It's already set up. | 00:00:00
OK. Appreciate you coming out to the meeting tonight. We have a full agenda. We'll have some time for public comment afterwards. | 00:00:03
You will please stand and join me with Pledge of Allegiance. | 00:00:08
I pledge allegiance to the flag of the United States of America and to the Republic for which it stands, one nation under God, | 00:00:15
indivisible, with liberty and justice for all. | 00:00:21
All right, all right, let's take a moment for individual. | 00:00:28
Silent thought, prayer, meditation, kind of focus for the meeting ahead tonight. | 00:00:37
All right. Thank you. | 00:00:57
See mainly regulars tonight. I think everybody's been really good with the cell phones so we'll. | 00:00:59
Pass on that part of the lecture tonight so we have a new business before us tonight. | 00:01:04
Rick Fox has a few different items we'll be starting with. | 00:01:12
A-team's member joining us Mr. Brad Bingham. So Rick, if you wanna take it away. | 00:01:15
Thank you. We have before us a resolution of the Board of Commissioners of Floyd County. | 00:01:24
Receiving and approving the petition of taxpayers requesting the leasing of a new county government center. | 00:01:31
And approving a farm of proposed lease and taking other actions related thereto. We have Brad Bingham with us and I'm going to | 00:01:39
pass the torch to Brad to tell us what we have here, educate us as part of the process and and how we get from beginning to end. | 00:01:48
Absolutely. Can everybody hear me? OK? Just want to double check. | 00:01:59
Yes. | 00:02:02 | |
OK, perfect. As Rick mentioned, this is the first sort of step in the legal process to provide the financing for the county's | 00:02:04
acquisition of what we all call the Chase building and for certain improvements and renovations, at least the the first phase, | 00:02:10
this financing we're structuring as a as a lease rental financing. And you may be asking well, what's the purpose of that you'll | 00:02:16
almost always find. | 00:02:23
Counties and other municipalities doing a lease financing for larger capital projects. | 00:02:30
And that's because of the constitutional and statutory debt limit that you're faced with. So anytime you have a, you know, long | 00:02:35
term kind of borrowing, we try to flip it and structure it as as a lease financing. When you do that, you actually the county goes | 00:02:41
and sets up a separate non profit building corporation, which has already been done. And then that entity essentially acts as the | 00:02:47
the borrower of the funds, constructs the asset or purchases the property and then leases it back to the to the county at the end | 00:02:53
of the financing. | 00:02:59
State law, as well as the lease itself, requires that the property and piece of ownership revert back to the county. It's just a | 00:03:05
technique we use again for debt limit purposes. And you may say, well, you know, how is it not that? And the reason for that is | 00:03:12
that Indiana courts have long said that lease obligations are really current expenditures. And the lease itself is what we call an | 00:03:20
abatement lease, so that if the property were ever damaged or destroyed, the county's obligation to pay rent would be abated. | 00:03:27
You wouldn't know anything. And so it's for that contingency reason that it's not it's not indebtedness. So really tonight starts | 00:03:35
the process and the way it just a quick overview, the way it works is Board of Commissioners, you'll approve a form of the lease | 00:03:41
agreement itself which I think Rick has distributed to you all there. There's a building corporation meeting this Thursday | 00:03:47
morning. They will also be presented with the form of this lease that we would expect them to approve it as well. It would then be | 00:03:53
set before. | 00:03:59 | |
The County Council, they're coming next meeting next Tuesday for the fiscal bodies approval and then it comes back to the | 00:04:05
commissioners for a public hearing and a confirmation on September 17th. At that point in time the lease could be signed between | 00:04:11
the county and the building Corp and then we have to publish a notice of lease execution which which triggers a 30 day period for | 00:04:17
review if anyone would request that. | 00:04:23
And so the long and short of it is we start the process tonight. If all goes according to plan, we would be able to close in the | 00:04:30
financing toward the end of end of October. | 00:04:35
Done. This resolution acknowledges that and accepts that that request. It also proves the financing via this this this lease | 00:05:10
structure with the term of the lease will not exceed 30 years. Obviously can be much shorter than that, but that's the maximum and | 00:05:18
the annual lease rental payment cannot exceed 1,461,000 Again, that's the maximum once you know your actual. | 00:05:26
Debt service schedule When you do your permit financing, we we adjust that we we true it up downward to to reflect what the actual | 00:05:35
rent would be owed. | 00:05:39
It also acknowledges the building corporation has been formed on behalf of the county. | 00:05:45
You would approve that there they exist. You ratify their articles for corporation and and their code of bylaws. | 00:05:50
Authorized the issuance of bonds, maximum principal amount not to exceed 12,500,000 and pending the issuance of the bonds, it also | 00:05:59
authorizes the issuance of bond anticipation notes with the maximum amount of $10,500,000. | 00:06:07
At at the end of the financing, as I kind of mentioned earlier, this this acknowledges that the county will accept these simple | 00:06:16
ownership of the property once once all the indebtedness goes away the the building Corp essentially at that point its purpose is | 00:06:20
fulfilled. | 00:06:25 | |
Transverse title to the county. | 00:06:30
We are, we are anticipating this the financial structure structured as a bond anticipation note. And the reason for that is, is | 00:06:33
sort of twofold 1 is a. | 00:06:38
Because as it stands, there's, there's currently certain tenants in that property that have different rights in terms of renewals | 00:06:44
and when they'll. So we don't really know when everyone's going to be vacated. | 00:06:49
And so and I mentioned that only because when we do bonds for counties, municipalities, you know you prefer to issue those on tax | 00:06:56
exempt basis, that's usually the lowest cost of funds. That's the best scenario. But when you have taxes and financing, you can't | 00:07:01
have private business use and private payment of the bond finance property. And so as it stands right now we're not quite clear | 00:07:07
out of the whole building how much will be governmental use versus versus private use. So over time you'll have a better picture | 00:07:13
of how that. | 00:07:19 | |
Look, let's say in two years or three years when you want to do your permanent financing. The other reason for a bond anticipation | 00:07:26
note is that your community capital fund rate is not its current maximum. And I think in talking to Rick, there's, there's some, | 00:07:32
you know, prospect and thinking that it will be increased to the statutory maximum, but it's not current. Well, when in terms of | 00:07:38
size and the bond issue, you have to kind of look at the facts as they are right now. You can't just assume a way that that rate | 00:07:44
will automatically increase. | 00:07:50
And so that, that presents a little bit of a challenge to doing a long term financing today. So the band will allow time for that | 00:07:56
kind of work itself out. And then also in the meantime, you just have assessed value. So as assessed value grows, the Q cap fund | 00:08:02
rate applied to the AV produces a higher amount of revenue. So that's another reason that would kind of give pause to do the | 00:08:08
permit financing now. | 00:08:15
When you don't necessarily have to. | 00:08:22
I've said a lot. So I'm going to pause right there and and turn it over to that the board pretty questions you may have. | 00:08:25
Now, thank you, Brad. I've had a lot of my questions answered. | 00:08:35
Over the last 72 hours on this, you know, we're talking about potential maximums here and it sounds like we're going to come back | 00:08:40
from those numbers. I think for the record, can you? | 00:08:44
State the members of the Building Corporation board. | 00:08:49
Yes, we have Todd Rosenbaum. | 00:08:54
We have Bill White and we have Tom Jones. | 00:08:58
I just wanted that. | 00:09:02
On record. | 00:09:04 | |
So people don't have to tease that out of the resolution. | 00:09:05
Any questions for Brad? | 00:09:13
I'm good. Thank you for your availability, particularly over. | 00:09:15
Labor Day weekend and even Labor Day, both of you guys. | 00:09:21
My questions No, no calendar so. | 00:09:25
Apologies. Retroactively. Absolutely. | 00:09:29
Make a motion that we approve resolution Floyd County Ordinance 2024 Dash 14. | 00:09:34
A second motion to second. All in favor, aye? | 00:09:40
Right then and then all we're signing is the resolution, Brad, in terms of the. | 00:09:46
The the lease itself that is just a the farm and so that requires no signatures at this point that will take place after the we | 00:09:52
have the hearing on the 17th. | 00:09:58
That's absolutely correct. Correct. And and I've got um. | 00:10:05
One of the building corporation members who's already responded that they can be here on the 17th for a meeting if we had run into | 00:10:10
a a quorum problem. I'll work on the next day for the building. | 00:10:19
Corporations so that we can go ahead and get it immediate approval from them. | 00:10:28
Yeah. And Rick, just on that note, so, so at this Thursday's meeting of the Building Corp, we will ask them to approve the formula | 00:10:34
lease and the authorize the execution subject to the Board of Commissioners giving having a holding a public hearing given their | 00:10:39
final approval. So we really don't need another meeting of the building corporation on the 17th. We we can simply have them sign | 00:10:45
it and a lot of times we'll get them signed the the lease and hold their signature pages in advance on on the assumption that the | 00:10:51
the the public. | 00:10:57
Will approve the lease and then we'd have the Commissioner sign it on the 17th. So we can work on that in advance, Rick, But we | 00:11:03
really don't need to have another building corporation meeting on the 17th, OK? So we don't need any further action on lease | 00:11:08
agreement item B, OK. | 00:11:13
Brad, you're welcome to hang out and, you know, virtually and listen about our door to door solicitation ordinance or we can let | 00:11:21
you go. | 00:11:25 | |
I will gladly step out, but I appreciate the offer. All right. Thank you for for your availability tonight. Thank you. Thank you, | 00:11:30
Brad. Thanks everybody. Take care. Bye. Bye. | 00:11:34
All right, Next up is the door to door solicitation ordinance. | 00:11:42
I. | 00:11:48 | |
I think I've got it right here, OK. | 00:11:54
All righty. We have a door to door solicitation ordinance. We recently passed one, but we've made some modifications to it. | 00:12:15
Basically in terms of the jurisdiction of solicitation, we deleted a redundant penalty. We added an identification card fee. | 00:12:24
Added harassing conduct and defined harassing conduct as a reason to revoke a license. | 00:12:35
And we I. | 00:12:42 | |
Added that a report from a complaint would not be provided if the complainant requested that their complaint not be provided to | 00:12:45
the the company that was doing the solicitation. | 00:12:52
The ordinance itself just to review a. | 00:13:10
Is an application for a non transferable door to door solicitation license that would come from the Floyd County Commissioners? | 00:13:16
If they were soliciting to sell any type of food or beverage, then that matter would be referred to the Floyd County Health | 00:13:26
Department for their review. | 00:13:31
They would be required to fill out vendor application form. There's a whole litany of general information that they're going to | 00:13:38
need to complete. We're going to know want to know a lot about the company and what they're doing here in our county. We're also | 00:13:45
going to want to know a lot about the individuals that are going door to door here in our county. And so we're going to require | 00:13:52
that they provide us a valid government issued photo ID. | 00:13:59
An assigned release so our Sheriff's Department can run a nationwide criminal history check on these individuals. | 00:14:07
We're going to require an application fee, a license fee, and an identification card fee. The we're going to have a 10 day license | 00:14:17
$50, a 120 day license for $150.00, and a one year license for $300. | 00:14:24
The application. | 00:14:33
Processing fee is $250 and the identification card fee is $20 per card and that's the card that they're going to have to carry | 00:14:35
with them if they're going door to door here in the county. | 00:14:41
We've restricted the times that they can go door to door. | 00:14:52
From October one through April 30th only between 10:00 AM and 6:00 PM of any day. From May 1 through September 30th, between 10:00 | 00:14:58
AM and 8:00 PM of any day. | 00:15:05
It's unlawful to solicit on posted premises, so if individuals have no soliciting here in front of their house, then you can't go | 00:15:13
there. And it's also unlawful to solicit without a permit. | 00:15:21
In terms of penalties, if we have somebody that's, for example, soliciting without a permit. | 00:15:32
They they can be subject to a fine of $100 for each separate offense, up to $1000 a day. So if they've gone to 10 houses or more | 00:15:38
in a day without a permit, then that could potentially be a fine up to $1000. | 00:15:48
And. | 00:15:58 | |
That is the outline of the ordinance we're asking you to pass. | 00:16:01
Rick got a question soon that this will if we approve that, that we need to advertise this in the newspaper because of the fines | 00:16:11
and all that we will population in the newspaper. | 00:16:17
Good deal. | 00:16:24 | |
OK. I'll make a motion with unanimous. | 00:16:26
Consent to pass to approve Floyd County ordinance 20/24/23 an ordinance governing commercial book door to door solicitation in | 00:16:29
Floyd County, Indiana and I'll second there's a motion and 2nd. | 00:16:36
Any further discussion? | 00:16:45
I'll just say that as much as anything I've been involved with, this comes from. | 00:16:48
Request from. | 00:16:53
Property owners who really instigated us pushing this forward so I. | 00:16:55
It's just, you know, a nice example of. | 00:17:02
Of. | 00:17:06 | |
Property owners kind of speaking up and. | 00:17:08
And getting some things done. I wasn't aware of this. I hadn't had anybody knocking out my. | 00:17:10
Door. I guess I don't like a real friendly household to knock on or something like that, but multiple neighbors have and we've | 00:17:15
already been. | 00:17:19
Thanked a couple times for ratcheting this up so. | 00:17:23
Sheriff, you had more time to think about this and he. | 00:17:28
Further thought on it, I mean does this make your life easier, more difficult? I've been working with Mr. Fox in terms of | 00:17:31
enforcement and how that procedure looks once someone gets cited. So I think we're working that out. So it shouldn't be a problem. | 00:17:37
Anything filed with the clerks office they need to was asking me that question. | 00:17:43
Everything runs through the Commission's office of Imagine. | 00:17:50
Yes, everything will run in terms of citations will run through me. | 00:17:54
And then I will be filing that with the clerk's office and having it set on the court calendar. That's operationally what we're | 00:17:59
going to need to work on with regards to the Sheriff's Department. | 00:18:05
Suzanne and I operation, they're going to need to get together and go through the ordinance. I've already drafted what the | 00:18:12
application would look like for the corporation and the individual applications we're going to need to. | 00:18:20
Put and the ID that we're going to have, we're going to need to formulate that and be prepared to be printing those for | 00:18:30
individuals as well as operationally we're going to need to work out. | 00:18:37
What we need in terms of the release for you all to be able to do the search with regards to any sort of criminality associated | 00:18:45
with those individuals. | 00:18:50
Versus E tickets on our computer systems, we can work that out, correct? | 00:18:56
So how much time do you think it'll take to? | 00:19:01
Get all that up and running. I would say two weeks where we have to publish within two weeks. It's it's my intention to have | 00:19:05
everything operational as soon as the ordinance becomes effective, after the two week publication period. | 00:19:12
Further. | 00:19:21 | |
Good. I have a motion a second. All in favor. Aye, aye. | 00:19:22
Thank you. | 00:19:27 | |
The next item is an ordinance establishing a procedure to replace an appointed Fire Protection district trustee. We've established | 00:19:31
the New Albany Township Fire District, the Georgetown Township Fire District and then the Highlander Fire District. | 00:19:40
And with regards to those ordinances? | 00:19:50
There was number provision in those ordinances in terms of replacing a trustee. | 00:19:56
So that's what this ordinance does. I'll just read what you're approving, be it ordained at the Floyd County Board of | 00:20:04
Commissioners, may replace an appointed trustee of the New Albany Township Fire Protection District, the Georgetown Township Fire | 00:20:10
Protection Protection District, or the Highlander Fire Protection District at their discretion, only upon a unanimous vote of the | 00:20:16
Floyd County Commissioners. | 00:20:23
That basically is an ordinance that. | 00:20:31
Shows that the individuals serving on those boards are serving at the pleasure of the commissioners, at the discretion of the | 00:20:36
commissioners, and the protection to the original appointments is that it takes a unanimous vote from the commissioners to replace | 00:20:41
them. | 00:20:47 | |
All right. Any further questions for Mr. Fox or discussion? | 00:20:57
Now I'll look for a motion to approve. | 00:21:03
I'll make a motion to approve with unanimous consent. Floyd County Ordinance 2020, 24-24 Procedure to replace an appointed Fire | 00:21:06
Protection District trustee. | 00:21:10
I'll second have a motion and a second all in favor. Aye aye. | 00:21:16
Aye as well, all right. | 00:21:21
Thank you. And thank you, Mr. Fox. That's your part of the show tonight, County Engineer Horatio Yuri Kit. | 00:21:23
You need to get your own music for when you're walking from all the way back there to here. | 00:21:39
Good evening. | 00:21:47
I'm here to Cresenti or the change order for the project after with a Buffalo trail paving. | 00:21:52
There were some iron. | 00:22:01
Require a little bit more pavement and some others less than those that the big ticket they well, not the big ticket, but. | 00:22:03
The higher price there was too high. | 00:22:11
Fix all the sections where they install the. | 00:22:15
The sanitary sewer line that they didn't repair the road properly. | 00:22:20
And you can see that at the bottom where you say patching utility trench. | 00:22:25
Arthur Wooden Buffalo thread. | 00:22:29
About $29,000. | 00:22:32
So. | 00:22:36 | |
Need a motion to? | 00:22:38
Approved. Yeah, we'll do these separately. I Don could not be here, but the discussion with with Don about these in advance, there | 00:22:40
is funding on hand to to cover these. | 00:22:47
So which is always important. | 00:22:54
To know of but hope for a motion to approve that change order on also wooden Buffalo trail so move. | 00:22:56
Second motion is second all in favor, aye. | 00:23:03
And the other change order that I have is for the community crossing. | 00:23:09
2023 second round. | 00:23:15
Where there were 12346 roadway were paid. | 00:23:19
And some of those the quantities were below. | 00:23:28
That was estimated and some other women. | 00:23:33
Above but the big surprise there, which I was expecting that to be. | 00:23:37
I totally bike because it is so difficult. | 00:23:43
To get a good information. | 00:23:48
They only fight regarding the width of the road. | 00:23:52
And that's what determine the amount of. | 00:23:55
As for, that is required to play the role. | 00:23:58
And on that one, there was, there was also. | 00:24:02
Painting the road. | 00:24:08
Thermoplastic. | 00:24:11
It looks really good. | 00:24:13
Good comments. People are calling and. | 00:24:17
Thank you the county for. | 00:24:20
The work there was not on Peoria Pike. | 00:24:23
And that changed. Water was increased by. | 00:24:25
$62,000. | 00:24:31 | |
One AI need a motion to approve. | 00:24:34
And all those roads have been painted already. | 00:24:38
And everyone, everybody is enjoying the. | 00:24:42
New baby. Yeah, just for clarification, 62,000 close to $300.00 for the entire listing, not just for paleo pipe. Yes, Paleo pipe | 00:24:46
was the most significant, probably 22,000. Pearly Pike was only 40, right? | 00:24:53
Motion Motion to approve Change Order number one for the. | 00:25:03
Rd. paving 2023 for Community Crossing second round. | 00:25:07
I'll second. | 00:25:11 | |
Motion second. All in favor, aye. | 00:25:12
Thank you very much. Thank you. | 00:25:17
Have a good evening. | 00:25:20
All right, Director of Building and Development, Mr. Nick Preview. | 00:25:22
All right, good evening, the creepy director Building and development. | 00:25:29
Have a few items for you tonight? | 00:25:32
1st is. | 00:25:35 | |
The announcement of a Safe Streets for All Safety committee. | 00:25:38
This was part of a grant that we are Co applicants on with Kipta, the regional development organization for transportation | 00:25:43
projects. | 00:25:47 | |
It required it's a planning grant for safe streets. | 00:25:54
It's a requirement to get access to implementation funds. There's currently $3 billion remaining of implementation funds that's | 00:26:00
available. | 00:26:04 | |
Nationwide. So this is the first step of that. | 00:26:11
On that safety committee. | 00:26:15
With your house help, we identified the County Sheriff, County EMA Director, County Engineer, Highlander Fire, Georgetown Fire, | 00:26:18
New Albany Township Fire and School Corporation Representative representatives from Georgetown and Greenville. | 00:26:26
So we're just kind of formally announcing that that committee. | 00:26:35
Formed and putting it into minutes and I don't know. | 00:26:39
We need a resolution for that. | 00:26:43
That was not requested from the consultant, so if we need to go back and do that, we'll do that. | 00:26:45
We did have our first meeting on August 26th. | 00:26:51
And had some good comments for that. | 00:26:54
There will be a couple more meetings during the planned development process and then hopefully we'll have a plan by the end of | 00:26:57
spring and hopefully get some some implementation funds for some road work. | 00:27:03
Safety projects that we can do it throughout the. | 00:27:10
You had one meeting already, So what? | 00:27:13
1-2 or three ideas that were kicked around in the. | 00:27:17
Well, I think a lot of discussion were. | 00:27:20
So our consultants provided us some crash data from around the county. | 00:27:23
It's kind of preliminary. We wanted some feedback on whether that crash data seemed accurate in what we know on the ground level. | 00:27:28
And then some of the areas of concern being narrow roadways. | 00:27:38
Road striping. | 00:27:43
Signage some of those issues that we can and and and unified communication of areas of concern for for drivers, pedestrians and | 00:27:47
bicyclists more and more more drivers and pedestrians. | 00:27:54
We discussed it all, OK. | 00:28:02
Do you recall topic with the School Corporation Rep? | 00:28:05
Eric Reid. | 00:28:08 | |
I think I remember doing Director of transportation OK. | 00:28:11
All right. Thank you. | 00:28:15
So next I have a Floyd County Ordinance 2024-22 which is a zoning map amendment. | 00:28:18
The Floyd County Planning Commission provided a favorable recommendation on August 12th for the rezoning of two parcels off Tunnel | 00:28:28
Hill Rd. from residential urban to general commercial. I've prepared that movement in attachments. There are some voluntary | 00:28:35
written commitments included. | 00:28:43
Which are. | 00:28:52 | |
Attachment D. | 00:28:54
Those are it'll be part of a larger development in that area. So their commitments are to use that development, strive for access | 00:28:56
instead of another drive to Tunnel Rd. to use regional detention and to provide to perfect the 30 foot right away on Tunnel Hill | 00:29:03
Rd. | 00:29:09 | |
Just for clarification, the the change that was made to the zoning ordinance was for general commercial, which takes multifamily | 00:29:19
residential off the table. | 00:29:23
The unanimous vote. | 00:29:30
I'll make a motion to post. | 00:29:33
Yes, it was a unanimous vote. | 00:29:36
All right. Well, I'll make a motion to approve with unanimous consent, Floyd County Ordinance 2024-22, the map amendment to the | 00:29:42
Floyd County Ordinance at Tunnel Hill. | 00:29:47
2nd, the motion is second all in favor, aye? | 00:29:52
Next I have a update for the Charles Town Rd. | 00:30:02
Multi use trail. We had a pre construction meeting last Thursday for that project. | 00:30:06
It is under or going to be underway shortly. Flagging will start September 10th. Excavation is expected to start about two weeks | 00:30:14
thereafter. They expect the the contractor for this is milestone. United is the inspector strength, did the preliminary | 00:30:23
engineering and expected timeline for completion is spring. | 00:30:31
End of spring. | 00:30:41
They have more time than that, but they think they can. | 00:30:43
20/25/2025. | 00:30:45 | |
Yes, Nick, that's primarily being funded by Kipta. | 00:30:49
Correct. It's actually funded by m.its 100%. The construction is 100%. | 00:30:53
In that initially started as 8020 for the county. | 00:30:58
And then 9010 and then INDOT took the rest of it. | 00:31:04
We are we are providing a 10% match. | 00:31:09
For the inspection, but the construction is three and a half million dollar profit. | 00:31:11
Yeah, that's good. | 00:31:16
Good. Next up, I have Brookline Trail extension contract. | 00:31:18
So with all terrain paving. | 00:31:29
Ending out of $21,860. | 00:31:32
One quick quote was received for this request and it is to be paid through Caesar Foundation money. | 00:31:37
Motion to approve the. | 00:31:46
All terrain paving construction for the. | 00:31:49
Of Brookline. | 00:31:54
Trail extension. | 00:31:55
I'll second motion is second all in favor, aye. | 00:31:57
Thanks along to Caesar's foundation. | 00:32:05
You know, of course. | 00:32:07
Final item is Nova Park Labs architecture and engineering contract. This is with Tower Pinkster and it is for the IUS lab filled | 00:32:10
out at Lenovo Park the. | 00:32:16
Amount is $44,000. | 00:32:23
And that is going to be paid through tip. | 00:32:26
Motion to approve. | 00:32:30
We have a motion approval. | 00:32:33
For the Nova Park lab contract and a second all in favor, aye. | 00:32:36
50 need a signature on the. | 00:32:43
I'm at Nova Park. | 00:32:46
OK. | 00:32:48 | |
Never mind. | 00:32:51 | |
All right, item 4. Here's a demon group plan of action Building inspector didn't see. | 00:32:54
So is that something that was taken care of? | 00:33:00
By that e-mail exchange that I saw. | 00:33:04
And I met with him briefly on the on that and it didn't cut up. | 00:33:08
After that e-mail changed. So yeah, I'm not aware of what Mr. | 00:33:13
Plan to discuss, but I can provide an update to the commissioners of where we're at. | 00:33:16
As you all know, we have had. | 00:33:21
Inspector out for. | 00:33:23
About 3 months now. I'm an emergency medical situation and progressively kind of kept. | 00:33:26
Longer and longer. | 00:33:31
So we've been using our building commissioner has been kind of doing double. | 00:33:34
Plan reviews and inspections. | 00:33:39
And, you know, we're starting to, he's starting to feel the pressure of that and get further behind every time he is sick. There's | 00:33:42
no one to make up for that. So it just gets a little further behind. And I believe that's what Don Mr. Siegeman wanted to discuss. | 00:33:48
We had right reached out when this initially occurred to neighboring jurisdictions to see if we could use some of their | 00:33:55
inspectors. | 00:34:01 | |
And Commissioner Sharp reached out to Jeffersonville's commissioner and. | 00:34:08
He he's willing to assist us. | 00:34:14
However, we do have an issue with insurance. | 00:34:17
That is of some concern that. | 00:34:22
I haven't had an opportunity to to reach back out to him and see what he's willing to do. | 00:34:25
On that matter, but the concern is to have some liability. | 00:34:30
It's like a physician doing local tennis work, you know, I would think. | 00:34:39
You know, if he's gonna be doing that, we should pick up the insurance at least for the time that he's with us. But yeah, it needs | 00:34:44
to be looked into. Yeah, if that's an option, you know, I know we would love to be able to get. | 00:34:49
Make a couple extra people to help out with Kelly's. Really. | 00:34:55
Contract, yeah, he would be an independent contractor. So that's one of the things we said. You can pay him more, you could buy | 00:35:00
the insurance. | 00:35:04
With you funding that through the additional payment and then we would ask that we be named an additional insured on this policy. | 00:35:10
Are quite possibly we can talk to Glenn Smith. | 00:35:18
To see about possibly naming him as an additional insured on our policy, I think that's probably what you're going to have to end | 00:35:24
up doing just for the simple fact that if you're dealing with inspectors from other jurisdictions, they're they're protected and | 00:35:29
they're covered under the jurisdictions that they're actually serving. So asking them to come over and lend us assistance would | 00:35:34
be. | 00:35:40 | |
You know something that we're going to. | 00:35:46
Have an issue with no matter who it is that we call. Probably the next step is Glenn Smith. | 00:35:48
Reach out to them tomorrow. | 00:35:54
All right, Item 5, Floyd County Resolution 2024-12 for the 2025 holiday calendar schedule. | 00:35:58
I think we've had time to look that over, look for a motion to approve. | 00:36:08
I've got a question. Next year there's no election so that the additional days for. | 00:36:14
Let me see for Independence Day and then also for the day after Christmas and Susanna. | 00:36:24
OK. | 00:36:29 | |
Motion to approve. I'll second. | 00:36:32
All in favor. | 00:36:35 | |
Item 6. Floyd County Resolution 2024, Dash 13 to 2025 Commissioner Meeting Day calendar. | 00:36:38
Motion to approve. | 00:36:45
One second, OK, All in favor, aye. | 00:36:47
Item 7. Appointment Highlander Fire Board. | 00:36:52
Just public affirmation on that or? | 00:36:57
We had. | 00:37:01 | |
You need to vote on it. | 00:37:03
So the nominee, we had three people apply for that, 3 interviewed. | 00:37:06
2 resumes submitted. | 00:37:12
And. | 00:37:15 | |
I'll look for a nomination. | 00:37:18
I'll make a motion to approve the appointment of Mike Zeller to the Highlander for our Fire Board. | 00:37:21
All right, I'll second that. | 00:37:27
Any discussion? | 00:37:29
I would like for y'all to reconsider. | 00:37:32
We had three nominees to our retired firefighters. | 00:37:35
One of his experience a little bit dated, but what he brought to the table was. | 00:37:39
He's involved in the mining industry and his skill sets are primarily safety. | 00:37:44
The other applicant, Mike Zeller, retired from the Louisville Fire Department. | 00:37:52
And the third applicant, which I think is superb for this for this position. | 00:37:57
Yeah, her name is. She's Executive Assistant Chief Catherine Klemmer. | 00:38:03
She's an active firefighter from Louisville. | 00:38:09
She has over 22 years experience as a professional firefighter. | 00:38:12
Apparatus operator, company commander, Battalion Chief medical officer and she is now the executive assistant chief. | 00:38:17
I understand that, Louisville. | 00:38:26
FAR is ISO Class 1 rated and out of the many fire departments out there they are considered. | 00:38:28
One of 25125 that are considered Class 1. | 00:38:39
At Highlander, we have 50 firefighters. | 00:38:44
And EMS personnel. Ten of those are female firefighters. | 00:38:48
And EMF, that is 20% of the Highlander workforce. | 00:38:53
Are female. | 00:38:57 | |
Our current Board of Trustees have had many years of retired firefighting in the Ms. experience. | 00:38:59
The 9 member board currently is off mail. | 00:39:05
20% of the workforce are female and adding assistant. | 00:39:09
Chief Catherine Clemmer would would provide diversity to the 9 member Board of Trustees. | 00:39:13
The other two applicants could be considered down the road if another if another another vacancy is available. | 00:39:20
But again, you know, when we have when we're trying to get diversity on our workforce, I think we also need diversity on our fire | 00:39:27
board. And I think she would be an excellent choice for that. And when you look at her resume. | 00:39:35
She has. I mean, it's, it's stellar. | 00:39:44
Currently, she she's been in this position position as Executive Assistant Chief since August of 2023. | 00:39:48
She acts as a liaison between the department and leadership. | 00:39:57
She fills the capacity of chief designee for all labor negotiations, grievances and other matters. | 00:40:01
She makes recommendations to the chief for all personnel actions that occurred in the department. Hiring, promotions, discipline, | 00:40:07
termination. | 00:40:11
Takes care of the open records. It goes on and on. But again, I think we need, we need to show that. | 00:40:17
The taxpayers and voters of this county that we that we need diversity and we haven't we have a very qualified. | 00:40:22
Candidate to do that and I would recommend that we that we cancel that vote and recommend that we that we appoint executive | 00:40:30
assistant Catherine, Executive assistant Chief Catherine clamor to that position for Highlander Fire District. So quick question, | 00:40:37
John, you have 10 female firefighters that's on the Highlander Fire Protection. There's 10 firefighters and EMS of combination, | 00:40:44
yes. | 00:40:50 | |
Any of those females serve in the command role? I do not know. | 00:40:58
Any Apple serve as a company officer? | 00:41:03
I do not know. | 00:41:05 | |
OK, let me ask you, how many, how many females do we have on the board? | 00:41:07
We have 9 male members on there and I believe. | 00:41:41
New Albany has one has a female OK. | 00:41:45
But this would be a good time for us to, you know, to encourage diversity not only in workforce but also on the board. And I think | 00:41:49
she brings a lot of good values. And I just think it's sad and it would be. | 00:41:55
Pitiful if we didn't. If we didn't consider her an appoint. | 00:42:01
All right, any further discussion? | 00:42:07
All right. | 00:42:10 | |
I'm gonna state for the record, I think all three of these individuals were very qualified. | 00:42:12
I looked at the resumes as I tried to do these, kind of blinded. I interviewed all three of them. | 00:42:17
My vote is going to go to Mr. Zeller, in part because he's also been through the process before. | 00:42:23
For other two applicants, both stated that they would be willing to stay in the applicant pool. | 00:42:30
Which is. | 00:42:35 | |
Always nice to have an active applicant pool and we do have some openings coming up in 2025. So I don't think it's sad and I don't | 00:42:37
think it's pitiful. I mean, she's very, very qualified. So is Mr. Zeller, in my opinion, he's the most qualified individual for | 00:42:44
the role at this moment in time. | 00:42:50
And I look forward to her. | 00:42:58
Re interviewing in the future. | 00:43:01
And I'm glad that she's. | 00:43:04
You know, stated for the record that she wanted to stay active in the applicant pool. | 00:43:06
So do I agree? | 00:43:10 | |
Anyway, any further discussion? I just think it's just. | 00:43:13
Disagree. Great opportunity. | 00:43:17
For us to Pratt to provide diversity on the on the fire boards. And this is just, you know, just just just unfortunate saying | 00:43:20
again, I'll make my comment for the record that I am voting through I believe is the most qualified individual at this moment in | 00:43:26
time for this position that is open at this time and I'll stand by mine. | 00:43:32
OK. All in favor of Mr. Mike Zellers appointment. | 00:43:39
All opposed. | 00:43:44 | |
All right. | 00:43:46 | |
Well, there's a whole other page here. | 00:43:50
Not quite a whole other trick or treat hours are upon us. That will be Thursday, October 31st from 6:00 PM to 8:00 PM just to be | 00:43:53
read into the record. | 00:43:57
Of seeking approval of the Commissioners Meeting Minutes for August 6, 2024 and special meeting August 12, 2024. | 00:44:02
Looking for approval, the commissioners meeting, That's awesome. | 00:44:14
Second effect all in favor? Aye, All right. Approval of payroll claims for August 2024 and September 3, 2024. | 00:44:18
Motion to approve. Second. All right. Motion to second. All in favor, Aye. | 00:44:26
While I'm on this page, I'll say the next Commissioners meeting is Tuesday, September 17th at 6:00 PM. Again, we're going to have | 00:44:37
that meeting in advance of that to discuss the Chase building one more time and. | 00:44:43
Sheriff, you've already spoke once and you've heard the public comments, Diana or any other elected govern. | 00:44:51
Any other elected government officials might be here. | 00:44:55
All right, public comment. | 00:44:59
Yep, 3820 year old. I have a couple. | 00:45:07
Questions. I want to make sure that I got right. Am I correct that from tonight forward, when you appoint someone to any of the | 00:45:11
three fire boards, it is a unanimous vote? | 00:45:18
What was what was FCO 2024? Wasn't there something in there about unanimous unanimous vote to rescind the position to remove | 00:45:27
someone? | 00:45:31 | |
To not not fill a position to remove them. So that would that would make sense then why you guys didn't think it was necessary on | 00:45:36
the current vote to have a unanimous vote? That's what I wanted to know. Thank you. | 00:45:43
Mr. Harps, and if I could, if I could comment on that, I think that. | 00:45:52
I was not, I was not in favor of this, especially with the current two out of three, but with unanimous I think it it, it adds | 00:45:56
more of a check and balance on that so. | 00:46:02
All right. Any other public company, Mr. Mann? | 00:46:09
Just call me old great grandfather, man. | 00:46:17
I just have a question on the solicitation. Does that include politicians? | 00:46:20
No, that's excluded. It's excluded politicians so everybody can walk to the door and. | 00:46:26
I will tell you that again, personally on that I don't know that there are too many who who if there's a no solicitor sign up | 00:46:32
there. I have never violated that myself. | 00:46:37
Mr. Bush is nodding in agreement on that. | 00:46:43
Yeah, yeah, most anyway that that usually is self correcting. In other words, you have no solicitation sign and I kept a knock on | 00:46:52
your door, your voting for me. | 00:46:57
And another question, Jason, on the zoning of the Tunnel Hill resolution amendment. | 00:47:02
You said something about it that doesn't include residential. General commercial takes multifamily residential off the table. | 00:47:09
I mean, you can't. You can't put apartments there. | 00:47:16
So I guess I'm stupid on, but you know, up there, there's houses up there on Tunnel Hill. | 00:47:20
Yeah, I'm talking about this development. | 00:47:25
Particular, but it's still kind of hill. | 00:47:28
It's a different development, separate development. It's not that one, it's a different one. | 00:47:32
Any other public comment? If not, I'll go back to boarding committee reports. | 00:47:38
OK, on Tuesday, the 2510 of the Redevelopment Commission meeting. | 00:47:48
Later that morning, I attended the LEPC meeting held in the EOC. | 00:47:53
On the 20th Tuesday in the afternoon, I attended a meeting to negotiate a contract with Teamsters representing. | 00:47:57
Our Public Works Department on Thursday 22nd attended a three hour Kipta Board Directors meeting via Zoom in the afternoon. | 00:48:04
On Thursday the 22nd, I attended the 50th anniversary dinner for River Hills. It was held at Hebrew Winery. It was a great event | 00:48:14
with local business leaders, mayors and other local officials. | 00:48:20
On August the 26th, on Monday, I attended the Innovation Expo 2024 at IU. There were speakers from Purdue University regarding | 00:48:28
innovations and technology related to EV batteries and Von Rush solar lighting. Innovations in solar lighting. | 00:48:38
And then on Tuesday the 27th, attendance joint workshop with commissioners and County Council. | 00:48:49
And this afternoon we had our monthly stormwater meeting. | 00:48:56
August 12th also attended the Planning Commission meeting where we discussed a change to the zoning map which we approved tonight. | 00:49:29
Like I said, it does take the multifamily residential off the table once you approve the general commercial. We also discussed a | 00:49:36
well head overlay protection district for the Edwardsville Water Corporation. | 00:49:43
August 15th the EMS Task Force heard a presentation from Putnam County EMS. We discussed how several our how Putnam County has | 00:49:51
changed the face of providing emergency medical services and how they are pioneering the way for the way they build for those | 00:49:56
services. It's a model that I would like to see used in Floyd County and we'll be making a presentation at our next EMS Task Force | 00:50:02
meeting on the date that has yet to be determined. | 00:50:07
On August 19th, I attended an event held by Congresswoman Aaron Houchin. It was a very well attended and I especially enjoyed | 00:50:13
meeting Congressman Morgan Latrell and his brother Marcus Luttrell. Those names are probably familiar to most people in this room | 00:50:19
as they were both Navy Seals and. | 00:50:25
Marcus Luttrell was involved and had a bullet community about his story called Moon Survivor. It was a true honor to meet those | 00:50:32
both of those people. | 00:50:36
On August 20th, myself, Commissioner Shellenberger, took part on the ongoing Teamsters negotiation and the process is still | 00:50:41
ongoing. August 27th I attended the joint Commissioner and Council meeting and finally on August 29th, I met with Terry Herfel, | 00:50:48
who is serving as the Acting Chief at Highlander Fire to discuss the future of EMS in Floyd County. And then later that evening I | 00:50:54
also met with Matt Smith, the Board President, to have the same discussion. | 00:51:01
All right, it's a busy couple weeks for everybody. | 00:51:08
812 BCA meeting. 813 Ribbon cutting for Ernstburg Orthodontics. 814 Caesars Foundation meeting 815 Envoy Builders Rep Call 817 | 00:51:13
Scribner House Daughters of American Revolution had a program for the anniversary of women's suffrage. 820 went down to City Hall | 00:51:21
where they rolled out the red carpet for me to help represent. | 00:51:29
Some of the folks who live out in the fringe area of the Bud Rd. | 00:51:38
There's a section out there that the city is looking to annex for a development so helped speak out on their behalf. 822 Parks | 00:51:43
Department steering committee meeting, our fund meeting, like 27 that joint meeting and then 830 met with some developers and also | 00:51:51
from Strand to get in. dot reports on the Highlander Point Highway 150. | 00:51:59
Master plan that's. | 00:52:09
Kind of gets extended out a little bit further, but. | 00:52:11
Pretty busy couple of weeks, so we turn around and we come back here on Tuesday, September 17th. Any closing comments from the | 00:52:14
commissioners? | 00:52:18
I'm good like it. | 00:52:23
