Our lead council tonight is going to be Chris Fox again. Mr. Fox has a family matter that he's attending to Mr. Steve Langman 00:01:12

We opened up or at some point during the last Commissioners meeting with regards to this, there were some question as to whether 00:01:23
or not. 00:01:26
There was in fact an interlocal agreement between the two parties and that. 00:01:30
Is what we predicated some of our decisions on. 00:01:33

Circuit Court Judge Brown here tonight to discuss. 00:01:41
His investigation into that matter and. 00:01:45

Good afternoon everyone. Always appreciate having the opportunity to appear before the Commissioners and the Council. 00:01:59
I'm going to be glad to provide everyone with an update on the status of Open Door Youth Shelter and I'm not here to make any ask 00:02:05
today. 00:02:08
There's been much uncertainty and confusion swirling around this topic, and I think we'll be able to put a little bit of that to 00:02:12
rest. 00:02:15
Issues surrounding the shelter first appeared. The first question I asked was, legally speaking, what is the shelter? 00:02:17
And we know it exists. It's just right over there. 00:02:23
But you know, what is it? On one hand, you have the shelter itself and you have the Youth Services Bureau. You have the Friends of 00:02:26
Open Door, which is the nonprofit. So the matter readily lends itself to a little bit of confusion. 00:02:31
For decades, the legal status of the shelter has been unclear. 00:02:38
Is a part of the court. 00:02:41
Is it part of the county? 00:02:42
Is an independent agency. 00:02:43
Is it some combination of the above, or is it something else altogether? 00:02:45
Well, after a thorough investigation, a review of documentation and correspondence to and from the State Board of Accounts. 00:02:49
In consultation with the Office of General Counsel for the Indiana Supreme Court. 00:02:55
It has been made clear to me that the shelter was created by Floyd Circuit Court Judge and released back in 1982. 00:02:59
Under Title 31, Article 31, Chapter 8 of Indiana Code. 00:03:05
And as such, the shelter was and remains under the direction and control of the Floyd Circuit Court. 00:03:09
I believe it would best be termed as a quasi governmental agency, something like our Floyd County community corrections. 00:03:15
So this brings me to the Interlocal agreement. 00:03:21
That's become the focus of so much attention and why we're here today. 00:03:23
I want to be clear that neither the office of the Floyd Circuit Court and that's including my predecessor whom I spoke with. 00:03:27
Board of Commissioners or the shelters in possession of a signed copy of that 2010 year local agreement bearing a signature. 00:03:32
From either the court. 00:03:38
Courts agent or the shelter? 00:03:39
As such, it's my belief that lacking the authorization of the court, there is no Interlocal. 00:03:41
You can't have an agreement unless you have all the parties too. It's signed. 00:03:47
Now, Despite that and in good faith, the Board of Commissioners have never wavered from intending to honor that agreement. 00:03:50
Furthermore, throughout my many conversations with the commissioners, it was made clear that they have never intended or desired 00:03:56
for Floyd County to be without a youth shelter. 00:04:00
If the shelter is not to remain here in Pineview, the commissioners are both intended and indicated they wish to help facilitate 00:04:04
the shelter's relocation. 00:04:08
So as it's become clear that the interlocal agreement does not exist, the question then becomes where does this put us going 00:04:12
forward? 00:04:15
Well, that answer is not yet set in stone, but I'm confident based upon many conversations that have been had together we will 00:04:18
find a solution to both complies with the law and which serves the need of the youth of our community. 00:04:23
So to that effect and by statute, I will be convening an Advisory Board of elected officials and stakeholders in the very near 00:04:29
future. 00:04:32
To determine and explore what this can, should and will look like, that Advisory Board will include a member of commissioners and 00:04:36
member of the council. 00:04:39
I will also be completing A thorough review of operations to better determine what the structure, objectives and needs of the 00:04:43
shelter are. 00:04:46
As this process unfolds, the Board of Commissioners are in agreement that the shelter will remain here at Pineview until we can 00:04:50
determine what the next steps are. 00:04:53
I know that myself, Miss Pesarosi and all of those involved with Open Door are grateful for that. 00:04:58
Now lastly is the shelter is under the purview of the Circuit Court, all communications their official statements must on behalf 00:05:02
of Open Door have to come through our office. 00:05:07

I believe so. I believe that based on what's been explained to me is the Circuit Court has autonomy to enter into those 00:05:35
agreements. So if you need an interlocal, I think we can talk about that and we can sit down and construct one if we want. I don't 00:05:39
know that it's necessary though. 00:05:44
But that's something you can sit down and talk about. 00:05:48
Does Open Door have the authority to enter into any new contracts? 00:05:52
No, it's only the court that has that authority. Unless I bestow or. 00:05:55
View that authority upon them but as of now there's no authority until we get sit down and community Advisory Board and. 00:05:59
Look at where everything is at. Everything has to come through. 00:06:06

The 2GO hand in hand in hand, but yet they're not mutually exclusive, so we might find an owner who's willing to accommodate that. 00:07:33

tried to find if there's anything that exists. I'm still waiting to hear back from State Board of accounts to get a complete. 00:08:14

Which is probably no small task, and once I have that I'll provide copies to the commissioners and Council so you all see. 00:08:21

This is what we wanted was some clarity on the issue. That's that's why we've taken on some of these issues that have. 00:08:32
Sat uncontested for. 00:08:38
A decade and 1/2 in this case, but longer in other cases. Less time in other cases, but. 00:08:40
We're we're finding out some things that. 00:08:46
Haven't quite been spelled out. 00:08:49
And if they're not transparent to us, how can they be transparent to the public? 00:08:51
It's been quite the task trying to go through some of these processes and. 00:08:55

You know, statutorily the way it should have been done at times. 00:09:02
But the only other question that I would have right now is do you have any kind of indication or a timeline of what? 00:09:06

Find a new owner for this building at some point, so and. 00:09:19
But at the same time, you know, I want to make sure the kids are. 00:09:23
Are taken care of, but at the same time we got to. 00:09:26

I mean, it depends. It really is. I mean, as we get into this process, there's a lot, you know, as we found out, sometimes asking 00:09:34
questions leads to more questions and that's where we got to where we're at. 00:09:39

Of obligations, where we're at and how we're going to navigate this moving forward. 00:09:48
