I pledge allegiance to the flag of the United States of America and to the Republic for which it stands, one nation under God, | 00:00:04
indivisible, with liberty and justice for all. | 00:00:09
All right, please silence your cell phones if you have any with you. | 00:00:17
And join me in a moment of silence for little individual prayer, meditation, contemplation for the meeting tonight. | 00:00:22
All right, thank you. We'll begin with new business. I do have a couple of additions to tonight's agenda. If I can get unanimous | 00:00:50
consent from the commissioners to add an item 1D approval of temple and temple whistle stop parking lot quote and items 5A and 5B. | 00:00:57
In addition, under County Attorney Rick Fox for Floyd County Resolution 2024 Dash 19 to purchase a Mecalac excavator and | 00:01:04
attachments and. | 00:01:11
Item 5B Approval U.S. bank or finance documents for same so moved. | 00:01:18
OK, All in favor, aye. All right, Mr. Creevy, with building and development, I do want to let folks know that the first item 2233, | 00:01:24
the Bud Rd. annexation future Development on County roads item was placed there at my request about two weeks ago. I. | 00:01:34
I asked Mr. Creevy if you could go ahead and put a preemptive letter together to send to the City of New Albany zoning officials. | 00:01:44
It's basically to let them know that we know that we have certain rights as the county government with regards to development and | 00:01:53
organization out there. I'll let Nick go into that. And then we do have some people here who'd like to discuss that. And they're | 00:01:59
also trying to get down to the City Hall meeting. So I'm going to let them have a little bit of public comment so that they can | 00:02:04
get you guys bring a bus or a yeah, and they can get down there to City Hall and let themselves be heard down there as well. So | 00:02:10
Nick, Yeah. And I will just be. | 00:02:16
To allow them to have their moment to speak. This is a development that we have heard a lot of concerns about from. | 00:02:22
County Citizens. | 00:02:31
It is in the recognized fringe area. | 00:02:32
Planning and zoning jurisdictions. So this is the city's planning and zoning jurisdiction. Although it is currently county | 00:02:36
property in there are voluntary annexation before the city. | 00:02:43
Currently, however. | 00:02:50
The pub, the roads there, Bud Road and Powderhouse Lane are county roads for the majority of the area where this development will | 00:02:53
take place. So we have prepared a letter that we will send with your aunt's approval to the City Planning Commission and Planning | 00:02:59
Director, Mr. Scott Wood. | 00:03:06
Just reiterating that we would like to have approval prior to final approval of the development of any. | 00:03:14
Ingress and egress onto those roadways and that those would meet our county standards primarily being that lots would would not | 00:03:20
have direct access access to those roads, but they would instead use a subdivision to connect to those roads. Subdivision Rd. | 00:03:28
along with some dedicated right away along with its roads. | 00:03:35
If you have any further questions of me, I can answer after they speak, I can maybe answer a few of those questions as well, | 00:03:44
right. And if I mean, you and I have had multiple discussions on this, I've also discussed it with the other commissioners. And | 00:03:50
thus far they're on board with everything that we've been trying to do with this. I guess ultimately we may have to investigate. | 00:03:56
If they choose to try to proceed without our approval on that, then. | 00:04:03
What leverage or we would have at that point in time, but thus far that has not happened and the plots that you and I saw were | 00:04:08
very, very preliminary from this point time. Yeah, that's correct. What we've seen so far is conceptual plats and. | 00:04:14
From my understanding, I have no reason to believe that they will not use a normal process and get approval from county | 00:04:21
engineering about these roads, but we want to because of the concern that the citizens have, we want to make sure that. | 00:04:28
The city is well aware that we are. | 00:04:36
Yeah. And so sending a letter like this is not normal protocol. Normally we would wait for the subject to come up, but. | 00:04:38
The amount of concern, I thought it was best for us to get out ahead of it and let them know that we'll be taking an active role | 00:04:44
to the degree that we can't with this. So with that being said, Mr. Ross. | 00:04:50
We need your name and address for the record. | 00:05:01
Oh yeah, get used to that, yeah. | 00:05:04
My name is Doctor Travis Ross. I live at 502 W Arrowhead, Dr. New Albany, IN. | 00:05:07
Commissioners, thank you for your time. I'm here tonight to bring to you, bring your attention the development at the property of | 00:05:13
2233 Bud Rd. that you're already aware of. This property was purchased by developer Dylan Fisher and DBWF Enterprises in the last | 00:05:19
month, against the wishes of literally hundreds of petitioners and protesters. This property has been rezoned by the City of New | 00:05:25
Albany as medium density residential. | 00:05:32
We and our legal representation believe it's well out of line with the Indiana. | 00:05:39
Statutes for responsible development and growth and in fact clearly violates the comprehensive plan for the City of New Albany and | 00:05:43
several areas I'd like to put forth. | 00:05:48
The following map for inclusion in the meeting minutes, it is the plat map that we discussed or that Nick discussed that is the | 00:05:55
preliminary. And as you can see on the map, there are 8 driveways that would have to be directly connected to the Bud Rd. area and | 00:06:02
then nine directly to a narrow blind curve on Powderhouse Lane. Both of these roads are very small. We just think the introduction | 00:06:09
of these driveways would be dangerous to both the current and future residents. | 00:06:15
There are also two roads on this plat and one is into the narrow blind curve on Powderhouse Road and then the other is on to Budd | 00:06:23
Rd. | 00:06:27 | |
City Council has ignored their own comprehensive plan and state statute to move forward with the this dense rezoning. We've asked | 00:06:33
that they really consider it light residential. Our requests were ignored. They've accepted a proposal that puts the current and | 00:06:38
future residents. | 00:06:44
Into narrow driveways, so a situation where current residents will be coming down, there will be never narrow driveways where | 00:06:52
individuals will have to back out. It looks like if anyone's going to have, for example, a holiday party, we're wondering where | 00:06:58
they're going to park. So these are our concerns. We're here to let you know that we aren't asking you to stop this development. | 00:07:03
We understand, you know, the city of New Albany is moving forward legally. We're just asking you and your director of zoning and | 00:07:09
planning, I think a good one. | 00:07:14
To uphold the statutes for responsible development and growth and your own county guidelines, and we are here to support your | 00:07:20
declaration to this developer in the city. | 00:07:25
I am honored to be here tonight representing over 600, it looks like 650 individuals that have signed a petition. | 00:07:30
For this type of responsible development. | 00:07:40
And we're just asking that you protect the current and future residents by not allowing any driveways onto the county roads. And | 00:07:42
our petition also asks that we work to ensure the developer brings the roadway out onto a safe area, which we believe would be Bud | 00:07:49
Rd. You know, there's a power line egress there. There's a lot of potential there for a horseshoe shape development. And we hope | 00:07:57
that you'll work with them to make that possible. So I am going to submit these petitions. | 00:08:04
And plat maps for you. | 00:08:11
Into the meeting minutes. I also have a copy for each of you of this letter. So OK, thank you. | 00:08:13
All right. | 00:08:19 | |
And did you have someone else who will be speaking tonight? I don't think so. OK, we'll take that and then we'll take the original | 00:08:20
documents. I'll give them to Commissioner Schellenberger. Let him look through it. | 00:08:26
And then give those to Commissioner Sharp and then I'll look at them too. And then eventually we'll put legal review them and | 00:08:34
we'll make sure that they. | 00:08:38
Yeah. And reside here, Yeah. And then. | 00:08:42
So before you leave. | 00:08:45
Look for a motion to approve the proposed letter. | 00:08:49
I'll make a motion. | 00:08:53
I'll suck it, Max, Have a motion a second. All in favor, Aye aye. | 00:08:55
Nick, if you will, e-mail a copy of the letter once you've signed it at the same time that you send it on to Mr. Wood so that they | 00:09:01
have that for their records. And I know you guys need to get down there in a way that doesn't break speed laws and all that type | 00:09:07
of thing. So I want to compliment you guys from the very beginning. You've been on this, you've been organized, and I really think | 00:09:13
this is what grassroots politics looks like. And I hope you get a fair shake and a fair hearing. | 00:09:19
Moves forward OK. | 00:09:26
Yeah, we're doing our best here. OK. Thank you all. Appreciate time. Thank you. | 00:09:28
All right. | 00:09:39 | |
Mr. Creeby. Item 1B, Bridge 51, Parcel 2. Access Agreement. | 00:09:40
This is for Parcel 2 of the right of way acquisition for Bridge 51. | 00:09:46
This is for the corporate property. | 00:09:52
They've requested this agreement that will. | 00:09:56
Asks the county to maintain access to their property. | 00:10:01
Through the construction period. | 00:10:06
And they actually just sent an update that I provided to you just before the meeting. | 00:10:09
Also erected maintaining signage directing the public to an alternate entrance during the construction if that entrance is locked | 00:10:13
during. | 00:10:18 | |
They requested this prior to. | 00:10:25
Approving the right of way. | 00:10:27
Purchase. | 00:10:30 | |
We can. | 00:10:32 | |
And obviously you don't see any. | 00:10:34
Our consultants say that it should not be an issue to maintain access during construction. | 00:10:39
And of course, signage is not a problem. | 00:10:45
All right. I'll look for a motion to approve. You OK with this? | 00:10:49
Rick, you're OK with this? | 00:10:53
Make a motion to approve. OK, all in favor, aye? | 00:10:55
That's actually the quotes. I believe you were provided the quotes for the key garbage services prior to the meeting. | 00:11:04
As well as the telephone number was stopped. | 00:11:13
Where you want to handle these separately. | 00:11:19
I think let's just go ahead and procedurally handle these separately. | 00:11:22
So as Nick said, we had the quotes on Rumpke garbage service. | 00:11:26
And temple and temple both that I'd like to do them separately. | 00:11:31
So. | 00:11:36 | |
I look for a motion to approve the Rumpke services 1st. | 00:11:43
I'll make that motion. I'll second. OK. Motion is second. All in favor. Aye, aye. | 00:11:46
And then just a note on the temple and temple, that was the lowest bid, correct? | 00:11:51
Motion to approve the temple and temple hearing, Yes. OK, so over here, yes, that was the lowest bid of two that we received, | 00:11:58
correct? | 00:12:01 | |
The motion. | 00:12:05 | |
Right. | 00:12:09 | |
On their end of it, OK. | 00:12:11
Motion to approve temple and temple. | 00:12:13
I was like, OK, all in favor, aye. | 00:12:15
All right. Thank you. | 00:12:20
I appreciate you working with. | 00:12:23
With him as well, I mean, it's. | 00:12:25
They're already gone because they have to be, but they've really approached this again. | 00:12:28
Been a class act the whole way. So that's been my interaction with them. So I hope that I really appreciate you working with them | 00:12:34
on that, Horatio. | 00:12:37
County Engineer Horatio Yuritia. | 00:12:44
Good evening. | 00:12:50
I just choose. You have right in front of you a termination contract with. | 00:12:52
RL boxes regarding the repair, the foundation of which 27 I think he's been the best way to approach that since there were some | 00:12:58
item that they were not. | 00:13:04
Wanted to do and they not thought they were necessary and they didn't feel confident with the work itself. | 00:13:11
And I think it's been the best way to. | 00:13:19
Stop this and look for a major Ave. so we can replace the entire bridge and do much better work for. | 00:13:22
Right. So there are no hard feelings on either side on this, correct. And we're gonna we do have a Plan B to proceed with that. | 00:13:33
We'll get into that. I need a motion to accept in. | 00:13:39
Sign so moved. I'll second. All right, then motion is second to agree to terminate contract bridge 27. | 00:13:47
Contract I. | 00:13:55 | |
I don't know. Boxing, yeah. | 00:13:58
All in favor, aye? | 00:14:01
All right. Bond release and then the bond release is for Legacy Spring, Mr. Ginseng. | 00:14:04
Has been pretty much complete all the work. | 00:14:10
Required for. | 00:14:13
Lego Legacy Supreme Subdivision, and he's requesting the rest of the month. | 00:14:14
I mentioned to him that he need to. | 00:14:20
Leave some of the money for the two years agreement. | 00:14:23
For maintenance of the road and all that and he's agree with that. So I think that pretty much. | 00:14:27
We'll explain him to the letter. | 00:14:33
So I need a motion to accept. | 00:14:36
All right. So you're taking into account two years worth of infrastructure maintenance and otherwise we're going to release them? | 00:14:40
Balance of the bond, Yes. OK. Motion to approve. So moved. I'll second. All in favor. Aye, aye. All right, Thank you. | 00:14:46
All right. | 00:14:56 | |
Here, judges in the House. All right, all right. I didn't know about that. | 00:14:57
OK. All right. | 00:15:08
All right, Well, welcome, Connie Moon here with me. | 00:15:10
So today I'm here on behalf of Floyd County Justice. Revisement. | 00:15:15
Justice Reinvestment Advisory Council. J Rack. | 00:15:21
And I know I've emailed the three of you with the recommendation that just for. | 00:15:26
Public information just to give an update where we are. | 00:15:31
Kind of where we how we landed here. If you'll recall, back February of 2023 was the time frame when the commissioners at that | 00:15:35
time had requested Jreck to make some recommendations on the 1st. | 00:15:41
Approximately $800,000 that of opioid funding that we had at that time that included restricted and unrestricted at that time. And | 00:15:49
it asked how does specific request of J Rack that we ensure some of some portion of the funds were used to? | 00:15:58
Provide funding in the community for. | 00:16:08
Organizations, agencies who were serving. | 00:16:11
Goes any mental health. | 00:16:15
Or addiction services and resources. | 00:16:18
And so we've been working pretty much since that time. | 00:16:21
On the best way to do that, he set up. | 00:16:24
Excuse me? We set up a work group and Connie Moon was the lead on that work group and. | 00:16:28
So. | 00:16:34 | |
She had five other member. There were 5 total. Connie. We had our community corrections director drives Vindalia. | 00:16:36
Denise Beckwith, assistant chief of probation. She's over our juveniles. Charlotte Bass, executive director for Floyd County | 00:16:42
Health Department. Sergeant Kara Hodges, case manager with Floyd County Sheriff's Office. And of course, coming in and so they | 00:16:47
have been meeting. | 00:16:52
Formulated an application and I know we've kept you informed through that process. | 00:16:59
Ultimately culminated in our meeting in the J Rec quarterly meeting October 21st, 2024, which was put to a vote after having | 00:17:03
created a rubric and the scoring mechanism and $280,000 of the funds have been assigned for this specific purpose. | 00:17:13
And so the top scores, about $280,490.75 to be precise, were proposed to the full J Reg to fund that there were full 100% | 00:17:24
requested amounts, and J Rack passed that as a recommendation. Now to this board, noting that the judges all abstained from voting | 00:17:33
as well as anyone who was any interested. | 00:17:41
Party related to someone who would have applied. | 00:17:51
And so they did not vote. | 00:17:55
So no applicants voted. | 00:17:57
Because we did have some members of J Rack who company who were participants in the application process as well because it was | 00:18:00
opened in. | 00:18:04 | |
And so you have the e-mail with the list, with the rubric, the scoring and the list. And we have not announced. We made no | 00:18:09
announcements. | 00:18:13
On this to the public because until it would be approved by the Commissioners who are in the final decision making. | 00:18:18
Process. | 00:18:26 | |
The highlighted or the top 6 scores? | 00:18:28
And so we're here today making that recommendation. | 00:18:32
Connie, anything else you would want to add? | 00:18:35
With the approval from the Commissioners this evening. | 00:18:39
I intend to send out an e-mail. | 00:18:43
To grant recipients and non recipients on Wednesday since tomorrow's Election Day, letting them know and then when we intend to | 00:18:46
have a. | 00:18:51 | |
Reception, so to speak. | 00:18:59
For those six winners? | 00:19:02
Which of course you guys will be. | 00:19:05
Ask the police now. | 00:19:09
This was a. | 00:19:12 | |
Tedious. Time consuming. | 00:19:16
Yet very educational process for the five of us. We spent two hours after everybody had gone through all 21 applications. | 00:19:18
And. | 00:19:28 | |
Finalized everything together and it was it was great. He learned a lot. | 00:19:30
And I would also like to add before you vote on this kind of what our plan is because as you know. | 00:19:34
So there were. | 00:19:41
The total requests I believe I don't have. The total is like. | 00:19:44
It was over $1,000,000. | 00:19:51
We only had $280,000 a song. | 00:19:53
Now since that February meeting and that first amount of funds were assigned to J Rag to make recommendations on as you know, but | 00:19:56
as some of the public may not know, I. | 00:20:02
There were additional funds announced from the state as far as what the county would be receiving, and then there was a decision | 00:20:10
by the commissioners then to treat the restricted funds and then the unrestricted funds differently. There is a separate ordinance | 00:20:18
for the unrestricted funds now and then the restricted funds which if I recall over 15 years is maybe about $7 billion or | 00:20:25
something like that. | 00:20:32
You've asked Jay Rock to continue to make recommendations on. | 00:20:41
So now. | 00:20:44 | |
Of course, we already had this process in place when that happened. We wanted to see this to its completion. But what we are doing | 00:20:46
is a J REC. We're working with the state Technical Support agency, the Center for Effective Public Policy. They are guiding our J | 00:20:53
Rack in setting objectives for our county J Rack. | 00:20:59
For reduction of recidivism. | 00:21:07
Primary thing which you know medic mental health and addiction is the. | 00:21:10
Primary driver. | 00:21:17
And the primary cost? Our criminal justice system, of course. | 00:21:20
And so. | 00:21:24 | |
A big piece of this will be data collection. | 00:21:26
So that the entities that are being recommended to be awarded these funds will have follow up and they're going to have a request | 00:21:29
to provide documentation. And we'll be gathering data from criminal justice partners and working with hopefully Justice Council | 00:21:37
going to be on on boarding with them as a data collection agency that several other counties in Indiana are starting to utilize. | 00:21:45
A similar purpose. And so the goal here is to set objectives, set performance measures, look at, look and see how we can best | 00:21:54
utilize these funds for the benefit of our community and in particular for those suffering from mental health and addiction | 00:22:00
related issues. So that's the sort of big picture plan. | 00:22:06
OK. Anything else or questions? | 00:22:14
No, I mean I know that you 2 are both very passionate about that and so I can only. | 00:22:18
I'm sure the rest of the your group was as well. So you had five of you working on this. | 00:22:24
Recommendation to follow there they they scored 21 applications and three large finders full of materials that were provided. I'm | 00:22:30
familiar with those processes, yeah. But yeah, it takes a lot of devotion and work to do that well. So thank you both for yours | 00:22:39
and please extend my thanks to or convey my thanks to everybody else on that team so. | 00:22:48
So you need approval for. | 00:22:59
The highlighted areas to receive those amounts so that you can move forward with that, correct. OK. So I'll seek approval motion | 00:23:01
to approve those and I'll second all in favor, when will that be made public? | 00:23:08
All right, So we'll be able to do that now. So she is. OK great. I'll send an e-mail on Wednesday to all of that applicants. | 00:23:15
Letting them know and then. | 00:23:22
We intend to go to the newspaper. | 00:23:25
With that information as well and. | 00:23:28
So they don't know yet. So gentlemen, keep your Yeah, that's, that's what I was trying to get at, OK. | 00:23:31
What do you have in the minutes for the record? Or do you need the? We can just read that document into the OR we can have it into | 00:23:39
the record and. | 00:23:46
For our purposes, we'll just say that the yellow highlighted areas were approved in the amounts. | 00:23:54
Summarized. | 00:24:00 | |
Yeah. | 00:24:04 | |
If you're comfortable with that, what are you gonna let him know Wednesday, since tomorrow is? | 00:24:08
Yeah. So, yeah, yeah. So my e-mail is going to. | 00:24:15
Do a slow burn on the minutes until Thursday until Thursday and then we'll schedule, we'll schedule an announcement time and | 00:24:19
hoping to do something special with that so. | 00:24:25
Thank you both. Thank you. Appreciate it. | 00:24:32
All right, Sheriff Steve Bush. | 00:24:36
Thank you very much. | 00:24:41
We got a quick slide for. | 00:24:44
Presentation. | 00:24:46
Play. | 00:24:49 | |
BJP. | 00:24:56 | |
So I'll be on the agenda. I don't know what how referenced, but basically have a request for this evening, but I'm going to go | 00:24:59
through a quick slide, a little bit of a history with the Frank C Denzig or Criminal Justice building in 1994. It's the when it | 00:25:05
was developed originally to house the jail, the Sheriff's Office at Newham Police Department, kind of addition to the city county | 00:25:11
building, which was built in 1961. | 00:25:17
It's messing up, but that's all right. In 2008, we requested, I was the commissioner at that time, and we requested along with | 00:25:24
president of the. | 00:25:28
The Sheriff's Office FOP in reference to change the name and honor of Frank Denzinger, who was killed in the line of duty in 2007, | 00:25:32
and so that name was changed. | 00:25:36
In 2008 to honor Frank. | 00:25:42
In 2017, a renovation of the jail took place, finished in 2022. Basically it housed, you know, our inmates were increased at that | 00:25:45
time. The way I understand it, your deterioration of the jail in different areas. And so by doing the renovation and add | 00:25:52
additional bunks and improve building infrastructure in reference to plumbing, electrical and IT, we've talked about some of those | 00:25:59
issues already even after the remodel which was completed in 2022, so. | 00:26:07
2422. | 00:26:14 | |
City of Love me along from the Police Department started to build their own police station, which they've been Frankenzinger. | 00:26:17
Building for many years, paying rent, and so they decided to build their own, which is just next door. They're on Scrivener, as | 00:26:24
you can see in that rendering. That will be completed, we're being told, in January. | 00:26:30
Of 25 S the next basically two months. | 00:26:37
So it will be vacating that building. So as we come before you, I've had several discussions over this last several months in | 00:26:40
reference to that time frame coming up. So in 2025, we are looking to move forward with housing the Sheriff's Office in that | 00:26:47
facility. And you'll see just a rendering here of what the facade on the outside could look like as we move forward. ARC local | 00:26:54
developer gave us that rendering of kind of what it would look like at that point. | 00:27:00
Some of the issues that we're looking at while we believe we need the whole space. | 00:27:07
We are looking at moving our training division or the training room, which is here in Pineview currently to the second floor. So | 00:27:11
when New Albany moves out, they're going to. | 00:27:15
They occupy the first floor, which you first go in the building. The 2nd floor in the basement is all that area. Our detective | 00:27:20
divisions are next door to each other. So that's all we have on the 2nd floor. And then of course our offices as you all been | 00:27:25
there before. So what we're looking at is some of the issues we're just running out of space when we're just sort of based around | 00:27:30
space is the main thing and we really don't have an entrance to the Sheriff's Office. This will allow that to happen at that time. | 00:27:35
So what we are proposing. | 00:27:41
Not going in great detail, but just keep it generic in terms of that. | 00:27:47
Of managing that space and that's what we're kind of proposing tonight along with parking lot that's out front and working with | 00:27:51
the building authority in terms of that because they oversee the parking lot and we've talked, we had a couple discussions. | 00:27:57
Anyways, regardless of how the parking lot is laid out and what the future of that looks like as well, they've been requesting the | 00:28:04
judges before and some other folks of how we manage the parking space in the basement. It's basically mechanical storage. | 00:28:10
So here's the first floor, kind of a rendering of what they would be. This is the current lobby. | 00:28:17
That we house currently, so that would almost stay the same, but in terms of. | 00:28:24
What we're looking at, you can see kind of what we were thinking at that point in time. Another aspect of what we don't have a lot | 00:28:31
of space of is attorney-client rooms. | 00:28:36
So we're really managing that right now, but it's don't have a lot of space. | 00:28:40
Also talked about, I spoke with some judges in reference to Zooming. So whatever you all decide down the road, which I know it's a | 00:28:44
couple years potentially down the road, but we still need to plan for while we have the opportunity of possible zoom cases. So | 00:28:52
we're taking that into consideration as well. But you can see a rendering of that first floor lobby right there. We'll make sure. | 00:28:59
I got that correct. Yeah, it looks like yes. | 00:29:07
So the next slide is the second floor administration, but it's technically currently where our administrative offices are. | 00:29:10
We'll move them down where the current city police administrative offices are and you can see how we manage those different | 00:29:16
offices that we have there on the 2nd floor. We would bring our training room back down the hall along with our detective division | 00:29:21
that would manage that whole space. | 00:29:25
And then so that's in a nutshell, that's kind of the proposal. | 00:29:32
I know there's been some discussions back and forth in terms of what hospital could go there over the years. | 00:29:36
We really need to start planning for that space. | 00:30:12
40. | 00:30:15 | |
OK, open that. | 00:30:19
For any questions, well, just a comment and maybe a question as well. I know there was discussion about maybe EMA down there. | 00:30:21
But you know, just my working with them in the past several years, you know, I think they need to be away from a building like | 00:30:28
that for several reasons #1. | 00:30:34
They also have their emergency operations center. | 00:30:40
And I know when they were up at the Rice building, they had their had a large room for that in the event of an emergency. | 00:30:43
And like during Covet four years ago, we used our DLC down here. So I don't think there's enough room for Emas office as well As | 00:30:49
for the conference room. And on top of that, when it's being used parking, your parking is limited down there. So you mean, you | 00:30:55
know, they've got meetings and you know, for them to have ample parking, it's it's going to be, it's going to be an issue, you | 00:31:02
know, but first, I think EMA needs to be. | 00:31:08
Not in the same building. And they do. I mean, if we have a catastrophe, you know, Jason's been around for a long time. He | 00:31:14
understands those command and control areas. You know, that could be, you know, down there. That wouldn't be a place for him, | 00:31:19
station or command, depending on what's going on. If we have a major tornado just like Henryville comes through. | 00:31:24
You know those different options with that as well we can talk about as well. I spoke with the processor's office. He has no, no | 00:31:29
intent on wanting to come to that building. You have the city Police Department on one corner, you have us on the other. And | 00:31:34
that's a good fit for that area along with the county building and on the direction that goes down the road. | 00:31:39
Well, three, there's just a lot of moving parts right now, you know, as far as what the future of Floyd County looks like, as far | 00:31:46
as what EMS looks like and all that everything looks like at some point. | 00:31:51
We've got to put people someplace and obviously big supporter of the Sheriff's Department is a member of that department for five | 00:31:58
years. So I. | 00:32:01 | |
You know, I just think that as of right now, I would like to see a few more things play out before I made that kind of commitment. | 00:32:06
The only thing I would ask with that it was having a discussion. | 00:32:13
What would go there because nothing, you know, they were going to probation there before. That makes no sense. No, it doesn't make | 00:32:16
any sense. Probation, Sheriff's Office and we have. | 00:32:20
We have things that we don't want the general public or even other officers here if we have discussions or if we have meetings or | 00:32:25
whatever that case may be. So you know why I don't I disagree with you, but also respectively, you know, I'm looking at the future | 00:32:30
as well. And when I see what I know what you're all doing in terms of how you're looking at the future, but nothing makes sense to | 00:32:35
go there, whether it's EMSEMA Cross, here's office. | 00:32:40
I mean, ideally we'd have another paying tenant in there, but that's not going to happen. I can't conceive of what type of. | 00:33:13
How that would workout, you know, another pain to it. Yeah. | 00:33:19
The city's moving out. | 00:33:24
I get so. | 00:33:27 | |
The uh. | 00:33:28 | |
I want to recommend that we table this tonight. | 00:33:31
I like the concept and I like the idea and I don't want to put you off forever. So I think we probably ought to have some sort of | 00:33:34
vote on this. But we do have an election tomorrow and. | 00:33:38
There was a guy here earlier who had an I voted stick around. So that's how I knew there was an election tomorrow. There's so | 00:33:44
there's an election tomorrow and I regardless of who wins the. | 00:33:48
The Commissioners race, I think it might be interesting for he or she to have a look at it too. | 00:33:53
Just for input, just for expertise on it and just for for other thought, but I really think. | 00:34:02
We should probably give them some direction on this before the the end of the year for sure. | 00:34:08
Funding for remodeling, have you gotten that forehead and your discussion that we need to have, could that be part of? | 00:34:13
Bond that y'all have in place, is that something that commissioners could be take out the different fund you might be able to pay | 00:34:21
for some things but not a lot so that that's another discussion to have at the same time. Yeah. And then you know, and that's | 00:34:26
going to dictate a lot then the timetable for those renovations and everything like that. But I think it makes good logical sense | 00:34:32
and they said. | 00:34:37
Gives a little bit of time. He was put this on the you'll be OK comfortable putting this on the first meeting in December. | 00:34:44
Yeah. I mean, I think it needs to be addressed this year. He needs to have some certainty. | 00:34:52
Yeah, and I'm OK to move on tonight because, I mean, I know when we had discussions a couple years ago, the previous sheriff was | 00:34:57
asking for the same thing. | 00:35:01
As far as expansion, so I don't see why there's any difference here. I mean, they need they need to grow. And at that time I was | 00:35:06
against it because we were looking at putting all of probation and county corrections down there and that's not going to happen. | 00:35:11
So, you know, I give on that. But I think this is a really a good plan, you know, for, for the expansion. So is it possible, if I | 00:35:16
may negotiate that maybe in the next meeting instead of waiting until December, we can put it on the ad agenda, we can always | 00:35:22
table it again if we're not ready. | 00:35:27
Yeah. So put it on the second meeting in November. And like I said, if, if, if we. | 00:35:34
Don't have the confidence to move forward at that point in time. We could always. | 00:35:39
We're good at tabling things. I'm still looking forward to that walkthrough with you too, so. | 00:35:43
That things OK. | 00:35:47
So look for motion to table this until second meeting in November. Motion to approve I'll second OK. | 00:35:48
You made a motion to approve to table. OK, All right. Motion is second to table. All in favour. Aye, aye. Thank you. Thanks, | 00:35:57
Steve. | 00:36:00 | |
All right, County Attorney Rick Fox. | 00:36:05
OK, we passed a resolution to buy a vac truck and in addition you have a resolution in front of you to purchase a Mccallack | 00:36:09
excavator and attachments and. | 00:36:18
With approval of this, that will take care of. | 00:36:28
The statutory approvals that we need in order to purchase the equipment and then. | 00:36:35
I will follow up after you approve the resolution. | 00:36:40
With documents associated with. | 00:36:44
Paying the purchase of the equipment off. Just to clarify, this is not. | 00:36:49
And additional expenditure, this was already bundled together with that previous. That is correct, yeah. | 00:36:56
OK, so motion to approve. Make a motion to approve Floyd County Resolution 20/24/19 Resolution to purchase a Mechaleck excavator | 00:37:01
and the attachments. | 00:37:06
And I will gladly second it. | 00:37:12
OK. The motion is second all in favor, aye? | 00:37:14
It's a hard word to say. Mecalac. It's Meccalecca. Hi Mekahini ho. If you're Pee Wee Herman fan, so does Makalak as opposed to | 00:37:19
Mccallac. | 00:37:24 | |
Sounds a lot like. | 00:37:29
Mick Cadillac, Yeah. | 00:37:31
Yeah, there you go. | 00:37:34
All right. And then the accompanying item on that in terms of the financing documents, it calls for 20 payments of 40 thousand | 00:37:39
4/06/80. | 00:37:46 | |
And the first due date is January 1 of 2025 and every six months is a payment is due through July 1 of 2034. | 00:37:54
All right. | 00:38:09 | |
A lot of 6. | 00:38:12 | |
Yeah, we've already allocated your earmarked with those funds are coming from and discuss those previously. So look for a motion | 00:38:16
to motion tip room. I'll say OK, all in favour aye, aye. | 00:38:21
All right, board and committee reports. | 00:38:27
John. | 00:38:31 | |
OK on Monday, October 21st attended the full J Rack board meeting at noon. | 00:38:35
The next day on the 22nd and met with. | 00:38:42
Luby and myself, Susanna and. | 00:38:45
Michelle to review our 2024. | 00:38:48
Usage later that day at the end of the Joint County Council meeting on Thursday, attended the Kipton meeting by Zoom, and later | 00:38:51
that night I attended the Highlander Fire District meeting at the Lafayette Fire Station. | 00:38:58
And then last Wednesday we attended the. | 00:39:05
Continue to. | 00:39:08 | |
Negotiate with the Teamsters for a contract for 2025. | 00:39:10
6th and 7th so OK. | 00:39:14
Likewise, John, on the October 15th and 20th, we have had meetings with the negotiation committee with this collective bargaining | 00:39:17
unit for the Floyd County road workers and those negotiations are ongoing. And then October 22nd, we had the Joint Commissioner | 00:39:23
Council meeting where we talked about several items including the Chase Bank purchase building in the new Health department | 00:39:28
building. | 00:39:34 | |
Very good. That's it. | 00:39:41
Gentlemen, my my dog ate my list. | 00:39:43
So couldn't be a past. | 00:39:46
Sounds like I was busy at least a couple things, you guys. | 00:39:51
So I. | 00:39:53 | |
Any government officials tonight with any comments? Yes, Judge. | 00:39:55
Well, I didn't realize the sheriff was going to be speaking tonight on the issue of the. | 00:40:04
Space in the NAPD space. But I just wanted to reiterate just because there were a couple things that I had been raising with him | 00:40:09
that I thought were important and. | 00:40:16
And unbeknownst to me, he was going to be coming to talk to you. So just happens to work out. I don't know that I'll be at the | 00:40:24
next meeting. So I wanted to kind of let you know on a couple of issues. Number one, in talking with Sherry and I've been working | 00:40:29
together because the jail is. | 00:40:35
Verging on full. | 00:40:43
We've got, what, 350 people today? | 00:40:46
That's about 100 up on a regular basis from where we were a couple years ago. | 00:40:49
But one of the things that we want to do to keep things moving is being able to have the lawyers meeting with their clients. And | 00:40:55
now not only lawyers, but there are a lot of other programs and things going on in the jail, which we're finding to be very | 00:41:03
successful in terms of our jail transition coordinator system of care is in there meeting with people, mental health. | 00:41:12
Meetings, so these are the kind of things that really didn't happen before so much and with more defendants that's more lawyer | 00:41:21
meeting. So essentially we're having a space issue with the rooms available. These are the same rooms that they used for the Zoom | 00:41:28
meetings as my understanding. I think or to some degree they kind of use them for multiple purposes. But there's also Zoom | 00:41:35
hearings that are conducted for not only the federal inmates but also for. | 00:41:42
The inmates or other courts that they have other courts that they're in our jail, but they have other. | 00:41:49
Court proceedings, they have to go to or even in our court sometimes if they're belligerent and they won't cooperate and come up | 00:41:54
to court. | 00:41:57 | |
Another thing that you know that I was thinking about in the talk with the other judges as far as planning for going forward would | 00:42:01
be the benefit of the the availability of Zoom conferencing for any sort of temporary location. If we had to do that, there would | 00:42:07
be the ability we would need. | 00:42:13
In this, if we have to move is what I'm talking about now that's a little bit down the road, but again in planning for that. | 00:42:19
So these are all the same purposes for these rooms that really they don't have. And so I would second the idea that that's | 00:42:26
something that would be extremely beneficial not only to the sheriff but also to the courts for moving court cases forward and | 00:42:32
through more quickly. | 00:42:39
That's the primary thing. Also, the core team, I just want to put a shout out there, they do a phenomenal job for records and our | 00:42:47
protection and they're currently on the 3rd floor after New Albany moved out and that's been very convenient. | 00:42:54
Of course, but you know, there they have to be nearby, so it's another space issue. So just from the courts perspective, the | 00:43:03
parking's been great. They accommodated our request. The sheriff did when New Albany moved out so we could move our parking to a | 00:43:07
little bit closer. | 00:43:12
Or just more safe location there? There are there is very limited parking. I think we still need a spot there for the public, the | 00:43:19
chief public defender who doesn't have a spot there who should, but that's a really critical thing in safety there. So I | 00:43:25
appreciate his consciousness of that and continuing to make sure we have that. | 00:43:31
Thank you. | 00:43:38 | |
And we're going to have time for public comment, but I want to before I forget, I need approval of the Commissioners meetings | 00:43:40
minutes for October 15, 2024. Motion to approve. I'll second all in favor. Aye aye. | 00:43:46
And approval of payroll and claims. | 00:43:52
Motion to approve. I'll second. OK, all in favor, aye. | 00:43:55
And we did have a storm water meeting at 4:30 today and our next meeting will be Monday, November 19th, 2024 at 6:00 PM. So public | 00:43:59
comment tonight. | 00:44:04
Yes, please. | 00:44:10 | |
Oh yeah, and I'm reading what was put in front of me. | 00:44:16
Sorry, Tuesday, November 19th, 2024 at 6:00 PM. | 00:44:19
Georgetown Township. | 00:44:26
Either the meetings gone real long or somebody hasn't put that back in. | 00:44:28
Haven't you heard? The county has decided not to honor the fall back just like Halloween. We're just but the city is going to, so | 00:44:33
it'll all be fine. That's a joke. And the meetings make sure that that is not part of the record. Al, sorry. | 00:44:43
And there was voluminous laughter. | 00:44:52
I wanted to bring some, I wanted to bring something up and I'm just asking you to consider it. | 00:44:58
Don't need or even desire response right now, I just want you to think over something. | 00:45:05
I raised the issue slightly before, but. | 00:45:11
We are a democracy and we are republican women democracy because otherwise we'd referendum everything. | 00:45:15
You gentlemen in the Council. | 00:45:21
The elected officials are, as you know, hired to speak for us, to represent our interests and basically needs to say they work for | 00:45:24
the taxpayers and the citizens. But. | 00:45:30
And once their employees. But you know your duties and you have to listen to the public take some input before you make your | 00:45:37
decisions. | 00:45:41 | |
I have a. | 00:45:46 | |
I have two things I'd like you to consider. | 00:45:48
One is to allow other than just for special meetings and hearings. | 00:45:51
Consider allowing public input before you vote on some items. | 00:45:57
Some of the things mundane, but there's other things that people are here for and they don't get to express. | 00:46:05
There it has to come out and express their opinions about it. The public comment at the end of the meeting when it's too late. | 00:46:10
The other thing I want to do to consider is. | 00:46:17
I've been coming here for over 12 years. Is. | 00:46:21
And Steve knows I've been. | 00:46:24
Applying the white men and other things for a long time, but recently the board has changed its policy from public comments and | 00:46:26
questions to just public comments. And I know sometimes you allow questions, but a lot of times you don't and. | 00:46:35
I think that it's important for transparency and participation. | 00:46:44
That the public ought to be allowed to ask questions. | 00:46:49
How can we participate in the process? If we're not allowed input until after the votes and it's too late, how can we be informed? | 00:46:53
About what just happened, or what's going to happen if we're not allowed to ask questions of something we've just witnessed being | 00:47:03
done. Votes or actions or comments? | 00:47:07
People come here to observe and learn and participate, but I think. | 00:47:13
Those. | 00:47:19 | |
Opportunities are diminished greatly when we're not allowed any input before a vote and we're not allowed to ask questions yet at | 00:47:21
the end of the meeting to figure out what this went on. So I'd like you to consider both of those. | 00:47:27
Concepts, whatever. And you know, maybe we'll talk about it next meeting. | 00:47:35
OK. Thank you. | 00:47:39
Yeah, I'm happy to comment on that. In the moment. I don't know, we're actually in a little bit early tonight, but I. | 00:47:42
You know, other boards have very very rigid. | 00:47:50
Procedures for for, for that type of thing. Some don't allow comment at all. And when I was president of the City Council, we had | 00:47:55
sign in sheets for the beginning. And I'm willing to do that if I get a feeling or consensus that that's what people want. But if | 00:48:01
we do that. | 00:48:07 | |
It does. | 00:48:15 | |
You know, when I came over here, there was another custom and tradition that was in place and I've kind of followed that and | 00:48:16
honored it. But the format would roughly be and I've looked for comment between now and the next meeting on this. | 00:48:22
You could sign up to speak. | 00:48:29
What you had to say, what you were going to speak for on the agenda and anything that was not on the agenda was a non agenda item. | 00:48:31
And I think we'd even talked about that a few meetings back, but for one reason or another, we just didn't push through on it. So | 00:48:40
I'm more than willing to contemplate and put something like that into place. The question part of thing becomes a little bit | 00:48:45
different because. | 00:48:50
We don't always have the answers to the questions and some people are not comfortable saying that. I'm not prepared to comment or | 00:48:57
answer that at this point in time. There's another issue with some folks who come to these meetings. | 00:49:03
Want to come to the meeting, they would like to leave. So my personal policy has always been I'll stick around after this and | 00:49:10
answer any questions that you might have about anything pertaining to the agenda or not. And I think John and Jason have always | 00:49:16
been really good about that too. You don't see us running out the back corridor to do that. And I think we've always kind of taken | 00:49:22
all comers. So I would probably continue to pursue that policy rather than a public Q&A which. | 00:49:28
You know, I think a lot of that can be done more personally. | 00:49:35
And more open-ended afterwards without us having to try to prolong a meeting that goes on. I mean, when I was on the City Council, | 00:49:40
some of those meetings went for three hours and and that's so we'll probably end up. | 00:49:46
Maybe trying to meet you halfway on that with regards to a sign in sheet that would talk about what are you here to talk about, | 00:49:53
what do you want to talk about, agenda specific? | 00:49:58
And then afterwards non agenda items to do that. But I think has been pointed out in the past many boards don't have this type of | 00:50:03
back and forth to begin with and. | 00:50:08
By chapter, consensus, statute, whatever it is, it's really not designed to be AQ and A here. | 00:50:14
In the middle of a formal meeting, but the Q&A should exist between employer and employee really in an open-ended fashion. And I | 00:50:22
have people stopping at Kroger yesterday. That's great. I mean, you know, and I had multiple emails from other people throughout | 00:50:30
the day. So there are lots of ways to to contact us about, hey, what just happened or what not that I think can be handled. | 00:50:38
Privately. To your point though, I agree maybe getting some input from you if you came to speak on something beforehand I'm. | 00:50:47
I'm open to that. Ultimately, it's kind of up to the discretion of. | 00:50:55
Folks up here and I don't want to trap anybody who will be sitting in this chair next week, you know, with my tradition or | 00:50:59
something like that. But I'm, I'm open to it. | 00:51:03
I appreciate your comments as well. I was asking you consider talking like. | 00:51:08
First thing for his input. I've been to the council meetings and been to school board meetings. It is only fair that they put in | 00:51:12
an agenda item because otherwise you can wait till the end of the meeting. So I I agree with that you sign in, it should be on an | 00:51:17
agenda item. | 00:51:22 | |
The only exception being something's added to the agenda that the public is not aware of the as far as the questions and answers. | 00:51:28
I understand some boards are more rigid. I've seen that planning board. Former planning board here. That was. | 00:51:35
Titus and Drum and all of that. It was very almost hostile to public input, but. | 00:51:45
With the questions, somebody doesn't understand what the vote just meant. I'm not throwing people lining up for a ******** | 00:51:52
session. Excuse my language. I'm talking about a legitimate question about what just happened if you answer that publicly. | 00:51:59
Then somebody doesn't have to explain the rest of the people in the hallway. I've had people buttonhole me asking what just went | 00:52:07
on, and I have to give my best guess. So that's right. So I'm just considering and limiting it to what's been discussed, not come | 00:52:12
up and say, hey, how come you let your dog go on my lawn? You know, irrelevant stuff. So that's why the reason I brought it up is | 00:52:18
because one question answered here. | 00:52:24
Can save 100 people trying to figure out what civic groups are with you guys and you know out of away from the meeting what | 00:52:30
happened yeah and I understand where you're coming from that's where I am on the Q&A at this moment in time but I'm one of three | 00:52:35
so I mean I don't know whether you. | 00:52:40
John or Jason have any? | 00:52:45
Would there be any issue with us? | 00:52:48
Having people sign in with regards to a discussion on some of the agenda items, no, I think this is, I think that would be great. | 00:52:51
I think this is exactly the format that you would want to have that transparency and that discussion, especially in regard to | 00:52:56
something that's going to be on the agenda. It's not like me being here in front of the commissioners having a direct | 00:53:02
conversation. It's not like hiding on the Internet behind a fake screen name, putting out bad information. | 00:53:07
And I think to be reasonable, not a lot. A bunch of repeaters coming up. If somebody just like you do with the crowded meetings, | 00:53:14
if someone brings up concerns and you say how many other people feel their way. | 00:53:22
There's there's ways to procedurally handle that. Yeah, I'm fine with that. I think one time I think we did that. We did that, we | 00:53:30
did that. | 00:53:34 | |
Milestone type of votes we we've tried to allow that, but I don't think problem codifying that though. | 00:53:40
Considered because it does make it more meaningful and I know some people that have been here would like to have spoken you can | 00:53:46
tell when it's a NIMBY issue when you get that many seats though but then later there'll be you know the express frustration and I | 00:53:52
think I like your thinking on that particular issue yeah it's a reasonable approach I will say that I don't think anybody's ever | 00:53:58
had trouble getting a hold of any of us before a boat but on on an issue at least I've not heard of that believe me I get plenty | 00:54:04
of phone calls and. | 00:54:10
People that aren't aware of the. | 00:54:16
That the particularly as you fax them until it's just prior to the meeting. I read people ask me about zoning things and I say | 00:54:19
that's the bridge down the street from you now. OK, you know that's what I'm saying. Not everybody. | 00:54:25
Not everybody that's interested is is prepared beforehand, that's all. | 00:54:32
Fair enough? Yeah. Any other public comment this evening? | 00:54:37
If not, I'll look for a motion all right. | 00:54:41
All right. Thank you all. Go vote. | 00:54:44
Tomorrow. | 00:54:47 |

Go vote. | 00:54:44
Tomorrow. | 00:54:47 |
