But they have to prescribe easements that they go through with regards to. 00:07:12

In March we had another hail storm and we all have to get our roots replaced and everything, so we're just really feeling. 00:08:22

In Clarksville, it's made getting to Clarksville into a whole and possible experience. 00:08:40

If you live in our subdivision, most of us have to make a left out on Charlestown Rd. 00:08:49
Charlestown Rd. feels like every time you pull out, you feel like you're in the midst of a new demolition Derby. How are you going 00:08:55

Has made cut, has made a bad Rd. 00:09:08
Works and we're all sort of frustrated on that. And the other aspect of that is The Walking trail is pretty much inaccessible to 00:09:11

Charlestown Rd. is bad. 00:09:21
The limousine has been really took all of us by surprise. We sort of all got a last minute notice. 00:09:24
And they're really damaging property pretty extensively, probably more than people are realizing. 00:09:31

We're just really frustrated in the fact that we feel really unprotected at this point. 00:09:39

And now our neighbors and they've been complaining to us on the HOA board are all getting a lot of property damage from from 00:10:14

Trail project that could have been diverted. I know that that's not my just so people know. I've never spoken to it on the public 00:11:20
record, but I feel compelled to do that, you know, when we came into office. 00:11:25
There was actually money earmarked for that that was under county. 00:11:30
Control for the trail project, we took that and that's what's rebuilding Old Vincent's Road hill slide right now. 00:11:33
And we took kind of a gamble. We didn't. 00:11:41
We actually just push that down the calendar on that trail project 3 or 4 years and thought we'd get money when we could get it, 00:11:44

Through grant writing we were able to get that, so we didn't miss a beat on that, whether you like the design on that or not. 00:11:49

You know, I don't, I'm not trying to cast blame on them. I mean, I signed off on that too. 00:12:00
But there was there was no way to take that money and. 00:12:04

Different things we can bring into the community. I didn't really mind. 00:13:35
However, last Tuesday when I saw Loomis begin construction in our subdivision, that concerned me. 00:13:38
I'm not going to come forward and. 00:13:44
Great stink of another company. I try to be very understanding. 00:13:46
However, I wanted to come today as well. I've been talking with Suzanne a lot of the. 00:13:49
I actually reached out to my real estate attorney last week. 00:13:53
Had several conversations around this. 00:13:56
The situation with Loomis is and Horatio and I discussed this after Susanna had requested him. 00:13:58
After Mickey Thompson had requested him several times to contact me. 00:14:03
Is the fact that they do have the right of way of the county roads? 00:14:07
They have 20 feet from the center line to do so. 00:14:10
However, once they enter a subdivision, they're supposed to abide by the plotted easements. 00:14:12
For the type of foundation they're laying. 00:14:17
Back in October. 00:14:20
They normally submitted with Indiana. 00:14:22
Utility Commission. 00:14:24
On what kind of license they wanted. 00:14:25
In March of this year. 00:14:27
Loomis was granted by Indiana a telecommunications utility certificate. 00:14:29
To operate in our state. 00:14:33
Unfortunately, they're moving so quickly. 00:14:35
That the Registry Commission cannot track them. 00:14:37
They weren't even familiar with them when I spoke to him 2 days ago on last Friday. 00:14:39
And they're very concerned, so much so that they reached out to them yesterday. 00:14:43
And asked him to put a stop. 00:14:47
Until they can get all the lines marked. 00:14:48
Their concern was is that once they reached a subdivision, they shouldn't be utilizing those easements that's been plotted by the 00:14:50
reporter's office. 00:14:53
And unfortunately, you're using the right away of the roads and Horatio unfortunately didn't know that he could prevent that or at 00:14:57
least mention that up front to utilize those easements. 00:15:01
He apologized. He's very humble and he's showed a lot of integrity. Integrity. 00:15:05

But he didn't ask me to reach out to Rick Fox as well as Susanna and the committee here. 00:15:10

The concerns we had with Loomis was the fact that they were moving so quickly that they're leaving open pits throughout our 00:15:23

Of course, we don't have sidewalks on our subdivision. 00:15:31
So most the children play 5 yards. 00:15:33
That was a major concern. 00:15:35
The concern I noticed is that the water lines were marked in the road where the water mains were. 00:15:37
There are no flags or other you. 00:15:41
Utilities marked in our subdivision. 00:15:42
Specifically, Whittemore Court. 00:15:44
Coverage crossing and Cobblers Court. 00:15:47
When I made a phone call to Indiana University. 00:15:49
Indiana Utility Commission based off my employers recommendation. 00:15:51
I was approached by Aaron, who was over pipeline safety. He reached out to Mickey Thompson after his phone call last Friday. 00:15:56
Try to figure out what the world's going on. 00:16:02
Because 811 had actually asked them not to begin digging until June 3rd. 00:16:03
Because the RMC or gas lines or water could not be marked until then. 00:16:09
The issue was that they had already begun and already dug those three sticks, those three-step streets worth. 00:16:14
Before they even got to the point of getting marked. 00:16:19
Supposedly they don't know. We can't prove it, that they think that even their own. 00:16:21
The contractor, which is Millennium Incorporated, who's digging on behalf of one of us, were marking the water mains himself. 00:16:25
Based off of people's. 00:16:31
Property lines and where the water meter was located at. 00:16:32
RMC requested them not to dig till June 3rd because they couldn't get out there till June till my May 28th. 00:16:36
But they've already completed the three streets. 00:16:41
The weird part is, is even though they got all the digging and all the piping laid round, none of it's been finished. They're 00:16:43
moving throughout the whole subdivision. 00:16:47
And they're not completing anything. 00:16:50
The concern was is that there are so many of these numerous subcontractors because they had told Mickey at the beginning when they 00:16:52
applied for the permit. 00:16:56
That it was going to be their own contractors. 00:17:00
But it's actually not. It's actually a subcontractor and they actually have another subcontract. 00:17:01
With them and Millennium Incorporated is requesting the dig permits. 00:17:05
And eight One One has finally got caught up with. 00:17:10
After the speaking to the OUCC. 00:17:13
Aaron called me yesterday. 00:17:15
And said hey, what streets are they performed on so far? 00:17:17
Informed on the same one that. 00:17:20
And he says, well, they're going to pause until they get it confirmed. 00:17:22
Bioluminescence actual contractor to come out and proceed forward. 00:17:25
The weird part is an hour and a half later. 00:17:30
They didn't even show up on those streets yesterday, they showed up on Hadley Place. 00:17:32
A whole different street. So they pause on the three streets that he mentioned. 00:17:37
That started up starting new work on a whole other area and they haven't finished the other ones yet. 00:17:40
The weird part was that today they came right back to covers court and it's finishing up what they showed us to finish to begin 00:17:44
with yesterday. 00:17:47
Prior to. 00:17:50
So the concern was is. 00:17:52
They're also supposed to give us as of January 1st this year. 00:17:53
They're going to use an easement they're supposed to let us know 48 hours in advance. 00:17:56
As of July July 1st, my lawyer said that. 00:18:00
811 requires that within 48 hours they're supposed to let you know. 00:18:03
Which easement they're going to dig? Which easement that is? 00:18:07
Whether it's the rear or the front and if they need to progress beyond that point. 00:18:10
There was no notice. 00:18:14
Portland in front of me, who's very elderly. She has irrigation lines all throughout her yard. 00:18:15
And she was so worried that they're gonna dig him up. 00:18:19
Because they'd already started digging and nothing was marked. 00:18:22
Not only the gas lines or water lines or electric lines, but her poor line, so we had to mark those forward. 00:18:24
Based off her memory. 00:18:30
Because our water company put them in, couldn't come out to a week later. 00:18:31
So those are the concerns we're worried about. 00:18:34
Obviously they're only three streets in. 00:18:36
For now, if you want to count, Hadley Place has been working like crazy, but we have several more left to go. 00:18:38
And it's not the only subdivision that I'm concerned about because it's one of the first they're getting started on. 00:18:43
Aaron at the pipeline safety was was concerned with the fact that. 00:18:48
We don't know why they're moving without stuff being marked. 00:18:51
Luckily, 811 sent out six different trucks yesterday and a training crew to get a whole subdivision marked. 00:18:54
Did an outstanding job of that. 00:19:00
But it wasn't for those phone calls that I made. I don't think it would have happened. 00:19:01
The frustrating part that I had was is I did reach out to numerous people, numerous phone calls last week. 00:19:05
And I spent two whole work days trying to reach someone that knew something about him. 00:19:10
Thankfully Susanna and Mickey Thompson with wonderful help with this. 00:19:14
And help me get tied into the right people. 00:19:17
But unfortunately not be able to reach out to you all, our Horatio. 00:19:20
Is concerned now, Horatio, I know he he's going to approve what he's presented. 00:19:23
Same with Vicki Thompson. 00:19:28
But if women's isn't being honest up front or utilizing the curriculum. 00:19:30
Prove that they say they're going to. 00:19:33
That we need to find a way to intervene. I don't know where that part comes into play. 00:19:35

Is the fact that they do have the right of way of the county roads? 00:14:07
They have 20 feet from the center line to do so. 00:14:10
However, once they enter a subdivision, they're supposed to abide by the plotted easements. 00:14:12

And asked him to put a stop. 00:14:47
Until they can get all the lines marked. 00:14:48
Their concern was is that once they reached a subdivision, they shouldn't be utilizing those easements that's been plotted by the 00:14:50

And unfortunately, you're using the right away of the roads and Horatio unfortunately didn't know that he could prevent that or at 00:14:57
least mention that up front to utilize those easements. 00:15:01

When I made a phone call to Indiana University. 00:15:49

I was approached by Aaron, who was over pipeline safety. He reached out to Mickey Thompson after his phone call last Friday. 00:15:56
Try to figure out what the world's going on. 00:16:02
Because 811 had actually asked them not to begin digging until June 3rd. 00:16:03
Because the RMC or gas lines or water could not be marked until then. 00:16:09
The issue was that they had already begun and already dug those three sticks, those three-step streets worth. 00:16:14
Before they even got to the point of getting marked. 00:16:19
Supposedly they don't know. We can't prove it, that they think that even their own. 00:16:21
The contractor, which is Millennium Incorporated, who's digging on behalf of one of us, were marking the water mains himself. 00:16:25

Property lines and where the water meter was located at. 00:16:32
RMC requested them not to dig till June 3rd because they couldn't get out there till June till my May 28th. 00:16:36
But they've already completed the three streets. 00:16:41
The weird part is, is even though they got all the digging and all the piping laid round, none of it's been finished. They're 00:16:43
moving throughout the whole subdivision. 00:16:47
And they're not completing anything. 00:16:50
The concern was is that there are so many of these numerous subcontractors because they had told Mickey at the beginning when they 00:16:52
applied for the permit. 00:16:56
That it was going to be their own contractors. 00:17:00
But it's actually not. It's actually a subcontractor and they actually have another subcontract. 00:17:01
With them and Millennium Incorporated is requesting the dig permits. 00:17:05
And eight One One has finally got caught up with. 00:17:10
After the speaking to the OUCC. 00:17:13
Aaron called me yesterday. 00:17:15
And said hey, what streets are they performed on so far? 00:17:17
Informed on the same one that. 00:17:20
And he says, well, they're going to pause until they get it confirmed. 00:17:22

The weird part is an hour and a half later. 00:17:30
They didn't even show up on those streets yesterday, they showed up on Hadley Place. 00:17:32
A whole different street. So they pause on the three streets that he mentioned. 00:17:37
That started up starting new work on a whole other area and they haven't finished the other ones yet. 00:17:40
The weird part was that today they came right back to covers court and it's finishing up what they showed us to finish to begin 00:17:44

They're also supposed to give us as of January 1st this year. 00:17:53
They're going to use an easement they're supposed to let us know 48 hours in advance. 00:17:56

Which easement they're going to dig? Which easement that is? 00:18:07
Whether it's the rear or the front and if they need to progress beyond that point. 00:18:10

Portland in front of me, who's very elderly. She has irrigation lines all throughout her yard. 00:18:15
And she was so worried that they're gonna dig him up. 00:18:19
Because they'd already started digging and nothing was marked. 00:18:22
Not only the gas lines or water lines or electric lines, but her poor line, so we had to mark those forward. 00:18:24

Because our water company put them in, couldn't come out to a week later. 00:18:31
So those are the concerns we're worried about. 00:18:34

For now, if you want to count, Hadley Place has been working like crazy, but we have several more left to go. 00:18:38
And it's not the only subdivision that I'm concerned about because it's one of the first they're getting started on. 00:18:43
