My name is Steve Lowe Meyer. I am the attorney for the estate of. 00:03:17
Jack Posey. 00:03:21
Jack Posey died in January of 2024. His wife had died six months before him, so he put me in charge of liquidating his estate. 00:03:23
And distributing roughly $1.5 million to 4 individuals and seven local charities. 00:03:31
We've successfully liquidated most of the estate, but we can't sell the house. 00:03:38
We can't sell the house because it does not have a working septic system. 00:03:43

And out around Benchmark and down toward the Floyd Central ball fields. 00:04:14

With aerobic bacteria that consume and digest the organic waste. 00:05:29
It's the kind of system specifically designed for building lots like Jack's. 00:05:35
Where the lot is too small or too steep for a conventional septic tank with lateral lines. 00:05:39

Was considered safe and effective in their day. 00:05:45
They were perfectly legal sex house was built. 00:05:48

EPA came along a few years ago and said no, no more. We don't like these. 00:05:54

In 2023, Indiana Code was amended to permit. 00:07:14
The resident use of NPDES residential discharging systems. 00:07:17
In order to do this and on site, wastewater management district must be formed and the homes must be part of that district. 00:07:22
According to the IC code, a hearing must be held, which we held the hearing and the hearing officer recommended that the county 00:07:29
move forward. 00:07:32
This is only a rescue system after all. 00:07:36
All other options have been exhausted. 00:07:38
The district will not charge a fee to join the district. 00:07:40
The only visa will be charged will be charged by the health department. 00:07:43
Health Department will. 00:07:46
Provide inspections, regulation, keep records. 00:07:47
And it's in those records to ident when requested. 00:07:50
So that being said, I'm here to present the ordinance of Commissioner. 00:07:53

And it does require operation and maintenance. It requires that be maintained for perpetuity. And the ordinance also requires a. 00:08:21
Operating permit be maintained with the Health department that is renewed every two years. 00:08:29
That's another check to make sure we have something. 00:08:33
If they were non compliance, we can pull that operating permit because the ordinance will require. 00:08:36
The ballot operating permit, right? I mean, we've been well versed on this for roughly 2 years, I think. 00:08:40

We are wanting to establish the Health department as a car seat inspection station. 00:11:19
Doing so will open us up to be able to apply for grants. 00:11:24

We'll also be able to get up to 100 car seats a year for no cost. 00:11:31
So we'll send two people to a conference every year. 00:11:37
We agreed to put our car seat inspections into. 00:11:42

And we will agree to have. 00:11:53
To car seat safety technicians on staff. 00:11:55

Copper's Crossing neighborhood apparently had difficulty with the Lumos people who came in to install. 00:13:48
That fiber for T-Mobile. 00:13:54
But in our neighborhood, they were great. 00:13:57
We didn't have any problems. They were in and out. They worked from dawn till dusk. 00:14:00
Once they were finished, you couldn't even tell that they had been there. So I just wanted to say that there were neighbors that 00:14:04
in neighborhoods that had a very different experience of. 00:14:08

Executive Director of Indiana 811. So your damage prevention group for utilities here in the state of Indiana. 00:15:05

Actually was key and instrumental with trying to take care of a lot of the bad telecoms out there. 00:15:13
Who are putting in fiber, who are damaging a lot of utilities recklessly with a lot of Cowboys out there. 00:15:18
I sit up there straight because I worked for a company and I said, hey, this has got to stop and we got to set standards for 00:15:23
companies. 00:15:26
That install fiber out there. 00:15:29
And so I'm glad when Lumos X brought me on earlier this year, they said we want to make sure that these standards are here as 00:15:30

Just sorry that a few of the things I'm introducing right now as we go along. 00:15:37

That we are already. We're doing a lot of the things that should be done. 00:15:46

Way out in advance, sometimes 90 days, worst case 30 days before we actually start construction. A lot of goes to the house. 00:16:00
When I get in my house, I just throw in trash. I think it's just junk mail, so we want to make sure we communicate as well. We 00:16:08
have these yard darts that go in the yard. 00:16:11
In advance of it, we have the door hangers that go on the doors before we actually show up as well. 00:16:14
We have a number of things. Then we also help out the city and the rescue departments and all of those to be able to know where 00:16:20
are we working on a daily basis. 00:16:23
I understand before I actually start able to come and talk to our construction groups are here. 00:16:26
They didn't actually have everybody on the list they need to have, so there was a lot of communication that wasn't happening. 00:16:31
So we've actually added the the fire department to that list now. 00:16:36
Want you to also know that I have got the best relationships with your gas company. 00:16:40
With center point energy. 00:16:44
Those guys are some of the best we've been on, some of the best panels talking about damage prevention. 00:16:46
We've worked to fine tune a lot of things, so we've got a great relationship. I introduced these folks here to my contacts. 00:16:50
They've got set up to where we are now going to be on a monthly basis. I always require a stand down to happen. 00:16:56
All of our crews. 00:17:03
Are required to be there to listen to center point. 00:17:04
To come in and give a damage wrench and update 15 minutes at least, if not 30 minutes sometimes. 00:17:07
And to invite anybody else who wants to come in to be able to share. 00:17:12
Then they also go over quality because some of the things that. 00:17:15
We pride ourselves on the communication about restoration. 00:17:18
We want to make sure that we actually end up coming through a neighborhood. 00:17:20
And we tried to. I heard the actual comment that you guys are going too fast. 00:17:24
Our objective really is. 00:17:28
To go through as fast as possible, but safe. 00:17:30
But to also get out of your neighborhood so we're not there as a nuisance. 00:17:33
So that's why we try to work through as quickly as we can, but at the same time they must be restoring behind themselves. 00:17:37
We always make sure that we actually have our Loomis folks where if you elected a lot of the other telecoms. 00:17:43
They don't have. 00:17:49
I'd like to name off some of the other ones. They don't have their employees out there, they just have contractors doing it 00:17:50
because they actually say, OK, just go do the work. 00:17:53
Do it however you have to do it. 00:17:57
And then when you get done. 00:17:59
Will sign off on it and take responsibility. We have our folks out there all the time. I've got one of our folks right back here 00:18:00

Messed up, he says. You guys didn't do anything near that mailbox, but you corrected it without even knowing who I was. 00:18:36

Now, are we going to have a few bad actors out there? 00:18:45
You never know when you hire somebody, we actually do the background checks. We do everything we can to try and find out who they 00:18:47
are. 00:18:50
But once we find out that they are who they say they were and they don't meet our standards, they're gone. We've fired a couple of 00:18:52
Subs who already worked for us in this area and they will never be working for us ever again. 00:18:57

So I appreciate you guys. We've done a number of things to correct and enhance here with communication restoration. Make sure it 00:19:05

But the biggest thing that we understand is if we don't take care of your residents. 00:19:11

And if there is somebody else that's a bad actor out there. Didn't guess if we found out there was a list of four. 00:19:20
And someone said that we did. 00:19:25
There were two. There was one that was an air fault. There was another one that was a locate issue. 00:19:27
And we took care of that one that was an at fault where we made sure that that person. 00:19:30
No longer works for us again. 00:19:34

We want to make sure that we take care of your residents. We want to make sure that. 00:19:37
That everything is. 00:19:40

The dig took place. We had a lot of communication during the dig taking place. 00:20:19

Whether speed was what you wanted or not, we had a lot of unsafe conditions because we had holes that weren't restored for 3-4 00:20:25
days. 00:20:28
You could take all the time that I've been public office together. 00:20:33
And cumulatively. 00:20:36
A hadn't had as many complaints by 1/2 as I had with this particular week. 00:20:37

And the meeting that we had last week was roughly an hour and change and we had multiple representatives from Malumas and also 00:20:44

And they basically basically came to an agreement with multiple items that needed to be taken care of before. 00:20:53

And really, that's what I was expecting tonight was an enumeration of those as well as a plan to. 00:21:00

You know, on our end of things, we're not going to reinstate those permits until we've had people out in the field who can 00:21:10
actually see that the work is being done as we agreed to last week. 00:21:14
And part which was going to be that any work that had been started. 00:21:19
Was completed before other permits were activated. 00:21:22
So I appreciate the fact that you weren't part of that meeting. 00:21:26
But the tone was totally different than than. 00:21:29
What we had here tonight and as far as. 00:21:32
What you listen to tonight being something to aspire to. 00:21:36

It was a mess with regards to what actually transpired in those neighborhoods that we yielded calls from it. 00:21:41

One in probably three or four or five years, so. 00:21:51
Anyway, that's where I am on that. I need to know that what we discussed and agreed upon last week is going to be implemented 00:21:54

As Commissioner Mabel said that we obviously had some very serious issues involving, you know, natural gas and some other 00:22:14
utilities that may or may not been. 00:22:19
All on Loomis are it could have been other utilities as well, but in the story is that. 00:22:24
You know, outside of that, we still had issues with holes being left in people's yards and, you know, their property and stuff. 00:22:29
Disrupted. 00:22:37
I personally have a real issue when it comes to safety. 00:22:41
Things like that, you know? 00:22:43
We just can't. 00:22:46
Ignore the fact that you know. 00:22:47
A lot of this these problems were caused was by either. 00:22:51
Loomis or their subsidiaries that were doing the work. 00:22:55
And when we tried to communicate with them. 00:22:59
We were forced to communicate through an app. 00:23:02
Because not a lot of them spoke English. 00:23:04
That was even difficult because half of what I was trying to say wasn't coming out. 00:23:06
As it was intended, but. 00:23:10

I would like to see a real. 00:23:14

Making sure the people out there have been taken care of before we even. 00:23:19
Remotely consider. 00:23:23

Personally, that to be verified by our people to make sure the things that are getting done. 00:23:29
That we're asked to get done or getting done. And it's my understanding that, you know, the employees went through some training 00:23:34
today that was provided by the fire department. 00:23:37

Being a former employee of 811, the importance of locating these utilities. 00:23:44
Before you go out, the last thing we need is a major incident involving. 00:23:49
Natural gas for something that could have very well been prevented. 00:23:53

You know, trying to. 00:23:59
Explain to the people, this community that. 00:24:00
That should have never happened. 00:24:02

So it's it's what you do tomorrow that matters to everybody in this room. 00:24:10
So I think that we need to inspect the area out there, make sure that everybody's on the same page before we lift the order. 00:24:15

A lot of the complaints that we received was. 00:24:57
Due to a lack of knowledge of. 00:25:00

Where work can and cannot occur. 00:25:05
And when people come to ask the workers, they can't get answers. They don't know who to talk to, talk to. 00:25:07
We can't talk to them. 00:25:13
So making sure that they have those appropriate signages they. 00:25:15

Of homeowners from the neighborhood here tonight, I said. I thought that there might be some that were here if you. 00:25:26

Some of the recommendations. Again, this project was all made possible by a Kipta granted Floyd County pursuit. 00:44:42

Hill, Paley Pike just outside in the wall when he's starting at Buffalo Trail. 00:44:58
Into the study area goes to US 150, so it's about a 2.5. 00:45:03
Mile corridor that we're looking at. 00:45:08

Got a lot of feedback on the corridor, the vision for the needs, the current uses, the potential future uses. 00:45:35

There was again a public survey that was initiated to try to gather further feedback, knowing that some members of the public are 00:45:46

Residents and businesses along the corridor and as well as. 00:46:00
Social media outreach on this ultimately got over almost 350 responses, which is fantastic. A huge number of those were Floyd 00:46:04
County residents, 97%, which is exactly what we want for those online surveys. 00:46:10

Taking that information, the feedback we got in the map gives you a little bit of an overview of. 00:46:19
Where the feedback came from along the corridor, so we had a huge response basically from Scottsville Road to the east. 00:46:25

A lot of interest, a lot of public feedback incorporated that looked at. 00:46:36
Some engineering What's feasible, what's not along the corridor? 00:46:42
And then develop some schematics and some visuals. 00:46:46
And then presented that in a second public meeting at the end of March. 00:46:50

Put in a 12 foot largely separated mixed-use path, but there still was a lot of need for connectivity. What we have out there is a 00:47:11

Segments, A sidewalk that stop and start and so provide a continuous strip all along that corridor is really what we're looking 00:47:19
at. The majority of the corridor we can do with. 00:47:25
Separated buffer strip between. 00:47:31
The trap vehicle travel lane as well as The Walking path. 00:47:34
Some areas where we're constrained a little bit by terrain or ownership. 00:47:39
We're proposing using. 00:47:44
Barrier curb. 00:47:46
So that again, those pedestrians where they have to walk a little bit closer to the travel lane, we at least have that a little 00:47:47
bit extra level of safety. 00:47:51
So again, as I mentioned, we have intermittent sidewalks out there. We know that speed is also. 00:47:55
Anybody who's traveling 4 or speed is an issue. 00:48:01
So ultimately what was recommended is a continuous travel lane. Basically start. 00:48:05
From the eastern end of the project to Scottsville Rd. We have a sidewalk that's really proposed on the north side of the road, 00:48:11
starting essentially at Altwood subdivision. We also have a parallel section with the eastern most end that connects Buffalo Trail 00:48:17
with Shambork. 00:48:23
Before having a hawk crossing which is a high visibility crossing. 00:48:30
But the main path is really east West on the north side of the road to Scottsville Rd. 00:48:34
Along the way we've got improvements to crosswalks at business interests and entrances in particular. 00:48:40
We also so in total, in total in this first phase section that we're looking at, we have. 00:48:48
Almost 2 miles of sidewalk that's proposed. That's a substantial investment. 00:48:55
But we've tried to. 00:49:01

Really looking and trying to break that into manageable segments. 00:49:08
Another large component of this because again, this is a fairly high traffic Rd. there's a lot of volume that uses it. 00:49:12

That still meets the functional classification for the roadway. 00:49:26
Secondary benefit to that is it can actually slow traffic down a little bit because folks don't feel like they have quite as much 00:49:30

To to travel to high speed. 00:49:38
And by narrowing that traveling, we're able to largely. 00:49:41
Minimize the amount of right away and property needs to be. 00:49:46
Purchased. 00:49:49
And try to utilize the existing space we have. 00:49:50

Jack Posey died in January of 2024. His wife had died six months before him, so he put me in charge of liquidating his estate. 00:03:23
And distributing roughly $1.5 million to 4 individuals and seven local charities. 00:03:31
We've successfully liquidated most of the estate, but we can't sell the house. 00:03:38
We can't sell the house because it does not have a working septic system. 00:03:43

In 2023, Indiana Code was amended to permit. 00:07:14
The resident use of NPDES residential discharging systems. 00:07:17
In order to do this and on site, wastewater management district must be formed and the homes must be part of that district. 00:07:22
According to the IC code, a hearing must be held, which we held the hearing and the hearing officer recommended that the county 00:07:29
move forward. 00:07:32
This is only a rescue system after all. 00:07:36
All other options have been exhausted. 00:07:38
The district will not charge a fee to join the district. 00:07:40
The only visa will be charged will be charged by the health department. 00:07:43
Health Department will. 00:07:46
Provide inspections, regulation, keep records. 00:07:47
And it's in those records to ident when requested. 00:07:50
So that being said, I'm here to present the ordinance of Commissioner. 00:07:53

And it does require operation and maintenance. It requires that be maintained for perpetuity. And the ordinance also requires a. 00:08:21
Operating permit be maintained with the Health department that is renewed every two years. 00:08:29
That's another check to make sure we have something. 00:08:33
If they were non compliance, we can pull that operating permit because the ordinance will require. 00:08:36
The ballot operating permit, right? I mean, we've been well versed on this for roughly 2 years, I think. 00:08:40

We didn't have any problems. They were in and out. They worked from dawn till dusk. 00:14:00
Once they were finished, you couldn't even tell that they had been there. So I just wanted to say that there were neighbors that 00:14:04
in neighborhoods that had a very different experience of. 00:14:08

Actually was key and instrumental with trying to take care of a lot of the bad telecoms out there. 00:15:13
Who are putting in fiber, who are damaging a lot of utilities recklessly with a lot of Cowboys out there. 00:15:18
I sit up there straight because I worked for a company and I said, hey, this has got to stop and we got to set standards for 00:15:23
companies. 00:15:26
That install fiber out there. 00:15:29
And so I'm glad when Lumos X brought me on earlier this year, they said we want to make sure that these standards are here as 00:15:30

When I get in my house, I just throw in trash. I think it's just junk mail, so we want to make sure we communicate as well. We 00:16:08

In advance of it, we have the door hangers that go on the doors before we actually show up as well. 00:16:14
We have a number of things. Then we also help out the city and the rescue departments and all of those to be able to know where 00:16:20
are we working on a daily basis. 00:16:23
I understand before I actually start able to come and talk to our construction groups are here. 00:16:26
They didn't actually have everybody on the list they need to have, so there was a lot of communication that wasn't happening. 00:16:31
So we've actually added the the fire department to that list now. 00:16:36
Want you to also know that I have got the best relationships with your gas company. 00:16:40

Those guys are some of the best we've been on, some of the best panels talking about damage prevention. 00:16:46
We've worked to fine tune a lot of things, so we've got a great relationship. I introduced these folks here to my contacts. 00:16:50
They've got set up to where we are now going to be on a monthly basis. I always require a stand down to happen. 00:16:56

Are required to be there to listen to center point. 00:17:04
To come in and give a damage wrench and update 15 minutes at least, if not 30 minutes sometimes. 00:17:07
And to invite anybody else who wants to come in to be able to share. 00:17:12
Then they also go over quality because some of the things that. 00:17:15
We pride ourselves on the communication about restoration. 00:17:18
We want to make sure that we actually end up coming through a neighborhood. 00:17:20
And we tried to. I heard the actual comment that you guys are going too fast. 00:17:24

To go through as fast as possible, but safe. 00:17:30
But to also get out of your neighborhood so we're not there as a nuisance. 00:17:33
So that's why we try to work through as quickly as we can, but at the same time they must be restoring behind themselves. 00:17:37
We always make sure that we actually have our Loomis folks where if you elected a lot of the other telecoms. 00:17:43

I'd like to name off some of the other ones. They don't have their employees out there, they just have contractors doing it 00:17:50

Some areas where we're constrained a little bit by terrain or ownership. 00:47:39

So that again, those pedestrians where they have to walk a little bit closer to the travel lane, we at least have that a little 00:47:47

So again, as I mentioned, we have intermittent sidewalks out there. We know that speed is also. 00:47:55

So ultimately what was recommended is a continuous travel lane. Basically start. 00:48:05
From the eastern end of the project to Scottsville Rd. We have a sidewalk that's really proposed on the north side of the road, 00:48:11
starting essentially at Altwood subdivision. We also have a parallel section with the eastern most end that connects Buffalo Trail 00:48:17
with Shambork. 00:48:23
Before having a hawk crossing which is a high visibility crossing. 00:48:30
But the main path is really east West on the north side of the road to Scottsville Rd. 00:48:34
Along the way we've got improvements to crosswalks at business interests and entrances in particular. 00:48:40
We also so in total, in total in this first phase section that we're looking at, we have. 00:48:48
Almost 2 miles of sidewalk that's proposed. That's a substantial investment. 00:48:55

Secondary benefit to that is it can actually slow traffic down a little bit because folks don't feel like they have quite as much 00:49:30
