Meeting you're actually. 00:00:07
Meetings tonight, not in April Fools, so. 00:00:10
So. 00:00:12
Go ahead and say the Pledge of Allegiance once for before our public hearing on the CCD Fund. So if you'll join me in that. 00:00:15
I pledge allegiance to the flag of the United States of America and to the Republic for which it stands, one nation under God. 00:00:22
Indivisible. 00:00:31
Liberty and justice for all. 00:00:33
All right. First I want to call to order the public hearing. 00:00:41
Regarding re establishment of the Cumulative Capital Development Fund. 00:00:45
No one signed up specifically to speak to that, but I don't know if anybody didn't know that they had to do that. So if you would 00:00:50
like to speak with regards to that, I will allow brief comment on that. 00:00:56
He come to the podium, you know the the drill. 00:01:02
Good evening, gentlemen. Thank you, Joseph Moore. 00:01:09
Georgetown Township. 00:01:12
My only concern was make sure I didn't misinterpret the agenda. 00:01:13
To my understanding, this is just a recertification of last year CCD, not a new one. 00:01:17
Is that correct? 00:01:22
Yes. 00:01:24
Ooh, that is it now. 00:01:28
In that case, no. 00:01:29
OK. In that case, I'm not in favor of that at all. Thank you. 00:01:31
All right. There's no other public comment on that. We'll go to the. 00:01:38
Discussion on that, you want to go ahead and close the public comment section, public hearing section and then? 00:01:42
No one else. 00:01:48
OK. Then we will consider the public comment on that closed. 00:01:49
All right, and we'll move forward. 00:01:54
To the. 00:01:55
Well. 00:01:57
The meeting. The meeting proper. 00:01:59
In which case I do want to remind people if they have a cell phone to please turn it off. 00:02:01
Or at least the ringer off. And if you need to use that phone please. 00:02:06
Make use of the hallway outside. 00:02:10
And I would have everyone join me in a moment of silence for individual prayer, meditation, thought we get ready for the. 00:02:13
Main meeting tonight. 00:02:19
Thank you. We do have a couple of tweaks on the agenda. 00:02:41
1st. 00:02:45
Tabling for item 4B, Floyd County Resolution 202507, Solid waste hiring moratorium. 00:02:48
I'll be seeking a motion to table that so moved. 00:02:57
Second, all in favor? 00:03:00
Item 6, which was linked to the agenda Superior Court 1 Judge Carrie Stiller, an independent contractor agreement. We'll need to 00:03:04
add that by unanimously. 00:03:08
Unanimous consent, please. 00:03:12
I'll make the motion to add that onto the agenda with unanimous consent. 00:03:14
Second all in favor, aye aye. 00:03:18
All right. 00:03:21
Item 1. 00:03:22
County Attorney. 00:03:24
Regarding Floyd County Ordinance 2025-11 reestablishment of CCD fund. 00:03:25
Thank you this re establishment of the CCD fund which was actually adopted. 00:03:30
I believe. 00:03:35
In April of 2023 or April 20, I think it was April 2023 and at that point in time the full. 00:03:37
.0333 was not utilized and so this is reestablishing it at that. 00:03:48
Max rate not to exceed that amount. 00:03:54
Happy to answer any questions if you all wish to adopt this. 00:03:57
With unanimous approval this evening, you can do so. 00:04:01
To clarify, when that was passed, it was with the intent of the .0. 00:04:05
333 for $100 but DLGF. 00:04:10
Notified us after. 00:04:13
Going through the process that. 00:04:15
First year is standardly set at 1/2 that rate. 00:04:18
That is correct to reestablish it that they. 00:04:21
Full rate of 0.033. 00:04:24
And with that clarification, I'll open this for any discussion. 00:04:29
I really don't have any discussion on I think. 00:04:34
I think we're all clear that this point in time would eventually come where we would have to make this adjustment. Umm. 00:04:36
I think that. 00:04:41
It was better on. 00:04:44
All parties involved. 00:04:46
To wait. 00:04:48
Until we had a more solidified idea of where. 00:04:50
We would be moving forward so. 00:04:53
The only comments I have. 00:04:55
Any comment? No Sir. 00:04:58
OK, I'm gonna, I'm gonna just make a comment, you know, for the record, stating that. 00:04:59
As long as I'm. 00:05:05
In this office, these funds are going for the projects which include the administrative building and the county. 00:05:06
Courthouse. 00:05:12
Refurbishment and we're down. 00:05:14
3 pathways on that. 00:05:18
And what we discussed and discussing those publicly in the very near future. 00:05:20
Whether we acquire? 00:05:24
Real estate that already exists downtown and remodel. 00:05:26
Whether we stay where we are. 00:05:29
We're going to have to remodel there or whether we build new. 00:05:31
And that's where this money will be going. 00:05:35
When we established the fund. 00:05:37
That's what I stated and we did establish a specific non reverting fund for the CCD and that's where that money is gone. 00:05:39
And thus far, every penny of that has gone towards that project and will continue to do so. 00:05:46
As long as I have a vote in it. 00:05:52
And one other coach backing up. 00:05:55
So, but that's my intent, that's the intent of this. So this money will continue to go for those projects. 00:05:58
And with that in mind, I'll look for a motion with unanimous consent to. 00:06:03
Reestablish the fund at the 0.033 rate. 00:06:08
I'll make the motion to approve with unanimous consent, Floyd County ordinance. 00:06:13
2025 Dash 11 The re establishment of the CCD Fund. 00:06:17
I'll second that. 00:06:22
All in favor, aye? 00:06:23
Alright, I think that was. 00:06:25
Oh, did I give you the wrong one? 00:06:27
The ordinance itself says 2025 eleven. 00:06:30
I think that OK. 00:06:34
Yeah, the agenda had 10. The ordinance itself says 1111 is correct. 00:06:36
So I did read it correct. 00:06:41
Yes. 00:06:43
Do we need any further clarification? 00:06:44
Are are we good on that, Susanna? 00:06:48
And so then when we get further down the agenda, there will be another one that says 11, that will be 12, OK. 00:06:50
No, I have, I do. 00:06:58
The revised 1 is correct. 00:07:00
The highlighted one with just still around it is really bad. 00:07:02
So you read it correct. 00:07:06
Thank you. 00:07:08
I was on the old one. 00:07:09
OK. 00:07:11
Thank you, old business. 00:07:13
Director of Building and Development Services and pre. 00:07:16
Yes, we have two ordinances that we have heard last meeting. 00:07:23
FCO 20/25/08. 00:07:30
And FCO 202509 the 1st is a rezoning from general commercial to multi family residential. 00:07:32
The second. 00:07:41
Multi family residential to. 00:07:42
Planned unit development multifamily this pertaining to the same project. 00:07:45
So. 00:07:51
We had public comment on those together. 00:07:53
And we are here now to. 00:07:56
Prove or not for those. 00:07:58
OK. Do you have any further? 00:08:00
Beyond what I presented last time, no. 00:08:02
OK. All right. 00:08:04
And we do have four people who signed up from the public to speak to this. 00:08:06
And we weren't planning on any further comment. 00:08:12
From the developer this evening, now just to the extent of. 00:08:16
Reviewing it, but thank you all have heard enough of the review and certainly any rebuttal that we would desire. 00:08:20
If there are any new public comments, we would love to speak to. 00:08:27
All right. Does anyone wish to have any further review from the developer themselves? No, but I think what they're asking, I would 00:08:31
only agree with Mr. Craft that he has the right to rebut whatever comes up. 00:08:36
OK, we have four people who've signed up to speak. 00:08:42
I think we'll allow three minutes per on that since we have 4. 00:08:45
I have first Carol Black. 00:08:50
I guess if you'd like to come up and. 00:08:54
If you will. 00:08:58
If you come to the podium, please state your name and your address for the record. 00:08:59
And then we'll let you know when you have about 30 seconds left. 00:09:04
Good evening, gentlemen, and I thank you for the opportunity to be able to speak. 00:09:07
My thoughts on this development. 00:09:13
My name is Carol Black. Carol Amon Black. 00:09:15
And I live. 00:09:19
I have to give my street address. Yes. 4012 Tanglewood Dr. Floyd Snobs, Indiana 47119. 00:09:21
OK. 00:09:30
Initially I was against. 00:09:32
The apartment buildings going in. 00:09:36
I have since changed my mind for a very. 00:09:39
Important and specific reason and I think it's one that. 00:09:43
Effects many. 00:09:48
Older citizens. 00:09:50
In our area. 00:09:52
I moved to. 00:09:54
The Floyd snobs in 1986. 00:09:56
And I worked. 00:10:00
At Floyd Memorial. 00:10:01
For 20 years as an RN and I remember Frank from when I worked in the ER. 00:10:03
You've gotten older and so have I, however, for the past two years. 00:10:09
I have been looking for available. 00:10:16
Adequate housing for myself. 00:10:21
I can no longer stay in my 3 level log cabin. 00:10:24
Which I hate to leave. I love that area. 00:10:29
And I cannot find anything. 00:10:32
In Floyd's Knobs or nearby? I don't want to go down the hill. My daughter lives down the street. 00:10:35
I have really. 00:10:42
Am encouraged to hear what Mr. Thenaman is planning. 00:10:44
These are apartments. 00:10:50
That go beyond regular apartments. 00:10:52
He's told me that he's going to put elevators in them. 00:10:56
I need that. 00:11:00
The people who will be able to live there. 00:11:04
I do not think are the transient. 00:11:08
Fly by night type of people. 00:11:11
I think. 00:11:15
There are many people in Floyd Knobs. 00:11:16
And the surrounding area like me who need to downsize. 00:11:20
But we're not ready for nursing homes yet. 00:11:25
So I. 00:11:28
Full heartedly am in favor of. 00:11:30
The apartments. 00:11:33
And I do believe it will increase the economic. 00:11:34
Ability for Floyd's knobs because commercial development is going to be greater. It's going to. 00:11:39
Receive more revenue through that. 00:11:47
And. 00:11:50
The the Road Commission. 00:11:51
The way they are. 00:11:54
Thinking ahead. And they're already making those changes. 00:11:56
To the street configuration by 30 seconds man. 00:11:59
So I think everyone is kind of in line. 00:12:04
To do this in this area would benefit from having these apartments and I thank you very much. 00:12:08
Thank you. 00:12:16
Joe Moore. 00:12:19
Hello again, Joseph Moore, Georgetown Township. 00:12:27
Sorry about my voice. 00:12:30
I appreciate what Miss Black said and I agree. 00:12:32
OK 1344 Edwardsville. 00:12:37
Yeah, I appreciate that. And I'm getting to that spot myself Where? 00:12:41
Similar stories about where I'm heading health wise but. 00:12:45
I don't believe that is the proper area. 00:12:48
Long before you gentlemen sought elected office. 00:12:51
The county did a big review master plan. 00:12:54
And established the two gateway districts. 00:12:57
Hollander Point area and. 00:13:00
Near where I live, down at Georgetown exit. 00:13:02
We saw in 2016, I believe, was Mr. Thaman. 00:13:05
Got permission, got rezoned the whole chunk of that area behind the marathon station. 00:13:09
That's now that hasn't going up. 00:13:14
Now this next area is going to do the same. 00:13:16
I have a big problem with it but. 00:13:20
Couple reasons #1. 00:13:21
The traffic there is already insane and no matter what they do for that little quarter mile stretch of Rd. between Shrivener and. 00:13:24
Luther I I shop there. I have a doctor there. I go there at least once a day, average. 00:13:31
It's nuts. You feel like taking life like you're playing Frogger sometimes. 00:13:37
They're crossing the Luther to the shopping center. 00:13:42
Second thing is. 00:13:45
Where are we going to put businesses and commercial? 00:13:47
If we keep allowing a rezoning of the most favorable areas. 00:13:51
From commercial to. 00:13:55
Residential. 00:13:57
That area was ideal. 00:13:59
It's right off the highway. It's by major roads. 00:14:01
Another thing is the. 00:14:04
You probably already heard about the. 00:14:07
Already know the fact that the more housing we have versus business. 00:14:10
The higher our property taxes go up. 00:14:13
Because we need the commercial to offset all the school and the emergency services. 00:14:16
So I just. 00:14:21
I don't think it's right. 00:14:23
That some developers can come in and make a lot of money. 00:14:24
At their convenience, where it's going to impose on the rest of us. 00:14:28
Remember, John, when you represent everybody, including current residents. 00:14:32
Not just future ones. 00:14:35
Thank you. 00:14:37
Thank you. 00:14:38
Janet Riggs. 00:14:41
My name is Janet Riggs and I'm at 4807 Elaine Drive in Country View. 00:14:52
And I'm at that. 00:14:57
Go through that area all the time. 00:14:59
Use JC for. 00:15:02
Uh, groceries and and everything. 00:15:05
I think as residents of the area. 00:15:08
I almost hear that we'd rather have a box store with more ability to shop than we would to have additional residents as we're 00:15:11
going to. 00:15:15
Have our schools and and. 00:15:20
Make so much more and I know when John talked the last time he spoke that there would be 4 times as much traffic in the area if we 00:15:23
did the big box store as opposed to the. 00:15:27
To the apartments and I find that hard to believe. 00:15:32
I, you know, I would say there would be a lot of traffic going into a big box store. 00:15:36
But they're just going to go from 1:50 into that. It may be a lot more traffic in the area and I'm not sure that the improvements 00:15:41
that are being done now. 00:15:45
Are really going to improve anything? 00:15:49
From what I've seen, they put a turn an additional turn lane, but there needs to be a whole lot more. You cannot cross between 00:15:51
Luther and the thing. I mean, I, we, my husband and I, my daughter. 00:15:56
We always go out scribe a road to get to 150 we. 00:16:02
You don't. You don't want to turn left there, or you're taking your life in your hands. 00:16:06
And so I don't think. 00:16:09
Putting additional traffic in that area is wise without additional. 00:16:11
Traffic without additional Rd. 00:16:17
Improvements. 00:16:20
I can't see that it's. 00:16:21
What's being done now? It's going to help anything. 00:16:23
There needs to be another exit out of there or something. 00:16:26
I'm a retired appraiser. 00:16:29
So you know it's any of that's going to affect any kind of development there is going to affect the surrounding properties. 00:16:32
And most people don't like to be. 00:16:39
Located next to a an apartment complex. 00:16:41
It's just got a bad. 00:16:44
Reputation most cases, I agree that it's probably going to be a better. 00:16:46
Higher quality of. 00:16:50
People than some apartment complexes. 00:16:52
I think Georgetown's building quite a few apartment complexes and. 00:16:55
They people could live there and still be in the Knobs and or still be in up the hill and in the Floyd Knobs district. So I don't 00:17:00
really think we need. 00:17:04
Additional. 00:17:08
Apartments in the area. 00:17:09
Thank you. 00:17:11
Thank you. 00:17:12
Sean Kravitz. 00:17:14
Hello, my name is Sean Kravitz and I live at 8038 Schreiber Rd. 00:17:27
And I'm going to read this really quick and then. 00:17:31
Talk a little bit about some of my other experiences. 00:17:34
In the 14 years I live next to high end luxury apartments. 00:17:37
I have seen high amounts of crime, drug deals, alcohol stores pop up. 00:17:41
Cars being vandalized. 00:17:46
And people, the community, being threatened with their lives. 00:17:47
Public safety was reduced since. 00:17:50
Smaller infrastructure could never handle the population, which greatly increased. 00:17:53
Car wrecks in the area. 00:17:57
This apartment complex is not for Floyd's knobs. 00:17:59
If we want a better community that we would need to do something such as smart designs for. 00:18:03
Businesses, condos and townhomes that truly benefit this community. 00:18:08
For us. 00:18:13
And our children's children. 00:18:14
Home ownership makes all the difference. 00:18:16
And costs way less than apartment rent. 00:18:19
I've I've lived next in some nice condos. 00:18:25
And townhomes in Louisville, KY. And one of the nicest zip codes in Louisville, KY. 00:18:28
And all the crime came from the apartments. 00:18:34
And what was crazy is I was sitting there spending 1000. 00:18:37
Thousand a month or even more. 00:18:40
Less than Those apartments had more square footage. 00:18:42
Than they did. 00:18:46
Because I had a mortgage. 00:18:48
And I was building equity and it allowed me to be here, actually. 00:18:49
And this neighborhood. 00:18:53
As well. 00:18:55
Because I was able to build equity. 00:18:55
So for the young people or for people who are older. 00:18:57
I think that's a much better viable option than jam packing so many apartments in such a small area. 00:19:01
It and I even emailed you all. 00:19:08
A map showing all the crime that happens in apartments that cost even 1000 a month more. 00:19:13
Than the zoo. 00:19:22
In an extremely nice area, it's just. 00:19:24
When people don't own it. 00:19:27
They don't. They don't care typically as much as someone who does own. 00:19:30
Say a townhome or condo. 00:19:35
And so. 00:19:37
I think it would be best for the community. 00:19:39
To have either be a business there. 00:19:42
Or to be redesigned to whether it is. 00:19:46
Greatly reduced the amount of population in that small area. 00:19:49
Is just my $0.02. 00:19:53
So I thank you all so much for listening. 00:19:54
To that and. 00:19:57
I hope you all consider that greatly. Thank you, thank you, thank you. 00:19:58
Art is crafted. You want to. 00:20:05
Just briefly, yeah, we'll give you. 00:20:07
3 minutes as well. Thank you. 00:20:09
John Craft with law firm of Young Lindenerson Craft, 126 W Spring St. appearing on behalf of Theenman Group LLC. 00:20:11
As you are aware, and certainly we've supplied information. 00:20:19
To address some of the issues that were just addressed traffic. 00:20:23
With regards to leaving it as GC. 00:20:27
Allowing commercial to continue there. 00:20:30
Would be greater amount of traffic and we use the county's traffic study in order to arrive at that. So it's not something that we 00:20:33
put together, but it's something the county paid for through the county's contractor as it relates to that report. 00:20:40
The other piece is. 00:20:47
This is there are two dockets here for this and and I'll address the fact the first one is changing it to multifamily or MF. 00:20:49
The second one is the piece that is the key element for you as commissioners. 00:20:58
Which is the planned unit development district? 00:21:03
The beauty of a planned unit development district is. 00:21:05
The planned unit district is a. 00:21:09
Divided, uh. 00:21:12
Area A subdivision 2 Lots. 00:21:13
And what happens with the PUD is you have control on what happens there. 00:21:16
Specifically, the development plan was approved at the Plan Commission level. 00:21:21
And a vote of seven to one. 00:21:27
As well as the subdivision, the two lot subdivision was also approved in that Plan Commission meeting. 00:21:29
The development plan is, Mr. Creevy will tell you. 00:21:35
Advises those items that must take place as it relates to number of units, as it relates to the issues of materials to be used. 00:21:39
Again, primarily brick with party board and again, I know that's a like a Band-Aid, it's a. 00:21:48
Trademark, but Hardy board elements to that. 00:21:54
We have provided to you the information as to what is expected of this Mr. Creeby, likewise in his report. 00:21:58
With regards to what was done when this was presented to the Plan Commission. 00:22:07
Both of these ordinances, which would be 202508 and 202509 they. 00:22:12
Go together. It's not as if you're just taking it to multifamily, but it's multifamily with the PUD. That requires a revisit to 00:22:19
the Plan Commission for final approval of the secondary PUD plan. 00:22:26
So it's not as if you pass it. 00:22:32
There's a development plan that has been adopted, but we have to appear one more time for purposes of the final approval of that, 00:22:34
and likewise appear for the final approval on the preliminary plat that the Plan Commission has already approved. 00:22:41
We've addressed the items in 603 Indiana Code 6. 00:22:48
3674603. 00:22:52
Comprehensive plan, current conditions, most desirable use, conservation, property values, and responsible development and growth. 00:22:55
Those are all covered likewise in the staff report on each of these elements 15 seconds. And we, we believe specifically we have 00:23:02
met those requirements we're asking tonight. 00:23:06
That the Commissioners approve both of those ordinances, 202508 and 202509. Thank you. 00:23:11
Thank you. 00:23:20
Can you leave 5 seconds on the board? 00:23:25
No, he cut it right at right, on right at the right, at the limit. 00:23:27
He's a professional, He's done that before. 00:23:34
All right, all right, so with no further comment, I. 00:23:37
On this, we'll look for discussion or introduction of these ordinances. We'll need to do both of those separately, so. 00:23:41
Looking for an introduction to discussion of FCO 2025 Dash 08. 00:23:48
Someone would like to bring that forward for discussion. 00:23:55
Yeah, I'll bring it forward for discussion. 00:23:57
Floyd County Ordinance 2025 Co 8. 00:24:00
OK, so. 00:24:05
Any questions for any of the folks here tonight or any further discussion? 00:24:07
I have no question. 00:24:11
OK. I have no questions either. I think we've been through this. 00:24:13
All right, so with regards to Floyd County 2025 Dash 08, I'll look for a motion to approve by unanimous consent. Yeah, I'll make 00:24:16
the motion to approve with unanimous consent Floyd County Ordinance 2025 Dash 08. 00:24:22
I'll second the motion. 00:24:28
There's a motion and a second, all in favor. Aye, aye aye. 00:24:29
All right, on Item 1B, Floyd County Awareness 2025, Dash 09 again. 00:24:34
Looking for this to be in Paul. Introducing for discussion. 00:24:39
So is there any further discussion question with regards to this? 00:24:43
No, I have none. 00:24:47
OK. 00:24:50
I'll entertain a motion for approval then. 00:24:51
Make a motion to approve. 00:24:55
Floyd County Ordinance 20/25/09. 00:24:57
By unanimous consent. 00:25:01
I'll second. 00:25:02
OK, any further comment on this? Have a motion this second. 00:25:04
No, no public comments. 00:25:10
I do have a comment on this, I mean because. 00:25:12
You know. 00:25:16
This has gone in public discussion. 00:25:17
For roughly 2 to three months now. 00:25:21
Going back to the planning and zoning meeting, so there's been plenty of opportunity. 00:25:22
Vet this this issue. 00:25:26
I'm really encouraged by the number of people that. 00:25:28
Have spoken to this publicly in our meetings and the planning and zoning meetings. 00:25:31
As well as private communications both for and against this. 00:25:36
I am going to be voting for this and I am going to explain why the overriding concern on this was traffic over and over again. 00:25:41
And there's not going to be a Meadow there like someone wrote us. 00:25:49
This is either going to be commercial property or it's going to be. 00:25:53
Mixed residential. 00:25:56
And we paid. 00:25:58
Engineers who we value their opinion and. 00:26:00
They basically came back. I believe that the number was more of a doubling. 00:26:03
With two commercial properties rather than fourfold, but nonetheless it was significant. It was statistically valid. 00:26:06
And so if I'm gonna. 00:26:12
Look at traffic is #1 issue, then I'm going to be voting on the one that's going to be putting less on the board. 00:26:13
I did hear concerns about property devaluation and I asked for data on that and I received none, so I did my own studies. 00:26:20
Research and. 00:26:27
Through about 8 years of meta analysis. 00:26:28
From Harvard University to other agencies, basically. 00:26:31
Everything that I've pulled said that on average. 00:26:35
Within 1/2 mile mixed residential similar to this, property values go up by roughly 0.9%. 00:26:37
Every first couple of years. 00:26:43
I reached out to school board members regarding school impact. 00:26:46
And I was not able to get any of them to register an opinion. So again I did some research. 00:26:49
And the best I could find is that in this price range for single. 00:26:53
Homes. 00:26:57
125 units would put roughly 30 to 35 new students within. 00:26:59
School District. 00:27:04
If I extrapolate that, I don't. 00:27:05
Through K through 12 you're looking at about 5-6 per. 00:27:07
Grade if they all go to Floyd. 00:27:10
The only Floyd County school, so I'm not sure that they would do. 00:27:13
But in any event. 00:27:16
I'll hearken back to. 00:27:18
To something that Commissioner Sharp said. 00:27:20
At the previous meeting, which is really the only way to protect properties such as this is. 00:27:22
To purchase them and put them. 00:27:26
Into binding agreements generationally. 00:27:28
And so we didn't have a choice of leaving this as an open field. 00:27:32
Choices were commercial properties or mixed residential. 00:27:36
And, umm. 00:27:39
You know, I've decided to go with. 00:27:40
Perceived to be the least impactful on the traffic. 00:27:43
And that's going to be the next. 00:27:46
Residential SO. 00:27:47
There's no further discussion. 00:27:49
I'll call for the boat. 00:27:52
All in favor, aye? 00:27:55
Any opposed? No. 00:27:57
Thank you, gentlemen. Thank you. 00:27:59
All right. Next order of business, new business. 00:28:02
County reports Lois interests. 00:28:05
Hi, I'm Lois Andrews, Floyd County Recorder, and I have a proposed new. 00:28:13
Contract for our enhanced access. 00:28:19
First time we've redone it since 2009 and I believe. 00:28:23
Rick Fox has reviewed that. 00:28:28
Kind of grouped it. 00:28:30
So I just need your blessings. 00:28:32
So that I can send those out. 00:28:34
All right. And just for clarification, this is going to be one that she will use with the users. So you guys are approving the 00:28:36
form? 00:28:39
And this agreement being in place, she will be able to execute it with each user that comes in. So we'll need to come back before 00:28:43
the board for every approval you're just approving. 00:28:48
The form and structure OK. 00:28:52
All right. Any discussion? 00:28:55
No, I'll look for a motion to approve. So moved. 00:28:57
Second, all in favor? 00:29:01
Aye, thank you. Thank you. 00:29:03
Mr. Nick Creevey once more. 00:29:09
It's Nick here. Oh, there he is. Nick is here. 00:29:11
I have a couple plats for your approval. 00:29:15
1st is an administrative plan. 00:29:18
1574 for Nevilleton Place. It's a four lot subdivision off of Middleton Rd. 00:29:21
And you require no discussion on the signature draft. 00:29:42
It's right there. 00:29:45
As you're all signing that, I'll introduce the next one. This is. 00:29:57
Flat 1579 The Springs of Old Georgetown. This is phase two of that development. 00:30:01
It is. 00:30:08
21 additional lots. 00:30:10
Franks got the pen. I'm not giving it up. 00:30:17
Start down there. 00:30:21
With Frank. 00:30:22
Anything else? 00:30:55
All right, County engineer ratio you reach yet? 00:30:57
Good evening. 00:31:08
Ratio Account Engineer You should have in front of you the annual report. 00:31:09
That need to be signed before being sent to. 00:31:14
In that. 00:31:19
Any highlights, low lights? 00:31:25
Is it is what it is. 00:31:29
OK. 00:31:33
Anyone have any questions for Horatio regarding annual report? Where is this going? 00:31:34
In that OK. 00:31:41
All right, so which copy needs to be signed? 00:31:44
Said which copy needs to be signed? Do you have the official copy that's going to come around later after the meeting? The last 00:31:48
page is got the. 00:31:51
Three language Commission. I assume Suzanna has the original for you. 00:31:54
OK. 00:32:00
And if you could motion for to accept this, I need a motion to approve. I'll make a motion that we accept the annual operations 00:32:01
report for local roads and streets and bridges. 00:32:05
I'll second. 00:32:11
Motion is second all in favor? Aye aye. 00:32:12
Thank you. 00:32:16
Post meeting post. 00:32:19
All right, County Attorney, Fox Law Office. 00:32:21
Item 4. 00:32:24
So the next one is the creation of an ordinance establishing the solicitation Permit Fund, which will be 4002. 00:32:26
That is for purposes of solicitation permits that are requested and received in the county. 00:32:35
Part of the permitting application there's a fee. 00:32:40
So that fund will be established to receive that fee. 00:32:44
And then to use that fund to pay for anything that needs to be paid for. 00:32:47
Sort of investigation or anything else that is conducted so. 00:32:53
All right, Any questions for Miss Fox? 00:32:59
And I'll look for a motion to approve. 00:33:04
By unanimous consent. 00:33:06
Yeah, I'll make a motion to approve with unanimous consent Floyd County Ordinance 2025 Dash 12, which is the establishment of the 00:33:07
Non Reverting Fund. 00:33:10
For solicitation permits. 00:33:14
2nd. 00:33:18
We have a motion and a second. All in a favor, aye? 00:33:19
Item 4B was. 00:33:23
Next item is the. 00:33:25
Blackstone's mail dam agreement. 00:33:28
And that's an agreement. 00:33:30
For the county to contribute $50,000. 00:33:33
For the Total project to takedown the Blackstone's Mill Dam. 00:33:37
That dam's been in the news. 00:33:44
For some time and. 00:33:47
Yes, and it needs to be taken down. 00:33:49
The the 50,000 contribution. 00:33:54
Is just that a contribution to the total cost of taking it down? 00:33:58
And that includes getting all the permits that are necessary. 00:34:03
With regards to taking the dam down and so. 00:34:09
That permitting processes. 00:34:13
Most certainly something that we need to get started immediately. 00:34:16
Secondly, in regards to the current flow of the water. 00:34:21
There has been damage. 00:34:27
To the surrounding area. 00:34:30
And so. 00:34:32
One of the. 00:34:35
Issues that we have is moving this forward quickly, which would require a declaration of emergency by. 00:34:36
The county commissioners. 00:34:43
In order to expedite the process. 00:34:45
I've asked Horatio. 00:34:48
If he could make some brief comments with regards to. 00:34:50
The status of the water flow and the issues that we're having. 00:34:55
To serve as a basis for a. 00:35:01
Motion for the county commissioners. 00:35:05
For a declaration of emergency to enter into the contract. 00:35:08
Yeah. Just to expound upon that, this is not a general declaration of emergency with regards to the site declaration of emergency 00:35:14
as it pertains to procedurally entering into a contract outside of normal processes. 00:35:19
That is correct. 00:35:25
Ratio. 00:35:27
Sir, I'll be monitoring the situation there and then many of in several locations that we've talked to people from in that. 00:35:28
I mentioned that. 00:35:35
My big concern is the bridge. 00:35:37
There has been the foundation of the Clarksville side is being eroded. 00:35:39
Rapidly in. 00:35:44
Quick due to the Craig found a new. 00:35:45
Pattern besides existing them and then. 00:35:49
The only way to. 00:35:53
Prevent this situation or collapsing the bridge or the. 00:35:55
The approach from. 00:35:58
Clarksville Side. 00:36:00
Is to bring the existing low head dam. 00:36:02
Down South that they. 00:36:06
Natural pattern or the natural? 00:36:09
Direction of the Creek can be rerouted. 00:36:12
And then the water can be moved away from the. 00:36:15
Bridge on the bridge or the bridge foundation itself? 00:36:18
And then stop the erosion and then from there on. 00:36:22
We can go and re. 00:36:25
Establish the bank. 00:36:28
Where the damage used to be. 00:36:30
And then? 00:36:33
Dry the area where the rich foundation is. 00:36:34
Right now is. 00:36:37
Not in best shape and. 00:36:39
And I'm afraid of the whole. 00:36:41
Embankment there will be, you know. 00:36:43
Wash it away slowly. 00:36:45
And then the forecast for the days coming. 00:36:47
And weeks is going to be pretty heavy rain. 00:36:51
And the way the Creek is running right now. 00:36:54
Is going straight to the foundation. 00:36:58
And even though we put some. 00:37:01
Shield there are heavy rib rat. 00:37:03
This thing is being. 00:37:06
Moving away and then? 00:37:07
The people that. 00:37:09
Control the Greeks in. 00:37:11
All that. 00:37:13
They advise not to do more material on it. 00:37:14
They prefer to. 00:37:19
Removed that and allow the Creek to go back to his natural cause. So I think he's a pretty. 00:37:20
Pretty heavy situation that we need to take care as soon as possible. 00:37:27
I would think that is within some sort of emergency. 00:37:33
That we can. 00:37:36
Handle that weaker and. 00:37:37
Thank you. Any questions for Horatio? 00:37:40
Do you suspect it? 00:37:44
If we get that 7 to 10 inches of rain, we're gonna have problem. 00:37:45
Here in the next 72 hours. 00:37:49
Yes, Sir, absolutely. 00:37:52
Plus the foundation itself is. 00:37:55
Getting weaker and weaker every time. 00:37:57
Yeah, yeah. 00:38:00
Any further? 00:38:03
No, Sir, no. 00:38:07
Any further discussion or comment on the contract itself. So your first step would just be to declare by motion and vote. So I'll 00:38:09
look for declaration or motion to declare an emergency to enter into the contract based upon testimony we've just heard from 00:38:14
Horatio. 00:38:19
So moved. 00:38:25
Second all in favor, aye. 00:38:27
All right. And then the contract itself, contract itself, any questions for attorneys regarding that or discussion or comment? 00:38:30
I'm done and that. 00:38:38
As Horatio mentioned, that is for the removal of the dam. It'll be cleanup and restoration as well as stabilization of that bank. 00:38:40
That is a concern, right? 00:38:43
I have a comment on that. I mean, I think the public is right to to wonder what the rate limiting step on this is and and. 00:38:48
You know why this is happening? 00:38:55
Several weeks after the. 00:38:57
Breach of the dam originally occurred and the answer is originally there was some thought that. 00:38:59
There might be a reestablishment of the. 00:39:04
The dam. 00:39:07
And trying to get that water hitting Med channel. 00:39:08
Rather than around the bank on the Clarksville side. 00:39:11
The DNR does not want to do that for safety concerns, and I agree with them on that. 00:39:16
But the rate limiting step on this entire process is trying to get assurances that whatever we do downstream of the new. 00:39:20
Bridge. 00:39:29
Build site is not going to change our timeline on the new bridge. That project has been in work since 20/17/2018. 00:39:31
Is taking a long time to get the projects and the funding in place. 00:39:39
And so whatever we do downstream with the old bridge. 00:39:42
Is a secondary priority to, not. 00:39:48
Not jeopardizing the building of the new bridge. 00:39:51
So the way I look at this is safety 1st and it's become very apparent that it's going to be safer to takedown the remnants of this 00:39:54
dam. And I say remnants because it's not a functioning dam at this point anyway. 00:39:59
So in order to affect repairs on the old bridge. 00:40:04
One would have to either reconstitute the old dam, which is expensive and a lot more complicated engineering. 00:40:09
Then removal of the. 00:40:15
Or we remove the dam, which is again safer in the short and the long term, less expensive in the short term as well. 00:40:17
Once the dam is down in the waters midstream, we can affect repairs on the old bridge. 00:40:23
And opened it. 00:40:29
For the duration of the time we have between now and the opening of the new bridge. 00:40:30
Again, none of that happens unless we can get assurances that by doing this. 00:40:34
We're not going to delay the construction of the new bridge. 00:40:39
And that's why we've contracted with an engineer. 00:40:43
Basically, lead those discussions with. 00:40:46
N dot and the Department of Natural Resources and the Environmental Management Agency and the Army Corps of Engineers so. 00:40:49
Best case scenario of all those agencies would sign off on that and we get a little good weather, we could takedown the old 00:40:58
bridge. 00:41:01
They're estimating. 00:41:04
Roughly 5 days to do that. 00:41:05
And another few days to. 00:41:07
Shore up the bank. 00:41:08
On the Corksville. 00:41:10
Then we can affect our repairs on the old bridge and get it up and running. 00:41:12
And we're still on time. 00:41:15
For the new bridge construction. 00:41:17
As of our last meeting, right, Nick? 00:41:19
So yes. 00:41:21
So anyway, hopefully it'll fall together pretty quickly. 00:41:22
So with that in mind, I have AI have a motion to accept the contract. 00:41:27
Summit and a second second. All in favor. 00:41:32
Aye, all right. 00:41:35
Thank you. 00:41:37
4D. 00:41:39
That's the architect design contract for the health department. We have Luanne Jensen here. 00:41:44
And Luanne is president of the Floyd County Health Department board. 00:41:50
And she's here to answer any questions you have with regards to. 00:41:56
The contract. 00:42:01
It's basically. 00:42:03
Umm, a contract. 00:42:06
For architect services. 00:42:08
To. 00:42:11
Fundamentally, layout the design for. 00:42:14
The Floyd County Health Department's use of the building. 00:42:17
And any other uses that may be out there with respect to the building. 00:42:21
And the contract is? 00:42:26
$10,000. 00:42:28
And the Floyd County Health Department will be paying for the cost of the architect as. 00:42:30
Part of the agreement. 00:42:38
And so I reviewed the contract and. 00:42:40
It's a good contract. It's as well as I know the architect themselves and he'll do a good job. 00:42:48
Doctor Jensen, any comments? 00:42:58
OK, umm. 00:43:03
Any questions or further discussion on the matter? 00:43:05
No, no. If not, we'll entertain a motion for approval. 00:43:08
I make a motion to approve the architect design contract for the health department. 00:43:12
I'll second. 00:43:16
OK, all in favor. 00:43:17
Aye, aye. 00:43:19
All right. Approval of solicitation permits of the Matthew Herzl. 00:43:21
All right, come forward and. 00:43:28
I don't know if we require any formal presentation tonight, just any opportunity for any questions. 00:43:35
No, good job I'm pronouncing the name though. Yeah, I'm impressed. 00:43:43
Yeah, with the way the market is, good luck. Yeah, yeah. 00:43:47
Thank you. All right, we'll look for a motion to approve. 00:43:50
I'll make that motion. 00:43:54
A second all in favor, aye? 00:43:55
Thank you. 00:43:59
That was easy. Is there anyone from Universal Builders of America here tonight? 00:44:00
All right, they are on the agenda for the record of. 00:44:06
We're going to I'm going to look for a motion to table this until make a motion for the background information. 00:44:09
I'll second it. 00:44:16
OK, they need to state exactly what we need. 00:44:17
What would you like to? 00:44:20
Thank you guys. 00:44:23
I'm not sure if they were aware they were on the agenda so. 00:44:25
I thought would be table it. 00:44:28
If they don't show up next time, I think you. 00:44:30
Would be every right for you guys to deny that so. 00:44:33
I'll leave that to you all, but. 00:44:37
OK, OK. 00:44:38
It's tabled, yeah. Public. Surreal. It's tabled so publicly. Formally, the motion is second. All in favour, Aye, aye. 00:44:40
Public Service Announcement Anybody that comes to your home soliciting business, you have the right to ask for a permit. 00:44:48
For them to show it to you. So that's. 00:44:55
What's the county requires? 00:44:58
Superior Court 1 Judge Kerry Stiller, Independent contractor agreement. 00:45:01
So we indicate that we would cover this so Judge Stiller didn't have to be here this evening. 00:45:05
This is for her office to be able to bring in a court reporter to assist her with the services and needs of her office while 00:45:10
another staff members out. 00:45:14
We have reviewed it. It's good to go. The only change would be inserting Floyd County, Indiana for the office of Kerry Stiller at 00:45:20
the very top after client. 00:45:24
Just to be in compliance with the state statute. 00:45:29
All right. Any questions or discussion? 00:45:33
Nope, no. 00:45:35
Look for a motion of approval. 00:45:37
Make a motion to approve. 00:45:39
The independent contractor agreement with the noted changes. 00:45:41
I'll second. 00:45:45
All right, motion is second. All in favor. Aye, aye, aye. 00:45:47
Board and committee reports. 00:45:51
Mr. Loop, anything to? 00:45:54
Uh, nothing. 00:45:56
Sharp just a 2 little things to note. So on the 220 I attended the Floyd County Parks Steering Committee meeting. 00:46:00
Where we talked about the future of some of our parks. 00:46:09
There was a question that I received from the public regarding. 00:46:12
Camping Arby's and they discuss that they talked about it. 00:46:16
But. 00:46:22
Nothing was made mentioned any further. I don't think it's really kind of a feasible option for them at that location, at least at 00:46:23
this point. 00:46:27
At this time, anyway. 00:46:30
Then. 00:46:32
We had the kept a meeting on 2/27. 00:46:33
So that's about it. 00:46:35
All right. It's kind of a short turn around between meetings. I think we had three admin meetings and a couple meetings with folks 00:46:37
over at building authority, the park steering committee that you went to and our. 00:46:42
Building Rep with Envoy as well as the architects. 00:46:47
On the chase and courthouse projects. 00:46:50
And then a little educational coffee with somebody on residential and commercial building solar. 00:46:54
Roofing. 00:47:00
I'm not personally buying at the moment but it was fascinating so. 00:47:03
All right, I need approval of Commissioners meeting meetings for March 18th, 2025. 00:47:08
Make a motion to approve. 00:47:13
Second, all in favor, aye and approval of payroll and claims. 00:47:16
Motion to approve. 00:47:21
Second all in favor, aye. 00:47:22
Next commissioners meeting is. 00:47:26
Tuesday, April 15th, 2025 at 6:00 PM. 00:47:28
Any government officials who would like to comment tonight? 00:47:33
Any members of the public that would like to comment tonight? 00:47:39
All right. Any closing comments from the commissioners? 00:47:45
I have one thing I'd like to talk about so. 00:47:49
Last month, New Albany Fire Department responded to Parkview Towers. 00:47:52
And ended up having. 00:47:56
Pretty large scale incident. 00:47:58
I would just like to take a moment and commend all of our firefighters and police officers. 00:48:00
All of our county agencies that assisted the Floyd County Sheriff's Department. 00:48:05
Floyd County, EMA and the multiple Floyd County. 00:48:09
Fire departments that covered the city of New Albany, you know, that was. 00:48:13
Tedious and. 00:48:18
High risk event. 00:48:20
And they're bravely saved a lot of lives that day, so I just want to take a second to commend them for that. 00:48:22
Mr. Loop. 00:48:30
Nothing. 00:48:31
Keep your powder dry. 00:48:33
Next few days, right Look for motion to adjourn, so moved. 00:48:34

2nd 2. 00:48:38
