We pray for the safety of our. 00:00:56

All right, the acceptance of the agenda for tonight. 00:01:19
We have a motion and a second for acceptance of our agenda. Is there any discussion? 00:01:29
All in favor say aye. 00:01:34
Any opposed? 00:01:36
That carries approval of minutes from February 11th meeting. 00:01:38
So move. 00:01:44
Second motion. 00:01:46
Any discussion or changes on the minutes from February 11th? 00:01:48
All in favor say aye. 00:01:53
Aye, any opposed? 00:01:54
That carries. 00:01:57
Anyone from the public would. 00:01:58
Like to speak about anything before we get into. 00:02:00
Our agenda. 00:02:05
OK. At this time, we're gonna open up a public hearing on an ordinance approving the issuance of general obligation bonds. 00:02:06
The purpose of this is for the. 00:02:12
Purchase of the Health Department building. 00:02:16
Is there anyone from the public that would like to speak? 00:02:19
For or against the issuance of the bonds? 00:02:23
Going once, going twice. 00:02:29
All right, seeing none, we will close the public hearing. 00:02:32
We'll move on to ODE. 00:02:37
Business. 00:02:39
Item number one. 00:02:41
Judge, good evening. It's good to see this body. 00:02:46
I don't think I've seen you all since this new body was formed, so it's nice to see you all. 00:02:50
I am Judge Maria Granger. I have two grants. 00:02:56
That. 00:03:00
The first being an additional appropriation for personnel. 00:03:01
To round out. 00:03:04
Three positions that work with the veterans. 00:03:06
Court of Southern Indiana. 00:03:08
For the duration of 2025. 00:03:11
So that's what. 00:03:14
That additional appropriation is and that's why I delayed it too, because I want to make sure the figures were correct so they're 00:03:15
less. 00:03:18
Than what I had originally advertised. 00:03:21
But the items the amounts here are accurate. 00:03:23
For the request on #1. 00:03:27
#2 is a. 00:03:30
Transfer just from another grant fund for the family Navigation grant. 00:03:32
So that we can. 00:03:37
Go ahead and continue on with collecting the data. 00:03:38
Through that program with the duration of this year. 00:03:42
Motion to approve 1A and B as advertised. 00:03:45
Second, all right. We have a motion, a second for old business 1A and B, any discussion or questions? 00:03:49
All in favor say aye. 00:03:59
Aye, any opposed? 00:04:00
Thank you. Thank you. 00:04:02
All right, new business number one is the Ordinance 2025 Dash O3 and ordinance of the Floyd County Council authorizing the 00:04:06
issuance of general obligation bonds and bond anticipation notes. 00:04:12
Of the county to finance the health department building project and incidental expenses appropriating the proceeds thereof. 00:04:18
And approving certain matters related thereto. 00:04:23
So we have Mr. Barry here. 00:04:27
Mr. Brad Bingham online SO. 00:04:29
Good evening, members of the council. Tim Berry with Crow Financial Advisor. 00:04:37
On this project and Brad Bingham is. 00:04:41
Here attorney with Barnes and Thornburg online. 00:04:46
Brad, do you want to? 00:04:49
Walk through the ordinance and then we can talk about sure, the other pieces. 00:04:51
Yeah. Thanks, Tim. Happy to do that. And. 00:04:56
I can hear everyone but I don't see anything so hopefully folks can hear and see me. We can hear you just fine, just tell me if 00:05:00
you have any issues. 00:05:02
Okay, fantastic. 00:05:06
As Tim mentioned and Councillor Short mentioned, the bond ordinance is for the to finance the purchase of the existing building to 00:05:07
be used for the new County Health Department. 00:05:12
The ordinance would authorize the issuance of general obligation bonds in a maximum principal amount not to exceed $3.2 million. 00:05:17
And pending the issuance of those bonds. 00:05:24
It would authorize the issuance of bond anticipation note. So bond anticipation note or Bayon. 00:05:27
Is just a fancy word for interim financing. 00:05:33
And based upon previous discussions. 00:05:36
It's my understanding that the council would like to do issue a ban so this interim financing. 00:05:38
With the intent that you're going to use freed up money from your general fund. 00:05:44
To actually amortize the band so that bonds would never be issued. 00:05:49
And that's perfectly fine to do. 00:05:53
But in order to issue a ban, you still have to authorize the the ultimately the issuance of the bonds in case that would ever be 00:05:55
necessary. 00:05:58
So that's really what this ordinance does, is it authorizes both bonds and bans. 00:06:01
The proceeds would be used to finance the purchase of the existing building. 00:06:07
Also a small amount to do some renovations to make it usable as the County Health Department facility. 00:06:11
Would also allow us to do what's called capitalized interest. 00:06:18
So again, knowing that your overall plan of finance is to shift some expenses from your general fund to the public safety lit 00:06:22
fund. 00:06:26
This is going to give you time and doing capitalized interest gives you time to kind of figure out and the shifting those 00:06:30
expenses. 00:06:33
Before you actually have to start finding a source of revenue to pay, pay the interest on the on the ban. 00:06:36
And then again, the proceeds could also be used to pay. 00:06:42
The issuance cost for the transaction. 00:06:45
The the ordinance also makes an additional appropriations, again because this amount wasn't included in your existing budget. 00:06:49
That was the purpose of the hearing was to allow folks to. 00:06:55
Ask about this additional appropriation. 00:06:58
But it does allow makes it the initial appropriation of $3.2 million. 00:07:00
That again would be funded with the proceeds of the financing, together with any investment earnings on those proceeds. 00:07:04
The last last point to kind of point out in this, which is. 00:07:11
Normally, bond anticipation notes are secured solely by the proceeds of the bonds if and when issued. 00:07:14
This ordinance does authorize as a backup. 00:07:20
The the ability to levy a tax to pay interest on the bands if that were necessary. 00:07:24
And again, it's kind of because of the unique nature of this financing that we put that in here because. 00:07:30
The percher of the band is going to want to understand how are they going to get paid interest every six months until until the 00:07:35
maturity of the ban. 00:07:39
And so again, we all understand the intent is to use your Freedom general Fund cash flow. 00:07:43
But from a credit standpoint, it gets kind of hard for a bank or a credit analyst to review that, especially when when that 00:07:49
overall shift in the expenses may not have occurred yet. So again, the the property tax levy is a backstop. 00:07:56
To pay interest on the bands in case that would be necessary. But again, I don't know that you necessarily anticipate. 00:08:03
Happened. I'll pause there. Happy to answer any questions though that you may have. 00:08:09
Yeah, this is not. 00:08:16
What I anticipated. 00:08:19
Happening I anticipated us having a. 00:08:20
I anticipated us paying the interest. I thought that's what we talked about. 00:08:24
That we were going to pay the interest as we go. 00:08:28
Can we still do that? Yes, we can. Yes, that is exactly what. 00:08:32
OK. Anticipated capitalizing the interest. I thought that meant that it was going to be. 00:08:36
You would capitalize the interest on the July in January payment. 00:08:42
Of July of 2025. 00:08:48
In January of 2026 payments. 00:08:50
Should you? 00:08:54
Be able to prior to. 00:08:55
The issuance of. 00:08:58
The sale or the term sheet? 00:09:02
Appropriate funds to pay that interest payment prior to that point in time. 00:09:05
Then you would do that out of that appropriation instead of. 00:09:11
Out of. 00:09:15
The capitalized interest, but this ban could go on for as long as five years. That is correct. And so it was my understanding that 00:09:17
we were going to pay on a. 00:09:22
Every six months, correct. Interest, correct. 00:09:28
Being accrued. 00:09:32
Correct. 00:09:34
Mm-hmm. During that time, OK. 00:09:35
I misunderstood that. I thought the cap when they he said capitalizing the interest that we were not going to pay the interest. 00:09:37
Yeah, no, the capitalized interest you would would be a part of the cost of it or of the additional of the initial. 00:09:44
Proceeds should you not? 00:09:52
Appropriate that interest payment. 00:09:55
Prior to the closing of those bonds or of the ban. 00:09:58
What we would anticipate on an ongoing basis. 00:10:02
Is that interest would be paid for through an appropriation that would be made for on an annual basis? 00:10:06
By the Council. 00:10:14
And if the Council chose not to do so? 00:10:16
You would then have as a backup to that. 00:10:19
The. 00:10:23
At Valorum property. 00:10:24
So that is exactly what is anticipated being done. OK, it needs to be done this way to. 00:10:28
Provide for. 00:10:36
An efficient sale of the ban. 00:10:38
And then my other question, my other thought is I'm. 00:10:41
I'm not sure I'm on board, at least at this point. 00:10:47
In time using cash on hand. 00:10:50
To pay off. 00:10:54
The Band. 00:10:56
And if that makes a difference in this document. 00:10:58
I don't know that I can and that's it. 00:11:02
It makes no difference in the document as it exists today. It provides for that as an option. 00:11:04
OK. You also within the document today provide for the issuance of a bond? 00:11:11
To take out. 00:11:18
Ban at some point in time, OK? 00:11:20
Either, umm. 00:11:23
Prior to. 00:11:24
The end of the five year period or at the end of the five year period of time? 00:11:26
And I haven't landed on either side of that either. So it provides that flexibility for everyone. OK, yeah, we, we that decision 00:11:30
will still be made heard the. 00:11:35
Right, the other. 00:11:40
Part of it, OK. 00:11:41
Yeah, I don't have any. I have a just a question because sometimes I don't understand fully. 00:11:43
In the warehouses, there's a number 3.2 million and there's a number not another number, 6.6 million. 00:11:51
So Dale, I'll jump in here real quick. 00:12:00
That's because. 00:12:03
Anytime you're going to finance something or you're pledging to levy an ad valorem property tax either as a backup or as a direct 00:12:06
levy to pay P and I any circumstance. 00:12:10
If the total cost of the project is above that. 00:12:15
This year, $6.6 million in change. 00:12:19
It is generally considered what's called a controlled project. 00:12:22
Which means you have to go through certain procedures. 00:12:25
Maybe a petitioner monstrance, Maybe a referendum if it's large enough. 00:12:28
What we're what why we put this in here was to say, look, this is not a control project because the total cost. 00:12:32
All in, you know, at the maximum would be 3.2 million. It's likely to be something less than that. So that's the reason that's in 00:12:39
there is just to document that this is not a control project. 00:12:44
Any other questions or concerns? 00:12:53
Mr. Chairman, I move. 00:12:57
That we approve Ordinance 25. 00:12:59
Dash 03 suspending the rules by unanimous consent. 00:13:03
2nd. 00:13:08
We have a motion and 2nd to suspend the rules for unanimous consent. 00:13:10
Any discussion on that? 00:13:14
What that does is means we can pass tonight unanimously without coming back for a second reading. 00:13:16
So all in favor of suspending the rules. 00:13:23
Say aye, aye. 00:13:26
Any opposed? 00:13:28
Tony, wasn't I OK? Thank you, Tony. You're slightly delayed, Tony. 00:13:31
I'll listen for you. 00:13:35
All right, now we'll accept a motion for the approval. 00:13:37
Of the ordinance. 00:13:41
I approve the. 00:13:42
I moved to approve ordinance #2025-3 by unanimous consent. 00:13:44
2nd. 00:13:49
Right, the motion a second. 00:13:50
Any further discussion? 00:13:52
All in favor say aye. 00:13:55
Any opposed? 00:13:58
Tony, you good? 00:14:00
That carries. Thank you. 00:14:04
Thank you. Thanks everyone. Thank you. 00:14:08
Thank you. Thank you so much for coming down. 00:14:10
All right, moving on to new business #2. 00:14:15
Hey, Todd. 00:14:17
On the good evening. 00:14:19
This month marks my one year anniversary of being the A Todd Task Force leader so. 00:14:24
For those of you that don't know, the county collects money. 00:14:29
And gives it to this coalition to give back into the community. 00:14:34
And it goes into the areas of prevention, treatment, law enforcement and administration of the. 00:14:39
And so I'm here before you asking that the funds that were collected last year. 00:14:46
Be appropriated to put in this fund this year and then I usually come back later in the year after the grants are decided on. 00:14:50
And ask for specific amounts. 00:14:57
So do you have any questions? This is a different. 00:15:00
Group SO Motion to approve 2A. 00:15:03
As advertised. 00:15:06
We have a motion in a second. 00:15:08
Any questions? 00:15:10
Governor. 00:15:12
All in favor say aye aye. 00:15:14
Any opposed? 00:15:16
That carries. Thank you. Thank you. 00:15:17
Mr. Tomlin. 00:15:21
Well, I come asking for an additional appropriation of $20,000 for my transportation budget. 00:15:28
Currently, transportation budgets have $4000. 00:15:35
With the changing. 00:15:38
Environment for EMS. 00:15:40
Then providing transport for my office. 00:15:43
We kind of ran into. 00:15:46
A little bit issue. 00:15:47
Received a bill for $53,000. 00:15:49
196. 00:15:52
$53,196.30 from America. 00:15:54
For transportation for part of 2023. 00:15:58
Yeah, 2024. 00:16:00
Since I've received that. 00:16:02
The Commissioner's Office is taking head on that. 00:16:04
On addressing that issue. 00:16:07
But in the meantime, we've switched to a private transfer. 00:16:10
Form to do our transportations for the city. 00:16:14
Apparently Highlander does our transports out in the county. 00:16:18
But in the city I have to use. 00:16:22
Private transport service. 00:16:23
So far. 00:16:26
This from January to February. 00:16:27
I've spent 2800 dollars, 28170 dollars. 00:16:29
And I'm just trying to seek an additional appropriation but. 00:16:33
Cover at least until middle of the year. 00:16:36
I can find a long term solution in terms of. 00:16:38
I'm coming to you all for a vehicle. 00:16:41
We have a motion for 3A. 00:16:47
I'll make a motion that we accept. 00:16:50
Is there a second we have motion in a second? 00:16:54
I I worked on the corners budget with. 00:16:59
Mr. Turan. 00:17:02
And just. 00:17:03
This is something that we've done. 00:17:06
Over the last few years we've kept the transportation budget. 00:17:07
Low and. 00:17:10
Purposely made the corner come back and ask. 00:17:13
Until we get a better handle on. 00:17:18
How we're going to move forward with. 00:17:19
Who's going to be responsible for it? 00:17:21
Or if we're going to. 00:17:24
Provide a vehicle to to do that. 00:17:26
Through the office. 00:17:29
This is not. 00:17:30
Something that's out of the ordinary. 00:17:32
That's happened. 00:17:36
At least twice over the last three years so. 00:17:37
And I spoke to Mr. Tomlin in the snowstorm. 00:17:40
Had some. 00:17:45
Extra inventory that needed to be moved. 00:17:47
Yes, they're in early January. 00:17:49
Bad way to say it, but. 00:17:51
We had a lot of movement that we had to hire out. 00:17:53
So that's. 00:17:58
That's some of the. 00:17:59
Back story on that SO. 00:18:00
Is there any further questions? Who are we using? Who did you were using? Ties Mortuary? 00:18:02
What are they charging us for transport? Charging us $200.00 of transport. 00:18:07
And then I get charged for storage. 00:18:11
If I have to. 00:18:13
Store over there at their facility. 00:18:14
So they charge us $200 to come pick up a body and then. 00:18:16
Take it to the morgue. 00:18:20
OK, just curious, what was a mayor pro charging for something like that just for curiosity? 00:18:22
So it kind of changed. 00:18:29
And I think. 00:18:32
Here recently it went up to $371 for transport. 00:18:33
And that's kind of the main reason I switched from them. 00:18:37
It's just 'cause I mean. 00:18:40
With the current transport budget $4000, I was going to. 00:18:42
Go through that. 00:18:46
No time. 00:18:46
You had also mentioned Highlander fire. How are they involved in that you said they're doing? 00:18:47
Their region they do out in the county. 00:18:52
Are they charging a fee or they're not charging no fee at all Contract. 00:18:55
It's good to know. 00:18:58
Mr. Tomlin, if you end up coming back and asking for vehicles mid year and there's still some of this money available, would it be 00:19:01
allocated toward that vehicle? 00:19:04
Yes. 00:19:08
I'll get some. 00:19:11
Transportation from where to where? 00:19:14
Just wherever the residence is. 00:19:17
I mean, it could be anywhere within city limits. 00:19:19
That's the usual transport. 00:19:24
I don't want to be harsh, but shouldn't that firm build a state of whoever passed? 00:19:26
I mean. 00:19:32
The one issue I have with that is. 00:19:33
It kind of comes down to just looking at the family and. 00:19:36
If I'm charging. 00:19:40
The family transport from the hospital to the. 00:19:42
Oh, the residents to the hospital. 00:19:44
And then a Funeral Home coming in and charging from the hospital to the Funeral Home. 00:19:46
They're getting double billed right there. 00:19:50
And then my issue is. 00:19:52
If I'm requesting an autopsy, they don't have a. 00:19:54
Voice whether to go straight to a Funeral Home or not. 00:19:56
So I'm putting a. 00:19:59
Unnecessary harm on the family just because I'm trying to. 00:20:01
Fulfill my duty as. 00:20:05
OK. 00:20:08
Any other questions for Mr. Tomlin? 00:20:11
All in favor say aye. 00:20:16
Aye, any opposed? 00:20:17
That carries. Thank you. 00:20:20
Miss Kelly. 00:20:24
Good evening. 00:20:26
Kelly Deucer, chief probation officer. 00:20:27
I am here for the appropriation. We received the funds from the. 00:20:30
So I would just like to appropriate that H hot grant. 00:20:35
Motion to approve for a as advertised. 00:20:40
Second motion a second for for a any questions or comments for Mr. 00:20:43
All in favor say aye aye. Any opposed? 00:20:49
That carries. Thank you. 00:20:53
Mr. Creevy. 00:20:56
Bob A is an additional appropriation request for a new line item is a cash surety for the infrastructure at Nob Hill, Section 9. 00:21:01
Developer provided the. 00:21:11
$61,000. 00:21:15
So move. 00:21:20
I move to improve 5A. 00:21:23
How about that? 00:21:26
2nd, we have a motion and a second for 5A. Any questions for Nick Now this goes from the developer into this fund, right into this 00:21:27
fund once the infrastructure is completed to our standards. 00:21:33
It's a retainer. 00:21:40
OK. 00:21:42
Any further questions? 00:21:43
All in favor of 5A say aye. 00:21:46
Aye, any opposed? 00:21:48
That carries. 00:21:50
I will speak to. 00:21:52
5B. 00:21:53
Probably should have. 00:21:55
Tabled this during the agenda round but we this was advertised out of general fund and I. 00:21:57
Believe the. 00:22:03
Consensus, as we talked last time, was to pay for this out of. 00:22:04
Riverboat SO. 00:22:07
I believe it and. 00:22:10
Mr. Creepy and. 00:22:13
Standard. Just looking for. 00:22:14
A commitment that we're going to move forward with this so they can. 00:22:16
Get the ball rolling and try. 00:22:18
Get them in here on time and save some money. 00:22:21
Before the prices go up, so. 00:22:24
Is there anything? Did I miss anything? 00:22:26
Can you tell us a little bit about the project? 00:22:29
Of course if he sees are up for replacement. 00:22:34
And so I have I started down the path. 00:22:38
I tried to ask for the money. 00:22:41
This budget. 00:22:43
But. 00:22:44
Something happened so. 00:22:45
But uh. 00:22:47
I was working with Judge and Stan on trying to get it done this year. 00:22:48
To get it done Windows. 00:22:53
10 is losing support and. 00:22:55
October. 00:22:57
So what I'm going to do is be able to repurpose the old. 00:22:58
Older court machines. 00:23:02
To then replace the machines I need to replace the county network. 00:23:04
Try to get us all. 00:23:07
Up to date on that. 00:23:09
Sugar. 00:23:10
Scanners, computer scanners and monitor. 00:23:13
For the workstations before staff. 00:23:17
Ports and clerks. It'll get the clerks on the same page, so you're getting all new computers and. 00:23:19
Monitors for the court staff, yes. And clerks, yes. And how many is that 65? 00:23:25
6565 and then. 00:23:33
Yeah, 65, we're doing 47 scanners to. 00:23:37
Are the old computers worth anything? 00:23:40
That well, so I'm going to repurpose those. Those will still support the Windows 11 version we need to get to. 00:23:42
On our stuff that doesn't support Windows 11. 00:23:47
Trying to beat that October deadline, so we're still getting all the security updates. 00:23:51
After that. 00:23:55
200 lbs in Switzerland for money. 00:23:57
Those are over five years old. 00:23:59
Yeah, we're trying to do every five year. 00:24:03
Our equipment to keep that life cycle going. 00:24:05
Right, so. 00:24:10
We had a phone conversation and I asked the question and you said I asked why wasn't this in the budgets for this year and you 00:24:11
said Don chose not to, even though I wanted to do that. Yes. 00:24:17
So. 00:24:22
I just find that. 00:24:23
You know. 00:24:25
Odd that were. 00:24:26
We're bringing this back now and just trying to float this out of the general fund and that's not really how this should have been 00:24:28
handled. I'm not challenging the project or the timing, OK, let's get that straight, but I'm. 00:24:33
Just challenging why this wasn't handled the correct way. 00:24:39
Did you have? 00:24:44
Well, I think he was told to keep the budget flat. 00:24:45
That's what I was told, so I don't know. 00:24:48
I was in a little true. 00:24:51
But in this case that could have been explained very easily. 00:24:53
I'll make a motion to table this in order. 00:24:58
But but move forward. 00:25:02
With purchase. 00:25:03
In order to advertise this out of the riverboat and. 00:25:05
Get this appropriated next month. 00:25:09
So it sounds like a reasonable motion. Yeah, that's. 00:25:12
Because they stopped the building so. 00:25:15
2nd, we have a motion and a second, any further questions? 00:25:18
So this motion is for tabling. 00:25:23
Only for the purpose of. 00:25:26
Paying for it out the. 00:25:28
Fund that we choose to pay for it out of so. 00:25:29
The consensus is. 00:25:31
For you to move forward. 00:25:33
Thank you everyone. Same page. 00:25:34
I just don't agree with this at all, period. So no. But you got your votes. All in favor say aye aye. Any opposed? 00:25:37
Aye, that carries. 00:25:45
Thank you. Thank you. 00:25:47
Michelle. 00:25:51
Good evening. 00:25:59
So the salary appeals committee met with three different departments. There are representatives from all three departments here 00:26:03
tonight. 00:26:08
The first one was probation and there's an individual who is working on data collection for a grant. It's they already have the 00:26:13
the money to pay for it. 00:26:20
And I believe you have the notes from our meeting. Is that correct? 00:26:27
I believe you sent him out. Yeah. 00:26:34
I'm getting blank stairs. 00:26:36
OK, so you all should have the notes that summarize the. 00:26:47
The meeting and the request. So all three of these requests were approved by the committee, so they're coming before the council 00:26:52
for final approval. 00:26:57
So I'm not sure if you want to take them one at a time or if you have any questions. Yeah, let's go one at a time here. 00:27:04
Does anybody need? 00:27:13
Kelly or Judge Stiller to explain further. 00:27:14
Thank you. I thought I might go ahead. 00:27:18
Yeah, go ahead. 00:27:23
And Sheldon working on this. 00:27:24
This is AJ rack position actually. 00:27:26
Or J Rack approved opioid funding. 00:27:29
For $5000 a year in this additional. 00:27:32
Daniel Mansfield. 00:27:35
One of our existing. 00:27:36
Probation case managers. 00:27:37
He has a special skill with that. 00:27:40
Spreadsheets in particular. 00:27:42
And we had a special need. 00:27:44
For data collection. 00:27:46
And it was something he was already helping Kelly on as we were working on. 00:27:48
A lot of these things. 00:27:51
And he had an interest and a desire to do more and just. 00:27:53
Wanting to help us with this project. 00:27:56
And so instead of having a contract. 00:27:59
With someone outside. 00:28:01
The government. 00:28:03
He was an existing employee and it just made sense and I don't. 00:28:05
I don't know economically where we could have gotten any. 00:28:09
Anybody to do this service for us for $5000 a year? We're hoping to do it over a period of years as we collect data. 00:28:12
On all of the. 00:28:20
Work that we're doing. 00:28:22
In the spending of the opioid funds. 00:28:23
So it's exciting to start to be able to start moving forward with this. 00:28:25
This is something we have talked about since the beginning. 00:28:30
Being assigned the J rack. 00:28:33
They'll be with funds to J Rack. 00:28:35
To be able to come up with a way. 00:28:37
To collect data to be able to show. 00:28:39
And identify. 00:28:42
You know, is this helping? How is it helping? Is it not? 00:28:44
You know what we're doing and in particular, focusing on the criminal justice system and all of their partners. 00:28:47
And the expenditures of opioid funds, that's that's what the position is going to do. Did I explain that? 00:28:53
Motion to approve. 00:28:59
6A Probation. 00:29:01
$5000. 00:29:04
Stipend. Is it a stipend? 00:29:07
For the individual to collect that item second. 00:29:11
All right. We have a motion and a second for Item 6 under probation. Any further questions? 00:29:14
When you get this data. 00:29:20
Who do you provide this data to? Well, you know, we want to provide to the public. 00:29:22
It will be provided to the public. 00:29:27
So you'll have stats and yes. 00:29:28
And money went to here and this is the result of that. So Daniel's job is twofold. He is working with the auditor. 00:29:30
Calf tracking, how the money is spent and where the money is spent through spreadsheets. 00:29:38
And then there will also have the data collection. 00:29:42
Looking at things like cases, file types of cases filed. 00:29:46
So many different aspects of. 00:29:51
What we're doing and so. 00:29:54
All of this would, of course. 00:29:56
Ultimately. 00:29:58
We wanted public facing. We're going to do this on a yearly. 00:29:59
Or quarterly or $5000 for the data collection. 00:30:02
Data collection, Well, data collection will be ongoing. 00:30:06
As long as. 00:30:10
We have somebody to. 00:30:11
Help us do it. 00:30:13
This is also. 00:30:15
An extremely important. 00:30:17
Piece for. 00:30:19
Reporting and transparency because we've already seen. 00:30:22
Other counties. 00:30:26
Using funds for. 00:30:29
Things that were not qualified. 00:30:31
And for us to be able to. 00:30:33
Quickly show. 00:30:35
I think it's great accountability. 00:30:38
Is pretty important. 00:30:40
And hopefully it's going to be able to tell us which of the programs that we're doing or being the most effective and reducing 00:30:42
recidivism. So those are the ones that's what we need to understand so that we can put our money. 00:30:49
Right where it is doing the best job. 00:30:58
And without data to do that. 00:31:01
Just don't know. 00:31:03
So I'm part of the J Rack committee and and. 00:31:05
I definitely think we need data to be able to make decisions and it is specifically authorized by the opioid funds and all of the 00:31:09
and encouraged to use the funds for. I mean this is part of the purposes. 00:31:14
What is the best use of the money and this is a state? 00:31:20
Website that we're not website still justice justice counts as a federal agency we could be actually with Daniels work we're even 00:31:24
we may not even end up needing to use justice accounts to be honest he's. 00:31:31
Pretty fantastic. 00:31:37
We'll see. We're still deciding on that. We're working. 00:31:39
The last couple of meetings. 00:31:43
And we have some more information coming. 00:31:45
So. 00:31:48
We may partner with the federal. 00:31:49
Agency. 00:31:51
But federal agencies are a bit. 00:31:52
Under the gun right now, so we don't. 00:31:54
There could be some. 00:31:57
Changes coming on that so. 00:31:59
So we want to have something that we have and that's our data and that we can count on and rely on and share with everyone and 00:32:01
also have internally. So we're excited to get to. 00:32:05
Get the opportunity to do that. Thank you for your vote. 00:32:09
All right. Any further questions or discussion? 00:32:12
All in favor of. 00:32:16
Item 6A Probation say aye aye. Any opposed? 00:32:17
That carries. 00:32:22
Thank you. 00:32:24
All right, Next up is the prosecutors office. 00:32:26
And this is here so. 00:32:30
I'll let him speak. 00:32:31
To pass this around. 00:32:34
Before I get started, this is House Bill 1006. 00:32:37
Waited to introduce this to you until I had an opportunity because I didn't know how this would go. But ipacking in a prosecuting 00:32:41
attorney counsel. 00:32:44
Allowed me and some other prosecutors to meet with the governor. 00:32:49
We did people together. He is fully supportive of this bill. 00:32:52
The hardest hurdle that we saw. 00:32:55
House and Senate and the governor. 00:32:58
Government supported to the House. 00:32:59
Was going to be the hurdle. It has passed the House out of committee and into the general House and passed is now with the Senate, 00:33:02
which was to be the easiest leg of those two legislative grants. So I'll talk about it now. We should know something next two or 00:33:07
three weeks. 00:33:11
House Bill 1006 is effectively a 50% reimbursement from the state. 00:33:17
Prosecutors. 00:33:23
Expenses in its original form it was for the entire prosecutors office. I don't know if the inform will be that. 00:33:24
The secure part of it is that will be for the prosecutor salaries themselves, FICA and those things. So we reimburse it. The 00:33:32
minimum amount was met. 00:33:38
50% The minimum salary requirement will be $100,000. 00:33:43
So that 50,000 of that then would be reimbursed by the state. 00:33:48
When that happens, and. 00:33:53
Believe it well. 00:33:54
My talks with. 00:33:55
The governor's office, not just me, but on a conference call. 00:33:56
When that happens, we anticipate that this body even with raises given at 2 to 3%, assume you'll give that with us requesting more 00:34:00
possibly transcripts, deposition fees, we believe we can save anywhere 250 to $280,000 next year for this Council. 00:34:08
And so I wanted to make sure we. 00:34:18
That and that's. 00:34:19
I'd hit 300,000. 00:34:21
Which will help. 00:34:23
Obviously I saw about the property tax, we don't know how that would go, but. 00:34:23
Anticipation of that. 00:34:27
I think we'll be able to do that. 00:34:30
While I'm here tonight. 00:34:31
We had 7 murders last year. 00:34:33
We currently have three trials are getting ready to go. We have a. 00:34:35
Attempted murder. 00:34:38
Where two individuals are alleged to have shot in downtown Milwaukee on a porch. 00:34:39
Firing multiple rounds. 00:34:46
That'll be going probably about 3 weeks. 00:34:48
We also have a. 00:34:51
Alleged sexual crime. They'll be going on Monday. 00:34:53
Then we have another drug dealing crime that is set to go. 00:34:57
On April 7th. 00:35:01
So we are using all of our people. 00:35:03
For that purpose, Matt Ely. 00:35:06
Sits behind me. Has been here since. 00:35:08
December of 2003. 00:35:10
Matt has been a fixture in our office and I moved Matt into the role of litigation. 00:35:12
Quite frankly needed. 00:35:18
We're down one attorney. One attorney left for Harrison County. 00:35:19
Got another? 00:35:23
With a pay raise. 00:35:24
It's good one left for private practice. 00:35:25
That's good. 00:35:28
Without an attorney, so Matt is now been moved back up in a role again of litigation. 00:35:29
And commensurate with that, I'd ask you this hour from 90,000 to 97.5, we will cover it. 00:35:35
In our line items. 00:35:41
Under 0009. 00:35:42
We have 10119, which is for Deputy, 11020, fifth deputy. 00:35:45
One of those is open. 00:35:51
We don't intend to fill it. We have. 00:35:53
Advertisements out that we've not. 00:35:56
At this point, Councilman of the. 00:35:59
Quality that. 00:36:00
This community deserves good people apply. 00:36:02
So we will easily be able to cover all that. 00:36:05
In our budget. 00:36:08
And if I have to diversion? 00:36:09
So that won't be any increase in budget. 00:36:10
But that's why I asked for it. We moved him back into that role. 00:36:14
That's what we pay our general litigators is 97.5. 00:36:18
So that. 00:36:21
I can tell I don't do a whole lot of criminal work anymore, but. 00:36:28
Matt is a. 00:36:30
Of your office. 00:36:33
He's a credit to that, to your office, into the community. 00:36:35
He's been loyal to us for years. 00:36:38
I'll make a motion to approve 6A prosecutor's salary. 00:36:40
Increase and it will come out of our budget. 00:36:47
And it's coming out of your budget? 00:36:50
However, Diana. 00:36:51
OK, this is just approving. 00:36:56
They're down prosecutors. 00:36:59
OK. So we don't need to make a motion to approve anything? 00:37:01
Yeah. 00:37:06
Increased salary, increase in salary, OK. 00:37:08
OK. On the salary. 00:37:11
OK, second. 00:37:13
Have a motion and a second for 6A. 00:37:15
Prosecutor salary increase. Any further questions or discussion? 00:37:18
Well, yeah, because that money they have now will go away next year. We've dealt with this last year 1 needs did some similar 00:37:21
things that. 00:37:25
Even though they covered it in the current budget, then the next. 00:37:29
Budget, we had to pick that extra money up so. 00:37:31
It's not net neutral. 00:37:34
Temporarily, but not long term. 00:37:35
But because if they. 00:37:37
Aren't going to fill those positions next year, Then why do we? 00:37:39
Add that new position. 00:37:42
Two years ago in the first place. 00:37:44
I don't think it was. We're not going to fill it. It's we can't at this time. They've tried to fill it. That means next year 00:37:46
though that. 00:37:49
That will by possibility, but it's not meant to stable. 00:37:52
But but. 00:37:56
But this bill? 00:37:58
You anticipate passing will save. 00:38:01
The county. 00:38:04
$250 and if it doesn't, I'll commit to continue to cover this increase next year. So that won't happen. I say that on the record. 00:38:05
That's how confident I am that this will pass and save this county 250 to $300,000. 00:38:15
This is a righteous thing to do. 00:38:20
We do intend to fill. 00:38:22
That position absolutely intended. 00:38:23
Fill it. But I'm not going to fill until we find that right person. We have hired one person. 00:38:25
He's fresh out law school. He'll be a great prosecutor. 00:38:30
But we don't bend on that. I'm going to get the right person. 00:38:34
Five months, but it's been open long enough that it can cover right now. I don't have to wait to hire. 00:38:37
That makes sense, So. 00:38:41
It will be neutral this year. I'll make sure it's neutral next year if I have to, and I don't mind that. Jim's right. 00:38:42
Guys were gracious enough to cover it this year. You won't have to do that next year. I'll cover this increase next year also my 00:38:48
diversion if I have to, I'll make that. So thank you. 00:38:52
All in favor for 6A prosecutor say aye. 00:39:00
Aye, any opposed? 00:39:03
That carries it. 00:39:06
OK #3 is Nick Creeby from Plan Commission and I'll let him explain. 00:39:10
This is for a salary increase for the Building Commissioner. 00:39:19
With the reorganization of our department with me taking on a lot of the Director of Operation roles. 00:39:23
I've hired a planner to take on some of my previous roles. 00:39:30
At a cost savings for that position. 00:39:35
And so. 00:39:38
The Building Commissioner will take on some of the. 00:39:40
Supervisory responsibilities. 00:39:44
And with that. 00:39:47
A salary increase is requested. 00:39:51
The planner I hired. 00:39:54
It's substantially less than. 00:39:57
The salary was. 00:39:59
And this increase is also less than the aggregate. 00:40:01
So we should have the funds in the budget existing. 00:40:04
This is being paid out of the. 00:40:10
Commissioners budget. 00:40:12
Point Yeah, Plantation. 00:40:14
Again, we don't need an appropriation. 00:40:16
Just approval of salary. 00:40:19
And this one will be long term as well. 00:40:23
This one will. 00:40:25
Money, but this the restructuring. 00:40:28
Currently saves $27,000 a year, right, Correct, Yeah. 00:40:31
You're going to come out. I mean, next year is not going. 00:40:34
Cost you extra money, right? 00:40:36
Motion to approve 6A planning Commissioner. 00:40:40
I'll second it. 00:40:43
We have a motion, a second for 6A Plan. Commissioner, any further discussion? 00:40:44
All in favor say aye. 00:40:49
Any opposed? 00:40:51
That carries. 00:40:53
Thank you, Nick. 00:40:54
Thank you, Michelle. Next up is item 7. 00:40:55
Ordinance for transfers. 00:40:59
Motion to approve the Ordinance for transfers Ordinance. 00:41:04
What county ordinance 2025, Dash 04. 00:41:09
2nd, the motion. Second, any discussion on our transfers for tonight? 00:41:14
All in favor say aye. 00:41:19
Aye, any opposed? 00:41:20
That carries. 00:41:23
Any committee reports or? 00:41:25
Further discussions. 00:41:29
Jim, we did. The Planning Commission had a special meeting yesterday for a little training for some inefficiencies we had. So it 00:41:31
helped catch us up on some of our proposals within the Planning Commission. So it was beneficial. 00:41:38
Excellent. 00:41:45
I don't think I have anything to report. 00:41:46
I talks with the road department have. 00:41:49
Sparked back up and. 00:41:57
Just a few. 00:41:59
Few remaining. 00:42:01
Details should be wrapped up. 00:42:02
I'm hoping. 00:42:05
Our next meeting rolls around. 00:42:07
For for that so. 00:42:09
Yeah, that's really all I have. 00:42:13
Are we gonna owe them back pay? 00:42:15
That's that is negotiable. We're still discussing that. 00:42:17
Public comment. 00:42:22
Please state your name for. 00:42:25
Record Share. 00:42:27
In accordance with provisions up to 10 IC 3-1-2, we turn an annual jail reported to the Honorable Judge Brown of the Circuit 00:42:31
Court. I like to present it to the commissioners and council and the public needs, so that's what I have here tonight. 00:42:37
Give you statistics of what we do in the jail and what's going on and some numbers. 00:42:43
You know, at the time of this report, we had an average daily population of 311. I want to make a note. 00:42:47
And also average stays about 30 days. Our population today is 342. 00:42:52
We can house up to I think 369 somewhere in that area, but really not. 00:42:57
Classify different inmates looks a little bit less so. Our population is rising and I have a document I'll eventually give you all 00:43:01
at some point. We're keeping an eye on it. The population is rising month by month. 00:43:05
So typically the winter it goes down to the summer goes up. 00:43:10
But lately it's been rising all over, so just want to let you all be aware of that, so. 00:43:14
Fun times and fun discussions. Eventually, Someday. That's probably not just yet. 00:43:18
And we are housing 21. 00:43:22
Fairly nice, but so you're all perfect like. 00:43:24
Yes. So we can get rid of those at any given time, but we will lose money. 00:43:27
Yeah. So we'll hang on to those. So we're doing good so far in terms of that. But this is where I can present to the president. 00:43:30
Anybody have to have a look at if they like. 00:43:33
Thank you, Sir. 00:43:40
If you have any questions, I mean tomorrow. 00:43:42
So you want Sam to stay out of the gym? 00:43:45
Everybody's welcome to jail. 00:43:48
I meant for population purposes 3 square mills. 00:43:50
I hear the food's a lot better than ours. 00:43:56
So also. 00:43:59
One other thing too, the last two today and years that we had a call to Floyd Central and Highland Hills in reference to kind of 00:44:00
what we call swatting call. 00:44:04
If you're not familiar with that, basically it's a fake call into a bomb threat or someone's going to shoot up the campus or so 00:44:07
forth. So. 00:44:11
We, our staff, responded very well yesterday and today. Yesterday we had a lot of health systems from Clark County was there. 00:44:15
With their helicopter. 00:44:21
I had drones, dogs and whole 9 yards. 00:44:23
Our staff did a really good job, response time within two minutes. 00:44:26
We had it locked down and secured, searching for a potential threat. 00:44:30
Didn't find any yesterday, didn't find today, but. 00:44:34
Work really well the school system and other agencies locally that came in to help us just. 00:44:36
I've got a senior in high school out there. The communication was for a parent was fantastic. Good. Well, the response, the 00:44:42
Sheriff's Office and employees that responded 1st and then continue to come out when we had I think it was. 00:44:47
Over 20 personnel at least. 00:44:53
That came extra. 00:44:55
And state police showed up so. 00:45:26
It was really good when we declared a foot central and did the vessel. 00:45:28
Fantastic job. 00:45:32
Glad you like dogs. 00:45:33
Thank you, Sheriff. Anyone else from the public? 00:45:36
I'll entertain a motion to adjourn. 00:45:40
Some who 2nd. 00:45:42
All in favor. 00:45:45
We are adjourned. 00:45:46
