Ingress and egress onto those roadways and that those would meet our county standards primarily being that lots would would not 00:03:20

2233 Bud Rd. that you're already aware of. This property was purchased by developer Dylan Fisher and DBWF Enterprises in the last 00:05:19
month, against the wishes of literally hundreds of petitioners and protesters. This property has been rezoned by the City of New 00:05:25
Albany as medium density residential. 00:05:32
We and our legal representation believe it's well out of line with the Indiana. 00:05:39
Statutes for responsible development and growth and in fact clearly violates the comprehensive plan for the City of New Albany and 00:05:43
several areas I'd like to put forth. 00:05:48
The following map for inclusion in the meeting minutes, it is the plat map that we discussed or that Nick discussed that is the 00:05:55
preliminary. And as you can see on the map, there are 8 driveways that would have to be directly connected to the Bud Rd. area and 00:06:02
then nine directly to a narrow blind curve on Powderhouse Lane. Both of these roads are very small. We just think the introduction 00:06:09
of these driveways would be dangerous to both the current and future residents. 00:06:15
There are also two roads on this plat and one is into the narrow blind curve on Powderhouse Road and then the other is on to Budd 00:06:23

City Council has ignored their own comprehensive plan and state statute to move forward with the this dense rezoning. We've asked 00:06:33
that they really consider it light residential. Our requests were ignored. They've accepted a proposal that puts the current and 00:06:38
future residents. 00:06:44
Into narrow driveways, so a situation where current residents will be coming down, there will be never narrow driveways where 00:06:52
individuals will have to back out. It looks like if anyone's going to have, for example, a holiday party, we're wondering where 00:06:58
they're going to park. So these are our concerns. We're here to let you know that we aren't asking you to stop this development. 00:07:03
We understand, you know, the city of New Albany is moving forward legally. We're just asking you and your director of zoning and 00:07:09
planning, I think a good one. 00:07:14
To uphold the statutes for responsible development and growth and your own county guidelines, and we are here to support your 00:07:20
declaration to this developer in the city. 00:07:25
I am honored to be here tonight representing over 600, it looks like 650 individuals that have signed a petition. 00:07:30

And we're just asking that you protect the current and future residents by not allowing any driveways onto the county roads. And 00:07:42

Rd. You know, there's a power line egress there. There's a lot of potential there for a horseshoe shape development. And we hope 00:07:57

And I know I've emailed the three of you with the recommendation that just for. 00:15:26
Public information just to give an update where we are. 00:15:31
Kind of where we how we landed here. If you'll recall, back February of 2023 was the time frame when the commissioners at that 00:15:35
time had requested Jreck to make some recommendations on the 1st. 00:15:41
Approximately $800,000 that of opioid funding that we had at that time that included restricted and unrestricted at that time. And 00:15:49
it asked how does specific request of J Rack that we ensure some of some portion of the funds were used to? 00:15:58
Provide funding in the community for. 00:16:08
Organizations, agencies who were serving. 00:16:11
Goes any mental health. 00:16:15
Or addiction services and resources. 00:16:18
And so we've been working pretty much since that time. 00:16:21
On the best way to do that, he set up. 00:16:24
Excuse me? We set up a work group and Connie Moon was the lead on that work group and. 00:16:28

She had five other member. There were 5 total. Connie. We had our community corrections director drives Vindalia. 00:16:36
Denise Beckwith, assistant chief of probation. She's over our juveniles. Charlotte Bass, executive director for Floyd County 00:16:42
Health Department. Sergeant Kara Hodges, case manager with Floyd County Sheriff's Office. And of course, coming in and so they 00:16:47
have been meeting. 00:16:52
Formulated an application and I know we've kept you informed through that process. 00:16:59
Ultimately culminated in our meeting in the J Rec quarterly meeting October 21st, 2024, which was put to a vote after having 00:17:03
created a rubric and the scoring mechanism and $280,000 of the funds have been assigned for this specific purpose. 00:17:13
And so the top scores, about $280,490.75 to be precise, were proposed to the full J Reg to fund that there were full 100% 00:17:24
requested amounts, and J Rack passed that as a recommendation. Now to this board, noting that the judges all abstained from voting 00:17:33
as well as anyone who was any interested. 00:17:41
Party related to someone who would have applied. 00:17:51
And so they did not vote. 00:17:55
So no applicants voted. 00:17:57
Because we did have some members of J Rack who company who were participants in the application process as well because it was 00:18:00

by the commissioners then to treat the restricted funds and then the unrestricted funds differently. There is a separate ordinance 00:20:18
for the unrestricted funds now and then the restricted funds which if I recall over 15 years is maybe about $7 billion or 00:20:25

Of course, we already had this process in place when that happened. We wanted to see this to its completion. But what we are doing 00:20:46
is a J REC. We're working with the state Technical Support agency, the Center for Effective Public Policy. They are guiding our J 00:20:53

For reduction of recidivism. 00:21:07
Primary thing which you know medic mental health and addiction is the. 00:21:10
Primary driver. 00:21:17
And the primary cost? Our criminal justice system, of course. 00:21:20

A big piece of this will be data collection. 00:21:26
So that the entities that are being recommended to be awarded these funds will have follow up and they're going to have a request 00:21:29
to provide documentation. And we'll be gathering data from criminal justice partners and working with hopefully Justice Council 00:21:37
going to be on on boarding with them as a data collection agency that several other counties in Indiana are starting to utilize. 00:21:45
A similar purpose. And so the goal here is to set objectives, set performance measures, look at, look and see how we can best 00:21:54
utilize these funds for the benefit of our community and in particular for those suffering from mental health and addiction 00:22:00
related issues. So that's the sort of big picture plan. 00:22:06

through a quick slide, a little bit of a history with the Frank C Denzig or Criminal Justice building in 1994. It's the when it 00:25:05
was developed originally to house the jail, the Sheriff's Office at Newham Police Department, kind of addition to the city county 00:25:11
building, which was built in 1961. 00:25:17
It's messing up, but that's all right. In 2008, we requested, I was the commissioner at that time, and we requested along with 00:25:24
president of the. 00:25:28
The Sheriff's Office FOP in reference to change the name and honor of Frank Denzinger, who was killed in the line of duty in 2007, 00:25:32
and so that name was changed. 00:25:36
In 2008 to honor Frank. 00:25:42
In 2017, a renovation of the jail took place, finished in 2022. Basically it housed, you know, our inmates were increased at that 00:25:45
time. The way I understand it, your deterioration of the jail in different areas. And so by doing the renovation and add 00:25:52
additional bunks and improve building infrastructure in reference to plumbing, electrical and IT, we've talked about some of those 00:25:59
issues already even after the remodel which was completed in 2022, so. 00:26:07

City of Love me along from the Police Department started to build their own police station, which they've been Frankenzinger. 00:26:17
Building for many years, paying rent, and so they decided to build their own, which is just next door. They're on Scrivener, as 00:26:24
you can see in that rendering. That will be completed, we're being told, in January. 00:26:30
Of 25 S the next basically two months. 00:26:37
So it will be vacating that building. So as we come before you, I've had several discussions over this last several months in 00:26:40
reference to that time frame coming up. So in 2025, we are looking to move forward with housing the Sheriff's Office in that 00:26:47
facility. And you'll see just a rendering here of what the facade on the outside could look like as we move forward. ARC local 00:26:54
developer gave us that rendering of kind of what it would look like at that point. 00:27:00
Some of the issues that we're looking at while we believe we need the whole space. 00:27:07
We are looking at moving our training division or the training room, which is here in Pineview currently to the second floor. So 00:27:11
when New Albany moves out, they're going to. 00:27:15
They occupy the first floor, which you first go in the building. The 2nd floor in the basement is all that area. Our detective 00:27:20
divisions are next door to each other. So that's all we have on the 2nd floor. And then of course our offices as you all been 00:27:25
there before. So what we're looking at is some of the issues we're just running out of space when we're just sort of based around 00:27:30
space is the main thing and we really don't have an entrance to the Sheriff's Office. This will allow that to happen at that time. 00:27:35
So what we are proposing. 00:27:41
Not going in great detail, but just keep it generic in terms of that. 00:27:47
Of managing that space and that's what we're kind of proposing tonight along with parking lot that's out front and working with 00:27:51
the building authority in terms of that because they oversee the parking lot and we've talked, we had a couple discussions. 00:27:57
Anyways, regardless of how the parking lot is laid out and what the future of that looks like as well, they've been requesting the 00:28:04
judges before and some other folks of how we manage the parking space in the basement. It's basically mechanical storage. 00:28:10
So here's the first floor, kind of a rendering of what they would be. This is the current lobby. 00:28:17
That we house currently, so that would almost stay the same, but in terms of. 00:28:24
What we're looking at, you can see kind of what we were thinking at that point in time. Another aspect of what we don't have a lot 00:28:31
of space of is attorney-client rooms. 00:28:36
So we're really managing that right now, but it's don't have a lot of space. 00:28:40
Also talked about, I spoke with some judges in reference to Zooming. So whatever you all decide down the road, which I know it's a 00:28:44
couple years potentially down the road, but we still need to plan for while we have the opportunity of possible zoom cases. So 00:28:52
we're taking that into consideration as well. But you can see a rendering of that first floor lobby right there. We'll make sure. 00:28:59

And then so that's in a nutshell, that's kind of the proposal. 00:29:32
I know there's been some discussions back and forth in terms of what hospital could go there over the years. 00:29:36

for the conference room. And on top of that, when it's being used parking, your parking is limited down there. So you mean, you 00:30:55
know, they've got meetings and you know, for them to have ample parking, it's it's going to be, it's going to be an issue, you 00:31:02
know, but first, I think EMA needs to be. 00:31:08
Not in the same building. And they do. I mean, if we have a catastrophe, you know, Jason's been around for a long time. He 00:31:14
understands those command and control areas. You know, that could be, you know, down there. That wouldn't be a place for him, 00:31:19
station or command, depending on what's going on. If we have a major tornado just like Henryville comes through. 00:31:24
You know those different options with that as well we can talk about as well. I spoke with the processor's office. He has no, no 00:31:29
intent on wanting to come to that building. You have the city Police Department on one corner, you have us on the other. And 00:31:34
that's a good fit for that area along with the county building and on the direction that goes down the road. 00:31:39

successful in terms of our jail transition coordinator system of care is in there meeting with people, mental health. 00:41:12
Meetings, so these are the kind of things that really didn't happen before so much and with more defendants that's more lawyer 00:41:21
meeting. So essentially we're having a space issue with the rooms available. These are the same rooms that they used for the Zoom 00:41:28
meetings as my understanding. I think or to some degree they kind of use them for multiple purposes. But there's also Zoom 00:41:35
hearings that are conducted for not only the federal inmates but also for. 00:41:42
The inmates or other courts that they have other courts that they're in our jail, but they have other. 00:41:49
Court proceedings, they have to go to or even in our court sometimes if they're belligerent and they won't cooperate and come up 00:41:54

Another thing that you know that I was thinking about in the talk with the other judges as far as planning for going forward would 00:42:01
be the benefit of the the availability of Zoom conferencing for any sort of temporary location. If we had to do that, there would 00:42:07

parking's been great. They accommodated our request. The sheriff did when New Albany moved out so we could move our parking to a 00:43:07

2233 Bud Rd. that you're already aware of. This property was purchased by developer Dylan Fisher and DBWF Enterprises in the last 00:05:19
month, against the wishes of literally hundreds of petitioners and protesters. This property has been rezoned by the City of New 00:05:25
Albany as medium density residential. 00:05:32
We and our legal representation believe it's well out of line with the Indiana. 00:05:39
Statutes for responsible development and growth and in fact clearly violates the comprehensive plan for the City of New Albany and 00:05:43
several areas I'd like to put forth. 00:05:48
The following map for inclusion in the meeting minutes, it is the plat map that we discussed or that Nick discussed that is the 00:05:55
preliminary. And as you can see on the map, there are 8 driveways that would have to be directly connected to the Bud Rd. area and 00:06:02
then nine directly to a narrow blind curve on Powderhouse Lane. Both of these roads are very small. We just think the introduction 00:06:09
of these driveways would be dangerous to both the current and future residents. 00:06:15
There are also two roads on this plat and one is into the narrow blind curve on Powderhouse Road and then the other is on to Budd 00:06:23

City Council has ignored their own comprehensive plan and state statute to move forward with the this dense rezoning. We've asked 00:06:33
that they really consider it light residential. Our requests were ignored. They've accepted a proposal that puts the current and 00:06:38

Into narrow driveways, so a situation where current residents will be coming down, there will be never narrow driveways where 00:06:52
individuals will have to back out. It looks like if anyone's going to have, for example, a holiday party, we're wondering where 00:06:58

Public information just to give an update where we are. 00:15:31
Kind of where we how we landed here. If you'll recall, back February of 2023 was the time frame when the commissioners at that 00:15:35
time had requested Jreck to make some recommendations on the 1st. 00:15:41
Approximately $800,000 that of opioid funding that we had at that time that included restricted and unrestricted at that time. And 00:15:49
it asked how does specific request of J Rack that we ensure some of some portion of the funds were used to? 00:15:58
Provide funding in the community for. 00:16:08
Organizations, agencies who were serving. 00:16:11
Goes any mental health. 00:16:15
Or addiction services and resources. 00:16:18
And so we've been working pretty much since that time. 00:16:21
On the best way to do that, he set up. 00:16:24

Ultimately culminated in our meeting in the J Rec quarterly meeting October 21st, 2024, which was put to a vote after having 00:17:03
created a rubric and the scoring mechanism and $280,000 of the funds have been assigned for this specific purpose. 00:17:13
And so the top scores, about $280,490.75 to be precise, were proposed to the full J Reg to fund that there were full 100% 00:17:24
requested amounts, and J Rack passed that as a recommendation. Now to this board, noting that the judges all abstained from voting 00:17:33
as well as anyone who was any interested. 00:17:41

And so they did not vote. 00:17:55

Primary thing which you know medic mental health and addiction is the. 00:21:10

And the primary cost? Our criminal justice system, of course. 00:21:20

So that the entities that are being recommended to be awarded these funds will have follow up and they're going to have a request 00:21:29
to provide documentation. And we'll be gathering data from criminal justice partners and working with hopefully Justice Council 00:21:37
going to be on on boarding with them as a data collection agency that several other counties in Indiana are starting to utilize. 00:21:45
A similar purpose. And so the goal here is to set objectives, set performance measures, look at, look and see how we can best 00:21:54
utilize these funds for the benefit of our community and in particular for those suffering from mental health and addiction 00:22:00
related issues. So that's the sort of big picture plan. 00:22:06

through a quick slide, a little bit of a history with the Frank C Denzig or Criminal Justice building in 1994. It's the when it 00:25:05
was developed originally to house the jail, the Sheriff's Office at Newham Police Department, kind of addition to the city county 00:25:11
building, which was built in 1961. 00:25:17
It's messing up, but that's all right. In 2008, we requested, I was the commissioner at that time, and we requested along with 00:25:24
president of the. 00:25:28
The Sheriff's Office FOP in reference to change the name and honor of Frank Denzinger, who was killed in the line of duty in 2007, 00:25:32
and so that name was changed. 00:25:36
In 2008 to honor Frank. 00:25:42
In 2017, a renovation of the jail took place, finished in 2022. Basically it housed, you know, our inmates were increased at that 00:25:45
time. The way I understand it, your deterioration of the jail in different areas. And so by doing the renovation and add 00:25:52
additional bunks and improve building infrastructure in reference to plumbing, electrical and IT, we've talked about some of those 00:25:59
issues already even after the remodel which was completed in 2022, so. 00:26:07

City of Love me along from the Police Department started to build their own police station, which they've been Frankenzinger. 00:26:17
Building for many years, paying rent, and so they decided to build their own, which is just next door. They're on Scrivener, as 00:26:24
you can see in that rendering. That will be completed, we're being told, in January. 00:26:30
Of 25 S the next basically two months. 00:26:37
So it will be vacating that building. So as we come before you, I've had several discussions over this last several months in 00:26:40
reference to that time frame coming up. So in 2025, we are looking to move forward with housing the Sheriff's Office in that 00:26:47
facility. And you'll see just a rendering here of what the facade on the outside could look like as we move forward. ARC local 00:26:54
developer gave us that rendering of kind of what it would look like at that point. 00:27:00
Some of the issues that we're looking at while we believe we need the whole space. 00:27:07
We are looking at moving our training division or the training room, which is here in Pineview currently to the second floor. So 00:27:11
when New Albany moves out, they're going to. 00:27:15
They occupy the first floor, which you first go in the building. The 2nd floor in the basement is all that area. Our detective 00:27:20
divisions are next door to each other. So that's all we have on the 2nd floor. And then of course our offices as you all been 00:27:25
there before. So what we're looking at is some of the issues we're just running out of space when we're just sort of based around 00:27:30
space is the main thing and we really don't have an entrance to the Sheriff's Office. This will allow that to happen at that time. 00:27:35
So what we are proposing. 00:27:41
Not going in great detail, but just keep it generic in terms of that. 00:27:47
Of managing that space and that's what we're kind of proposing tonight along with parking lot that's out front and working with 00:27:51
the building authority in terms of that because they oversee the parking lot and we've talked, we had a couple discussions. 00:27:57
Anyways, regardless of how the parking lot is laid out and what the future of that looks like as well, they've been requesting the 00:28:04
judges before and some other folks of how we manage the parking space in the basement. It's basically mechanical storage. 00:28:10
So here's the first floor, kind of a rendering of what they would be. This is the current lobby. 00:28:17
That we house currently, so that would almost stay the same, but in terms of. 00:28:24
What we're looking at, you can see kind of what we were thinking at that point in time. Another aspect of what we don't have a lot 00:28:31
of space of is attorney-client rooms. 00:28:36
So we're really managing that right now, but it's don't have a lot of space. 00:28:40
Also talked about, I spoke with some judges in reference to Zooming. So whatever you all decide down the road, which I know it's a 00:28:44
couple years potentially down the road, but we still need to plan for while we have the opportunity of possible zoom cases. So 00:28:52
we're taking that into consideration as well. But you can see a rendering of that first floor lobby right there. We'll make sure. 00:28:59

know, they've got meetings and you know, for them to have ample parking, it's it's going to be, it's going to be an issue, you 00:31:02

Not in the same building. And they do. I mean, if we have a catastrophe, you know, Jason's been around for a long time. He 00:31:14
understands those command and control areas. You know, that could be, you know, down there. That wouldn't be a place for him, 00:31:19
station or command, depending on what's going on. If we have a major tornado just like Henryville comes through. 00:31:24
You know those different options with that as well we can talk about as well. I spoke with the processor's office. He has no, no 00:31:29
intent on wanting to come to that building. You have the city Police Department on one corner, you have us on the other. And 00:31:34
that's a good fit for that area along with the county building and on the direction that goes down the road. 00:31:39

We've got to put people someplace and obviously big supporter of the Sheriff's Department is a member of that department for five 00:31:58

next meeting. So I wanted to kind of let you know on a couple of issues. Number one, in talking with Sherry and I've been working 00:40:29

That's about 100 up on a regular basis from where we were a couple years ago. 00:40:49
But one of the things that we want to do to keep things moving is being able to have the lawyers meeting with their clients. And 00:40:55
now not only lawyers, but there are a lot of other programs and things going on in the jail, which we're finding to be very 00:41:03
successful in terms of our jail transition coordinator system of care is in there meeting with people, mental health. 00:41:12
Meetings, so these are the kind of things that really didn't happen before so much and with more defendants that's more lawyer 00:41:21
meeting. So essentially we're having a space issue with the rooms available. These are the same rooms that they used for the Zoom 00:41:28
meetings as my understanding. I think or to some degree they kind of use them for multiple purposes. But there's also Zoom 00:41:35
hearings that are conducted for not only the federal inmates but also for. 00:41:42
The inmates or other courts that they have other courts that they're in our jail, but they have other. 00:41:49
Court proceedings, they have to go to or even in our court sometimes if they're belligerent and they won't cooperate and come up 00:41:54
to court. 00:41:57
Another thing that you know that I was thinking about in the talk with the other judges as far as planning for going forward would 00:42:01
be the benefit of the the availability of Zoom conferencing for any sort of temporary location. If we had to do that, there would 00:42:07
be the ability we would need. 00:42:13
In this, if we have to move is what I'm talking about now that's a little bit down the road, but again in planning for that. 00:42:19
So these are all the same purposes for these rooms that really they don't have. And so I would second the idea that that's 00:42:26
something that would be extremely beneficial not only to the sheriff but also to the courts for moving court cases forward and 00:42:32

That's the primary thing. Also, the core team, I just want to put a shout out there, they do a phenomenal job for records and our 00:42:47
protection and they're currently on the 3rd floor after New Albany moved out and that's been very convenient. 00:42:54
Of course, but you know, there they have to be nearby, so it's another space issue. So just from the courts perspective, the 00:43:03
parking's been great. They accommodated our request. The sheriff did when New Albany moved out so we could move our parking to a 00:43:07
little bit closer. 00:43:12
Or just more safe location there? There are there is very limited parking. I think we still need a spot there for the public, the 00:43:19
chief public defender who doesn't have a spot there who should, but that's a really critical thing in safety there. So I 00:43:25
