Issue. 00:00:01
Right, I would like to. 00:00:03
Call to order. 00:00:05
The public hearing. 00:00:07
On the matter of the. 00:00:09
Open Door youth shelter. 00:00:13
This was a matter that we appreciate. 00:00:15
After our last Commissioners meeting. 00:00:20
Where there was a vote to dissolve the interlocal agreement. 00:00:22
Between the Floyd County Commissioner. 00:00:27
County employees and the. 00:00:29
Open Door youth shelter. 00:00:31
And we have. 00:00:32
Some information to share, which would be fine, but let's say the Pledge of Allegiance first. 00:00:35
I pledge allegiance to the flag of the United States. 00:00:41
United States of America. 00:00:43
And to the Republic for which it stands. 00:00:45
One nation under God, indivisible, with liberty and justice for all. 00:00:48
Alright, this 2 is joint meeting and. 00:00:54
And, umm. 00:00:56
I don't know if we need a formal roll call. 00:00:58
Public hearing to move It's a joint public hearing, if you will, on the matter with the council and the. 00:01:00
Commissioners present. We do have a majority or quorum of both bodies. 00:01:06
And. 00:01:10
Our lead council tonight is going to be Chris Fox again. Mr. Fox has a family matter that he's attending to Mr. Steve Langman 00:01:12
here. 00:01:16
Representing the Council. 00:01:20
We opened up or at some point during the last Commissioners meeting with regards to this, there were some question as to whether 00:01:23
or not. 00:01:26
There was in fact an interlocal agreement between the two parties and that. 00:01:30
Is what we predicated some of our decisions on. 00:01:33
And so. 00:01:37
We're honored to have. 00:01:40
Circuit Court Judge Brown here tonight to discuss. 00:01:41
His investigation into that matter and. 00:01:45
Believe you have some common scores. 00:01:47
Good afternoon everyone. Always appreciate having the opportunity to appear before the Commissioners and the Council. 00:01:59
I'm going to be glad to provide everyone with an update on the status of Open Door Youth Shelter and I'm not here to make any ask 00:02:05
today. 00:02:08
There's been much uncertainty and confusion swirling around this topic, and I think we'll be able to put a little bit of that to 00:02:12
rest. 00:02:15
Issues surrounding the shelter first appeared. The first question I asked was, legally speaking, what is the shelter? 00:02:17
And we know it exists. It's just right over there. 00:02:23
But you know, what is it? On one hand, you have the shelter itself and you have the Youth Services Bureau. You have the Friends of 00:02:26
Open Door, which is the nonprofit. So the matter readily lends itself to a little bit of confusion. 00:02:31
For decades, the legal status of the shelter has been unclear. 00:02:38
Is a part of the court. 00:02:41
Is it part of the county? 00:02:42
Is an independent agency. 00:02:43
Is it some combination of the above, or is it something else altogether? 00:02:45
Well, after a thorough investigation, a review of documentation and correspondence to and from the State Board of Accounts. 00:02:49
In consultation with the Office of General Counsel for the Indiana Supreme Court. 00:02:55
It has been made clear to me that the shelter was created by Floyd Circuit Court Judge and released back in 1982. 00:02:59
Under Title 31, Article 31, Chapter 8 of Indiana Code. 00:03:05
And as such, the shelter was and remains under the direction and control of the Floyd Circuit Court. 00:03:09
I believe it would best be termed as a quasi governmental agency, something like our Floyd County community corrections. 00:03:15
So this brings me to the Interlocal agreement. 00:03:21
That's become the focus of so much attention and why we're here today. 00:03:23
I want to be clear that neither the office of the Floyd Circuit Court and that's including my predecessor whom I spoke with. 00:03:27
Board of Commissioners or the shelters in possession of a signed copy of that 2010 year local agreement bearing a signature. 00:03:32
From either the court. 00:03:38
Courts agent or the shelter? 00:03:39
As such, it's my belief that lacking the authorization of the court, there is no Interlocal. 00:03:41
You can't have an agreement unless you have all the parties too. It's signed. 00:03:47
Now, Despite that and in good faith, the Board of Commissioners have never wavered from intending to honor that agreement. 00:03:50
Furthermore, throughout my many conversations with the commissioners, it was made clear that they have never intended or desired 00:03:56
for Floyd County to be without a youth shelter. 00:04:00
If the shelter is not to remain here in Pineview, the commissioners are both intended and indicated they wish to help facilitate 00:04:04
the shelter's relocation. 00:04:08
So as it's become clear that the interlocal agreement does not exist, the question then becomes where does this put us going 00:04:12
forward? 00:04:15
Well, that answer is not yet set in stone, but I'm confident based upon many conversations that have been had together we will 00:04:18
find a solution to both complies with the law and which serves the need of the youth of our community. 00:04:23
So to that effect and by statute, I will be convening an Advisory Board of elected officials and stakeholders in the very near 00:04:29
future. 00:04:32
To determine and explore what this can, should and will look like, that Advisory Board will include a member of commissioners and 00:04:36
member of the council. 00:04:39
I will also be completing A thorough review of operations to better determine what the structure, objectives and needs of the 00:04:43
shelter are. 00:04:46
As this process unfolds, the Board of Commissioners are in agreement that the shelter will remain here at Pineview until we can 00:04:50
determine what the next steps are. 00:04:53
I know that myself, Miss Pesarosi and all of those involved with Open Door are grateful for that. 00:04:58
Now lastly is the shelter is under the purview of the Circuit Court, all communications their official statements must on behalf 00:05:02
of Open Door have to come through our office. 00:05:07
Now, if anyone has any questions, I'm happy to try to answer them now, or you're more than welcome of course to reach out to me at 00:05:11
any time. 00:05:14
So go ahead, I'll and I'll start it off, Your Honor. 00:05:20
It is, yeah. 00:05:27
Is an era local needed to move forward? 00:05:30
Is an air local needed to move forward? 00:05:33
I believe so. I believe that based on what's been explained to me is the Circuit Court has autonomy to enter into those 00:05:35
agreements. So if you need an interlocal, I think we can talk about that and we can sit down and construct one if we want. I don't 00:05:39
know that it's necessary though. 00:05:44
But that's something you can sit down and talk about. 00:05:48
Does Open Door have the authority to enter into any new contracts? 00:05:52
No, it's only the court that has that authority. Unless I bestow or. 00:05:55
View that authority upon them but as of now there's no authority until we get sit down and community Advisory Board and. 00:05:59
Look at where everything is at. Everything has to come through. 00:06:06
Just for definitions, the Floyd. 00:06:10
Or is you and or the magistrate or just. 00:06:13
Judge Brown. 00:06:16
I am simply a steward of the office for the time being, but yes. 00:06:17
I am. 00:06:22
Because the magistrate is the magistrate of the circuit and Superior Court, so it's just the Floyd circuit. So the statute reads 00:06:24
that it's the juvenile court and Floyd County, it's the juvenile court is the. 00:06:28
Workout so and. 00:06:33
The lease was ensconced within the interlocal agreement that. 00:06:36
Does not exist. 00:06:40
Correct, that is fair to say the police does not exist. 00:06:41
But I think we've already discussed the obligations under 31318. So I think that kind of. 00:06:44
Right. That's why I think I look forward to gaining clarity with that. I mean, I think Commissioner standpoint, everything you 00:06:49
said is true and valid from. 00:06:52
Beginning to now and I think. 00:06:57
Conversation would have probably flowed differently, and they're not. 00:06:58
With the question on the interlocal agreements validity. 00:07:02
That we brought into question at the last meeting, but anyway, I'm glad to have. 00:07:06
Finality on that? 00:07:09
A state only on my behalf because I'm only one of the three commissioners, but I believe it is still our intent. 00:07:12
To move our government offices from the Pineview Building at some point and whether or not. 00:07:18
We can find a new owner that would. 00:07:22
Accommodate. 00:07:24
The youth shelter. 00:07:25
It's already a new location for the youth Shelter would be our two goals then. 00:07:28
The 2GO hand in hand in hand, but yet they're not mutually exclusive, so we might find an owner who's willing to accommodate that. 00:07:33
We might not, but either way. 00:07:40
We acknowledge the. 00:07:42
The circuit courts authority over. 00:07:45
Watching out for us with regards to our duties as outlined in those. 00:07:48
Precepts from 1982. 00:07:54
1982 And I think from our conversations, I believe the statute probably would have originated. 00:07:56
Sometime right before, right then because of the ability for that statute for a youth shelter we created. Yeah. And what year was 00:08:01
the interlocal agreement? 00:08:05
The one that you because it was 2010. The one they go, I don't know. And that's the thing I've I've went through the office, I've 00:08:09
tried to find if there's anything that exists. I'm still waiting to hear back from State Board of accounts to get a complete. 00:08:14
I've requested everything they have. 00:08:19
Which is probably no small task, and once I have that I'll provide copies to the commissioners and Council so you all see. 00:08:21
You all will have complete transparency with everything I'm working. 00:08:27
OK, well, I mean. 00:08:31
This is what we wanted was some clarity on the issue. That's that's why we've taken on some of these issues that have. 00:08:32
Sat uncontested for. 00:08:38
A decade and 1/2 in this case, but longer in other cases. Less time in other cases, but. 00:08:40
We're we're finding out some things that. 00:08:46
Haven't quite been spelled out. 00:08:49
And if they're not transparent to us, how can they be transparent to the public? 00:08:51
It's been quite the task trying to go through some of these processes and. 00:08:55
Understand how they were. 00:08:59
Set up versus. 00:09:01
You know, statutorily the way it should have been done at times. 00:09:02
But the only other question that I would have right now is do you have any kind of indication or a timeline of what? 00:09:06
This looks like to get some more information so we can. 00:09:12
Before, because at the end of the day, I do think that. 00:09:15
You know, we, we want to try. 00:09:17
Find a new owner for this building at some point, so and. 00:09:19
But at the same time, you know, I want to make sure the kids are. 00:09:23
Are taken care of, but at the same time we got to. 00:09:26
We had some planes that we got to figure out. 00:09:28
I'm going to give you the law school answer. Maybe, I don't know. 00:09:31
I mean, it depends. It really is. I mean, as we get into this process, there's a lot, you know, as we found out, sometimes asking 00:09:34
questions leads to more questions and that's where we got to where we're at. 00:09:39
I think we're in a good spot though. 00:09:44
I think we really have a nice clear directive. 00:09:46
Of obligations, where we're at and how we're going to navigate this moving forward. 00:09:48
So I see. 00:09:52
A representative from the Tribune there. So I want to make sure that. 00:09:54
You realize that this means that the February deadline is no longer in existence. 00:09:57
That's correct. So again, the absence of an interlocal agreement basically vacates. 00:10:03
The proceedings of our last Commissioners being with regards to the establishment of a timeline. 00:10:08
And we look forward to working with all parties. 00:10:13
For inamicable solution. 00:10:15
Likewise, and I think once we can meet the Advisory Board that will help give us a nice direction. 00:10:17
About what the needs are. 00:10:22
Where we need to move forward. 00:10:23
This now. 00:10:25
Any other comment or question I will just make a statement. 00:10:28
I guess. 00:10:32
I served on the board for a bit. 00:10:35
Shelter. They do a lot of other things other than just the shelter. They have a lot of programs. 00:10:37
I totally agree with that. 00:10:42
But I would just. 00:10:43
Maybe put my name on the line. I commend the commissioners. 00:10:45
For doing what they did. 00:10:49
This is as clear as I've been since I've been sitting on this council. 00:10:51
Thank you, Judge Brown, to make it clear what's expected, what's not. 00:10:55
And I think going forward, it's going to be a really good resolution. 00:10:59
I appreciate that and I agree. I think we've all got great relationships. We'll sit down and talk and we're going to figure out 00:11:03
what this is going to look like. 00:11:06
It's been confusing for a long time. 00:11:09
To a lot of people, but we're going to clear that up so. 00:11:11
Your Honor, would you be willing to take questions from the public, if any? 00:11:15
Sure. 00:11:19
Opportunities to question the judge. 00:11:24
OK. 00:11:31
Yeah, I think we'll actually allow for public comment. 00:11:33
I didn't want, I didn't want to don't want acknowledge that there's been a lot of work done this. 00:11:38
And that a lot of movement and help and. 00:11:42
Everything I can on my. 00:11:46
It on my part too. 00:11:48
Up try to get a good solution. 00:11:51
I've been in a lot of meetings so. 00:11:55
Well, good. We appreciate your efforts on this. 00:11:59
And again. 00:12:01
All the messy at the beginning, but he. 00:12:03
So that's what you have to do, RIP band aids off sometimes. 00:12:06
Yeah. 00:12:10
Thank you. Thank you. Any other public comment? 00:12:14
All right. Well, we appreciate your time here tonight. 00:12:21
And. 00:12:24
Questions or comments from the board? 00:12:25
Nothing is very clear. 00:12:27
Thanks, Judge. 00:12:30
All right. Thank you. Any final statements? 00:12:31
Otherwise open for a motion to adjourn this public hearing. 00:12:36
Someone second. 00:12:40
All in favor, aye? 00:12:42
