The January 20th, 2026 Floyd County Commissioners meeting. 00:00:02
You'll please join us in the Pledge of Allegiance. 00:00:08
I pledge allegiance to the flag. 00:00:11
Of the United States of America. 00:00:13
To the Republic for which it stands. 00:00:16
One nation under God. 00:00:18
Indivisible with liberty and justice for all. 00:00:20
All right. Thanks everyone for being here tonight. You have a cell phone, if you'll please put that on silent and if you need to 00:00:24
take a call the hallways out there. 00:00:28
All right, sign in sheet for the evening. 00:00:33
If you'll please. 00:00:37
Just help me observe a a moment of silence for individual prayer meditation. 00:00:40
We'll get ready for tonight's meeting. 00:00:46
All right. Thank you. 00:01:05
Couple of agenda. 00:01:07
Adjustments we do need to add an I do 7BA revised attorney contract if I can get a motion to hand that by. 00:01:10
Unanimous consent, please. 00:01:17
So moved. 00:01:19
All in favor, aye? 00:01:20
Aye, and for those who are keeping box scores out there, item number 4 is probably going to be dropped to about 6:20 or 6:30. 00:01:22
Chris Lane told me that he was running a little bit late. 00:01:32
So we'll do that as a courtesy for him. 00:01:34
Old business on community corrections. 00:01:38
Dryas was told that I think his presence was not required tonight for that, correct? 00:01:42
Will not take care of it, OK? 00:01:47
This is an amendment to an agreement. 00:01:49
Umm, where we he was successful to lower the rate of the monitoring bracelets. 00:01:52
So. 00:02:02
You're looking for an amendment to the. 00:02:05
It's just a. 00:02:07
Square 9 contract. 00:02:09
Got it. 00:02:11
That's the one you had on. 00:02:14
Yeah, got. 00:02:16
Yep, this is square 9 soft works and it's. 00:02:17
Reducing the rate, no, the square works is it's just this person. It's total court services, yes. 00:02:22
TCS. 00:02:29
PCs, yeah. 00:02:30
OK, got it. 00:02:33
Let me try that again. 00:02:36
I'm going to make a motion that we. 00:02:38
Approve this amendment. 00:02:40
To the. 00:02:42
TCS. 00:02:43
Agreement that we've. 00:02:44
Previously have. 00:02:46
OK. Just for discussion purposes, it's a rate decrease, correct on the unit per day use? 00:02:48
Yes. 00:02:53
Went from. 00:02:54
490, I believe to 365. 00:02:56
OK, any further? 00:02:59
Question their discussion on that. 00:03:03
No, other than I think there is a draft hopefully in the original packet that changed it to Fleet County, Indiana for the Floyd 00:03:05
County community Corrections. I think, I think that's on the original that you will sign so. 00:03:10
OK. 00:03:16
I'll make a motion to approve. 00:03:17
2nd I have a motion and a second for approval. All in favor, aye? 00:03:20
All right. 00:03:26
Mr. Nick Creevy scored a couple of tonight's contract night I guess. 00:03:29
So this is the Square 9 concept in this software database that the building department and some of operations uses. 00:03:34
Just a. 00:03:42
Renewal or extension of their services. 00:03:43
2020 April 9th, 2027. 00:03:46
Amount is 2174 dollars. 00:03:50
I think we had a presentation at the joint meeting for new digital this kind of. 00:03:54
Cover us to that. We we did make sure that they would be able to port this over. 00:03:59
Into that if that's the route we go. 00:04:03
So just curious. 00:04:06
Is there any? 00:04:09
Significant increase in this over last year. Service cost on this. 00:04:10
And how many? 00:04:14
Of those units, do we actually have? 00:04:16
Well, it's, it's a database system, OK. So OK, there's no hardware with it. 00:04:19
OK. All right. 00:04:23
I have no further questions. 00:04:26
Motion approved. 00:04:28
2nd. 00:04:29
All in favor. 00:04:30
Aye. 00:04:32
OK, the next item is for network switches for the. 00:04:33
Downtown UH. 00:04:39
New downtown building. 00:04:41
The it's from Trace Three. They are the preferred sole proprietor of this. 00:04:43
Equipment. 00:04:51
The. 00:04:52
Total amount is 49,370. 00:04:52
Here's the $0.23. 00:04:57
When's that going to be completed? 00:05:04
Well, this portion of it. 00:05:08
Gary, you know if you have. 00:05:10
For the network searches. 00:05:13
So if we get a ******* week. 00:05:19
OK. And are they on? 00:05:22
Timely delivery right now. 00:05:24
So. 00:05:33
There were. There was no. 00:05:36
OK. 00:05:38
All right. I have no further questions on that either. 00:05:42
And if anyone else does. 00:05:45
Now make a motion to approve. 00:05:46
I'll second that. 00:05:48
OK, all in favor, aye? 00:05:50
All right. 00:05:55
Mr. Tomlin. 00:05:58
This is just for the contract that my attorney, we had it last year, you guys approved it. 00:06:02
It's the same cost every once in a while we need to. 00:06:07
Attorney to comment on certain matters that come through the coroner's office. 00:06:10
So I'm just seeking approval of the contract for this year as well. 00:06:13
Is there any increase over? 00:06:20
Their hourly rate over last year? No, it's the same amount. 00:06:22
OK. And. 00:06:26
I guess this is a good time as any we're gonna implement. 00:06:28
Asking anybody that presents for a contract. 00:06:31
What line item or what fund it was going to be? 00:06:35
And to ensure they have proper funding within their budget to cover it. 00:06:37
Through my professional services budget. 00:06:40
$6000 in there. 00:06:42
We didn't get anywhere near going over that. 00:06:44
Last year. 00:06:47
And just needed a user here and there. 00:06:48
OK. 00:06:51
I can confirm that they did budget for this cost this year. 00:06:52
OK. I mean, is that kind of how you envisioned? 00:06:55
These contractual discussions going with regards to or do you need an actual. 00:06:58
I think having them confirm, I don't think the fund number is necessary. 00:07:04
OK. 00:07:10
All right. I have no questions. Motion to approve. 00:07:12
Second, all in favor? 00:07:16
Aye, aye. 00:07:18
All right, we'll go down to Item 5, I think. 00:07:21
This box was gonna. 00:07:25
Take care of that for Mr. Moore, correct? 00:07:26
I can or Nick can either one. These are a couple of contracts that have already been approved by the Storm Water Board. 00:07:29
The first one is Oh hmm services. 00:07:35
And that's for Storm Water Review. 00:07:39
That's a multi county and jurisdictional. 00:07:41
Contract that gets entered into for them to perform their services. 00:07:44
And I believe that one was approved at the January storm water meeting. 00:07:50
I believe you are correct. 00:07:55
We'll make a motion that we approve the OHM contract. 00:07:57
I'll second. 00:08:02
OK. And. 00:08:04
Everything has been budgeted. 00:08:07
Within storm water for that. 00:08:08
I'm going to assume so. Nick, can you answer? 00:08:10
I I I can confirm that all of these contracts for stormwater are the goals. 00:08:13
And are in there. 00:08:19
Annual budget, OK. 00:08:20
All right, Thank you. So for Ohm looking for a motion to approve. Yeah, so moved. 00:08:22
You already made the story. Yeah. All in favor, aye. 00:08:27
The next one is Stand Stantec. Sorry. That one was approved at the December storm water meeting is my understanding. 00:08:32
I'll make a motion that we approve the Stantec. 00:08:40
A stormwater billing system. 00:08:43
I'll second. 00:08:46
All in favor, aye? 00:08:47
And then the last one that they have was the Heritage engineering for engineering services for the stormwater department. 00:08:50
And that was approved at the January meeting. 00:08:56
Yeah, I'll make a motion that we approve. 00:08:59
Heritage Engineering's. 00:09:02
Agreement as well. 00:09:05
I'll second. 00:09:07
OK, all in favor. 00:09:07
Aye. 00:09:09
All right. Thank you both for that. And then? 00:09:11
County Auditor Diana Topping. 00:09:15
Good evening. I'm here on behalf of the Opioid Oversight Committee, the committee. 00:09:23
Commissioners put in place over the unrestricted opioid settlement, settlement funds. We did have a meeting. 00:09:28
Late November, potentially December. 00:09:35
I'll be perfectly honest until you I'm not exactly certain which month it was in. 00:09:38
Where the? 00:09:42
Floyd County Sheriff's Department did request. 00:09:44
An appropriation from the Oversight Committee of 27,500. 00:09:46
As a. 00:09:54
A way to procure and train and provide for a dedicated drug dog. 00:09:58
For FCPD. 00:10:03
The Opioid Oversight Committee did approve this request. 00:10:06
So we're just here today for approval from the Commissioners prior to going to the Council next month for the actual appropriation 00:10:09
itself. 00:10:12
And what this should cover is the cost of. 00:10:17
The dog. 00:10:20
Training for. 00:10:22
The dog and the officer that will be assigned and setting up the officer for care and keep as well as. 00:10:24
Health maintenance for the dog. 00:10:29
All right, so when will uh? 00:10:35
If all the approval goes through, when will that? 00:10:38
Project be up and running. 00:10:41
Most likely later in the year. 00:10:43
OK. 00:10:44
All right, Is there no further? 00:10:47
Questions. I'll look for a motion to approve. So moved. 00:10:49
2nd. 00:10:52
All in favor, aye? 00:10:53
All right. Thank you very much. 00:10:56
County Attorney Christy Fox Yes, the next thing is going to be a permit modification request of the Clark Floyd Landfill. 00:10:59
To submit to idem. 00:11:08
Happy to go into some more details about what that is for, but they need Floyd County's approval on that permit application as 00:11:10
well. 00:11:14
We don't have that though, correct? 00:11:18
Say that again, you don't have. 00:11:21
We don't have that. 00:11:23
The e-mail. 00:11:24
Yeah, I. 00:11:26
Don't know if I forwarded, I don't think it's printed in the thing, but I think I forwarded the e-mail train. 00:11:28
I think part of the public it would be nice to know just in a paragraph or two. 00:11:33
So the different requests that are going to go before I dim 1 is a boundary line change. One is to relocate the maintenance shop 00:11:38
at the landfill. 00:11:43
Proposed renewable natural gas plant location within the facility modify the existing. 00:11:48
Conveyance system within the facility. 00:11:54
And deal with final gas collection and control system layout. 00:11:57
At the facility and so that requires an A permit. 00:12:00
To be submitted to item for approval. 00:12:04
I'll make a motion to accept. 00:12:09
I'll second. 00:12:11
OK, I have a motion to have a second all in favour. 00:12:12
Aye. 00:12:16
The next thing under my list is revised attorney contract at Charles request for a 2.8% cost of living adjustment on the monthly 00:12:24
retainer. 00:12:28
Under the contract services. 00:12:33
Make a motion. 00:12:35
To accept the. 00:12:37
Revised attorney contract. 00:12:38
I'll second. 00:12:40
OK, all in favor, aye? 00:12:41
All right. We do have a couple of board appointments. There's a vacancy on the Georgetown Fire Board appointment. 00:12:44
And I'm looking for a. 00:12:50
Nomination. Umm. 00:12:52
I think that's actually clarification. Yeah. You did it last month. The name was Yeah. So there was a clerical error on the on the 00:12:54
last name I. 00:12:58
Ah, that which is on me, you know, I'm the one who did that. But that was. 00:13:03
I put the wrong name on that. So yeah, it's just clarifying that board appointment. 00:13:08
So do we need to formally ratify that? Yes, if you can formally fix that since it was said wrong at the last meeting. Yeah. So 00:13:11
I'll make a motion that we approve the. 00:13:16
Tom Fisher. 00:13:22
To the Georgetown Fire Board. 00:13:23
I'll second. 00:13:25
OK, all in favor, aye? 00:13:26
And then the New Albany Economic Development Commission. 00:13:29
Was that the incorrect name as well? 00:13:34
No, that's the correct name. 00:13:36
OK, so. 00:13:38
Looking just to ratify. 00:13:42
Nomination of Alec Mabel for that. 00:13:44
I'll make that motion. 00:13:47
I'll second all in favor, aye. 00:13:48
Approval of Commissioners meeting minutes from January 6, 2026. 00:13:52
Make a motion to approve. 00:13:56
Second all in favor, aye. 00:13:57
As well that passes and then approval of payroll and claims. 00:14:01
Motion approved. 00:14:06
2nd. 00:14:07
All in favor, aye? 00:14:08
Hi I. 00:14:10
We're waiting to see if the prosecutor is going to be able to join us tonight or not. 00:14:13
I want to go ahead and see if there's any. 00:14:18
Comments from any elected government officials this evening. 00:14:21
OK, I see. 00:14:26
Two folks back there, any public 3. 00:14:28
For more of us like Where's Waldo? The more I looked at Morrissey. 00:14:31
Any public comment? 00:14:35
For this evening. 00:14:37
Yes, Sir. 00:14:40
Indeed, please come to the podium. 00:14:42
State your name and address. 00:14:47
Right, right. 00:14:49
Hello, my name is Blake Bramer and my wife and I own and operate 413 Fit Club. 00:14:52
At 5455 Grant Line Rd. 00:14:57
I got some materials, can I present these to you guys? 00:15:01
Yeah. What's it pertaining to? 00:15:04
This is for a guardrail appeal in our area. 00:15:05
No, I think, I think I spoke to Susanna. 00:15:09
Or one of the assistants, Suzanne, is over there. Yeah, you can bring those forward. 00:15:13
Are you familiar with this prank? 00:15:19
Yep, I is my first topic. That's OK. 00:15:21
No worries. I know, right? We're here at. 00:15:25
Thank you. 00:15:28
There's Chris where we. 00:15:31
All right, so. 00:15:33
Yeah. 00:15:36
So my wife and I, we got a personal training facility. 00:15:39
Right on the curve and Grant Line Rd. across from the junkyard or the auto warehouse. 00:15:42
And uh. 00:15:47
Since we've been there for about. 00:15:48
Three years now we've had. 00:15:50
A bunch of cars coming off the road in that corner, even in fair weather conditions. 00:15:52
They just come off probably. 00:15:57
Texting or who knows what. 00:15:58
But. 00:16:01
Our members park up close to this parking lot, so that second image on the front page is. 00:16:02
A little overhead view of our parking lot. 00:16:07
Very faintly, you can see all the. 00:16:09
Spray painted lines out there and then all those yellow exes are where I estimate all the accidents to occur. 00:16:13
With the help of. 00:16:20
Sheriff Bush over here, he pulled an accident report and it has nine on record. 00:16:22
But I can assure you that those numbers are very underreported based on what we experience. 00:16:27
Um, let's see. 00:16:33
If you flip onto the second page you'll see a picture from one of the accidents and December that we had mid month. 00:16:36
Last year, umm. 00:16:42
And had a car overturn the. 00:16:43
Ditch there just on the side and. 00:16:46
Last winter we actually had a car end up. 00:16:48
Into our parking lot there. 00:16:51
Some of my research from Indiana Department of Transportation guidelines recommend for guardrails if speeds are over 45 miles an 00:16:53
hour or. 00:16:58
If the traffic is considered to be high volume, and that's defined as over 2000 vehicles per day. 00:17:03
Based on. 00:17:11
I don't know where I got this from. It was. 00:17:12
I guess some traffic. 00:17:15
Indicator. 00:17:17
Right in our nearest intersection at Payne Rd. there or maybe by the storage units? 00:17:18
Our two way traffic is estimated at about. 00:17:23
9500 a day, so that's almost five times the. 00:17:26
High traffic definition there. 00:17:30
And then? 00:17:32
My ignorance, I don't know how to. 00:17:33
Calculate any sharpness of corner angle or anything. 00:17:35
Through there but. 00:17:39
Just in our experience, we. 00:17:40
How cars come off quite a bit there. 00:17:41
It's been a little bit of a growing concern from members. 00:17:44
Traveling to and from the parking lot just since they've seen where some of the cars have. 00:17:47
Ended up and some of the damage. 00:17:51
The people were around. 00:17:54
They could have been possibly injured. 00:17:56
Also. 00:17:59
I don't have a bunch of money for business development so I got to grab a lot still and clean up. 00:18:00
Uh, straight thing. Tongue twister. 00:18:05
Shattered glass. 00:18:08
Out of a gravel lot isn't quite fun. 00:18:09
And our little ditch drainage culvert from the last accident is still like all clogged up so. 00:18:12
I don't own a dirt excavation business so going to rent and. 00:18:17
Maintain that areas also. 00:18:21
A little bit of the hassle. 00:18:23
My proposal. 00:18:26
And personal training we kind of do like a sliding scale of success, Good, better, best, as opposed to all or nothing. 00:18:28
So I think at minimum. 00:18:33
Maybe just getting some rumble strips added in and maybe even extending. I saw the the speed limit was actually recently dropped 00:18:35
from 50 to 45, so I thank you guys for that. 00:18:40
But maybe if we could even extend the 35? 00:18:45
A little bit out further, as the Monon path develops, that's a. 00:18:48
High interest area for us to just being a fitness facility we're going to. 00:18:52
Eat that up there. But. 00:18:56
If you flip back to the first page, you'll see. 00:18:58
On the Google Street View, there's a section where Grant line is like. 00:19:02
Equal to. 00:19:06
Level. 00:19:08
Or elevation with the monon path, or actually a little bit above it. 00:19:09
That terrifies me to send any members out there that. 00:19:13
The path is actually a little bit lower than the road without some sort of a barrier there, so. 00:19:16
Maybe if you guys do any sort of guardrail extending out that way as well? 00:19:21
Sorry I got a little bit off track there from the good better best. So maybe some rumble strips and extending the speed limit? 00:19:25
Out a little bit further. 00:19:31
Maybe some signs of a sharp corner. 00:19:32
And then at minimum on the guardrail, maybe extending. 00:19:35
From umm. 00:19:39
The first part of our parking lot, you can see there's a little bit of a blue line. 00:19:40
Layered in under all those yellow X's down there basically at the first entrance. 00:19:45
Entrance and then. 00:19:49
All the way to the corner. 00:19:50
All right, so you you. 00:19:54
Have you spoken to anyone on our staff other than? 00:19:55
The sheriff. 00:19:58
Unspoken with Horatio, I believe, through the. 00:19:59
Yeah, Sydney, there's a. 00:20:03
A ratio has contacted me the last week week. 00:20:04
Only we're going to get discussion before he's talking about as well as the other area. 00:20:07
And that's sexy. I would. 00:20:12
OK, so. 00:20:15
Well, for someone who says that's. 00:20:17
They've not done much of this. You did a great job, I mean. 00:20:18
Thank you. Actually very, very useful information. You've already done some work with the staff and. 00:20:21
They'll bounce around inside internally and then. 00:20:27
Shall we get back with you on it? 00:20:29
Yeah. Did you have anything to add, Sheriff Bush? 00:20:31
Is there any? 00:20:35
Issue out there since that. 00:20:36
Speed limit was reduced anymore ticketing or? 00:20:38
Eddie. 00:20:42
Moment. 00:20:44
You're such a pain grow. There's four or five axis over this past year or so. 00:20:45
Couple around the businesses. 00:20:49
And again, I think probably all those are underreported. There's been a lot in the evenings that. 00:20:53
Drunk drivers or whatever, you're not found. Bottles of liquor and beer and stuff kind of don't make me think the best of 00:20:57
whoever's crashing out there. 00:21:00
And that's one thing too, is like. 00:21:04
The our front area gets damaged and you know, not one time has anybody ever said hey I. 00:21:06
Crash up your lawn can I? 00:21:11
Help fix it or anything so. 00:21:13
It'd just be nice to be protected from that. 00:21:15
OK, well who could I follow up with on this? 00:21:17
Who's been your point of contact with you? Said Horatio or Nick. Who do you recommend that he? 00:21:20
Horatio would be. 00:21:26
Yeah, if you've already made phone contact with Horatio then. 00:21:28
Cindy and Nick and I and Frank and Jason can make sure that they. 00:21:32
If you don't hear anything within. 00:21:35
710 working days give us a yell back and. 00:21:37
OK, you call me anytime you want. 00:21:39
Absolutely. Thank you, fellows, for your consideration. Yeah, thank you. More familiar with that area. 00:21:42
So. 00:21:46
All right, no further public comment, so. 00:21:50
Chris is here. 00:21:54
Oh, thank you. 00:21:55
Perfect timing. 00:21:57
Sorry it's running late. I appreciate your patience. 00:21:58
Want to kind of update you. There's two things. We have the independent employee contract. 00:22:01
Hey, Christy, look that over and you suggested changing the headings. The only thing I would recommend is changing where it says 00:22:06
Floyd County Prosecutor's Office. Just that language we have it says Floyd County, Indiana 4. 00:22:11
The Floyd County Prosecutor's Office or just that little addition and I'm fine with. 00:22:17
You writing that in? 00:22:21
As appropriate and then fixing it going forward. 00:22:22
Thank you. And that will come out of our funds. 00:22:24
This will not be a burden on the County Council. 00:22:27
The second is the update on the blood draw process. 00:22:30
So you just heard and I think hold on. 00:22:33
We you must go ahead and take action on if you could take action on both those. There are two of them. 00:22:36
Two different contract employees there that we have. 00:22:40
And they're similar enough we can just take action simultaneously. Yes, I'm fine with that. All right, look for a motion to 00:22:43
approve these contracts so moved. 00:22:47
Second all in favor, aye. 00:22:51
Thank you. Sorry I jumped ahead. 00:22:54
As you heard about the. 00:22:56
Was it the bottles? 00:22:58
Alcohol of goggles as they hit. 00:22:59
As we face all the time, blood draws are really one of our our tools that are essential in fighting. 00:23:02
Impaired driving. I don't say drunk driving, I say impaired driving. Impaired driving now. 00:23:08
With the prevalence of marijuana in our community and the. 00:23:13
Changing belief and attitudes toward that now the law hasn't changed. 00:23:16
But some of the beliefs have. 00:23:20
Marijuana is impaired driving under Indiana. 00:23:22
Law. Having that in your system at all is impaired driving. 00:23:24
And studies have shown that. 00:23:28
So we're not just talking alcohol, we're talking drugs. 00:23:29
Methamphetamine. 00:23:32
This is throughout our community and you also have now. 00:23:34
Much more advertised on social media from some attorneys. 00:23:36
Did you go to Louisville? You'll see. 00:23:40
The drunk driving guy, I think he has these billboards and then he'll put out things like don't cooperate. 00:23:43
Don't take the. 00:23:48
The portable breath test don't do any of that. 00:23:51
So then we have to get search warrants for blood draw, so they're essential for us. 00:23:54
Baptist Floyd had always been for years our go to here in our community. 00:23:58
That's ended. 00:24:03
As of February 1st, they will no longer do any blood drops for us. Period. 00:24:04
We tried to workout some kind of fee schedule and that just isn't going to work with them. 00:24:09
So we had to look at alternatives. 00:24:13
Now I'm in alternative phase and I have to make this work. 00:24:15
And then I also have. 00:24:18
Different agencies working together. We have New Albany, we have Indian State Police, we have Georgetown, we have Greenville. 00:24:20
And the Sheriff's Office. 00:24:26
We don't always get along. 00:24:28
But we're all part of this community, so I have to make this work as prosecutor. 00:24:29
This is on. 00:24:32
So I mean it has to work. 00:24:34
So looking at some avenues, I've talked to Norton's Health. 00:24:36
They are willing to work with us. 00:24:40
I want to set up a meeting and I'd like. 00:24:42
To ask the commissioner, County person. 00:24:44
County Council person go with me. 00:24:46
We're going to hopefully get a meeting in the next two to three weeks with their CEO or CFO over here in Indiana. 00:24:49
And they're willing to work with us on using two locations. There's one on 10th St. Jason, you'll know better than me. It's the 00:24:56
new Chick-fil-A out that area, is there? 00:25:01
There's horns out there. 00:25:06
Complex. 00:25:09
There and then also downtown Jeff. 00:25:10
They would OfferUp both of those for use for us. 00:25:12
I told him the volume would probably be about 150 to 200 a year total. 00:25:15
It's about what we do. 00:25:19
All of them combined if we need it. 00:25:20
Don't anticipate we need that much. 00:25:22
The other avenues of Ameripro. 00:25:24
Al gave me the number for America. I have reached out, they seemed. 00:25:27
Interested. Mm-hmm. 00:25:30
So again, I'd ask for that same commissioner and County Council person to be part of that negotiations if we have it, because. 00:25:31
Any contract will have to be signed. 00:25:37
And any monies will have to be funded, I'm hoping. 00:25:39
That Norton's will be very reduced if anything. 00:25:42
Omeprazole, I have no idea. 00:25:45
We're just in the beginning phases, but. 00:25:47
That's my ***. 00:25:49
If you would, one of you would join me in that process and then I'll talk to the Council. 00:25:50
About them inviting someone on. 00:25:55
So three of us can join. 00:25:57
I would love to have both. 00:25:59
I'd love to have Norton's and Repro. 00:26:01
As options for officers, Mayor Pro. 00:26:03
Hopefully we do it on site. 00:26:05
On an ambulance. 00:26:07
But if that's if they're busy, then we'd have a backup Enormous. That would be my. 00:26:08
What I'd really like to see. 00:26:13
So that's my ask if I can get one of you. 00:26:15
To work with me. 00:26:17
Then, Dale, if we can get one of your people to work, we can. All three meet with both Norton's and American Pro. 00:26:18
I've set the stage. 00:26:23
Here's the other thing. 00:26:25
To recoup any cost, there is a statute on the books and I'm going to send this over to Christie. 00:26:28
That we can pass an ordinance. 00:26:32
That would require them to pay for their blood draw. 00:26:34
If a blood draw is done on their plea agreement sheets. 00:26:37
That would set up a fund. 00:26:41
For the Commissioners. 00:26:42
And then that money would go into that. 00:26:44
So that would be a way we could attempt to recoup it if they're put on probation. 00:26:46
So those are some options too. 00:26:50
On the. 00:26:52
That's my ask. 00:26:54
Yeah, the number one, I think just. 00:26:55
Send us a formal e-mail and. 00:26:57
One or more of us will be there, you know. 00:26:59
Hope we'll make that happen. It sounds like you don't have anything. 00:27:02
On the books yet so just. 00:27:05
Just talking today. 00:27:07
They want to set a date but I was waiting for you guys so. 00:27:08
Second, on an ordinance like that. 00:27:11
Can you make them? 00:27:16
Pay or require them to pay even if it comes up negative or. 00:27:18
He said as part of the police, so it's only part of a plea, so they would have to leave guilty for that to go in there. 00:27:22
Fact. So I don't know. I was just thinking about the yeah. 00:27:28
I assume it's probably a pretty low percentage of people who. 00:27:32
Do you have a clinical suspicion for? 00:27:35
I think it's very rare that we don't get it. 00:27:38
Our thoughts will be yeah. 00:27:40
Not happens, but it's. 00:27:42
The vast majority of people. 00:27:44
So you're saying as part of a plea deal that would be something the prosecutors office would push for, is for them to pay that fee 00:27:46
as part of all the fees they're paying? 00:27:50
So I don't know what percentage of cases. 00:27:53
Are playing out but I just want to make sure we have the option of. 00:27:55
Quote UN quote not requiring it for someone who had a neurologic condition or. 00:27:58
I'm going to give you mimicked. 00:28:02
Or cases dismissed. 00:28:05
Or nothing comes up. 00:28:07
We cannot charge them under state statute. That would be impossible. It's only as part of the plea agreement where they have 00:28:08
probation fees and other fees already listed that would be part of it. 00:28:12
So just maybe I'm not caught up on things. I thought we already passed the contract take care of this issue. 00:28:17
Well, I was gonna ask. 00:28:22
So I'll leave that more to the sheriff. 00:28:25
Yeah. Sheriff, can you give us some rundown? We passed the contract. 00:28:27
There was supposed to be addressing these issues, yes. So that's in our contract as we currently speak blood draws. 00:28:32
But that was for our agency only. 00:28:38
Attorney had concerns with liability and procedurals. 00:28:40
With outside agencies. 00:28:43
No one speak for nobody, please. But they weren't going to be working, I don't think. 00:28:45
At this point know where their stance was, but they were going to bring them dust anyways and. 00:28:49
So you're telling me that your contract is going to take care of your department? Yes. 00:28:54
Not New Albany. 00:29:01
Not state Police, not Georgetown, not Greenville. As of right now, yes. 00:29:02
That's correct. 00:29:07
Isn't that for the nurse in the jail though, which houses inmates from all the other? 00:29:09
Entities. 00:29:13
The the nurses, the 24/7 nursing was for that only, not blood draws. 00:29:14
That was for because we had concerns with in June. 00:29:18
Inmate medical bills were going away. That was going to be a cost that we're going to endure as a county. 00:29:22
And then we have nurse or inmates going to the ER during early morning hours. 00:29:27
So having a nurse there on site made it a lot easier maybe to not have that happen as much. 00:29:33
But the contract says they shall perform those blood draws. 00:29:38
So where's the are they going to reduce their contract price since they're not going to do those was not in the contract price? 00:29:41
I thought it was the contract says they shall perform blood draws. The price was not in there and I was not at that meeting where 00:29:47
that increase was approved, but. 00:29:52
I don't know if anybody else can. 00:29:56
We'll have to review it because I agree with you. 00:29:58
I don't have it committed to memory, so we'd have to review it. Yeah, no, I just. 00:30:05
That the code review if it's in there. 00:30:08
We may end up amending it based on councils. 00:30:12
Well, the cost was not in there. 00:30:16
So I'm telling you the cost of the increase of the contract was the normal 3%. I think it was increased. 00:30:17
And the 24/7 nursing, which is 84 hours. 00:30:23
That's one thing that was that raised our contract price, not blood draws. 00:30:26
And at the time Baptist was doing this, we were concerned of not having anything in place. So that's why I pushed for this to be 00:30:32
in there only as a secondary thing, not as. 00:30:36
Cost while we got the contract. 00:30:40
I know you can't. 00:30:43
Control other agencies it just seems like. 00:30:45
From a public point of view. 00:30:48
That would be the. 00:30:50
Ideal point. 00:30:52
To take somebody and have the medical personnel there draw. 00:30:55
And keep it all right there in evidence. But. 00:31:00
There was concerns from liability standpoint that are not in our custody. 00:31:03
And they're brought in, and if they're out of control or if there's force that's necessary. 00:31:07
That was part of the issue as well through our discussions. 00:31:11
And our attorneys advising us of that. So I didn't want to go against attorney, we can evaluate it again. 00:31:13
But that's the advice of our attorney that was given. 00:31:19
All right, well. 00:31:23
We won't get final resolution on this tonight. We'll have our attorney do it. 00:31:24
I'll be more than happy to meet with anybody, Chris. 00:31:27
So if you're good with it, I'll e-mail all three of you. 00:31:31
And you decide who you want to represent. I'll get some dates. 00:31:34
They're working for late and then. 00:31:37
Dale, can you take that back with Danny? 00:31:39
See maybe. 00:31:41
Be represented. I'll e-mail them as part of it. 00:31:43
Then I think that'd be the most effective way for us to go if you're good with that so. 00:31:46
Sure. Then of course, we'll get everything to Christine with you. 00:31:49
So thank you for your time. I appreciate it. Yeah, thank you. Yeah, Thank you, Chris. 00:31:52
Any further recommendations on? 00:31:56
Those are the last items. 00:31:59
No other than I think if. 00:32:00
If that's the guidance of the Sheriff's Department is getting on liability, then it may be wise that we sit down, Chris, myself 00:32:02
and the sheriff's department's attorney and discuss this so that we can try to come to some sort of resolution because. 00:32:07
Whether or not. 00:32:14
The intent was to increase the price for blood draws. It says that they shall perform blood draws. So I think we need to circle 00:32:15
back to that and either have a reduced contract price that we. 00:32:19
Do an amended contract and reduce the price with the nursing staff. 00:32:24
Or we resolve the liability issue and we can all talk about what that looks like and what the concerns are and whether Chris has. 00:32:27
Chris has a lot more criminal knowledge than I do on the statutes related to criminal matters, so. 00:32:34
Right, I agree. 00:32:42
Right. 00:32:46
And so. 00:32:48
Right. And I think so then if we could sit down and try to see what that looks like and talk through that, maybe we can come to 00:32:49
some sort of resolution. I agree. 00:32:52
OK, that's perfect. That'd be great. 00:32:58
All right. I think that took care of everything. Know that any closing comments from commissioners? 00:33:00
Jason Yeah. Who else enjoyed the game last night? 00:33:07
Yeah, yeah. 00:33:10
Well, you know, I'm not a Hoosier guy, but you know what I love? 00:33:13
Watching the Hoosiers win last game I think I've ever seen. 00:33:16
What's that? 00:33:20
Who? Who? 00:33:22
Hooters, there we go. 00:33:24
Frank. 00:33:27
Any comments I can't follow up that just can't. 00:33:29
I'll look for a motion to adjourn. So ****. 00:33:33
We're adjourned. That's why he's moving off. 00:33:36

take a call the hallways out there.
