | 00:25:38 | |
| Joe's here, Marty's here. | 00:25:40 | |
| Yeah, go ahead, go ahead. Just to clarify on the number of participants it is. There's a cap. | 00:25:45 | |
| That they don't exceed. So it's not we're gonna have 20,000 people go out and shoot. | 00:25:49 | |
| Uh, once a time. | 00:25:53 | |
| Slots are filled. | 00:25:56 | |
| For for the different events they're filled, they don't, they don't allow extra. So how many people is that per slot that that's | 00:25:57 | |
| going to help me here? | 00:26:00 | |
| So that that's the number we're trying to get right now because that's something attack doesn't they do all the registration | 00:26:04 | |
| internally. | 00:26:06 | |
| But I would. | 00:26:10 | |
| I would think that the Max they would be. | 00:26:12 | |
| I wouldn't. | 00:26:15 | |
| I wouldn't be able to throw a hard number on it, but. | 00:26:16 | |
| Last year was was pretty close to their Max I believe. | 00:26:19 | |
| What was it? | 00:26:22 | |
| We well. | 00:26:24 | |
| The neighbors had the photos, but I think it capped out around just over 500 total vehicles. | 00:26:25 | |
| Total vehicles, but what? | 00:26:31 | |
| How many people at each shoot though? I guess that's what I'm trying to understand. So they they move through it almost like a | 00:26:32 | |
| golf course where there's a. | 00:26:35 | |
| 10 to 15. | 00:26:39 | |
| Different stations for each of these three targets. | 00:26:40 | |
| And they set up three to five different courses. So you have three to five different courses with 15 stations each and then groups | 00:26:43 | |
| of. | 00:26:47 | |
| 2 to 4 shooters. | 00:26:52 | |
| Per station at a time, and they filter through that through the day. | 00:26:53 | |
| I think on average a course takes about two hours to complete, so kind of gives you a. | 00:26:57 | |
| Are we, are we thinking like a thousand 1500 people? I wouldn't say. I would not say 1500. I would say under 1000, I would say. | 00:27:03 | |
| Chapter 1000 probably. | 00:27:12 | |
| Just so I understand. | 00:27:13 | |
| A golf course only allowed so many. | 00:27:15 | |
| Golf carts on golf cart? OK, how many golf carts do you allow your shooting range so I can understand? | 00:27:17 | |
| These part of the main part of the challenge is it's a lot of folks that are preparing for for things like Western archery hunts. | 00:27:23 | |
| So they don't have golf carts, they're out there. | 00:27:27 | |
| And I would say I didn't know how many people on the course at one time, 12. | 00:27:34 | |
| 12 stations per course. | 00:27:39 | |
| Three people per average. | 00:27:42 | |
| That's 3636 on each course at. | 00:27:43 | |
| A time. | 00:27:47 | |
| Each course can turn over. | 00:27:49 | |
| Probably 3 times in a day, right? | 00:27:51 | |
| OK, so. | 00:27:53 | |
| So the 500 people's not on the course at one time. | 00:27:54 | |
| No, but part of the more than likely not. But if somebody's there and hanging out and they hang out in the vendor area. | 00:27:58 | |
| After they finish shooting or if they show up. I'm talking about shooters. | 00:28:04 | |
| Shooters, I would say under 500 at a time. | 00:28:07 | |
| Yes, OK. | 00:28:09 | |
| How many Marshall, how many Marshalls did you have last year? We did not have any marshals. We're. | 00:28:20 | |
| The attack group was handling that. I just did get word that Tech confirmed that they do have the registration cap at 500 | 00:28:27 | |
| participants per day. | 00:28:31 | |
| OK. | 00:28:37 | |
| So the rest of the people, they be spectators if there is a larger crowd. | 00:28:38 | |
| OK. | 00:28:42 | |
| Do you guys want to see this is the traffic study that is the traffic study that was just not only. | 00:28:47 | |
| Always. I'm not asking for tonight, just. | 00:28:52 | |
| Sure. | 00:28:55 | |
| OK, just for a reference. | 00:28:56 | |
| Yeah. Other questions? | 00:28:57 | |
| From the board. | 00:29:00 | |
| We have. | 00:29:02 | |
| A motion in a second. | 00:29:04 | |
| With. | 00:29:05 | |
| What is the condition? | 00:29:07 | |
| Yeah, with the condition. Read the condition. | 00:29:08 | |
| Yeah, what's the conditions? | 00:29:11 | |
| That we get information regarding how many was there right daily report of number of participants. | 00:29:14 | |
| Estimated numbers. | 00:29:21 | |
| Spectators and maximum that were on the grounds at one time. | 00:29:22 | |
| For each each day. | 00:29:25 | |
| I will tell You Beautiful. | 00:29:27 | |
| Can you commit to to Marshalls? | 00:29:28 | |
| Can you commit to how many? | 00:29:31 | |
| If you've got 500. | 00:29:33 | |
| People on a course of time, how many marshals will we have? | 00:29:35 | |
| Yes. So 2 marshals at a time on that. So we'll be sticking to any of the requirements put in place in the last meeting. | 00:29:37 | |
| As far as marking the boundaries. | 00:29:45 | |
| Marshals, all that OK. | 00:29:47 | |
| All right. Any other questions? | 00:29:52 | |
| OK, so we have a motion. | 00:29:56 | |
| In a second before. | 00:29:58 | |
| So you guys have a motion? | 00:30:11 | |
| This is kind of an unusual request because you guys are considering tabling, but there's been a request made with the tabling. | 00:30:15 | |
| Right, You probably want to consider opening that up to public comment. | 00:30:21 | |
| To hear the opposition before you vote on the motion. | 00:30:24 | |
| I'll feel better about that so that you can at least hear the opposing sides, if any, to that, since we do have an unusual | 00:30:31 | |
| request. Generally speaking, you would normally table it, but you do have this request. | 00:30:35 | |
| And just to clarify that. | 00:30:40 | |
| And I think you all agreed to that, that this would be. | 00:30:41 | |
| One thing you're considering changing that's the number of guests. All other conditions would remain. | 00:30:44 | |
| Until this at least until such time that you come back to the April meeting. | 00:30:49 | |
| Is what Mr. Andrew asked. I just want to make sure that we're clear. And then again, I, I think. | 00:30:53 | |
| I would recommend that you guys consider. | 00:30:57 | |
| Opening it up to public comment again, it's you're not. | 00:31:01 | |
| Going through the full in favor and opposition. | 00:31:03 | |
| Just a public comment piece because it's just a. | 00:31:06 | |
| An agenda item, not a. | 00:31:08 | |
| Public hearing, Can we put a time frame on that please? | 00:31:10 | |
| Yes, I think reasonable time frame would be appropriate. | 00:31:14 | |
| So our normal standard is 10 minutes for, 10 minutes against. | 00:31:17 | |
| In this case, since we were debating. | 00:31:23 | |
| How we wanted to. | 00:31:26 | |
| Handle this. We were a little outside of our normal. | 00:31:27 | |
| Time for just getting to this point. | 00:31:29 | |
| But I do think it's reasonable. | 00:31:32 | |
| To allow 10 minutes for opposition. | 00:31:34 | |
| Is that OK with the board? | 00:31:37 | |
| Oh, absolutely. | 00:31:39 | |
| OK. | 00:31:40 | |
| So for those of you that are here, thank you folks. | 00:31:42 | |
| Let me let me ask another question, Christy. So we're going to open it up to those who may be in opposition. | 00:31:47 | |
| We're just going to have it be public comment because it's not going to be a public hearing, just public comment, OK? | 00:31:52 | |
| So they would need to come up, state their name and address for the record. And then if you, you know, I think if you're | 00:31:58 | |
| outlining, the board said 10 minutes, that's not 10 minutes per person, that's 10 minutes total. | 00:32:03 | |
| Is that for people for and against anybody the ones comment on the? | 00:32:08 | |
| Tabling and it's open. | 00:32:13 | |
| And this is only capacity only. That's what we're supposed to speak on there. They should. That is what their request is, yes. | 00:32:15 | |
| Nothing else we don't need to hear. | 00:32:22 | |
| Right. The rest of the agenda, this is we're not having a meeting on the agenda. It is. I think that's a good on the table for | 00:32:25 | |
| that's a good request that we do open it up and we keep it to just what they've asked. | 00:32:30 | |
| And and and let me. | 00:32:36 | |
| Let me make can't. Well, I guess we can't. We can't deny them to say what they want. So. But let me. | 00:32:37 | |
| Let me make one other suggestion, just because I'm looking at the room and I know there's a number of folks that would like to be | 00:32:42 | |
| heard, and I think it's only fair that we do that as much as possible. | 00:32:46 | |
| 10 minutes for open comment may be a little limiting. | 00:32:52 | |
| Would board be OK if we expand that to 15? | 00:32:55 | |
| Let's go over and wasting time. Let's make it happen. OK, So just to clarify for those you, they're here when we open up the | 00:32:59 | |
| public comment, you can come and speak to the issue. | 00:33:03 | |
| That, as I understand it, is simply raising the cap. | 00:33:08 | |
| One time for this event. | 00:33:11 | |
| Until we can come back and hear the full petition, that's much. | 00:33:13 | |
| Correct. So with that said, I'm going to open the floor to public comment. If you would like to speak, please come forward and | 00:33:18 | |
| state your name and address for the record. | 00:33:21 | |
| And share your thoughts. | 00:33:26 | |
| My name's Paul Riley and I live at 3934 Mile Lane. | 00:33:28 | |
| And I think the attendance thing should be looked at again. | 00:33:33 | |
| And kept at the cab. | 00:33:37 | |
| Like it was originally. | 00:33:38 | |
| The traffic study and everything needs to be looked at. | 00:33:42 | |
| So. | 00:33:47 | |
| In the 300 yard buffer. I just want to clear clarify this, it still stands for this shoot, right? The only thing we're doing is, | 00:33:48 | |
| is addressing the cap. | 00:33:52 | |
| When we vote. | 00:33:57 | |
| Assuming we approve it. | 00:33:58 | |
| OK, just it didn't cause me that big inconvenience. | 00:34:00 | |
| A year ago when I. | 00:34:05 | |
| Brought an attorney in from Indianapolis. | 00:34:06 | |
| For two different months in a row, it ain't got. | 00:34:08 | |
| Rescheduled. | 00:34:12 | |
| Because of the letter, the certified letters, and I think it should be all of this should be rescheduled. | 00:34:14 | |
| For April. | 00:34:21 | |
| Including the attendance. | 00:34:22 | |
| And that that is the plan, so it. | 00:34:24 | |
| We will hear the full petition. | 00:34:26 | |
| In April. | 00:34:28 | |
| So this what we're doing. We're not discussing a permanent change. | 00:34:29 | |
| But the attendance should stay the same. | 00:34:33 | |
| Right now. | 00:34:35 | |
| OK. And that's that's my opinion because we dealt with it. | 00:34:36 | |
| Last year. | 00:34:41 | |
| And we brought an attorney in three months in a row because of the notification to the. | 00:34:42 | |
| And that's how I stand on. | 00:34:46 | |
| Thank you. | 00:34:48 | |
| Please come forward, state your name and address for the record. | 00:34:54 | |
| Frank Loop, 6850 Reacher Rd. | 00:34:58 | |
| Floyd Knobs. | 00:35:02 | |
| I've heard the word reasonable. | 00:35:03 | |
| Several times. | 00:35:05 | |
| I agree with that. | 00:35:06 | |
| And I want you to know Saint Mary's Church is here. They had 600 and. | 00:35:07 | |
| 50. | 00:35:11 | |
| At their fish fry. | 00:35:12 | |
| Friday in three hours. | 00:35:14 | |
| So every fish fry that's going on on Fridays has more than 500. | 00:35:16 | |
| So just. | 00:35:22 | |
| Dad and mom. | 00:35:23 | |
| My name's Andrew Glush. | 00:35:30 | |
| I live at 4155 Mile lane. | 00:35:32 | |
| And I do think the. | 00:35:35 | |
| Should be held to 500. | 00:35:37 | |
| For this event. | 00:35:40 | |
| You recommended or you said? | 00:35:42 | |
| Another test. How many tests are we going to give them? This will be the third round. | 00:35:44 | |
| Of this ********. | 00:35:48 | |
| Where we continue to find arrows on my property. | 00:35:49 | |
| I believe it was 30 year olds last time. | 00:35:53 | |
| And there's still arrows out there. | 00:35:55 | |
| That were found last week. | 00:35:56 | |
| And as far as comparing this to Knobs Fest or Mount Saint Francis or, it's comparing apples to oranges. | 00:35:58 | |
| You're going to have 500 people out there. | 00:36:06 | |
| With bow and arrows you got weapons. I don't believe anybody at Knobs Fest had a. | 00:36:08 | |
| So. | 00:36:14 | |
| As far as comparing the two. | 00:36:15 | |
| Events is absolutely absurd in my opinion. | 00:36:17 | |
| So I believe the cap should stay 500. | 00:36:22 | |
| Hear it again in April. | 00:36:25 | |
| And go from there. | 00:36:27 | |
| Thank you, Sir. | 00:36:28 | |
| Is there anyone else who would like to come forward? | 00:36:30 | |
| Where's the main Rd. | 00:36:40 | |
| I live at 4319 Five Mile Lane. | 00:36:46 | |
| None of these people live in our neighborhood. | 00:36:50 | |
| That's all I have. | 00:36:54 | |
| Good afternoon, my name is Morgan OTT. I live at 6700 Keesler Rd. in Greenville, IN. | 00:37:05 | |
| As a mother of a shooter. | 00:37:12 | |
| My 15 year old son finally found a sport that he enjoys. | 00:37:14 | |
| And that he can fine tune his craft in. | 00:37:17 | |
| I think that. | 00:37:20 | |
| The hoops that I've seen the farm jump through. | 00:37:22 | |
| Has been pretty incredible and I think that. | 00:37:25 | |
| Testing the theory. | 00:37:28 | |
| Is the least that you guys can do to see how responsible? | 00:37:30 | |
| They are. | 00:37:33 | |
| To this. | 00:37:34 | |
| To this option. | 00:37:35 | |
| Being able to bring more money into this county. | 00:37:37 | |
| Through different events. | 00:37:41 | |
| For responsible shooters, I think is. | 00:37:43 | |
| A wonderful thing and for the farm to put their energy into something like this should be noted. | 00:37:46 | |
| Thank you. | 00:37:51 | |
| Thank you. | 00:37:52 | |
| My name is Arjun Van Buell and I live in Georgia in Ball Ground. | 00:37:59 | |
| And. | 00:38:04 | |
| I came here. | 00:38:05 | |
| You know, for the mitigation and the reclamation, but. | 00:38:06 | |
| As a. | 00:38:10 | |
| Citizen. | 00:38:11 | |
| You know I've I've worked at every. | 00:38:12 | |
| Range in this county. | 00:38:14 | |
| And at Indian Creek. | 00:38:16 | |
| Also at the county gun club. | 00:38:18 | |
| And and I've worked at. I'm very familiar with the, with everything that's going on. | 00:38:21 | |
| And I think. | 00:38:26 | |
| What I've seen around the country when kids are getting involved in bow shooting like they are. | 00:38:27 | |
| It's really amazing. | 00:38:32 | |
| You know, and they have gadgets that they sit on all day long. | 00:38:33 | |
| So I think if it's. | 00:38:37 | |
| If it's not impacting. | 00:38:39 | |
| Anything. | 00:38:40 | |
| You know we should all support this. | 00:38:41 | |
| Just to get the kids out there and do something. | 00:38:44 | |
| Thank you. | 00:38:48 | |
| My name is Vicki Mileback. | 00:38:58 | |
| I live at 5743 Blancob Road, right about five mile. | 00:39:00 | |
| I'm a former. | 00:39:05 | |
| Intermediate School archery coach. | 00:39:06 | |
| For over three years. | 00:39:09 | |
| I've been to many statewide events in the state that I was a coach for. | 00:39:10 | |
| As far as looking at the number of shooters. | 00:39:17 | |
| It's, you know, you talked about Marshalls and. | 00:39:19 | |
| People monitoring that. | 00:39:22 | |
| They want more kids to come. It's great as long as you do have. | 00:39:23 | |
| The right amount of supervision available. | 00:39:27 | |
| In order to keep it safe. | 00:39:30 | |
| I think what concerns me more. | 00:39:35 | |
| Is that when this board who? | 00:39:37 | |
| Gave the original variance in 2020. You put stipulations and guidelines in place. | 00:39:39 | |
| Those have been disrespected repeatedly. | 00:39:45 | |
| Month after month we have come. We've shown up here. | 00:39:48 | |
| But you guys still allow yourselves. These are your rules. | 00:39:52 | |
| Your guideline. | 00:39:56 | |
| That you expected. | 00:39:58 | |
| And yet we keep getting told, oh, that's not good enough, That's not good enough. | 00:40:00 | |
| And I'll close with this. | 00:40:04 | |
| At a meeting, I don't know. I think it was a November meeting, but I won't swear to that. | 00:40:07 | |
| It was mentioned. | 00:40:11 | |
| That oh, this is tough for the farm because. | 00:40:12 | |
| You know they can't make money if they're not allowed to have these additional changes to the guidelines and variance. | 00:40:15 | |
| Maybe they need to be given time to make a Better Business plan. | 00:40:22 | |
| Thank you. Oh, Vicky. | 00:40:26 | |
| Yes, Sir. Can I get your opinion? | 00:40:28 | |
| Yes, Sir. | 00:40:30 | |
| How many? | 00:40:30 | |
| People, do you think they need for supervision? | 00:40:31 | |
| You you are. You have done this before, correct? | 00:40:35 | |
| We had two coaches for seven students. | 00:40:37 | |
| And then when the times when we had additional students, so we had. | 00:40:41 | |
| Maybe. I think the highest we had was 13. | 00:40:45 | |
| That we took, these ones we took with us, we had to then borrow from other schools to bring in their qualify because we have to | 00:40:48 | |
| pass the certifications etc. | 00:40:53 | |
| And so we borrowed additional bodies to come with us. So I would say about. | 00:40:57 | |
| For as far as supervision in the monitoring for us, for our kids, we had about four students per adult. | 00:41:02 | |
| OK, that was first. | 00:41:10 | |
| Intermediate. Yes. Intermediate School, SO 1314. | 00:41:13 | |
| You really want the literature, right? | 00:41:17 | |
| All right. Thank you. Thank you. | 00:41:19 | |
| Is there anyone else that would like to come forward? | 00:41:21 | |
| And speak on this matter. | 00:41:27 | |
| My name is Andrew Bush, 4155 Mile Lane. | 00:41:32 | |
| They were talking about the numbers. | 00:41:35 | |
| Uh, per course. | 00:41:38 | |
| There are five different courses that. | 00:41:39 | |
| Are being shot. | 00:41:41 | |
| So it's not just one course that's going around, there's five of them. | 00:41:42 | |
| Just want to clarify that. | 00:41:45 | |
| Thank you. | 00:41:47 | |
| I'm Kathy Smock at. | 00:41:56 | |
| And I'd have it 4157 Gap Hollow Rd. | 00:41:58 | |
| And. | 00:42:02 | |
| This is really just a question I'm sure it can answer. | 00:42:02 | |
| I understand that there's not going to be more than 500 contestants, so that's just. | 00:42:05 | |
| That's apples to apples. | 00:42:12 | |
| What the unknown? | 00:42:14 | |
| Is what kind of. | 00:42:15 | |
| Pull the addition of vendors. | 00:42:17 | |
| Will have. | 00:42:20 | |
| On the mass of people. | 00:42:21 | |
| Who show up? | 00:42:23 | |
| And how? | 00:42:24 | |
| You know, I'd be interested in knowing what mechanism. | 00:42:26 | |
| They're going to have. | 00:42:30 | |
| You know, somebody sitting there with a. | 00:42:31 | |
| Every time a car goes by and count the number of people inside. | 00:42:35 | |
| How are they going to estimate over 500 because we know 500 space lines. | 00:42:38 | |
| I was gonna be sure. | 00:42:43 | |
| Thank you. | 00:42:45 | |
| Right. Recall this 2696 Georgetown Greenville Rd. | 00:42:49 | |
| I just spoke with Sean who is the owner of the TAC event Total Archery Challenge. | 00:42:53 | |
| Because I wanted to clarify some safety things. They've been doing this for over 14 years. | 00:42:58 | |
| They've had one accident. | 00:43:03 | |
| Over 14 years they've had over 250,000 archery shooters. | 00:43:05 | |
| Millions of errors. | 00:43:09 | |
| One accident. | 00:43:10 | |
| They have a mountain crew and they have marshals on site and I just asked him how many. | 00:43:12 | |
| They'll have 8 marshals. | 00:43:16 | |
| On the courses, there are multiple courses. | 00:43:18 | |
| I myself have walked every course, not last year but the year before because I took pictures on the social media person for the | 00:43:20 | |
| farm. | 00:43:24 | |
| There was never an overcrowding. I would never put myself in a position where I could get an arrow in my head or feel unsafe. I'm | 00:43:28 | |
| the same way on the Sporting Place course. | 00:43:33 | |
| So I just want to kind of. | 00:43:37 | |
| Re emphasize to you guys how safe and how serious they take this event. | 00:43:39 | |
| It's a huge event. These Archers that are out there are so experienced. | 00:43:43 | |
| They're not like a. | 00:43:47 | |
| And I don't. | 00:43:48 | |
| I don't know the differentiation between the archery courses and the archery types, but like an IBO. | 00:43:49 | |
| This is. | 00:43:54 | |
| Dedicated hunters and Archers that have lots of experience. | 00:43:55 | |
| Just let me put that out there. Any questions for me? | 00:43:59 | |
| Thank you. | 00:44:02 | |
| O'Reilly again the accident she's talking about a young Archer that. | 00:44:14 | |
| What is very experienced took an arrow to the head. | 00:44:18 | |
| It changed his life. | 00:44:21 | |
| Forever. | 00:44:23 | |
| And they might have. | 00:44:25 | |
| 8 Marshals. | 00:44:27 | |
| But they. | 00:44:28 | |
| The those guys set the targets up last year where they shouldn't be and we need to keep the minimum. | 00:44:29 | |
| Shoes for this shoe. | 00:44:34 | |
| Down. That's not all the arrows got found. | 00:44:36 | |
| Beyond the property because the shooters were allowed. | 00:44:39 | |
| We don't. We're not saying they don't know how to shoot. | 00:44:42 | |
| But it needs to be kept down for our safety. That's what we're here for. We're here to fight for our safety. | 00:44:44 | |
| And it needs to keep the minimum of Shooters Day on. | 00:44:50 | |
| For this event until we all get to come in here and discuss it. | 00:44:53 | |
| Thank you, Mr. Riley. | 00:44:57 | |
| Just just a time show. We've got about four minutes left. | 00:44:59 | |
| Gabrielle Adams, 67427 Mott Lane. | 00:45:08 | |
| I just want to say that they shouldn't have been heard at all since they didn't send out the notifications and I think what this | 00:45:12 | |
| is once again is showing special treatment. | 00:45:15 | |
| To the farm. | 00:45:19 | |
| I don't think this event has just been scheduled. | 00:45:20 | |
| They even likely have known about this for months and they should have came in before. | 00:45:24 | |
| And had all this taken care of? | 00:45:28 | |
| Before this meeting. | 00:45:30 | |
| It again just kind of shows their lack. | 00:45:31 | |
| Of business ethics. | 00:45:35 | |
| I believe it was in the November meeting where you all told him that they needed to go and mark the boundary. | 00:45:37 | |
| He admitted that they still have not done that again, just. | 00:45:42 | |
| Showing that they can't refuse to follow the rules. | 00:45:45 | |
| I believe this board has given them numerous chances. | 00:45:48 | |
| In Toms and I just ask that this be tabled and not being. | 00:45:51 | |
| Nothing be ordered on today and be able to next month. | 00:45:55 | |
| For the record for the Board, and I think the Board's aware of this, but. | 00:45:59 | |
| The notice issue was staff related. | 00:46:02 | |
| Not the farm related. | 00:46:05 | |
| Just want to make sure that's on the record, right? | 00:46:06 | |
| How much time? 2 miles. | 00:46:12 | |
| 2 minutes. | 00:46:15 | |
| Mark Phillips, attorney for the farm. | 00:46:17 | |
| The sad part of this is. | 00:46:20 | |
| That the order in November was that the market had to be before the event. | 00:46:22 | |
| The lady who spoke who was employed at that time is no longer employed. | 00:46:27 | |
| With this board. | 00:46:30 | |
| One of the problems that we have here. | 00:46:33 | |
| Is that exceptions are attempting to be made. | 00:46:35 | |
| Without any factual support. | 00:46:39 | |
| You you you ordered. | 00:46:42 | |
| I mean as a lawyer. | 00:46:46 | |
| You ordered I I take it the same way as a judge, and judges changed their orders based on the facts that are presented. You | 00:46:47 | |
| changed your order but what your order said. | 00:46:51 | |
| And and and and for those who were not at the meeting. | 00:46:56 | |
| The purpose of the marshals. | 00:46:59 | |
| Were to ensure that people stayed within the boundaries. | 00:47:01 | |
| That's what you said. | 00:47:05 | |
| And now this is morphed into a safety concern. | 00:47:06 | |
| Suggesting that the organization that sponsors this is going to be haphazard in their administration. | 00:47:10 | |
| Hasn't happened yet and won't happen again. | 00:47:16 | |
| With respect to the number of people. | 00:47:19 | |
| This county should want. | 00:47:22 | |
| Economic development that's successful and responsible. | 00:47:24 | |
| And professional. | 00:47:27 | |
| In reoccurring. | 00:47:29 | |
| So all the things that you ordered, we're going to follow. | 00:47:31 | |
| And had we had the opportunity to present this tonight through no fault of our own? | 00:47:34 | |
| We was we would have presented the basis upon which we believe. | 00:47:39 | |
| An approval would have found success. | 00:47:43 | |
| But I want to make it really clear we're not up here making changes arbitrarily. | 00:47:45 | |
| You've told us what we have to do, and we stand ready to do it. | 00:47:50 | |
| Thank you. | 00:47:54 | |
| Thank you. | 00:47:55 | |
| 30 seconds. | 00:48:01 | |
| Anyone else have something? | 00:48:03 | |
| Hold on. Hold on, ma'am. | 00:48:05 | |
| I don't want to get in a *** for tat, I really don't. But the. | 00:48:07 | |
| What Mr. Riley is Speaking of was a man that took an arrow to the head. | 00:48:12 | |
| And he has admitted that he was in the wrong place at the wrong time. | 00:48:15 | |
| Check because of that has now. | 00:48:18 | |
| It may have been forced when you go and to get your arrow you have to put a flag down that signals to other Archers that there's | 00:48:21 | |
| someone out here getting their arrow. | 00:48:24 | |
| I just want to say so. | 00:48:28 | |
| Chris Welch, Floyd Knobs, Indiana, 3806. | 00:48:39 | |
| Look, you all don't have this is a bunch of Cowboys and Indians. | 00:48:44 | |
| OK, there's more accidents that happen on a tennis court. | 00:48:47 | |
| Or a golf course. | 00:48:51 | |
| Then what? What the? | 00:48:53 | |
| This would happen. | 00:48:54 | |
| Hunters are responsible. | 00:48:55 | |
| And you all need to. | 00:48:57 | |
| Some of y'all might have bad experiences. | 00:48:59 | |
| But this is about time to let these people start earning. | 00:49:02 | |
| OK. We are going to officially close that section of the meeting. | 00:49:08 | |
| We have. | 00:49:14 | |
| Heard public input. | 00:49:15 | |
| We're discussing. | 00:49:17 | |
| Tabling this event. | 00:49:19 | |
| And we're considering. | 00:49:22 | |
| Possibly giving a one time exception. | 00:49:24 | |
| On the attendance. | 00:49:26 | |
| Only so that is the. | 00:49:27 | |
| That is the issue that we're gonna vote on 1st. | 00:49:31 | |
| And then we will vote on. | 00:49:34 | |
| Tabling. Is that correct? | 00:49:36 | |
| You're doing conjunctions with each other or doom separate however you all see fed if you want to vote to table and allow for a | 00:49:38 | |
| one time exception or not allow for it however you. | 00:49:43 | |
| Let me let let me ask the question is there any way that? | 00:49:48 | |
| We're saying this can be a test. | 00:49:53 | |
| Is there any way that we could have a third party? | 00:49:55 | |
| At this event. | 00:49:58 | |
| That's experienced has does not have. | 00:49:59 | |
| Anything in the fight? | 00:50:03 | |
| Is not on the opposition side, is not for the farm side. | 00:50:04 | |
| Somebody. | 00:50:07 | |
| That we could consider a professional that. | 00:50:08 | |
| That we that the staff would agree to. | 00:50:11 | |
| By both sides. | 00:50:14 | |
| OK, Mr. Rally, come in. | 00:50:16 | |
| Let let the farm come in. | 00:50:18 | |
| And and agree to the the individual and. | 00:50:20 | |
| Because. | 00:50:23 | |
| As a board once again. | 00:50:25 | |
| We hear what they have to say. We hear what they had to say. OK, that's and, and, and I'm. | 00:50:27 | |
| Trust me. | 00:50:32 | |
| I'm not saying anybody's not telling the truth or whatever it may be. | 00:50:33 | |
| But we're hearing two sides. We're always hearing two stories. Let's get a third party. Let's get a professional that they agree | 00:50:36 | |
| to that Hunt Farm agrees to will be at this event. | 00:50:40 | |
| And at any time. | 00:50:45 | |
| That this that event is out of a compliance. | 00:50:48 | |
| That we as a board. | 00:50:51 | |
| Them or them are the staff. | 00:50:53 | |
| Shut it down. | 00:50:56 | |
| I mean, that's to me. That's that, that, that. Then you back the wall. They got to walk the talk, OK? | 00:50:58 | |
| And let's walk it. | 00:51:03 | |
| And so to me is that is that an option? | 00:51:04 | |
| Because we're going to hear the same thing. | 00:51:06 | |
| I was gonna tell you right now. | 00:51:08 | |
| We are going to hear the same thing guys. | 00:51:09 | |
| At the next meeting, it's gonna be the event did this. This is that. They didn't do that. They didn't do whatever. | 00:51:12 | |
| And we're going to be up here. | 00:51:17 | |
| How do we make decisions, I mean. | 00:51:18 | |
| We so. | 00:51:20 | |
| OK, so that's my suggestion. | 00:51:24 | |
| Whatever. | 00:51:26 | |
| This time. | 00:51:29 | |
| Other board member members. | 00:51:31 | |
| I don't if if you feel it's reasonable, I guess I'll just I'm not obviously don't get to make a decision, but if you think it's | 00:51:34 | |
| reasonable to add that as part of your. | 00:51:37 | |
| Vote. | 00:51:41 | |
| I think one thing I would caution you is that it's really. | 00:51:43 | |
| At that point between. | 00:51:46 | |
| You all as a board. | 00:51:47 | |
| And the applicant. | 00:51:49 | |
| Not any other people that have. | 00:51:50 | |
| Um, comments. | 00:51:54 | |
| Because then you're opening the door to. | 00:51:55 | |
| Every resident in Floyd County chiming on on who that is versus it's really it's the applicant that's seeking something and you | 00:51:57 | |
| all as the board. OK, so for some sort of expert. So let me change that the the applicant. | 00:52:02 | |
| Brings the next part. | 00:52:08 | |
| And it's approved by the board, I mean by the asset. | 00:52:09 | |
| I'll leave that to you over the discussion. | 00:52:13 | |
| Well, I don't know, he said. Why can't staff go out there every day? And I don't know. We, we don't, we're not, we don't want them | 00:52:16 | |
| involved in it. I don't think we want that. Liability does say that, right, Nick? | 00:52:20 | |
| Thank you, I did. | 00:52:26 | |
| They know all the rules so. | 00:52:28 | |
| All right, so I'm done. | 00:52:29 | |
| That's it. | 00:52:31 | |
| I'm finished. | 00:52:32 | |
| So I'm circling back to where I began. | 00:52:35 | |
| Which was? | 00:52:38 | |
| We have an issue before us to vote on. | 00:52:39 | |
| The I'm going to try to. | 00:52:42 | |
| Bring this back to something that that we can all. | 00:52:45 | |
| Get our heads wrapped around. | 00:52:48 | |
| Do we want to vote? | 00:52:50 | |
| On the item separately or do we want to do it as more? | 00:52:52 | |
| Meaning tabling and the exception for. | 00:52:55 | |
| Let me let me take you back to where you were just. | 00:52:58 | |
| To kind of circle back. | 00:53:01 | |
| To help you so you do have a motion and 2nd on the table. | 00:53:02 | |
| To allow the one event March 27 through the 29th where wherein you. | 00:53:05 | |
| The motion was made to drop the number of participant or sorry. | 00:53:11 | |
| Number of guests. | 00:53:15 | |
| On the property for that event, with the caveat that they would have to report to you. | 00:53:17 | |
| With a daily report of participants and spectators and everyone on the grounds. | 00:53:22 | |
| Each day of the event. | 00:53:27 | |
| So kind of taking you back to that, I think you should probably. | 00:53:29 | |
| Vote on that now that you've heard comments and then decide on the tabling, OK? | 00:53:31 | |
| So we have a motion. | 00:53:37 | |
| And a second. | 00:53:38 | |
| So let's vote. | 00:53:39 | |
| All those in favor signify by saying aye. | 00:53:41 | |
| Aye. | 00:53:43 | |
| What's the conditions? | 00:53:44 | |
| Just did you want to? Is the only condition is just? | 00:53:46 | |
| What? | 00:53:49 | |
| So do you want? | 00:53:50 | |
| Did you want to suggest another amendment? | 00:53:51 | |
| Yeah, I wanna, I want an amendment. I I want somebody at that event that's an independent. | 00:53:53 | |
| So we can. | 00:53:58 | |
| Have him come in and tell us what happened at that event. | 00:54:00 | |
| I don't want to hear they say, he said. We said. | 00:54:03 | |
| So that's what I want saying that. | 00:54:06 | |
| But who's going to be responsible? | 00:54:09 | |
| To get that person. | 00:54:11 | |
| Is the county going to do it? No, they're going to, they're going. It's the are you going to have the applicant? | 00:54:12 | |
| Talk to somebody or what the applicants going to submit to the staff. The staff will look at the person's criteria and credentials | 00:54:18 | |
| and approving. | 00:54:22 | |
| I think the question is who's going to pay for it? Is that what you're asking? | 00:54:25 | |
| I think they pay for it 100%. | 00:54:28 | |
| So John Barksdale is somebody who's a world class world champion Archer. | 00:54:33 | |
| Used to work with. | 00:54:38 | |
| No longer works there. | 00:54:40 | |
| He's local. | 00:54:42 | |
| There is going to be a cost. | 00:54:43 | |
| It'll probably be expensive. | 00:54:44 | |
| We'll pay for it. Here's the reality of it. | 00:54:46 | |
| Mr. Henry, you're right. | 00:54:50 | |
| It doesn't matter what you hear. | 00:54:51 | |
| You're going to hear the same arguments. | 00:54:53 | |
| And the same over and over and over and over. | 00:54:55 | |
| We're we're going to do this so well that. | 00:54:59 | |
| They they may come in and say the same things. | 00:55:02 | |
| There won't be any facts to support it. | 00:55:04 | |
| But if you want John Barksdale, which is somebody we thought of, who's familiar with the property, who's a world class Archer and | 00:55:06 | |
| who has, who has no loyalty to the farm, he doesn't work there, hadn't for several years. | 00:55:12 | |
| And that's somebody we can think of immediately who's local. | 00:55:17 | |
| And we've already had somebody drive here from Atlanta. | 00:55:21 | |
| All right. And so we're trying to minimize that cost, but if it. | 00:55:23 | |
| There's no reason for him to come in and not answer whatever questions you have and. | 00:55:27 | |
| We can explain to him what his purpose is, if he'll do it. | 00:55:31 | |
| If not. | 00:55:34 | |
| We'll find somebody. | 00:55:35 | |
| Who is objective? | 00:55:37 | |
| I mean, Miss Fox says you can appreciate we're going to bring somebody in here that's connected with everybody and have no | 00:55:38 | |
| credibility. It's not going to happen. | 00:55:41 | |
| But if you want us to have a third party observer. | 00:55:45 | |
| Who comes in that we can get to make a presentation or comments or whatever you want from that person. | 00:55:48 | |
| We're all for that. | 00:55:54 | |
| And your your client is willing to pay for that? Absolutely OK. | 00:55:55 | |
| I think the board has what they need on that then. | 00:55:58 | |
| I'm good. | 00:56:00 | |
| OK, so we need to restate this again. | 00:56:02 | |
| Alright, so my map proposed. | 00:56:04 | |
| Ballot is. | 00:56:08 | |
| A1 time exception. | 00:56:10 | |
| For the March 27th of the 29th event. | 00:56:11 | |
| No cap on attendees. | 00:56:15 | |
| A report at the end. | 00:56:17 | |
| Of the number of attendees and how all that goes. | 00:56:19 | |
| And then an independent. | 00:56:23 | |
| Report on the event. | 00:56:25 | |
| Of how they followed all the restrictions. | 00:56:27 | |
| That they're currently. | 00:56:30 | |
| Required to follow. | 00:56:32 | |
| I think just to elaborate that on that a little bit as an independent. | 00:56:33 | |
| Party to be on site. | 00:56:36 | |
| During the. | 00:56:38 | |
| Entire event. That's right. | 00:56:39 | |
| That can come to the next meeting in April. | 00:56:41 | |
| To answer any questions and address that. | 00:56:43 | |
| I accept your amendment and the individual agreed to by staff. | 00:56:46 | |
| Correct. | 00:56:50 | |
| Group. I concur with all those. | 00:56:54 | |
| All of that OK, we have an amended. | 00:56:56 | |
| Recommendation or ballot? | 00:57:00 | |
| And do we need to 2nd that again? Yes, because you have amendments to it. | 00:57:03 | |
| Wait a second, I'll SEC. | 00:57:08 | |
| OK with ballot and a second all those in favor signify by saying aye aye. Any opposed like sign. | 00:57:10 | |
| OK, now we'll vote on cabling. | 00:57:17 | |
| The event. | 00:57:19 | |
| Do we have a motion to table? I'll make a motion to table event. | 00:57:20 | |
| I'll second. | 00:57:23 | |
| Sorry, table, table the agenda. I'm sorry, not the. | 00:57:24 | |
| Just to be clear, if I can say that. | 00:57:29 | |
| A motion to table Agenda Item 3, FC 022608 and tabling that to April 13th, 2026 at 5:00 PM. | 00:57:32 | |
| Correct. So moved. | 00:57:43 | |
| And I'll second it. | 00:57:45 | |
| So we have a motion and a second. All those in favor signify by saying aye aye. | 00:57:46 | |
| And that motion? | 00:57:51 | |
| Pastors. | 00:57:52 | |
| On notice. | 00:57:55 | |
| Address the board. | 00:57:58 | |
| Yes. So as I, as Miss Fox and I talked about we when we first started this process, we notified 8. | 00:57:59 | |
| Property owners. | 00:58:06 | |
| This past time we notified 23. | 00:58:08 | |
| There were three. | 00:58:11 | |
| Families. The Rileys were one where they got multiple notices. | 00:58:12 | |
| Makes no sense. There were multiple redundant and we. | 00:58:16 | |
| We have e-mail communication. We were told we had to do it anyway. | 00:58:19 | |
| Can can you and I work on clarifying who? | 00:58:23 | |
| The the relevance you are so we don't keep. | 00:58:28 | |
| You know. | 00:58:31 | |
| Sending notices out multiple times to the same people. | 00:58:31 | |
| I'm happy to help at that with with Miss Box, if that if that works, I'll let Nick chime in, but I have no issues if the board | 00:58:36 | |
| directs me to. And let me say this, Nick before you. | 00:58:41 | |
| Share whatever's on your mind. | 00:58:45 | |
| I do think. | 00:58:47 | |
| Given that. | 00:58:48 | |
| We have. | 00:58:50 | |
| Stubbed our toe on this. | 00:58:51 | |
| That, at the very least, we need to do everything in our power to ensure that we. | 00:58:53 | |
| We make sure that this gets heard in April and there are no errors that are based on. | 00:58:57 | |
| Anything that we or our staff have done. | 00:59:03 | |
| Yes. | 00:59:06 | |
| We will only need to notify the people that we failed to notify this time, correct? | 00:59:07 | |
| We will have that list. | 00:59:13 | |
| And I think. | 00:59:15 | |
| Staff will probably go ahead and send those certified to. | 00:59:19 | |
| Ensure that it's done, although we were the ones that made the air. | 00:59:23 | |
| So just for clarification, because we've tabled it in the meeting, we don't have to re notice everybody. | 00:59:27 | |
| Because those people are here or had the opportunity to be here. So notice something goes out to those that did not get notice. | 00:59:32 | |
| So it sounds like staff is going to handle that notice, correct? | 00:59:38 | |
| OK, perfect. Thank you. Thank you. | 00:59:43 | |
| OK. | 00:59:47 | |
| So we are. | 00:59:48 | |
| Going to move along with our agenda this evening. | 00:59:49 | |
| The next item on our agenda this evening? | 00:59:52 | |
| Is agenda item 2. | 00:59:56 | |
| FC-02-26. | 00:59:58 | |
| Dash 03 and. | 01:00:01 | |
| FC-02-206-04. | 01:00:04 | |
| So we have two. | 01:00:10 | |
| Zip 2 separate requests. | 01:00:11 | |
| What I would like to do is the applicant here. You don't have to come forward, but it's the applicant here. | 01:00:13 | |
| Mr. Brown. | 01:00:19 | |
| Are you OK, Sir? If. | 01:00:21 | |
| We hear these as ones that vote on them separately. | 01:00:23 | |
| Just in the interest of time and efficiency. | 01:00:27 | |
| OK, Frank, we'll. | 01:00:30 | |
| Defer to you to give the staff report. | 01:00:33 | |
| OK, so petitioners William Brown, location at. | 01:00:36 | |
| 8551 Strawberry Meadows Lane. | 01:00:41 | |
| For an accessory structure to be placed in front of a home on a corner lot. | 01:00:43 | |
| So applicant is requesting A variance from Section 5.04 Item I to allow an accessory structure to be placed in front of a primary | 01:00:47 | |
| structure on a corner lot containing .74 acres. | 01:00:52 | |
| In the Agricultural Residential zoning district and being Lot 1 of Plat 12/21 in the Greenville Township. | 01:00:57 | |
| Lots. It's at the intersection of Cunningham Sorrells Road and Strawberry Meadows Lane, which per Section 5.02, Item D of the | 01:01:03 | |
| zoning ordinances. | 01:01:07 | |
| Requires that both Streets St. frontages be considered the front of the lock. | 01:01:10 | |
| This is paired with FC 02264 which request a variance from the front yard setback. | 01:01:16 | |
| So the proposed accessory structure would not impede traffic or site visibility and does not create issues with utilities. | 01:01:21 | |
| While the proposal is not informed with the surrounding neighborhood, there is pre-existing landscaping that helps mitigate the | 01:01:27 | |
| any aesthetic concerns. | 01:01:31 | |
| The proposal would not create issues for sight lines or congestion. | 01:01:35 | |
| As a corner lot with the septic system in the rear, there are practical difficulties in placing an accessory structure anywhere | 01:01:38 | |
| else on the lot. | 01:01:41 | |
| There is not an airstrip in the Vista in the vicinity. | 01:01:45 | |
| As a recommendation, encourage keeping the existing landscaping or replacing what is disturbed by this proposal. | 01:01:49 | |
| Proposal is not found to be injurious to the Community. Would not affect adjacent property in a substantially adverse manner. | 01:01:55 | |
| There are practical difficulties resulting from the property in question. | 01:02:01 | |
| I'll go ahead and read that second staff report now as well. | 01:02:05 | |
| So applicant is requesting A variance from Section 4.09 to allow a structure to encryption to the front yard setback of 60 feet by | 01:02:11 | |
| roughly 18 feet on a corner lot containing the .74 acres in the Agricultural Residential Zoning District and being Lot 1 of Class | 01:02:16 | |
| 12/21 in the Greenville Township. | 01:02:21 | |
| The lot sits at the intersection of Cunningham Charles Road and Strawberry Meadows Lane, which per Section 5.02, Item D of the | 01:02:26 | |
| zoning ordinances. | 01:02:29 | |
| Requires that both St. frontages be considered the front of the line. This is paired with the previously read. | 01:02:32 | |
| Staff report for Docket which requested variance to allow an accessory structure in front of a primary structure. | 01:02:39 | |
| The proposed accessory structure would not be traffic or site visibility and does not create issues with utilities while the | 01:02:44 | |
| proposal is not in form. | 01:02:48 | |
| With the surrounding neighborhood there is pre-existing landscape that helps mitigate aesthetic concerns. The proposal would not | 01:02:51 | |
| create issues for sightlines or congestion. | 01:02:54 | |
| As a corner lot with septic system in the rear, there are practical difficulties in placing an accessory structure anywhere else | 01:02:58 | |
| on the lot. There's not an airstrip in the vicinity. | 01:03:02 | |
| Again, encouraging existing landscaping be retained or replaced. What is disturbed? | 01:03:06 | |
| It's not found to be injurious to the community, would not affect adjacent property, and substantially. | 01:03:11 | |
| Adverse manner and there are practical difficulties resulting from the property in question. | 01:03:15 | |
| So OK, any questions for staff? What's the rear lots requirement? | 01:03:20 | |
| Set back. | 01:03:25 | |
| I don't have that off the top of my head. Thank you. OK. | 01:03:28 | |
| Thank you. | 01:03:33 | |
| Frank, when I looked at the proposal, I think it was to have the drive. | 01:03:34 | |
| On to the actual Rd. there. Is that a problem? Do you have to get a permit to do that? | 01:03:39 | |
| Off of Cunningham Sorrows Rd. I believe so yes. | 01:03:43 | |
| I believe that would be a conversation with Horatio and the county engineer to see if that's something necessary. But I. | 01:03:48 | |
| I was wondering if I didn't check in to see if that was a required permit. OK, I've seen that, so it was. | 01:03:54 | |
| Going on to that. So I thought I'd bring that up. | 01:04:01 | |
| Subdivision. The county does not issue driveway permits, we just review them. | 01:04:05 | |
| But so that is a counterpoint so. | 01:04:10 | |
| The county engineer was muted to make sure that. So that's not a problem then. | 01:04:12 | |
| I've seen him second an extra driveway. That's that was my only concern. | 01:04:17 | |
| Any other questions? | 01:04:22 | |
| Another hand comes. | 01:04:24 | |
| Go back to slide somewhere, gentlemen. Any other questions for staff? | 01:04:26 | |
| No, thank you. | 01:04:29 | |
| OK, so we've heard from Staffs, the applicant here or the representative? | 01:04:34 | |
| He would come forward, state your name and address for the record. | 01:04:39 | |
| My name is William Brown. I live at 8551 Strawberry Meadows Lane. | 01:04:44 | |
| Mr. Brown, anything you would like to share with the board that we haven't already heard? No, not in particular. I think Frank | 01:04:49 | |
| summarized it well. I did bring pictures that I know the corner lot. If you've not looked at it, if you're driven by or looked at | 01:04:53 | |
| on Google Maps, it might seem a bit confusing. I took pictures and brought them if you're interested to see them if you haven't | 01:04:57 | |
| already. | 01:05:02 | |
| If you guys, if anybody is interested in seeing them. | 01:05:06 | |
| Any of you like to see the pictures? | 01:05:08 | |
| I've been there, I've been there, been there. | 01:05:11 | |
| Drama. Yeah. Any any questions for Mr. Brown? | 01:05:13 | |
| No, I'm good. | 01:05:17 | |
| Thank you, Sir. | 01:05:18 | |
| Thank you. | 01:05:19 | |
| OK. We've heard from the staff and the petitioner. Is there anyone here this evening that would like to have board speak in favor? | 01:05:23 | |
| This request. | 01:05:28 | |
| Seeing none, anyone who'd like to come forward speak in opposition. | 01:05:31 | |
| Seeing none, we'll move to the ballot. | 01:05:37 | |
| Do we have a ballot? | 01:05:40 | |
| Docket FC02-206-04. Petitioner William Brown. | 01:05:44 | |
| After careful review, the board finds that number one approval of the variance will not be injured to the public. | 01:05:50 | |
| Health, safety, morals and general welfare of the community because the proposed accessory structure. | 01:05:56 | |
| Will not impede traffic or site visibility. Does not create issues with utilities. | 01:06:01 | |
| #2 the use and value of the area adjacent to the property included in the variance. | 01:06:06 | |
| Will not be affected in substantial adverse manner because there is a pre-existing landscaping. | 01:06:10 | |
| That helps mitigate aesthetics concern. | 01:06:16 | |
| The prosa would not create issues. | 01:06:18 | |
| For site lines are congestion. | 01:06:20 | |
| Number the street. | 01:06:23 | |
| The strict application the terms of the zoning ordinance will result. | 01:06:24 | |
| Impractical difficulties and use the proper because. | 01:06:28 | |
| As a corner lot with a septic system in the rear. | 01:06:31 | |
| There are practical difficulties in placing accessory structure anywhere else on the lot. | 01:06:34 | |
| #4 The variance does not involve a structure that is near an airstrip regulated under Indiana Code H-201-10. | 01:06:39 | |

| And or is required to replace. | 01:07:07 | |
| That it. | 01:07:10 | |
| That. | 01:07:11 | |
| Is disturbed by this proposal. | 01:07:13 | |
| That completes my ballot. | 01:07:15 | |
| OK, we have a ballot. Do we have a second? | 01:07:17 | |
| I'll second. | 01:07:19 | |
| Any other questions or comments from the board? | 01:07:20 | |
| Seeing none, all those in favor signify by saying aye. | 01:07:24 | |
| Aye, any opposed like. | 01:07:27 | |
| OK, motion passes. | 01:07:30 | |
| Moving on to our next agenda item. | 01:07:32 | |
| Sorry, sorry, I said we vote on them separately, but I was, I was on a roll. I want to, I want to get out of here before I melted | 01:07:36 | |
| my CO2-206-03. Petitioner William Brown. | 01:07:41 | |
| After careful review, the board finds that one the approval of the variance will not be interest to the public health, safety and | 01:07:46 | |
| welfare of the community. | 01:07:49 | |
| Because the proposed accessory structure will not impede traffic, our site distance and. | 01:07:53 | |
| Does not create issues with utilities. | 01:07:57 | |
| #2 the use and the value of the area adjacent to the property include. | 01:08:00 | |
| And the variance will not be effective standard adverse manner because? | 01:08:03 | |
| Across Cunningham, Cyril's Road and other surrounding areas is rural setting. Additionally, there is pre-existing landscaping that | 01:08:08 | |
| helps mitigate the aesthetics concern. | 01:08:12 | |
| #3 The strict application of terms of zoning ordinance will result in practical difficulties. | 01:08:17 | |
| And the use of the property because as a corner light with a septic in the rear. | 01:08:22 | |
| Is there a practical difficulties in placing accessory structure anywhere else on the lot? | 01:08:26 | |
| #4 This variance does not involve a structure that is near an airstrip or regulated. Indiana Code 821-10. | 01:08:31 | |
| The Board of Zoning hereby grants the petitioner variance at the meeting held on the 9th of March, 2026. | 01:08:38 | |
| Approve The Board is subject to completion of the following conditions. The applicant is required to keep existing landscaping is | 01:08:44 | |
| required to replace any that is disturbed by this proposal. | 01:08:49 | |
| The African news encouraged increased landscaping to better shield. | 01:08:54 | |
| The backyard property line that completes my ballot. | 01:08:57 | |
| OK, we have a ballot. Do we have second? | 01:09:00 | |
| I'll second it. | 01:09:02 | |
| Ballot and a second. Any other questions from the board? | 01:09:03 | |
| All those in favor signify by saying aye aye. Any opposed like sign. | 01:09:07 | |
| Now we officially approve both of those. | 01:09:11 | |
| I think the heat's made me drift off. | 01:09:14 | |
| OK. Next item on the agenda tonight is that I'm going to ask those of you from Saint Mary's if you guys. | 01:09:17 | |
| Have a problem with us doing the same thing? | 01:09:23 | |
| Present all of these. | 01:09:25 | |
| As one and vote separately. | 01:09:26 | |
| And this time, I'll remember. | 01:09:28 | |
| We're getting a thumbs up from. | 01:09:31 | |
| Jason Copperweight. | 01:09:33 | |
| OK, that's what we needed. | 01:09:34 | |
| So we're going to hear the staff report on their C-02-0. | 01:09:36 | |
| 26-09. | 01:09:40 | |
| 10:00 and 11:00. | 01:09:42 | |
| All right. | 01:09:45 | |
| Petitioner St. Mary's. | 01:09:47 | |
| 3500 Martin Rd. Fort Knobs. | 01:09:50 | |
| For a conditional use permit. | 01:09:52 | |
| An institutional use in rural residential zone district. | 01:09:54 | |
| Applicant is requesting A conditional use permit to allow an institutional use in a rural residential zoning district located on | 01:09:58 | |
| 94.296 acres and Lafayette Township. | 01:10:02 | |
| The proposed building would serve up to 500 students as a preschool through 8th grade private school, replacing an existing school | 01:10:06 | |
| building. | 01:10:09 | |
| Said existing building would be removed, accepting 1 portion of the building intended for use by the church youth ministry. | 01:10:13 | |
| The property is located to the South of Martin Road, less than half a mile from. | 01:10:19 | |
| Less than half a mile north of Letty Walter Park. | 01:10:23 | |
| The proposed school building would contain 60,400. | 01:10:26 | |
| 52 square feet on the 1st floor, 14,768 square feet in the basement. | 01:10:29 | |
| In 509 square feet. In second basement totaling 75,729 square feet. | 01:10:34 | |
| Included in the proposal to service this location are an elementary playground, a middle school playground, 31131 parking spaces, | 01:10:40 | |
| and a loading dock. | 01:10:44 | |
| A company in the stocket are the other two variances for height and for? | 01:10:48 | |
| The use is already existing on the site. | 01:10:53 | |
| And we'll have existing points of access along both Saint Mary's Road and Martin Rd. | 01:10:56 | |
| Traffic circulation onto and through the site is expected to be improved. | 01:11:00 | |
| The use is already existing on the site. The proposal is located a couple 100 feet from the nearest right away and several 100 | 01:11:04 | |
| feet from the nearest neighboring property line. | 01:11:08 | |
| Traffic circulation is expected to be improved and the upgraded building is expected to be more aesthetically pleasing than the | 01:11:12 | |
| existing structure. | 01:11:15 | |
| The zoning ordinances. | 01:11:19 | |
| Require conditional use to operate a school within the rural residential zoning district. | 01:11:21 | |
| The uses already existing on the site. | 01:11:25 | |
| This proposal is intended to upgrade the facilities and streamline traffic circulation, improving the use of the site. | 01:11:27 | |
| The Comprehensive Plan does not explicitly discuss educational uses. It does mention management of growth as an objective, | 01:11:33 | |
| encouraging linking. | 01:11:36 | |
| Sorry, leaking growth. | 01:11:40 | |
| To infrastructure and service capabilities rather than agricultural areas. | 01:11:41 | |
| The land use for the proposed site within Lafayette Township is in the transitional Residential. | 01:11:45 | |
| The proposal would not contradict the comprehensive plan. | 01:11:51 | |
| As a recommendation, the use is permitted by Wright within the. | 01:11:54 | |
| Commercial and industrial zoning districts. As such, to mitigate potential negative impacts for use of this intensity, the site | 01:11:57 | |
| should follow at least some of the standards for the zoning districts rather than the standards intended for a rural residential | 01:12:01 | |
| development. | 01:12:04 | |
| Sections that should be applied in four and part listed here. Section 5.09 Buffer yards. 5.11 Environmental standards. 513 | 01:12:09 | |
| Landscaping standards. 514 Loading standards. | 01:12:14 | |
| 520 parking standards, 553 internal sidewalks and pathways. 555 and 556 for lighting. | 01:12:19 | |
| Staff suggests scheduling a technical review committee and. | 01:12:27 | |
| Permitting them to set requirements based on what is appropriate for use of this intensity on the site of this zoning. | 01:12:29 | |
| That must be meant for a building permit is granted. | 01:12:35 | |
| And then I will move on to the. | 01:12:38 | |
| Petition for the height requirement. | 01:12:46 | |
| To exceed section 4.1435 foot high requirement. | 01:12:51 | |
| Applicant is requesting A variance to exceed the 35 foot height requirement in the Rural Residential Zoning District by no more | 01:12:55 | |
| than 15 feet for a proposed school building located on 94.296 acres in Lafayette Township. | 01:13:00 | |
| Per the Floyd County zoning ordinance, height is defined as the vertical distance of a structure measured from the average | 01:13:06 | |
| elevation of the finished grade surrounding the structure to the highest point of the structure. | 01:13:10 | |
| The tower is 37 feet above the base elevation at its foot and 50 feet above the base elevation at the lowest elevation of the | 01:13:15 | |
| basement along the hillside. | 01:13:19 | |
| I do not actually have an average of the. | 01:13:22 | |
| Across the entire building. | 01:13:25 | |
| The proposed building would serve up to 500 students as a preschool through 8th grade private school, replacing an existing school | 01:13:27 | |
| building. | 01:13:30 | |
| Said existing building would be removed, accepting one building intended for use by the church youth ministry. The property is | 01:13:33 | |
| located to the South of Martin Road, less than half a mile of. | 01:13:36 | |
| North of Letty Walter Park, the proposed school building would contain 60,000. | 01:13:40 | |
| Umm, if you don't mind, I'll. | 01:13:44 | |
| Skip through the square footage. There, accompanying this document are the conditional use and the variance for a sign. | 01:13:46 | |
| So through staff comments, the height will not cause any site issues, problems with utilities, and we'll still need to meet | 01:13:53 | |
| building code requirements. | 01:13:56 | |
| There exists several towers associated with Saint Mary of the Knobs and the structure is within the interior of the lot. | 01:14:00 | |
| The building is seated on a hill, resulting in practical difficulties from. | 01:14:06 | |
| Meeting high requirements. | 01:14:09 | |
| And there is not an airstrip in the vicinity. | 01:14:10 | |
| As step recommendations, the proposal is not injurious to the public and general welfare, will not cause a substantially adverse | 01:14:13 | |
| impact on the neighboring properties, and is a result of practical difficulty from building with this terrain. | 01:14:18 | |
| And then last one. | 01:14:24 | |
| Development standards variance Maximum wall sign. | 01:14:29 | |
| Size of 50 square feet. | 01:14:32 | |
| From section 5.27, point B. | 01:14:34 | |
| Applicant is requesting A variance for from the maximum sign square footage by 46 square feet to allow a 96 square foot. | 01:14:37 | |
| Sign for an institutional building in a rural residential zoning district located on 94.296 acres in Lafayette Township. The sign | 01:14:44 | |
| dimensions are proposed as 48 feet by two feet. | 01:14:48 | |
| The proposed building will serve up to 500 students as a preschool through 8th grade private school. | 01:14:53 | |
| Replacing existing school building set. Existing building would be removed. Accepting one building intended for use by. | 01:14:57 | |
| The church Youth ministry. The property is located to the South of Martin Road, less than half a mile north of Bloody Walter Park. | 01:15:03 | |
| Again. | 01:15:09 | |
| We'll skip over the square footage. | 01:15:10 | |
| Accompanying this document are the conditional use and the height. | 01:15:13 | |
| Staff comments The proposed structure, including its wall sign, will be located. | 01:15:16 | |
| Located roughly 200 feet from Martin Rd. and over 300 feet from the southern property line. | 01:15:20 | |
| Given the distance from the neighboring properties and that this site already contains an institutional campus, no substantially | 01:15:24 | |
| adverse impact is expected. | 01:15:28 | |
| Given the size of the site and its distance from the property lines, larger signage is requested to assist with navigation of the | 01:15:31 | |
| site. | 01:15:34 | |
| There is not an airstrip in the vicinity. | 01:15:37 | |
| Staff recommendations The proposal is not expected to be injurious to the public or general welfare of the community and is not | 01:15:40 | |
| expected to have a substantially adverse impact on the surrounding properties. | 01:15:44 | |
| The size of the site. | 01:15:49 | |
| Provides practical difficulties for the use of standard sign sizes. | 01:15:50 | |
| That's all I have for this afterwards. OK, I've got a question, Frank. So, So what we have in front of us right now is just. | 01:15:54 | |
| To request one. | 01:16:01 | |
| 33. | 01:16:03 | |
| OK, the the the sign. | 01:16:04 | |
| The height of the building. | 01:16:07 | |
| Correct. Yes. | 01:16:09 | |
| Where's your thermal continue to use at the school? | 01:16:10 | |
| Conditions You're in a rural residential area. | 01:16:13 | |
| OK. So those are the three conditions that were that's in front of us right now, is that correct the three proposals? Yes. OK. All | 01:16:16 | |
| right. Thank you. | 01:16:20 | |
| Any other questions for staff? | 01:16:25 | |
| With thank you, Ferry. | 01:16:27 | |
| Conditional allowed. | 01:16:29 | |
| And use the rural resin to make a school. Mr. Coppery. | 01:16:31 | |
| I thought they were already approved. | 01:16:34 | |
| I assume you're the representative this evening, Mr. Chairman. | 01:16:36 | |
| Thank you, Sir. | 01:16:40 | |
| Thank you, Sir. | 01:16:46 | |
| I can see that that's going to read this one. | 01:16:52 | |
| Good evening, Jason Copper weight with Primavera and Associates, 1000 Bell Lane, New Albany IN here representing the applicant. | 01:16:59 | |
| The applicant is Saint Mary's of the Knobs cap. | 01:17:03 | |
| Church and school. | 01:17:07 | |
| Also with me this evening is. | 01:17:08 | |
| Let's see, Father Bill marks the pastor. | 01:17:11 | |
| Tracy Janssen, the principal. | 01:17:13 | |
| Building Commission members are building. | 01:17:16 | |
| Committee members Gary Lives and Bill Sprigler. | 01:17:19 | |
| Their architect John Hawkins with talent Pinkster. | 01:17:21 | |
| And Bobby lives there with AML, their construction manager. | 01:17:24 | |
| The first slide this is a an aerial showing the entire property. | 01:17:30 | |
| Complex of the school and church. | 01:17:35 | |
| You can see the school is along the existing schools along Martin Rd. | 01:17:37 | |
| And the church is sort of South. | 01:17:41 | |
| East portion of the overall site. | 01:17:43 | |
| The next slide is a little bit of a blow up. | 01:17:47 | |
| Shows the existing school church. | 01:17:49 | |
| And then just to the left. | 01:17:51 | |
| And N behind the existing church. | 01:17:53 | |
| And multipurpose building. | 01:17:56 | |
| Is where the proposed school will be located. It sort of sits up on the hill. | 01:17:57 | |
| Behind the church. | 01:18:01 | |
| The next slide is the proposed site plan. | 01:18:04 | |
| Because of the size it actually. | 01:18:07 | |
| Stands back into the hillside just a little bit. | 01:18:10 | |
| Making it perfect for a walkout. And that's why the proposal for the base. | 01:18:13 | |
| You can see parking would be. | 01:18:17 | |
| To the front, with the loading dock to the rear, the existing driveway through the site would be relocated. | 01:18:19 | |
| To accommodate the school and parking lot. | 01:18:25 | |
| The next slide. | 01:18:28 | |
| I did want to show you. | 01:18:29 | |
| How exactly? How far away the the the proposal is from property lines? | 01:18:32 | |
| So to the north, the rear of the building will be about 275 feet to Martin Rd. | 01:18:36 | |
| In the front it would be about 1030 feet to Saint Mary Rd. | 01:18:42 | |
| On the South, there would be about 275 feet to the property line. Now that's not the building, that's the actual driveway, so. | 01:18:46 | |
| The building is even further back than that. | 01:18:52 | |
| And then to the West. | 01:18:54 | |
| Again, to the driveway. | 01:18:55 | |
| Is 980 feet to the property line, so it's. | 01:18:57 | |
| It's well positioned. | 01:18:59 | |
| Well, well isolated from adjacent properties. | 01:19:01 | |
| And and bring respectful of them. | 01:19:04 | |
| The next slide would be. | 01:19:07 | |
| The building elevations, you can see Mr. Hawkins did a great job. | 01:19:09 | |
| Preparing an attractive building. | 01:19:13 | |
| But as architects like to do, he included a special feature on the top. | 01:19:17 | |
| I call it an architectural tower. He calls it the entrance lobby. | 01:19:21 | |
| Tower. Its purpose is to extend extend vertically. | 01:19:25 | |
| And then let light into that entrance lobby. | 01:19:29 | |
| That's why it's there, but it does. | 01:19:32 | |
| I had some height to the building. | 01:19:34 | |
| The next slide is the zoning. You can see the site and all the adjacent properties are zoned rural residential. | 01:19:37 | |
| On the next slide is the use table from the ordinance. | 01:19:45 | |
| All you can see from rural resin. | 01:19:49 | |
| Rural residential at the top. | 01:19:50 | |
| Down to school, public, private is a is a conditional use and that's why we're here. | 01:19:52 | |
| Today asking for that conditional use. | 01:19:57 | |
| The next slide, these are the special exception justifications that we provided in our in our. | 01:20:00 | |
| Application. | 01:20:06 | |
| They agreed very well with what the staff said and we wholly, wholly endorsed the staff report. | 01:20:07 | |
| We think it is very fitting. | 01:20:12 | |
| If you would like me to read these to you, I can, but you have them in your application and I would just enter them into the | 01:20:14 | |
| record as. | 01:20:17 | |
| As evidence in support of the special exception. | 01:20:20 | |
| There are two development standards variance as staff mentioned. | 01:20:24 | |
| Building height of 50 feet in lieu of the allowed 35. | 01:20:28 | |
| A single sign area of 96 square feet in lieu of the allowed fifty. | 01:20:32 | |
| Again, your next slide. | 01:20:36 | |
| So the building height was actually measured to. | 01:20:38 | |
| The walkout. | 01:20:41 | |
| I think as staff mentioned, from first floor to the top of the architectural tower is 37 feet. | 01:20:43 | |
| Which is slightly higher than the allowed 35. | 01:20:48 | |
| The 50 measures when you go to the walk out. | 01:20:51 | |
| And again, that's necessary because of the topographical restraints. | 01:20:53 | |
| I did again excerpt. | 01:20:57 | |
| Copies from our application of the of our justification for those variances. | 01:21:00 | |
| Again, I will read those if you'd like, but I would like those entered into the record. | 01:21:04 | |
| In support of the application. | 01:21:08 | |
| The sign variance on the canopy. | 01:21:10 | |
| It's simply it's channel letters that simply say Saint Mary of the Knobs Catholic School. | 01:21:14 | |
| Just so people can identify, it is a large site. | 01:21:19 | |
| I need more than. | 01:21:22 | |
| More sign area. | 01:21:24 | |
| Than what otherwise would be required at 50 square feet. | 01:21:25 | |
| It would be a 25. | 01:21:28 | |
| Sort of long sign, it just would not be visible. | 01:21:30 | |
| Very visible from from around the side. | 01:21:34 | |
| You can see it's still an attractive building. | 01:21:36 | |
| Very much in scale with the facade. | 01:21:38 | |
| That's being proposed. | 01:21:40 | |
| Not out of, not out of place at all. | 01:21:42 | |
| The next slide again is the excerpts from our application. | 01:21:45 | |
| For the justification for the sign variance, the three criteria. | 01:21:49 | |
| And again, I would ask those be added into the record. | 01:21:52 | |
| And with that, we'll be happy to answer any questions you have. | 01:21:55 | |
| Questions. | 01:21:58 | |
| I have a couple questions. | 01:21:59 | |
| Sure, but mainly on the height, just so I understand. | 01:22:00 | |
| So on the front of the building. | 01:22:03 | |
| How tall? How tall is it to here? | 01:22:07 | |
| 37 feet. That's 37 feet. | 01:22:09 | |
| Yes. All right. So I go to the back of the building. | 01:22:11 | |
| Yes, if I'm at the back of the building. | 01:22:16 | |
| You're, you're, you're. It's this dark area that you're talking about. | 01:22:18 | |
| The the whole. | 01:22:23 | |
| Thing on top. | 01:22:25 | |
| From this eve down, how are we? How much are we? | 01:22:27 | |
| I don't have an answer for that. | 01:22:30 | |
| From the top of the tower. | 01:22:32 | |
| To the bottom of the walkout would be 50. | 01:22:34 | |
| It's not accepting the tower, just to the rift to the roof power. | 01:22:37 | |
| But but this is this is. | 01:22:43 | |
| How tall is this tire? I guess is what I'll get off of the. | 01:22:44 | |
| Are we talking 10 feet, 15 feet? So you're. | 01:22:48 | |
| Bear with this just a second, OK? | 01:22:52 | |
| Top of the the top of the building. The main building wall. | 01:23:00 | |
| Prague. | 01:23:07 | |
| Steps a little bit so it's 22 foot 6. | 01:23:13 | |
| It steps up a little bit right before the tower. | 01:23:17 | |
| That's 24. | 01:23:20 | |
| And then on the backside. | 01:23:22 | |
| That's John Hawkins, the architect speaking. | 01:23:27 | |
| John Hopkins Tower, Pinkster, 320 Pearl St. New Albany. | 01:23:33 | |
| Yeah. So on the front, the front wall. | 01:23:37 | |
| I'm not worried about the front. I'm OK with the front. I'm just wondering about the back, what we're talking here on the back. | 01:23:40 | |
| How much it extends above the roofline? How much extends above the roof from the ground? | 01:23:47 | |
| To the normal roofline, excluding. | 01:23:52 | |
| Right, excluding the time on the backside. | 01:23:55 | |
| Because I saw a basement, I guess there was a sub basement. | 01:24:03 | |
| No, it's just it's just to walk out basement. So there's first floor, then there's a basement below. It seemed to me it's going to | 01:24:06 | |
| be around 13 because if it's 24 to step up before the tower and the tower goes to 37, it's going to be 22. | 01:24:13 | |
| We'll call it 24 + 1337. | 01:24:21 | |
| About 37 feet, so the north. | 01:24:24 | |
| The normal. | 01:24:27 | |
| I think it's just two foot over our. | 01:24:29 | |
| Regular requirement it's the. | 01:24:31 | |
| The white thing that. | 01:24:34 | |
| Brings it up to 50 OK, the architectural feature. | 01:24:35 | |
| And then the reason there's not a sub basement, the reason we're saying 2 basements is. | 01:24:39 | |
| We could do the whole thing as a basement. We could have a. | 01:24:44 | |
| 60,000 square foot basement. We don't need a 60,000 square foot basement. We've got a 15,000 square feet. | 01:24:47 | |
| And then it's all filled in except over here we've got a little utility basement. OK, well that's what confused me because I saw 2 | 01:24:53 | |
| numbers for two different basements. So there are two basements that are at the same level but not connected with. | 01:25:00 | |
| OK. | 01:25:06 | |
| I'm good with that, I understand that. | 01:25:07 | |
| Thank you. Thank you. | 01:25:09 | |
| Other questions for Mr. Copper. | 01:25:11 | |
| Thank you, Sir. Thank you. | 01:25:16 | |
| OK, so excuse me from the staff, heard from applicant. | 01:25:20 | |
| Is there anyone else here this evening would like to come forward and speak in favor? | 01:25:24 | |
| Of this. | 01:25:28 | |
| These requests. | 01:25:29 | |
| I see smiles, but I'm gonna, I see nobody standing, so I'm gonna assume we can go to anyone here this evening that would like to | 01:25:34 | |
| speak in opposition. | 01:25:38 | |
| If so, feel free to come forward. | 01:25:42 | |
| OK, seeing none, we will close the public comment section. | 01:25:47 | |
| And we will go to. | 01:25:51 | |
| Ballot Do we have a ballot this evening? | 01:25:54 | |
| And this first ballot ballot will be on FC-02-206-09. Is that correct? That is correct. | 01:25:57 | |
| OK, petitioner Saint Mary's of the Novice. | 01:26:07 | |
| After careful review, the board finds that one the condition will not be interest to the public health, safety, morals and general | 01:26:10 | |
| welfare of the community. | 01:26:14 | |
| Because the use is already. | 01:26:18 | |
| Existing on the site and will have existing. | 01:26:20 | |
| Points of access. | 01:26:23 | |
| How long ago Saint Mary's and. | 01:26:25 | |
| Mark and Martin wrote Traffic circulation on to and through the. | 01:26:27 | |
| Site is expected to be improved. | 01:26:31 | |
| #2 the use and value the area adjacent. | 01:26:34 | |
| To the property will not be adversely affected because the use is already existing on the site the proposed. | 01:26:36 | |
| Proposal is located. | 01:26:42 | |
| A couple 100 feet from the nearest right of way, and several. | 01:26:44 | |
| 100 feet from the nearest neighboring property line, traffic circulation is expected to be improved. | 01:26:47 | |
| And the upgrade. | 01:26:53 | |
| Upgraded building is expected to be more aesthetically pleasing. | 01:26:54 | |
| Then the existing structure. | 01:26:58 | |
| #3 the need for the conditional use. | 01:26:59 | |
| Does result from. | 01:27:02 | |
| Any condition from any condition unusual or peculiar to the property because the zoning ordinance requires. | 01:27:03 | |
| The conditional use to operate a school within the rural residential area. | 01:27:11 | |
| Zoning District. | 01:27:15 | |
| #4 the strict application, the terms of Floyd County zoning. | 01:27:17 | |
| Will result in an unnecessary hardship in the use of the property because the use is already existing on the site. This proposal | 01:27:20 | |
| is intended to upgrade the facility and streamline traffic circulation, improving the use of the site. | 01:27:26 | |
| #5 the approval of this condition. | 01:27:33 | |
| Of the conditional use will not contradict the goals and objectives of the Floyd County Comprehensive Plan because the | 01:27:36 | |
| Comprehensive Plan does not explicitly discuss educational uses. | 01:27:41 | |
| It does mention management of growth as an objective. Encouraging. | 01:27:46 | |
| Linking growth through infrastructure and service capabilities rather than agriculture areas, the proposal would not contradict | 01:27:49 | |
| the comprehensive plan. | 01:27:53 | |
| The board is owning a period. | 01:28:01 | |
| Appeals hereby grants. | 01:28:03 | |
| The petitioner. Conditional use at the meeting held on the 9th of March, 2026. | 01:28:04 | |
| Approval by the Board of Zoning is subject completion of fine conditions. | 01:28:09 | |
| The following Floyd County Zoning garage requirements will apply to this application. | 01:28:13 | |
| Section. | 01:28:18 | |
| 5.09, SECTION 5.11. SECTION 5.13. SECTION 5.14. | 01:28:19 | |
| Section 5.20. SECTION 5.53. | 01:28:26 | |
| Section 5.55 and Section 5.56. | 01:28:29 | |
| A technical review committee meeting will be scheduled, permitting the Comm. | 01:28:34 | |
| For meeting the committee to set requirements based on what is appropriate for the use and the. | 01:28:38 | |
| In sea of a on a site. | 01:28:43 | |
| Of this zoning. | 01:28:46 | |
| That must be met before a building permit is branded. | 01:28:47 | |
| That completes my ballot. | 01:28:50 | |
| OK, we have a ballot. Do we have a second? | 01:28:52 | |
| I'll second. | 01:28:54 | |
| With the ballot and a second, any other comment questions from the board? | 01:28:55 | |
| All those in favor signify by saying aye aye. | 01:29:00 | |
| Any opposed sign? | 01:29:02 | |
| OK, we'll go on to the. | 01:29:04 | |
| Next request. | 01:29:06 | |
| To consider to waive a ballot for FC-02-206-10. | 01:29:09 | |
| Yes. | 01:29:14 | |
| The petitioner of Saint Mary's the Knob and this one is for the building height. | 01:29:15 | |
| After careful review, the Board of Zoning finds that board approval the variance will not be interest to the public Health Safety. | 01:29:19 | |
| Morals and welfare of the community because the Heights will not. | 01:29:26 | |
| 'Cause any site issues problems with utilities and will. | 01:29:28 | |
| To be met. | 01:29:33 | |
| And will still need to meet building code requirements #2 the use and the value of the area adjacent to the building. | 01:29:34 | |
| Included in the variance will not be affected in the substantial adverse manner because there. | 01:29:41 | |
| Our existing tires associated with Saint Mary's of the Knobs. | 01:29:46 | |
| And this structure is within the interior of the property. | 01:29:50 | |
| #3 the strict application in terms of zone yarnage. | 01:29:53 | |
| Will result in practical difficulties proper use of the property. | 01:29:57 | |
| Because. | 01:30:01 | |
| The building is seated on a hill, resulting in practice of difficulties. | 01:30:02 | |
| For meeting height requirements. | 01:30:06 | |
| This number 4 the variance does not involve. | 01:30:08 | |
| The structure that is near an airstrip and regulated under Indiana Code 8-201-10. | 01:30:10 | |
| The Board of Zoning Appeals hereby grants the petitioner. | 01:30:16 | |
| The variance at the meeting held on the 9th of March 2026. | 01:30:19 | |
| That completes my belt. | 01:30:23 | |
| OK, we have a ballot. Do we have a second? | 01:30:25 | |
| 2nd. | 01:30:26 | |
| Ballot in a second. | 01:30:27 | |
| Any other questions from the board? | 01:30:30 | |
| All those in favor signify by saying aye aye. Any opposed like sign. | 01:30:31 | |
| OK, we're going to vote on. | 01:30:36 | |
| Or looking for ballot now in FC-02-206-11. | 01:30:39 | |
| This ballot for the signage. | 01:30:45 | |
| After careful review, the board finds that one approval of the variance will not be interest to the public. | 01:30:47 | |
| Health, safety and morals and general welfare of the community because the proposed structure, including its wall sign, will be | 01:30:54 | |
| located roughly 200 feet from Martin Rd. and over 300 feet from the southern property line. | 01:30:59 | |
| #2 the. | 01:31:05 | |
| The use and the value. | 01:31:06 | |
| Value the area adjacent to the property, including the variance will not be affected in substantial adverse manner because the | 01:31:08 | |
| given distances from neighboring properties. | 01:31:12 | |
| And. | 01:31:16 | |
| Already contains an institutional campus. | 01:31:18 | |
| Campus. | 01:31:21 | |
| No substantial adverse impact is expected. | 01:31:22 | |
| #3 the strict application of the terms of zoning. | 01:31:26 | |
| Ordinance will resolved impractical difficulties and use prop because the status of the site and its distance from the property | 01:31:29 | |
| lands. | 01:31:33 | |
| Larger signages requested to assist with. | 01:31:37 | |
| Navigation of the site. | 01:31:40 | |
| #4 This variance does not involve the structure that is near an airstrip and regulated under Indiana Code 8-201-10. | 01:31:43 | |
| The Board of Zoning Appeals. | 01:31:51 | |
| Nearby grants the petitioner of the variance at the meeting held on the 9th of March. | 01:31:53 | |
| 2026 that completes my ballot. | 01:31:58 | |
| OK, we have ballot. Do we have second? I'll second. | 01:32:00 | |
| Ballot in a second. Any other questions from the board? | 01:32:03 | |
| Seeing none, all those in favor signify by saying aye aye. | 01:32:06 | |
| Any foods like sun? | 01:32:10 | |
| And that motion passes. | 01:32:12 | |
| Congratulations. | 01:32:14 | |
| Our thank you. | 01:32:17 | |
| Seeing the weather business on the agenda this evening. | 01:32:21 | |
| The only other thing was discussing the June meeting. I have requested if we could consider moving that. | 01:32:24 | |
| Think Nick was saying he could send out an e-mail to pull what dates are available that month. | 01:32:29 | |
| If that's OK with the board, I'm. | 01:32:35 | |
| OK, OK, so. | 01:32:37 | |
| She may change the June meeting to send something out to. | 01:32:39 | |
| Modify our June board meeting. No need for us to vote on that. No, you don't need to vote on it. Is there anything else to come | 01:32:43 | |
| before the board this evening? No, Sir. No, no. Entertain a motion to adjourn. | 01:32:48 | |
| I'll make a motion. | 01:32:52 | |
| 2nd. | 01:32:53 | |
| All in favor signify by saying aye. We are adjourned. | 01:32:54 | |
| What date do you have a problem with? Uh, Christy? | 01:33:00 | |
| So what do you want if? | 01:33:04 | |
| 29. | 01:33:10 | |
| Hey, Cortana. | 01:33:27 | |
| I'm OK with the 8th, with the 15th doesn't work for me. | 01:33:30 | |
| I hate to do it. | 01:33:38 | |
| The first one worked better for me, that's on the 1st. | 01:33:45 | |
| I don't know. | 01:33:56 | |
| I don't think they did. Yeah, if you have a copy, Bill. | 01:34:00 | |
| Yeah, at the end, you don't want to signature on your testimony if you look at the past minutes. | 01:34:06 | |
| I would have thought that he's right there. | 01:34:30 | |
| Yeah, yeah. But next time you can just go back to the prior form. It's perfect. Just signal and then test and I can test it or | 01:34:39 | |
| Nick or you, whatever. | 01:34:44 | |
| Totally missed that. | 01:34:51 | |
| I guess Gabrielle wants to approve something because you said. | 01:34:57 | |
| That was a disaster, that was. | 01:35:14 | |
| I don't know how she could normally. I mean, so I. | 01:35:28 | |
| In my mind I was thinking the reason why combination. | 01:35:41 | |
| Like. | 01:35:47 | |
| I just found out. | 01:35:57 | |
| But even 3. | 01:36:03 | |
| But then also. | 01:36:12 | |
| We need to make some days, right? Hi. How are you doing? Good. You did a good job. Thank you. Sometimes I am, yeah. | 01:36:22 | |
| Miss 05, I didn't get seen, but my wife said if you were at church. Yeah, he's, he's doing well, good, all things considered. So | 01:36:31 | |
| glad to hear. Yeah. | 01:36:37 | |
| It's good to see you now. | 01:36:43 |

| The Board of Zoning. | 01:06:48 | |
| Appeals hereby grants. | 01:06:49 | |
| Petitioner variance at the meeting held on the 9th day. | 01:06:50 | |
| Of March 2026. | 01:06:53 | |
| Or the 52 foot set back from the center. | 01:06:55 | |
| Of Cunningham Sorrows Rd. | 01:06:59 | |
| Approval by the Board is subject to the completion of the following condition. Applicants required to keep the existing | 01:07:01 | |
| landscaping. | 01:07:04 | |
