At last, we welcome you to the August 6th meeting of Floyd County Commissioners. 00:00:04
It's a it's a busy agenda, but we'll get through it together. 00:00:10
And if you'll please rise and join me in the Pledge of Allegiance, I pledge allegiance to the flag of the United States of America 00:00:15
and to the Republic for which it stands, one nation under God, indivisible, with liberty and justice for all. 00:00:23
All right, big agendas get big crowds, which is great. 00:00:34
Just be mindful of cell phone usage and and courteous to neighbors and whatnot with that. Thank you. 00:00:39
We do have some additions to the agenda. 00:00:46
That'll ask for unanimous consent to add. First of those will be under a Horatio Yuritia, the county engineer. We're going to add 00:00:52
a plat correction for old Vince in slide. 00:00:58
I'll look for a motion for that second. 00:01:05
I have motion a second all in favor Aye, aye. And we'll also add under Mr. Yuri, she's section the Jersey Park culvert replacement 00:01:09
which will now which is now 3C. 00:01:16
I have a motion for that addition please. 00:01:24
Second, yeah, motion is second. All in favor, Aye, And item six will be taken off. 00:01:28
And we'll go from there. There might be a couple items tabled, but we'll pass. We'll get to that when we get to that. 00:01:38
We'll table that when we get to it. Yeah, I've got a couple there. Thank you. 00:01:46
You're going to do 4 to one. 00:01:53
I am, but I almost in my my haste forgot to have a little moment of silence for reflection, which I have done before and. 00:01:55
I felt that about, so we're not going to forget that again. So if you will please just join me. 00:02:04
For a moment of silence, For individual prayer, meditation, reflections, we prepare. 00:02:09
To get into the heart of the matter tonight here with the agenda. 00:02:15
All right. Thank you very much. I. 00:02:34
Item 4. 00:02:37
We're going to add to the move to the top of the agenda and that is Chief Probation Officer Kelly Deucer, who is accompanied by 00:02:39
one of the magistrates tonight. Yep, there you go. So and you have. 00:02:46
Somewhere to be, yes. All right. Sure. Need to take up some court business somewhere that's not here. So I am mindful that my time 00:02:53
is no more valuable than anyone. So I appreciate you all taking me first. For those of you in the room that don't know me, my name 00:02:59
is Julie Flynn. Again, I've been the magistrate for Floyd County for 10 years. I've never had to. 00:03:05
Come to the commissioners to ask for anything that I remember in those ten years. So I. 00:03:12
This is the first time I'm here with Miss Deucer. As you all know, under you gave J Rack the approval to spend the first tranche 00:03:17
of opioid money and we came to you with an idea for a juvenile attendance liaison. That was, I've spent a year developing that 00:03:24
with a committee. I've run it through that committee, I've run it through the Superintendent. 00:03:32
New Albany Fleet County Schools Miss Gardner was on J Rack the board everyone's on board with this and so the J Rock had a vote in 00:03:39
our our quarterly meeting and voted to create this position and to fund it with some opioid money and Miss Doozer has the exact 00:03:47
pennies. What this will be is a two year county paid position with full benefits and at the salary of $50,000 a year. We have sent 00:03:54
it up to our consultants that do the. 00:04:01
Analysis and they did agree that it is a pat a correct pat a that it fits right within that so it will fit neatly. This will be 00:04:09
funded through the opioid source for two years after which I hope to seek funding from additional other sources and so we're just 00:04:16
asking for the commissioners to. 00:04:23
This language, we're just asking you to approve the recommendation by the Floyd County J Rack and we were granted an amount of 00:04:31
$165,328.92. 00:04:37
And this will be in Fun 1237 and we will be in 236, which is a departmental fund underneath the opiate fund. 00:04:43
This is for two years that correct? 00:04:52
And it also will include salaries, all benefits. It may be less than this. If the person chooses a single plan versus a family 00:04:55
plan will be quite a savings. And Miss Deucer built in computer. 00:05:02
Gas for a pool car. There's already an office of juvenile probation, so we won't need any other space. So this should take care of 00:05:10
really anything that will be needed for two years. What this person will do is. 00:05:17
We have had a identified part of my job as the juvenile or the magistrate is to do all the juvenile delinquency cases in Flake 00:05:25
County. And what I have identified in my committee is that there needs to be much earlier intervention. And one of the true flags 00:05:32
for delinquency and and drug use and opioid use starts to be truancy in younger grades. And so this will be somebody that works 00:05:40
with the schools at the middle school and high school level. 00:05:47
Hopefully to build it out to even grade schools, but to get when the school identifies a high risk person. 00:05:55
Juvenile probation will be able to work with that person to get the person services or see what's going on to really get in there 00:06:03
much faster than we have been in the past and. 00:06:09
I think it's going to be a great program. I can tell you I went to the judges conference in. 00:06:17
June for juveniles and many other counties have similar type programs they're getting up and running so I think it will have 00:06:21
support from the Supreme Court if I need help that way I. 00:06:26
But I'm happy to answer any questions that you all have about it. 00:06:33
So First off, educate me. 00:06:38
As a magistrate, is it OK if I call you, Your Honor, just like the judge or anything like that? And is it expected? Well, I know I 00:06:43
can and I could, but in a formal setting I like to at least. 00:06:48
Well, when I when I called you up here, I did not do that and that was not courteous of me to do so. So please accept my apology 00:06:55
on that. 00:06:59
If at the end of the two years, other sources for funding are not found, then this position goes away. What if it is successful? 00:07:05
Commissioner, if it is successful and we will have to keep stats. If it is successful and we I can't find an additional source of 00:07:15
funding, there is additional opioid funding that perhaps if it's successful and it's really doing what it's meant to do, I can 00:07:22
seek that. I do know that the state is very keen on juvenile diversion money right now and I've started to work with the Court of 00:07:29
Appeals person that's on that committee to try to already build those bridges. 00:07:35
My hope is it wouldn't go away. It is not my plan to come to the county general fund to ask for funding for this. However, I would 00:07:42
reserve the right if it's successful and some for some reason all the funding sources would dry up in two years to come back and 00:07:49
readdress that. OK. And are there objective criteria to define success? 00:07:56
It would well part of the this is such a brand new. 00:08:04
Idea or philosophy or position that I think part of this person and it'll be someone with a bachelor's degree in social worker 00:08:09
teaching. The reason we made the salary a little higher is so that is to identify those benchmarks of what we want to see. I went 00:08:16
to the school and, and, and spoke with them and I met with them several times. 00:08:23
I don't think I would not be fair of me right now to say that there are. 00:08:34
Exact criteria of what will be successful, because this is such a new and novel idea and we're really trying to get in there and 00:08:39
start something fresh. Obviously it would be to reduce truancy at the younger ages, but I think that it would also have success 00:08:45
for getting people to services they needed, things like that. 00:08:52
So it's not a very specific answer. 00:08:59
And, and I do, I do just want to say that on my committee I had. 00:09:05
Various people from juvenile probation system of care, the public defender's office. 00:09:11
And and juvenile probation. Then we pulled in Casa, we pulled in people from the school. So this was vetted as an idea. There is a 00:09:19
job description that lined that out. That was presented to the committee. It was presented to the Superintendent of public 00:09:25
schools. It was presented to JROC. So there is a formal job description that exists. We're really ready to move on to hiring if 00:09:31
this gets. 00:09:37
Put in place. 00:09:45
Any further? I'm on the committee, I've heard it all and I think it's really good program. 00:09:47
OK. Thank you, Jason. I'll make a motion then that we. 00:09:55
You're looking for. 00:10:00
Kelly exactly you're looking for what I'll let Miss Producer say since she wrote the language. I want to get it right. It was 00:10:02
approved for $165,328.92. 00:10:09
And this is for the juvenile probation school attendance liaisons, is that correct? 00:10:17
That would be my motion. 00:10:22
All right, Motion is second. All in favor, aye. 00:10:25
Best of luck with that. Thank you. 00:10:30
That would be most welcome. And again, thank you to everyone who let me go first. I really do appreciate it. 00:10:35
Thank you. 00:10:44
Continuing with new business director of operations and Planning Don Lop. 00:10:46
Good evening. First item that I have is a change order for all to Wood and Buffalo Trail. That is our ARP project. It is a close 00:11:01
out. 00:11:06
The total change order is $7410, however the county's portion is 4227 dollars. 00:11:12
That equals out to be 1% of the original contract cost and the 4227 was. 00:11:23
Basically due to for unfortunate. 00:11:31
Hitting of some pipes as we were moving to culvert. 00:11:35
In the project, so you're so close to having it. 00:11:38
Perfect, perfect. Well, I. 00:11:41
1% we, this project, the next project are are good examples of projects that go well. C is one that probably won't be so. 00:11:44
OK, So the amount was four $24,227.00. The total change order is 7410. Our, our our contribution is 4227. So you need you need 00:11:55
approval for which amount the Deerwood has already submitted their, their portion to us. So that would be my my request motion to 00:12:04
approve 7000. 00:12:14
$410 for the change order. close out all the wood in the Buffalo Trail sewer project. Yeah, I'll second that. All right, I have a 00:12:23
motion and a second. 00:12:28
All in favor, aye? 00:12:33
Second item is also change order to closeout State Road 62, the signalization project, which is there at Cordon Pike. That total 00:12:37
change order earlier in the year, we were looking at about a $23,000 change order. Actually we found some deductions as we came 00:12:43
through for the project. So the total project. 00:12:50
Is $6745, which is again a 1% over the original contract amount. And that's primarily my understanding is it's primarily regarding 00:12:57
some additional dig out that was required as they went through the the chain of the lanes on 62 and also at Carolyn Ave. So 00:13:06
request is for to approve the change order for $6745. 00:13:16
So, so moved, I'll say a motion is second all in favor, aye. Well, you got the two nice ones. Now here's the one that's kind of 00:13:26
frustrating and that is old Vincennes Road to give you a project update. That project was scheduled and slated to start June 1. We 00:13:34
sent out letters. We did our signage, the utilities and primarily the telecommunication utilities. There's four. 00:13:43
We were in communication with them in October of 23. That gave them notice to proceed. 00:13:53
It last communications we've had and some have been silent and some others have have communicated to either myself or the the. 00:13:59
Our Strand, our construction engineer. 00:14:09
There's some work being done today or this weekend, so there are still 4 utilities to move. 00:14:12
Have had a conversation with with our construction, our construction company Dan Christianity. We're at it probably at a time 00:14:20
where we'll need to actually. 00:14:26
They the time to do phase one, which we gave between June 1st and November 1st. 00:14:34
We've lost that time, so I. 00:14:42
They, we had a meeting and a conversation. I would say what, what will happen? What since we still have three utilities that 00:14:46
haven't moved is we're going to have to delay that project to the spring and come up with a revised schedule for you, for you all 00:14:53
to, to review. So I. 00:15:00
That's that's the. That's just the. 00:15:09
Facts of the situation. 00:15:13
Well, there's lots of nearby construction going on around there, so. 00:15:17
So the silver lining might be that one less project going on at that time might save some heartache in the short term. 00:15:20
It will. It is frustrating obviously, because we like to see projects move forward, get complete and go on to the next one. I will 00:15:28
say that this is a project that actually this is the third phase. This started in 2000. So this is in 2000. We did the first leg 00:15:35
of Open Sins Row by Floyd Central. 00:15:42
1415 we did Section 2 which was from Floyd Central to Pass Luther Road and now we're in intersection three, so. 00:15:49
So it is, I guess now going on 24 years so. 00:16:00
Was it a silver anniversary for 25 S? Maybe, Yeah. I mean, they're variables we can't control. 00:16:04
Chief among them the weather and the utility companies, I guess, you know, Yeah. 00:16:11
And, and we will have you having some, some very, we'll be having some conversations with you. 00:16:15
So that's an update on that. There's really nothing to to. 00:16:25
Action there the 4th item Charlestown Rd. trail project give you an update that went through in dot. Letting that project was 00:16:28
awarded by endot to the low builder was Milestone construction out of Columbus. 00:16:35
INDOT is funding 100% of the construction, so that is $3,346,600. 00:16:44
And then they're funding 90% of the construction inspection which is three 392,000 and $500 pre construction conference will be 00:16:52
next couple weeks. Instruction starts in September and is scheduled to be completed July of 25. And that is a project that has. 00:17:02
And that has DES numbers and they use their first first two numbers are usually the year. So that's a desk number. It started with 00:17:14
14, so a little bit sooner than open sends around so. 00:17:19
But just an update there on that as well. 00:17:26
If you had any questions, OK. That's my understanding that you're also going to be pitch hitting for Mr. Creevy on. 00:17:30
Agenda 2, ABC and B, So roll on and and if you, if you give me the little discretion, I'd like to do A and C&D and then come back 00:17:39
for probably the B is the last item since it'll take hopefully a little bit longer. 00:17:46
A is a paleo Pike. It's a multimodal construction contract with Clark Dietz. 00:17:54
That is a Kipta project. It's $100,000. They were the selected firm. I think Mr. Creeby has a contract in front of you that is a 00:17:59
reimbursable of 7525 S and that project is should be concluded by May of 2025. 00:18:08
And that's for multimodal bike and pedestrian travel along the Palo Pike. 00:18:18
Motion to approve Clark Dietz as the Paley Pike multimodal plan consultant. 00:18:24
One second or motion and a second for approval. All in favor, aye? 00:18:31
C is a resolution to allow. 00:18:38
The firm of Rep our EPP real estate services to be the. 00:18:42
Purchaser and offer purchasing agent for our Bridge 51 project. 00:18:51
Any further information for us on that, that that is that is just that part of the process for for providing just offers of 00:19:01
compensation to the 24 property owners? 00:19:07
And then serving as, instead of the county serving as the agent, there's actually a purchasing agent, which is pretty standard 00:19:14
operating procedures or projects of this size. 00:19:19
And that's covered under our, under the kepta. 00:19:29
Their contract, which I'm sorry I don't have the amount is covered under the right of way acquisition services. 00:19:33
So you're looking to approve the resolution, Don? Yes. 00:19:39
Motion to to approve Floyd County Resolution. 00:19:44
2024 Dash 10 Bridge 51 offers and litigation one second. 00:19:47
OK, Motion, second on that resolution, FCR 2024-10 all in favor, aye. 00:19:53
And I believe you have in your packet there is a offer of compensation to be offered. 00:20:01
For Bridge 51, I'm going to make an assumption Mr. Fox has had ability to review that as well. I have it for 6.6 acres. The owner 00:20:07
is Beeler. 00:20:13
And the offers 860,700. 00:20:20
No further comment from either of you on that. That's the. That's the one property that is part of the project. Is a is a whole 00:20:29
taking. 00:20:33
For the property OK. 00:20:38
Any further discussion I'll ask for a motion approve, so move. 00:20:41
2nd. 00:20:47
Motion a second on that. All in favor, aye? 00:20:49
Then the last item is in the Planning Commission is forwarded to you FC 2024 Dash 20, a map amendment rezoning on the property 00:20:54
with an address at 6527 Cordon Ridge Rd. I believe Mr. Popovich here with the with the applicant and if you have any questions and 00:21:03
I believe Mr. Creeby sent both. 00:21:13
All the information regarding ballot and a memo summarizing the actions and planning position. 00:21:23
Right. And with regards to that, does anyone? 00:21:30
Want to hear from the petitioner on that. 00:21:35
At present. 00:21:38
And is there anyone? 00:21:40
Hear from the public to speak. 00:21:41
Are there for or against this measure this evening? I'd ask them to give them the opportunity to speak now before we would vote on 00:21:44
that. 00:21:47
Mr. President, I'm the applicant you have an opposition letter from. 00:21:52
OK. 00:21:57
Yeah, please. 00:21:59
There's a lady. She raised her hand back there. 00:22:02
To the right. 00:22:05
Figure over to the right. 00:22:07
Raise your hand again, ma'am. 00:22:10
The opportunity to speak as well. 00:22:13
After. After. 00:22:18
Thank you. Yeah. Come on. Yeah, Come on. Yeah. Sorry. No, it's OK. 00:22:25
It's like A8 ring circus tonight. Got a lot of things going on. Lots of things. I'll do my best to be brief. 00:22:30
Thank you. 00:22:40
For the record, Jake Elder, applicant with Elder Company located at 501 E Pearl Street in New Albany, IN With me tonight is Jason 00:22:43
Copperway with Paul Primavera. 00:22:47
If you have any technical questions, I defer to the engineer. 00:22:52
We're here seeking the approval of the Planning Commission's favorable recommendation. Rezone the property located there at 6527 00:22:56
Cord Ridge Rd. from rural residential rural suburban. Our intent is to allow for a garden style patio home community detached 00:23:03
before you. What Jason presented you with is the site plan as well as the commitment letter. 00:23:10
And if you'll turn to the commitment letter, this is this site plan. The commitment letter took quite a bit of work. We were able 00:23:18
to work with Mr. Nick Creeby and going through kind of the needs and desires of the county. He also requested that we reach out to 00:23:23
the Parks Board. I had numerous conversations with Mr. Matt Dennison. I actually met him on site and we walked the property. So if 00:23:28
you look at the commitments, at least under each paragraph one, here were the things we agreed to after meeting with the Parks 00:23:33
Board. 00:23:39
At the if you look at the site plan, at the top of it there's vegetation. 00:23:45
That's on both. 00:23:50
Properties and if it's successful, we're happy to go ahead and clear that vegetation at no expense to the board. We want to make 00:23:52
sure to retain any and all mature trees and other bushes that do not interfere with overhead power lines. There is a power line 00:23:57
that runs the length of the property all the way to the back of the park. 00:24:03
Neighborhoods could cut through this neighborhood and gain access to the park. 00:24:39
Paragraph two of the commitment and is also that the planning director want to make sure that the front had a more of a rural 00:24:44
aesthetic, which we agree wholeheartedly. You know, my personal residence is a mile from from this location. We frequent the park 00:24:50
on a regular basis and at this point we're going to plan on putting a berm up front and then we'll get with Mr. Creevy specific to 00:24:56
the signage to make sure it does flow with the surrounding areas. 00:25:03
I know anytime you hear a rezone. 00:25:12
Very hard to satisfy all parties. 00:25:15
That we've done our best to meet with some of the neighbors who called her early on at our first neighborhood meeting. Most were 00:25:18
concerned one, you know, where were they going to be apartments. And once we told them no, that that satisfies some the the 00:25:23
neighborhood on the other side of the park. I had some phone calls there. They were concerned with the depth of this neighborhood 00:25:28
and whether or not it was going to. 00:25:33
Remove the tree line, which we assured them that that it wasn't. 00:25:39
I know from my in laws the appeal is still owning a nice home without. 00:26:13
A lot of required upkeep is an excellent selling point. Another plus that the neighborhood will be a garden style homes and not 00:26:17
attached. 00:26:21
He states that there are not many options in Floyd County that fits the bill and as our community grows, so does the need for 00:26:26
housing options. This is an excellent opportunity to develop desirable area without adding a lot of extra strain on existing 00:26:30
infrastructure while maintaining the rule feel that we all value. There's no doubt this project, when completed, will be a great 00:26:35
value add to the neighborhood as well as Georgetown. 00:26:40
I'm happy to answer any questions or. 00:26:46
Mr. Are there sidewalks? There will be. 00:26:48
I don't see it on the you show the common area, the Burnham and all epidosity side, so the the blue. 00:26:51
Area will be a sidewalk and then we have to meet county standards and we've agreed to at the Planning Commission to install 00:26:59
sidewalks consistent with the subdivision requirements of the county. I mean, the big sidewalk out on Long Court Ridge Rd. 00:27:06
If it's required, we wanted to work with. I mean, we can absolutely put them in, but then it kind of dumps to either side. But 00:27:14
yes, I'm happy to install those. 00:27:18
OK. Yeah, that was one of the requirements for Mr. Dennison, that there be a pedestrian access along Cordon Ridge from the back. 00:27:23
OK, OK. 00:27:31
And how wide is the IS roadway? 00:27:33
The county standard is 28 feet back-to-back of curb, so 2024 feet of pavement. 00:27:36
All right. Any further questions for? 00:27:47
So this is this is for the zoning and then? 00:27:50
Change and then it'll go back to the Planning Commission. Is that right? They approved primary plat for a conservation subdivision 00:27:55
contingent on the zone change. 00:27:59
And how many acres for the common area, for the, for the, for the recreation and all that? 00:28:05
It's a little over half an acre. So we were proposing the Planning Commission granted a modification for the open space. We were 00:28:11
asking for 15% open space. They required us to go to 20% open space. That's not reflected in this plan, but prior to secondary 00:28:17
approval that will be reflected and we can do that. We can do that with the same number of lots and still meet all the 00:28:23
requirements of the lot size. 00:28:30
By creating some additional common area along the back of the lots. 00:28:36
OK. Do you recall the? 00:28:41
Vote of the Planning Commission, I thought it was 7 to one, I believe 7, seven to one on the pass and 7:00 to 2:00 on the adding 00:28:43
to do the 20% or maybe it was 6:00 to 2:00 on that one, but it was it was quite a majority. Do you recall any of the lingering 00:28:49
concerns from the nay votes? 00:28:55
That were expressed publicly. I'm not sure exactly. They weren't expressed, I think. I think the switch on the second vote was. 00:29:02
Mr. I believe I'm reading into this a little bit. Mr. Wells didn't didn't want the 20%. I think he was OK with the 15, so he voted 00:29:13
no. 00:29:17
If I read that correctly, voted no on that second vote because of that. But that was there was just my impression. 00:29:21
Taken as such. 00:29:29
You guys aren't leaving, so in case we have any other questions, ma'am, you hit. 00:29:33
Pretty much covered what I was going to say. If you will just state your name and address for the Ross. I live at 5031 Chris Lane 00:29:39
in the Floyd County and Floyd Knobs. My husband and I have lived there for 41 years. 00:29:46
We're obviously senior citizens and he has a lot of health problems, Parkinson's among among them. So we need to downsize. We want 00:29:55
to downsize, but we need to downsize and we have been looking for months and there is not. 00:30:01
Wait, they want to stay in Floyd County and it's and it's not easy right now, not allowed to homes out there. 00:30:38
In the the size that we're looking for. 00:30:47
Well, we appreciate your input. Anyone else wishing to speak on the matter? 00:30:51
Tim Harbison, paper builder that made. 00:31:02
So much for my evening. 00:31:05
But as I've been walking neighborhoods, I've had several people talk about a subdivision that's being completed on Frank OTT that 00:31:08
was originally sold to be patio homes at narrow two-story residences. Whether that's legit or not, that's just what people have 00:31:16
told me. I'm just curious, is there a definition for what makes a patio home? 00:31:24
And if there is a set definition. 00:31:33
Who would be the enforcing body if the builders built something other than a patio home and sold that property as such? I mean, 00:31:37
that may be something that the Planning Commission deals with and I don't understand. But I was just curious what exactly because 00:31:44
I've heard that from several people that that big development on Frank OTT was originally sold as if it was going to be patio 00:31:51
homes. So I didn't know if there was a definition for what made a patio home. 00:31:58
And whether people. 00:32:06
And who enforced it if that was not? I think. 00:32:08
I don't know who could answer that question. Who's coming right now? 00:32:11
Play. 00:32:16
In the, in the zoning ordinance, they we have definitions regarding types of homes, single family detached through single family 00:32:24
attached. So there's a definition regarding that. 00:32:30
For. 00:32:37
And then the enforcement component would be the Planning Commission and building develop. 00:32:39
Building services so. So there is a definition in there and there is an enforcement. 00:32:44
OK. There's going to be some changes to the UDC coming as well for Mr. Previous, correct? 00:32:51
Yes, my, I mean the ordinance is right now almost. 00:32:58
Almost 20 years old and so it's had about 20 amendments to it. So one of the items that we've talked about is unifying bringing in 00:33:03
a unified code, which would also which would then have one ordinance. So you would have your subdivision ordinance and your zoning 00:33:08
ordinances 1. 00:33:13
Streamlines definition. Streamlines process so still enforced by Mr. Creepy's office. Thank you. Any further discussion on the 00:33:21
matter? 00:33:26
Look for a motion of approval then. 00:33:34
I'll make a motion to approve. Let me find it here. 00:33:38
Floyd County Ordinance 2024-20, the rezoning zoning map amendment. 00:33:41
Five, I'm sorry, 6527 Cordon Ridge Rd. OK, that need to be by unanimous consent. 00:33:47
No, a rezoning doesn't require. That's an ordinance. I wasn't sure because I don't know. 00:33:55
I've had one of those come before me. That's an exception to the statute for requiring unanimous consent for an ordinance. The the 00:33:59
zoning is an exception. Keeping track. I've learned two things so far tonight. That's good. All right. One second. The motion is 00:34:05
second. All in favor. Aye, aye. All right. Thank you. 00:34:12
Thanks. 00:34:19
All right. 00:34:21
Section 3. County Engineer Horatio Yuritia. 00:34:24
Good evening. 00:34:32
The first item you have in there is a change order, right? 00:34:35
Yes, OK. It is the change order for paving project local. 00:34:39
Local spring paving, 2024. 00:34:49
That it was paving Phyllis Smith, Philip Smith wrote and the Scottsville Rd. 00:34:52
Initially was. 00:35:01
Estimated the cost about 65,812.90 and it was reduced to 62,000 to 8 hundred 884.9. So there is a reduction of 2928. 00:35:03
Dollars. 00:35:23
And it was for the HMA surface. 00:35:26
And the other item within the same row was for waiting level and the price original estimate was 19,418.40. 00:35:29
It was reduced to 7149. There was a saving of 12,000. 00:35:43
268 point $80.00 there, so. 00:35:50
On Scottsville Rd. paving the. 00:35:54
The section of the road that we're supposed to pay it was estimated to be 111,300 and. 00:35:58
2 + 40. 00:36:07
Went up 224,379.52 so the price the cost increased by 13,077.12. 00:36:09
But there. 00:36:21
HMA, the weapon level that was estimated on 32,175.20 was reduced to 25,425.66. There was a saving there of 6700 and 4954. 00:36:24
So a total saving on the project was 8869. 00:36:42
.22. 00:36:50
Original cost for the whole project was supposed to be 275,720 ending up in being 266,850.78. So right there you should have this 00:36:52
form. 00:37:02
That requires a ride to talk. 00:37:13
Will be signed. 00:37:18
Yes. So a net savings of $8869. 00:37:23
Yes, 8000. 00:37:30
869.22. 00:37:32
OK, so you need a motion to approve the change order for that amount. 00:37:36
Need a motion to approve that change order? Make a motion to approve the change order for the Floyd County Local spring paving in 00:37:39
the amount of $8869.22. The motion is second all in favor. 00:37:47
Well, Mr. Loppy, beat your 1% tonight that. 00:37:56
He's made us very happy. 00:38:00
There's I think that's all you needed from me on that. 00:38:02
What is in a family out there? 00:38:08
I have the original Horatio. 00:38:12
The next item that we have was 3B mainstream fiber network permit agreement and that we have decided to table that I'll need a 00:38:17
motion. 00:38:22
I'll second, OK, so all in favor, aye. So the next is going to be 3C, the Jersey Park Culver replacement. Yes, the first thing I 00:38:27
wanted to do wanted to have a motion to cancel the previously bidded project because it came way high more than what we were 00:38:36
estimating it. So I want to reject that was approved on the July. 00:38:44
16th, 2024. 00:38:54
Seeking a motion to reject previous bids based upon unacceptable. 00:38:56
So moved I'll 2nd. 00:39:04
All in favor, aye? 00:39:06
So after that. 00:39:11
I get a meeting with the contractors. 00:39:15
And explain them that that was. 00:39:18
Too much money? Yeah, I was looking for something. 00:39:22
Less than that so. 00:39:26
And then? 00:39:28
We decide to provide the the pipe. 00:39:31
80 feet long, 12 feet diameter pipe for the culvert. 00:39:35
So we want to provide that and then we collect quotes. 00:39:40
For from Civil Con. 00:39:47
Ideas and main core The lowest was silicon with. 00:39:50
48,595.76 that's the lowest for the pipe. 00:39:58
I want to have a motion to approve. 00:40:06
Buying the pipe. 00:40:11
Motion to approve by the the pipe to Civilcom. Yes. 00:40:16
Did you get that? 00:40:22
Gloria, say one More time 48,000. 00:40:26
595.76. 00:40:30
For the Jersey Park culvert replacement. 00:40:34
So then hold on. 00:40:40
We got a vote on that. We have a motion. 00:40:44
I'll second. OK, All in favor, aye aye. 00:40:47
So we bought the pipe. 00:40:52
OK then. 00:40:54
When I recalculate. 00:40:58
The work and we offer the contract to provide some help to bring the cost down. So then it was estimated to be below 150. 00:41:01
Which for 1:50 we only require quotes. We don't have to beat that out. So our request request a quote to the regional. 00:41:14
Two contractor boxing. 00:41:25
Temple and temple and I'd invite Max construction. 00:41:27
And they declined because they have too much work and they were not interested on. 00:41:32
So boxing provide us a new quote for 198,950. 00:41:39
Which is way higher than 150, so it could not be. 00:41:47
Accepted, but temple and temple. 00:41:51
Give us a quote Gave us a quote for 1:42. 00:41:56
825. 00:42:00
I need a motion to say. 00:42:05
Temple and temple. 00:42:08
But I want to have that under advisement because I need some stuff I need to do there motion to approve temple and temple in the 00:42:10
amount of one 42825. We take that our advisement under advisement I'll say. 00:42:19
Motion in a second. So that will have to come back for final approval under the terms of this right? Yeah, the next commissioner 00:42:28
meeting then. 00:42:33
We can. 00:42:39
Awarded project to them all in favor aye? 00:42:40
And there was also a cover sheet for the Albinson Rd. I need a motion to. 00:42:46
Approve that, yeah. OK, so there's item. 00:42:57
3. 00:43:00
D That was added at the beginning of the meeting. 00:43:02
Motion to approve. Motion to approve the plant Correction. OK. All in favor, Aye. All right, You can pick that up from Suzanne. 00:43:05
That's what I have. Thank you very much. All right, Thank you. County Health Department. 00:43:12
We have Doctor Jensen and. 00:43:20
Crew part of a crew. 00:43:26
Me and drive Ankenberger. 00:43:28
Before your last meeting, I asked Doctor Knable about if we could need to proceed with the appraisals for the purchase of the 00:43:32
property on Grant Line Road and he said yes, you guys go out and. 00:43:37
Proceed on that and I said, who's going to pay for it? He said you need to come back and discuss that with us. So that's why I'm 00:43:44
here. One of the things that came up at our last meeting is. 00:43:49
A lot of people. 00:43:56
Don't really understand budgets. 00:43:58
With government, because they haven't had the experience, so they asked me to come forward and ask you all to pay for the 00:44:01
appraisals because they feel like since they haven't had to ask for any rent money for 10 years and previously before we got the 00:44:07
Indiana money from the state. 00:44:14
60% of our budget came from grant money. 00:44:21
And we know we got all this money from the state, but only a part of it, 10% of it can be put towards the building. And so we're 00:44:24
not going to have, you know, we're not going to have enough money to purchase a building. So we're concerned about using up all 00:44:32
the the money that we can contribute for things like appraisals in the bids from the engineers went ahead and issued the two 00:44:39
people that we decided on that had the lowest bids for the appraisals and they're working on the appraisals. 00:44:46
I currently ask them to build the County Health Department because I don't want to get them stepped up being paid but the board is 00:44:54
asking me to ask for reimbursement on that based on. 00:45:00
Fact that we haven't asked for a lot of money in the past. 00:45:08
I think our whole conversation went as such that what you had said was true. But I also said, yeah, see if you've got it within 00:45:11
your own budget to do that as well, Just and it will come out for Full disclosure. But I have that if I go out and have lunch with 00:45:18
Rick, I usually ask Rick if he has, hey, you going to pay for that? It never hurts to ask or to look, right. So what's the total 00:45:25
on the two appraisals? It was 6500. That was the total for both appraisals. 00:45:32
I mean one for three and one for 30. I mean, I see this on both sides of it, because if you do have an operating budget that you 00:45:40
could pull from, I think it's not unreasonable to ask for you to do that. The other part is that the commissioners. 00:45:45
Ultimately have ownership assigned to them of the building that we're going to be acquiring and and we are going to be desirous of 00:45:51
input along the way with regards to this project. I mean, ultimately we have to sign off on pretty much every aspect of it along 00:45:59
the way. But at the same time our funds are limited as well as anyone associated with county government anywhere can appreciate. 00:46:08
So. 00:46:18
I'm not as concerned about this because I would like to close the deal on a good piece of property as I am about the next step, 00:46:20
which is going to be having someone come in there and look at. 00:46:25
What it's going to cost to? 00:46:30
Even have some way you look to see what it's going to cost to remodel that second part of our presentation. But before Dan does 00:46:32
that, once we get the appraisals, which they said it'd be about two weeks, how soon can we move forward with the purchase of the 00:46:37
property? 00:46:41
I'm sorry, what was that last once we get the appraisals? 00:46:48
Which should be in about two weeks. How soon can we move forward with purchase of the property? I think that's a bridge we'll have 00:46:51
to. 00:46:54
Legally caught cover when we get to that because. 00:46:58
The rubber is going to hit the road when it comes to, you know, where is the money for purchase going to come from? And as 00:47:03
everybody in the room who wants to know about it has heard in the past, evidently there was somebody in discussion about assigning 00:47:08
CARES Act money to the purchase of it. And I don't know. That was not, That was before my time and it wasn't in my lane, so to 00:47:14
speak. But you have some part of that discussion saying, yeah, the money's still there, and part of the discussion saying, no, we 00:47:19
need it forever. So. 00:47:24
That may get real creative real quick. 00:47:31
With regards to that, OK, So I have no further questions or concerns about the appraisal money, but my colleagues might so. 00:47:33
John, do you have any comments with regards to I agree, I think that. 00:47:46
The bigger question is, at some point in time we need to have this discussion. 00:47:51
These include the County Council. We need to find out. 00:47:56
How it's going to get paid for and we're going to have expenses coming along like the appraisal like this. We need to be in the 00:47:59
line item so that way you don't keep coming to us and say, hey, can you pay for it? And we we tell you, you know, sometimes what 00:48:07
you don't want to hear, you know, but again, you know, we need to have a joint meeting with them to determine how we're going to 00:48:14
pay for the building and for items like this. So should I try to send in addition to the renovation at this time because. 00:48:22
We're afraid we're gonna lose the property. 00:48:29
I would say that. 00:48:32
It hurts you have something on the calendar because it's like hurting cats to try to get everybody. 00:48:34
And it's a lot easier to cancel a meeting than to schedule one. So yes, I get a motion to pay for the appraisals so moved. 00:48:41
To pay for the appraisal for US $6500. 00:48:52
I would rather table it until it comes in and we have until we have had that discussion. 00:48:59
I will second the motion. So we do have a motion in this 2nd to pay for this 6500. See at least we go forward on the appraisals 00:49:04
all in favor on that, aye, aye. 00:49:08
Abstain. 00:49:14
So to provide more information on so she is right. I mean the owner of the building is a little frustrated with the timing it's 00:49:17
taken and there is a second interested party that if we don't move forward, we're going to lose this building. 00:49:25
So that's the bottom line as far as how it goes. What you got in front of you is a summary of all the pages behind the front page. 00:49:33
There are two architectural firms. We had look at the building and they gave us these preliminary numbers and these are just 00:49:39
preliminary. 00:49:45
They're close but wouldn't be the exact numbers, but the architectural firms divided into 4 sections, preliminary design phase, 00:49:53
construction document phase, bidding phase and a construction administration phase. 00:49:58
The Tire Pinkster basically works on an hourly rate rather than a defined number, so it could come in a little higher or lower. 00:50:05
The rates are between 95 and $250 an hour, depending on whether it's an architect or a staff individual working on the project. 00:50:14
As far as the purchase price, that's to be determined awaiting appraisals. And then the last meeting we talked to you, we you 00:50:25
asked specifically about a lease option. 00:50:29
The lease option that has been provided is also in the packet. It would be a triple net lease, 120 month term with two five year 00:50:34
options at a cost of $252,000 a year with a 2% escalator. So that would be the option and whether or not we, you know, purchase or 00:50:43
lease is going to be again a decision that you all need to make as a body, but as far as the building goes. 00:50:51
I talked to Pinkster today to get an update. 00:51:01
And he said with this building, it was out of the all the buildings we looked at, this would be the least expensive remodel 00:51:04
inside. And he said basically this building has two floors, 27000 square foot floors. The top floor really doesn't need a lot, you 00:51:11
know, paint, maybe some carpet in some areas, but no redesign of any major sort. So 50 to $80.00 per square foot for the top 00:51:19
floor. The bottom floor does need some major renovations to meet the health. 00:51:26
Needs and he said on an average it's about $110 a square foot to redesign that building. So 110,000, I mean $110.00 at 7000 square 00:51:34
feet would be another $770,000 for the building once we acquired it. But the key issue right now is if we don't move forward, 00:51:41
we're going to lose the buildings. So once we get the appraisals back, we're asking for a more expedited review process with you 00:51:49
and the County Council so we can make some decisions. 00:51:56
What was the renovation on the top floor? 00:52:04
50 to $80.00 square foot, approximately 50 to 80, yeah, depending on how much we would need to do. 00:52:08
They give you any kind of deal when you would have a turn around on your appraisals by chance, she said. Two weeks is what we were 00:52:18
two weeks from. 00:52:21
So a week from today, perhaps? 00:52:28
Or yesterday's. 00:52:31
All right. Well, your appraisals are covered. 00:52:33
And executive session scheduled. And so any, any movement forward is a positive thing for these folks. I mean, we agree, But, you 00:52:36
know, I mean, if we'd lose this building, I'd start over again. You know, timing is an issue. 00:52:44
And they they move at different speeds, which can torque you up if you have one foot, neither one of them. Yeah. Thank you for 00:52:54
your time. Sure. And then as part of closure on this, we also have FCR. 00:53:02
2014 Dash 11, the amendment that we need to do tonight to replace FCR 2024 Dash 08 for the appraisal of real property. We handle 00:53:11
that. Yeah, we had two appraisers that were originally in in the original resolution. And so that then we got the bids and we have 00:53:21
a a change in appraisers because we got took the two lowest bids. And so that's. 00:53:30
The resolution we're asking you to approve, which are the two appraisals that you'll be paying for, correct? 00:53:40
OK, so I need a motion. Motion to approve Floyd County Res Floyd County Resolution 2024 Dash 11. 00:53:49
All right, motion is second all in favor. 00:53:56
Thank you all for your ongoing efforts on that. It's a great opportunity and I hope we can move forward at a speed that works for 00:54:00
everyone. 00:54:03
Of most patient man in the room tonight thus far, Sheriff Steve Bush. 00:54:07
Thank you very much. Before you this evening, you'll see there's four contracts. I'm going to give a little back story real quick 00:54:16
because everybody's time. 00:54:19
Valuable, but I think it's important to to do that. I'd like to separate 4 contracts, the two collective bargaining contracts for 00:54:23
last out of the four and talk about the 1st 2, the medical contract and SRO contract back I think it was a couple years ago 00:54:29
sheriff sued the commission's up and I think it was Lake County in reference to over a dispute over contract signing medical 00:54:35
contract. 00:54:41
You know, we've communicated very well and so typically what will happen I think going on future, we've learned a few things that 00:55:18
we can do a little better on our end. 00:55:22
We're talking about our medical contracts. It's a very large one by our largest one. 00:55:57
So we've been working with them on all the nuances with the contract, a new one working, how we transition from an old one to a 00:56:02
new one. 00:56:05
And so we've been working diligently, very hard. We've pushed them quite hard in the past week to get this contract up. And that's 00:56:09
why you kind of got it late. I reviewed it. I know Mr. Howe in our office has reviewed it as well. We believe it's a good 00:56:14
contract. It's under budget as well. But it's up for your review now to look at it and either sign off, table it or turn it down, 00:56:20
I believe. 00:56:25
We looking at this would rather table 7A having received it late hour that's the your medical contract. 00:56:33
At this point in time, at least, that's. 00:56:42
Motion to table. 00:56:44
All in favor, aye. So before you, the next one is SRO contract. 00:56:47
So we have as well as in the schools processor, High, close, Central and Highland Hills. 00:56:53
Contractors for that, they pay 82% of our salaries. I was trying to push them to pay 100%, but we're still in negotiations on that 00:56:59
docs. But that's a simple contract and all these contracts and agreements will come before you all. Basically that's what they 00:57:05
are. They're pretty much simple for the most part. You know, we go analyze them, we look at them in terms of what they call us, if 00:57:11
there's money attached and also procedural and policies and what it is. 00:57:17
So, So the next one's SRO contract, Steve, is that the same amount as last year, the last contract or what? OK. 00:57:23
Yes, 82 percent. 80% is what the county pays and the school pays 20. 00:57:31
Well, they do. 00:57:36
OK. 00:57:38
Make a motion to approve. Second motion is second for approval. All in favor, aye? 00:57:40
So the next two are our correctional officers contracts and our merit police officers contracts. We've been in negotiations. 00:57:47
With Mr. Sharps on that board. 00:57:54
Danish Councilman Danny Short and Connie Moon are on that board. We did have Jim Freiberger, but he recused himself and got off 00:57:57
the door. So there was left with three. And so we've had several meetings and negotiating these contracts in good faith. I support 00:58:03
both contracts with both contracts that helps us. The first one with the correctional officers. He keeps us and competitive within 00:58:09
two years and those sides will be competitive with other. 00:58:15
Jails around the area benefit package as well. It helps out to retain. 00:58:22
Officers in the jail, we have a lot of turnover. We've worked really hard and diligently in my first twenty months in terms of 00:58:28
retaining people and trying to make and work with the commissioners and councils in terms of a package that makes them want to 00:58:34
stay and make this a career. So the first one is a correctional contract. That's before you. 00:58:40
I'd just like to add that during the contract negotiations that the the bargaining committee is made-up of myself, Councilman 00:58:47
Short, who is the president of the council, Councilman Councilman Moon, and also Councilman Freiburger originally but like. 00:58:55
Sheriff said he had to back off, but he had a really good negotiation with the corrections crew. They represented themselves very 00:59:03
well. 00:59:07
I think everybody was very comfortable moving forward with the numbers, what was offered. 00:59:13
The the council felt like they could move it forward on their end from Councilman Short so. 00:59:20
I just want to thank them for their professionalism. 00:59:26
As well. And I like to say, you know. 00:59:28
To me, there's two parts. We're talking about the increase in salary and I talked to Michelle and she showed me comparisons of 00:59:33
other counties in Louisville and all that. And so I'm in favor of the salaries, but it's the. 00:59:39
It's the fringe benefits is where I kind of have some, some heartburn. You know, we had a joint meeting. 00:59:46
With the County Council several and we talked about Perth right now the county portion is is 6% and we've asked the thinking about 00:59:53
asking the county employees to pay three and then the county pay the other three. 01:00:01
And, you know, and then it got tabled at our last meeting, You know, that's one of the fringe benefits at the. 01:00:09
That County Council has zoned in on We had a Mr. Freiberger last year. 01:00:16
He made a motion to to cut some of the perf out of the General fund. 01:00:22
You know, and so you know, they, you know, we, we hear this mantra that you know, we, we need to, we need to cut back on the 01:00:28
benefits. We need to rein it in. 01:00:33
And you know when you look at this, the deferred comp currently it's at. 01:00:39
I think $50 I believe. 01:00:48
And. 01:00:51
Yeah, currently it's at $50.00. So the employee pays 50 and the county pays 50 and they want to increase that to $100. 01:00:55
And I know we're only talking about. 01:01:04
The correction officers and not last count, I think it's about 60 or 70 when you have a full. 01:01:06
A full head count I believe. 01:01:12
But so you're looking at $1200 a month times that amount and you know it, you know, it's, I'll say this and it'll, it'll, it, 01:01:15
it'll also. 01:01:20
I I guess be. 01:01:28
Attributed to to the next discussion too, is that we we received the budget summary from. 01:01:31
Baker Tilly today. 01:01:40
And they're forecasting, if I'm reading this right on the 2025 that the general fund is going to be in a deficit of $4 million. 01:01:43
And the jail, the the lift, the corrections will be in the deficit $1.4 million. We're talking about $5.4 million. 01:01:52
You know, and we just had the health department come up here and they talk about, you know, how we're going to pay for the 01:01:59
building. 01:02:03
Talk about the renovation and I did a quick, it's around $133,000, you know, and so every pain that we can save, you know, I think 01:02:07
we need to bottom line is I think this needs to be vetted by the County Council first because they're going to be the ones paying 01:02:13
the bill. 01:02:18
And. 01:02:25
We are the ones that, you know, supposedly handle the, the fringe benefits and all that. But but again, you know, the council has 01:02:26
not vetted this. We've not had any kind of public hearings on it or anything. And and I don't know if. 01:02:35
If in these figures here the 400,000 and the 1.4 deficit, if that includes the salaries and all that. But you know to me, I, I 01:02:45
have to. 01:02:50
County Council needs a bed at first before I can if I can get my approval. 01:02:56
Again, I'm not against the pay raises. If this was a separate vote on pay raises, I would vote yes. But because of the other 01:03:00
stuff, I cannot focus on it. Do you know what somebody makes as a retirement, say if they're a county employee? I'll just say the 01:03:06
jail. 01:03:11
Do you know what somebody makes retirement wise? 01:03:17
From the jail? No I do not. 01:03:22
Do you know, no, do not OK, because you spelled a lot, a lot of the figures you know, and part of that deferred comp is a way to 01:03:26
help folks out when it comes to their perf. The county is looking at taking away a percent so they'll have to pay more money. So 01:03:31
the raise will be cut into that was given. 01:03:36
Expect someone to deal with the worst people in this community. 01:04:12
Council, you don't need public hearings. You have a council person representative on our collective bargaining meetings. In good 01:04:46
faith, over several meetings we've done this. 01:04:50
So I mean that's. 01:04:54
My two cents, but also too, if I could say you mentioned that the the other employees, I think theirs is what 1750? 01:04:56
So it was $35.00 a month. Well, this is already. 01:05:05
What, $100 a month with a match and we're going to go up to. 01:05:10
To $200.00. So it's possible, but I think you're dealing with apples and oranges just a little bit when it comes to the services 01:05:14
they provide, whether it's in the jail, whether it's on the road as a police officer. And Steve, I understand, but again, we need 01:05:18
other employees in order to. 01:05:23
To do what they have to do in order to to support us. 01:05:29
So I think everyone of our county employees is important, but I would like to touch a little bit on what the sheriff is talking 01:05:34
about. You know, we have our corrections officers that deal with some of them. 01:05:39
What I would consider. 01:05:44
The roughest elements and some of the roughest people at times. And it's a pretty thankless job. I mean, I think we have a very 01:05:46
dedicated bunch. 01:05:50
I think that the salaries and the benefits match. 01:05:54
Fairly close to what we have surrounding us and I think deserve every penny of it. I mean, there's nobody working for the 01:06:00
corrections off department driving Ferraris into work. You know, these guys coming to work. It deserves a fair day wage and 01:06:06
retirement. We don't know when they could tell you so. 01:06:11
And again, I'm not against the the pay increases, but it's the. 01:06:17
It's the other portion that it. 01:06:21
It keeps going up and up and up and we have this have this discussion with the County Council about the about the perch, you know, 01:06:24
and this just adds to it. 01:06:28
You know it's going to be a discussion. Well y'all need to rein this in. It's. 01:06:33
It's just getting out of hand, you know. But again, I'm, I'm totally in favor of the raises. It's the other, it's the other 01:06:38
portion that I. 01:06:41
That I've got heartburn over. 01:06:45
All right. 01:06:50
We'll need a motion to. 01:06:52
Approve. Again, approval by the commissioners does not mean that the contract didn't be executed. It's still going to have to be 01:06:55
vetted by the council on funding sources found, otherwise it will not. 01:07:00
I'll make the motion to approve the collecting bargaining agreement with the corrections officers. 01:07:06
I have motion to have a second. 01:07:12
I will second all in favor aye aye. 01:07:15
I abstained again. I support the raises, but the French benefits we have to be careful with. 01:07:19
Thank you. The last contract before you is a merit police officer contract. 01:07:25
Yeah, once again, the bargaining committee met with the bargaining unit from the White County Sheriff's Department, Rd. officers, 01:07:31
the merit officers, and I think there's. 01:07:36
There's no surprise. You know, the salaries and benefits for many of our surrounding agencies have gone up very tremendously, as 01:07:42
well as some other benefits. I think are the representative, Mr. Brewer from the Floyd County Sheriff's Department did a great job 01:07:49
presenting their case and actually I think came in with with some very reasonable requests. 01:07:57
Once again we had members of the Council that were on the bargain committee. All parties bargained in good faith. 01:08:06
It does increase, you know, salaries, but in, in my opinion, you cannot afford not to pass this because, you know, we have an 01:08:14
outstanding Police Department and we want to keep it that way. So. 01:08:20
I'd like to see this contract approved tonight. 01:08:27
I feel the same way. I mean, I'm I'm in favor of the raises, but it's a French benefits that we just need that. 01:08:32
We've got the reign in. 01:08:38
All right, there's no further discussion on the matter. I'll look for a motion to approve. Yeah, I'll make a motion to approve the 01:08:41
collective bargaining agreement with the merit officers. 01:08:45
And I'll second all in favor. Aye, aye, abstain, thank you very much. And as far as. 01:08:50
The signatures always on the meeting will sign on. 01:08:57
OK, Thank you. Thank you, County Attorney Rick Fox. 01:08:59
Got a few atoms here. The 1st is the Floyd County Extension office lease renewal and that's with Purdue and the monthly 01:09:03
installment $4019.35. That's. 01:09:12
With the Purdue Research Foundation. 01:09:21
And the Board of Commissioners, and I have no idea what they do, but that's in front of you to approve. 01:09:24
What's the duration of that? 01:09:34
The duration is. 01:09:37
60 months. 01:09:42
OK. Is that what the previous from renewing at least? 01:09:45
From September 1 of 2024 and expiring August 31st to 2029. 01:09:48
Mr. Bagshaw, I know you're involved with that. Do you have any comments as to what that extension office does? I don't mean to put 01:09:59
you on the spot. And you can always no, he cannot pass up. 01:10:03
He's a good politician. He cannot pass up the open microphone. 01:10:09
Actually, Mr. Fox, they are an amazing group that do a lot of good in our community. I've called them to. 01:10:13
Now, one of the jewels of the community that's really don't. 01:10:21
Get not utilized as much as what they should be utilizing. 01:10:25
Well, First off there. 01:10:29
They're over 4H, which we all know about 4H. They're over the. 01:10:31
A lot of different programs of. 01:10:36
The county extension agent works for them and I forget her title now, but Gina Anderson, she did. She's a hard worker. But 01:10:39
actually I can say it's just I think it's a underutilized unknown agency in our community. And I know I'm set on there and I think 01:10:46
it's pretty consistent with what they've been charging. I will just make a comment that why is Purdue Extension paying rent to 01:10:54
Purdue University and they go well Purdue. 01:11:01
Foundation owns the building. 01:11:09
So that's why we have and they're well known to the agricultural community. That's probably where they interact with the. 01:11:11
The population probably the most meaningful way, not that other things aren't meaningful, but they they answer a lot of queries 01:11:18
for them with regards to soil content. There's a problem they they'll come out well. They also do soil test for anybody in the 01:11:23
garden. 01:11:28
They put on Pollinator Day in April. 01:11:33
They also like to say work with 4H, You have a lady there, forget what her name is, but she puts she has worked with people with 01:11:37
diabetes, diets, you know, things like having diabetes. There's just a whole, a whole host of stuff that they do. 01:11:44
Yeah. 01:11:53
OK, so. 01:11:57
Having said that, a motion to approve, motion to approve, All right, all in favor, aye. 01:11:58
All righty. The next item is FCL 2024 Dash 21 Door to Door Solicitation Ordinance. 01:12:06
This ordinance has been revised and just to highlight some of the the things in the ordinance, we have a license fee that will be 01:12:17
charging a 10 day license fee of $50, a 120 day license fee of $150.00, a one year license fee of $300. 01:12:29
And then there's a $250 application fee. 01:12:42
So we have restrictions on. 01:12:48
License and door to door solicitation. 01:12:53
Door to door solicitation by the vendors may be conducted. 01:12:58
Between the following hours, October one through April 30th between 10:00 AM and 6:00 PM of any day. 01:13:04
And from May 1st through September 30th, between 10:00 AM and 8:00 PM of any day. 01:13:15
And subject to. 01:13:24
Revocation will be issuing identification cards and we'll also be going through a process to approve people to get a permit. 01:13:27
They're going to be required to give us information whether it's a corporation or whether it's an individual with respect to. 01:13:37
Whether or not they're doing have done door to door solicitation any any other counties we want to research. 01:13:49
Whether or not that's. 01:13:57
Been problematic for the residents of those counties. We also want to do criminal background checks before we issue permit we want 01:13:59
to know who it is that we're giving a license to to go door to door and. 01:14:06
We also have a release for them to sign so that we can get with the Floyd County Sheriff's Department and do the background check 01:14:16
on them. 01:14:21
That basically highlights the the ordinance and you've had an opportunity to review the. 01:14:31
The detail of the ordinance, without reading it to you, I think was long overdue. I think there was also a revision of the fines 01:14:39
that can be imposed for. 01:14:44
Non adherence of that and I don't know if you want to review those or not either. Other significantly higher than what they have 01:14:49
done in the past. 01:14:53
Yeah, that's, that's what I mentioned. The first violation $100, second violation $500, third or more violations, $1000 for each 01:14:58
violation. 01:15:02
OK, so again, my opinion long overdue and. 01:15:08
Appreciate everyone who brought that need to our attention, including those in the room and those not in the room presently. 01:15:13
Motion to report County Ordinance 2024 Dash 21, Door to door Solicitation Ordinance with unanimous consent. Motion to approve with 01:15:20
unanimous consent and a second all in favor, Aye. 01:15:27
All right, OK. And we have a modification to the Building Authority contract. 01:15:36
And basically what this is all about is that we had set the budgetary process with the building authority and the commissioners 01:15:45
that occurred in the middle of the year and the County Council has requested that we revised that agreement so that the budgetary 01:15:53
analysis take place. 01:16:02
At the same time as the County Council reviewing. 01:16:12
All the other offices and so in light of that request from the County Council. 01:16:15
I have put together a modification to the contract and. 01:16:23
It's in front of you to just align with the County Council and the county budgetary process and so. 01:16:29
With with that being said, the building authority has their meeting in another week or two and I've talked to their council and so 01:16:40
they should be entertaining this. And so it's on your docket to go ahead and approve first. 01:16:47
Motion temporary, I'll 2nd. 01:16:55
Motion to approve. And the second all in favor, aye. 01:16:58
All right. Thank you, Mr. Fox. 01:17:01
Item nine We have a request for a solicitation permit from Oxy Pest Control. 01:17:04
So my name is Matteo Estes. I'm the regional manager for Moxie Pest Control. I've been with the company for over half a decade 01:17:13
with my local branch boasting a 4.9 out of five stars with over 500 reviews. I currently have 346 active customers in Harrison 01:17:20
County and then 266 active customers. 01:17:28
In Clark County and other counties throughout Louisville. 01:17:36
We are a locally operated pest control company. The reason our model is a lot better than other companies is one, it's a win, win 01:17:41
situation for everyone involved. Meaning we save people money because we're at the door. There's no cost for drivetime, There's no 01:17:48
cost for driving across the entire city to customers can ask any question that they want at the door face to face. They can get 01:17:55
information and then they can schedule a service right away. 01:18:02
I'm in the business of just doing what's right, so if we get the motion to approve one. 01:18:10
We're ready to pay any fee needed, but to we're ready to save people some money in Floyd County and upgrade their pest control. So 01:18:16
thank you. 01:18:21
All right. Any questions, comments. 01:18:29
I have one quick question. How long you've been servicing people Floyd County? 01:18:31
Floyd County, we have only a couple customers because we didn't know the process for the permits, so we've been serving people for 01:18:35
under a year in Floyd County. 01:18:40
But you do business in Clark and Harrison, they have processes as well, correct? And you can check with Shelby Hardin, you can 01:18:47
check with a lot of other counties that we've done as well, Heart Bullet and specific cities. It's Sellersburg, we've done 01:18:53
Jeffersonville. There's a lot of other companies that don't do things the right way and like it's door to door. Like we'll 01:19:00
obviously get confused with them. But I'm in the business, like I said, I'm doing what's right and so. 01:19:07
I'm here to do whatever we need to. 01:19:14
Well, I only ask because, you know, all those places have you know, similar ordinance or something in place. Why would you think 01:19:17
that we would not? Why would you think we would not? Because there is one county that we got denied from and we're actually having 01:19:23
to go through the process of before we even did any business there. So we're in the process of actually sending them a demand 01:19:28
letter and. 01:19:33
That process. 01:19:39
Thank you SO. 01:19:40
We actually have also called. 01:19:42
I called multiple times to different people. I have the names, I can e-mail them over to you guys, but they we were also told that 01:19:44
there were no permits required. 01:19:48
And then we found out through the Sheriff's Department, which we contacted, and they referred us to the commissioners. 01:19:52
Do you know who told you there were no permits required? 01:19:59
I will have to go back and scroll through my emails. 01:20:03
But I have phone calls and emails specifically from people. 01:20:06
You said that there were no permits required. 01:20:12
Sheriff, how many contacts did you have in regard to this company and your officers? 01:20:14
We had several and quite frankly multiple contacts. The only thing I'm all for someone trying to make a living in their 01:20:21
businesses, but I would have one thing to say to you is the fact you were stopped at least once, right? 01:20:27
Yep, not me specifically, but your company. 01:20:34
Yes, and they were told not to go door to door and they continue. So as soon as I was told I moved them out of the town. 01:20:37
OK, so that's my only caveat. If they want to make a visit, that's their choice and that's fine as long as they go through the 01:20:44
procedure of getting permits, which they sound like they're doing. But that was knowing Kevin, we did get a lot of calls in 01:20:48
reference to the company people that made people nervous or, you know, they were really not so aggressive, a little aggressive, 01:20:53
you know, staying on the property, that sort of thing. So we take pride in here in Floyd County what we do and people want to be 01:20:57
safe. And then just. 01:21:02
Well, let me ask, with our new ordinance we just passed, they'd have to go ahead and reapply with it. 01:21:13
That ordinance becomes effective. 01:21:21
As soon as you pass 5 minutes ago. So yeah, there would have to be. So from a procedural standpoint, options for the board tonight 01:21:23
would include taking no action, which would essentially. 01:21:29
Table it. We could officially table it, we could bring it up for a vote, and tonight we could bring it up for a boat and approve 01:21:36
it so I. 01:21:39
If we take no action upon this tonight formally, at what point could they come back with for reapplication? 01:21:44
Well, there isn't an application right now. 01:21:54
Well, for another request. 01:21:58
Could they come back at the next meeting? 01:22:01
They could OK and if we formally table it. 01:22:04
They can come back for a request. 01:22:07
At a later date to be named by us when we put it on the docket, correct? Correct. 01:22:10
If we approve it, it's approved. If we disapprove of it, at what point could they come back and seek re application? 01:22:16
Or seek a demand upon us. 01:22:24
You mean if you turn them down, turn them down? 01:22:26
I think probably at that point in time it. 01:22:32
I would guess, say a year. 01:22:38
It depends on what you're turning them down for. 01:22:40
And so you know, there you'll have certain reasons why you turn somebody down. And so you know if those the reasons why you turned 01:22:43
them down haven't been resolved. 01:22:49
By the time they come back for a new application then. 01:22:55
You know you're. 01:22:59
You're going to turn them down again? 01:23:00
Yeah. So it might be. 01:23:02
Best to formally table this. 01:23:05
To a date. 01:23:09
Down the road where we have had time to. 01:23:10
Assimilate companies through the new ordinance. 01:23:13
Yeah, I agree. I think we need to table it and that way you all can take a look at the ordinance and see what's required, OK. 01:23:16
We can have one for you probably. 01:23:25
Online What tomorrow you think? 01:23:29
Yeah. 01:23:35
OK. 01:23:36
John, would you like to table it to a certain date? Second meeting in September? 1st meeting September. 01:23:37
I suggest. 01:23:45
The first part of September, kids are going to have to do background checks. 01:23:46
For all of their staff. 01:23:50
Let's give him, let's give him Thomas to the second. 01:23:52
Make a motion. We table to the second week in September, 2nd meeting in September or the second sorry, second week, second second 01:23:55
meeting in September. Yes. 01:23:59
OK. I'll say I have a motion and a second to table the matter until the second week, second meeting in September. Susanna can give 01:24:03
you the date of that meeting and also guidance with regards to where to find that online and the requirements that will be. 01:24:11
Necessary for that meeting. OK, cool. Thank you. Request to apply for the permit today though. 01:24:20
No, yeah, I would be a no one. No, I would say no. 01:24:30
Why not? 01:24:34
Because we have a new ordinance that you haven't looked at it yet, OK. 01:24:36
And so you need, you need to look at that make sure that you can meet all the requirements of the ordinance, OK? I've been doing 01:24:42
it in six years, so I'm pretty familiar with the ordinances, OK. 01:24:47
So then no application process. 01:24:55
As of right now, no. 01:24:58
Yeah, thank you. That means. 01:25:00
No business employee county until OK, yeah and we take your former voter and if you want to. 01:25:02
On, I mean the matter has been tabled. So that's that's it, none of us, OK. 01:25:08
Thank you. 01:25:13
All right, I need approval of Commissioners meeting minutes for July 16th, 2024. Motion to approve. 01:25:17
Have a motion in a second. All in favor, all right, approval of payroll and claims. 01:25:24
Motion to approve and I'll second. All right, all in favor, aye, I would comment. I looked at the credit card and everything looks 01:25:32
yeah. 01:25:36
Looks good. It's being used what it's supposed to be used for. 01:25:41
Appreciate. 01:25:44
All right. Any public comment from any elected officials? 01:25:46
I've already heard from. 01:25:49
Both of them identified their self. 01:25:54
Any public comment on any other matters this evening? 01:25:58
All right. 01:26:04
Today's meetings in addition to this, we had a stormwater meeting at 4:30 and our next Commissioners meeting will be August 20th, 01:26:06
2024 at 6:00 PM. 01:26:10
We. 01:26:16
Any committee reports? 01:26:18
OK. 01:26:21
On July the 18th, I attended our joint workshop with commissioners and the County Council. On Wednesday the 24th, I attended Zoom 01:26:23
call. The Indiana County Commissioners were discussing our winter conference on the 25th. 01:26:30
Jason and I, we attended the meeting to negotiate the contract with Teamsters, represent our Public Works department. On the 30th 01:26:39
I attended our Redevelopment Commission meeting and then in the afternoon I attended an event at Dover Park with Don. We met with 01:26:44
a. 01:26:49
That start up innovation educated fellowship and we talked about Nova Park, its history started up as a professional development 01:26:56
program designed to empower students and teachers to install and still a mindset of innovation to see problems in the world as 01:27:02
opportunities. 01:27:09
On August the 1st attended the J Rack mental health addiction meeting and that afternoon now you and I, we attended the shirt 01:27:16
partners through our ex update for insurance and then later that day we had the virtual. 01:27:24
Envoy meeting and then on this last Friday, Don and I, we attended the RDA meeting on August the August the 2nd at Ivy Tech. 01:27:34
So it's John alluded to. On July I attended the Floyd County Council workshop as well. Also on July 19th attended the Joint 01:27:47
Counselor Commissioner meeting where several topics were discussing. 01:27:53
Including how EMS operation were going from both Ameripro and Highlander fire. 01:27:59
That date also had a meeting with Kyle New from Prosser School of Technology in regard to opening up more training opportunities 01:28:05
for law enforcement, fire and EMS. They were very receptive about assisting with that. 01:28:11
July 24th we had an EMS task force meeting. The task force is wanting to hear a presentation from Putnam County, Mississippi. So I 01:28:20
made contact with Anthony Taylor who's their Deputy Chief of Operations, and he will be making a presentation on their system to 01:28:26
the task force on August 15th at 3:00 PM. 01:28:32
I would highly encourage the public to intend to hear about the pioneering changes that Putnam County has implemented since their 01:28:39
EMS lit was put into place. On July 25th, myself and Commissioner Schomberger as well as Councilman Short begin our negotiations 01:28:46
with the Teamsters in regards to the Floyd County Road Department contract and then on August 1st attended a meeting with the 01:28:53
Harness Envoy in regard to the County building and proposed annex. 01:29:00
All right, It's been busy. Everybody's been busy. Yeah, I think I was part of some of those, but not all of them. The only ones I 01:29:08
can think of that were unique. I. 01:29:11
From those already listed were Ribbon Cutting for Indiana Hot Yoga July 17th and. 01:29:16
A secondary meeting after our envoy call August 2nd with Michelle Allen and Reeds to start looking at space utilization for the 01:29:23
Chase building. 01:29:28
So that is it. Any closing comments from? 01:29:34
Yeah, a couple. I mentioned that Don and I, we attended the RDA meeting. 01:29:39
On Friday and they announced we had 74 different projects that people had submitted, Not people, but. 01:29:45
Government had had submitted. 01:29:54
And they they selected 30 of the 74 and they rated them and the number one project out of the 30. 01:29:56
Was Floyd County's project, the Edwardsville school Community Center located within the gateway Village. It the rating was 6.98 01:30:08
and I forgot what the Max you could have, but anyway, out of the 74 our project was was rated #1 which I think says a lot for our 01:30:17
redevelopment committee and also for for Don Mopp back there does a really good job. He's visionary and and he was a. 01:30:27
And putting this together, we also, as part of that we are eligible. 01:30:38
Part of the Lilly Endowment. 01:30:46
They have two different parts. One of them is for the arch, the other one is for blight remediation and development. On that one, 01:30:50
we we ranked it was third. But again, overall we did really well. They have not decided how much money would be would be put put 01:30:57
aside to these projects, but that's coming down the road. 01:31:04
And then second, just real briefly, our EMA 8 version management agency couple several weeks ago, they were called to assist in 01:31:11
locating a hiker who had been missing for seven to 10 days in Wolfe County. Their EMA had contacted ours and they, Jason Malkin 01:31:20
went down here and he took the Indiana United search. 01:31:29
And rescue dogs down there. And within several hours they were able to. 01:31:38
Locate the hiker and took several hours, several hours to rescue him. Anyway, the hiker was taking safety and received medical 01:31:43
care. So that was a big, big win, the big accolade for for Floyd County. So I appreciate our Floyd County, MA, what they do there. 01:31:52
I think Mr. Mark just got approved for Indiana Task Force One, too. Yeah, yeah, he was. He was selected as a team member of the 01:32:01
Indiana Department of Homeland Security Incident Management Assistant Assistance Team. 01:32:09
And the IMEI team will respond to local and regional states, statewide incidents and possibly be deployed by FEMA in the event of 01:32:17
a nation incident. And if he is deployed and while deployed, I'm at will reimburse the county for his wages and his benefits. So 01:32:23
that's a big, that's a big plus for Floyd County. 01:32:29
I, I just want to give props to the health department and their board. I know you guys have been working really hard here lately 01:32:36
and I just want to acknowledge that and say thank you for everything that you're all doing. I'd also like to say thank you to all 01:32:42
of our corrections officers. I see several of you on attendance today, as well as our merit officers. I just want to say I thank 01:32:48
you for everything that you do to help keep our community safe. Thank you. 01:32:54
And you've heard me talk enough tonight, so I'll look for a motion for adjournment. 01:33:01
Thank you all. 01:33:06
Who's Rick running off to you? 01:33:14
