Yeah, yeah, because I would never welcome to the pre election election eve party here tonight, meeting of the commissioners. | 00:00:00
Welcome everybody, if you'll join me for the Pledge of Allegiance please. I pledge allegiance to the flag of the United States of | 00:00:09
America and to the Republic for which it stands, one nation under God, indivisible, with liberty and justice for all. | 00:00:18
All right. Do you have a cell phone? Please put it on silent or put it away and. | 00:00:27
If you need to text or have a conversation, the hallway is open for business. | 00:00:33
You'll please join me in just a moment of silent reflection, meditation or prayer, and we'll get ready for tonight's meeting. | 00:00:40
Thank you. | 00:01:08 | |
All right, item. | 00:01:10
We have a couple adjustments to tonight's Agenda. 1st. I have a few items that I'd like to have added to the agenda by unanimous | 00:01:13
Consent I. | 00:01:18 | |
1st we have a envoy contract amendment again that's our owners representative for the city county building. I'll do these | 00:01:24
individual I think probably the best way to do it. I can have a motion to add some. All in favor aye we have a Floyd County | 00:01:33
ordinance 2024-10 establishing a non reverting fund for non reverting fund for Edwardsville school TIF debt service fund. | 00:01:42
Motion to add second All in favor Aye Floyd County Ordinance 2021-11 Establishing non reverting fund for non revert. Yeah 2024 it | 00:01:53
says 2021. | 00:01:59 | |
2024-11 Establishing non reverting fund for non reverting fund for Red Wire TIF debt service fund. | 00:02:06
All in favor. Aye, aye. All right and. | 00:02:16
Floyd County Ordinance 2024-12 addendum to ordinance establishing a consolidated Fire Protection district for Lafayette and | 00:02:23
Greenville Townships, Floyd County, Indiana, and providing for the appointment of fire district trustees for the Highlander Fire | 00:02:30
Protection District. FCO 2022 Dash 41 So moved second. All in favor, all right. | 00:02:37
All right. So those items will be added. And under new business #1 county engineer ratio Yuritia, the approval for bids for local | 00:02:45
paving spring 2024 has been tabled. | 00:02:50
All right. So that's all the. | 00:02:56
Changes at the line of scrimmage here, OK? | 00:03:01
So new Business #2 Building and Development director Nick Creeby. | 00:03:04
I am substituting for Mr. Creeby. He is at a parks board meeting. | 00:03:16
This afternoon, so he gets all the fun. | 00:03:20
Yes, he did. I believe you have a resolution regarding the Development Impact Advisory committee that he was working on. | 00:03:24
So next ask, I believe there's seven, seven members of that advisory committee. | 00:03:33
And that would start the process for review for development impact fees. | 00:03:43
All right. Have those individuals been? | 00:03:48
Notified in advance of tonight's meeting. | 00:03:51
I do not know. | 00:03:55 | |
I believe so, but he did not elaborate whether they've been. | 00:03:57
OK. I believe we were going to read them into the record tonight in any event. So we can do that and then just check with Nick if | 00:04:03
you will, make sure that everybody can notify appropriately. I sure will. | 00:04:07
And do you have a list to read in? | 00:04:14
You have it on the back of the amendments, Jenna. | 00:04:17
Front and back all right. | 00:04:21
Well. | 00:04:23 | |
John, would you like to do the honors? | 00:04:26
OK, Bob. Bob Murphy, He's a. | 00:04:28
Development community representative Brad Benson, development community representative, Jason Copperweight, development community | 00:04:32
representative, Dale Mann, community representative, Colin, receiver, development community representative, Billy Stewart, | 00:04:39
community representative, and Lois her talk community representative. Those are the seven. | 00:04:46
All right. Very good. And we thank all those individuals I see Mr. Mann here tonight. So thank you for stepping up to do that. | 00:04:55
Don't be surprised if I come to a few of those meetings and ask some questions of you. | 00:05:01
That was in good humor, Mr. Mann. | 00:05:09
I thank you for stepping up to do that. | 00:05:15
64. | 00:05:19 | |
Present her civilians instead of. | 00:05:21
That split covers what is mandated by the state statute for putting those together. I don't know if it's 64 or how it came about | 00:05:26
on that, but it required it. You know that the state statute had to be followed and I know Nick was careful on how he allocated | 00:05:30
that, so. | 00:05:34 | |
Need a motion? Need a motion to approve Motion to approve Floyd County Resolution 2024-03 Impact Fee Advisory Committee and I'll | 00:05:41
second that all in favor. | 00:05:47
Second item I have is he has a platform approval for Bridlewood. | 00:05:58
Subdivision Section 3. The development agreement is in place and the cash charity for the bond is in place. | 00:06:03
Davis and a friend. | 00:06:13
Somewhere. | 00:06:19 | |
OK, Motion to approve Bridalwood Plat 3. | 00:06:23
And I'll second. All right. I have a motion and a second. All in favor. Aye. Aye. | 00:06:26
All right. Thank you. We'll sign and get that to you and I'll leave that closed out your duties recovering for Mr. Creeping. Now | 00:06:31
we'll move on. Director of Operations and Planning, Mr. Don Lop. His first item I have is a Nova Park build, operate transfer | 00:06:37
contract for Building 5, which is the red wire building. | 00:06:42
At your last meeting you approved the recommendations to for Jeff are for Shireman Construction to be the contractor of record and | 00:06:48
this would be to enter into that agreement. The next steps in the process after this would be to then submit this documentation to | 00:06:58
River Hills for review for the ready funds and then after that we have a process, a two step process. | 00:07:07
One, going through planning and zoning in terms of. | 00:07:18
The technical review committee for the building and then also the architectural review committee that is part of the plan. | 00:07:23
So Mr. Fox has has the contract so. | 00:07:32
I believe everything's in order. So we just, I would ask ask tonight for approval of that contract. Any any comments for Mr. Fox | 00:07:36
on that after your review? | 00:07:43
Any comments or questions? | 00:07:51
Look for a motion to approve. | 00:07:53
Motion to approve Nova Park Build, Operate, Transfer contract on Building #5. Second all in favor. | 00:07:55
Second, second item is just some is informational. That is Ramsey Water. They met with myself regarding their American rescue | 00:08:06
plan. They had two projects. One of those projects is was with the town of Greenville. They are unable to obtain the. | 00:08:16
The land for that project. So they will be requesting formally to move $60,000 from that project into their water to their main | 00:08:26
project, which is a water main project that goes through the town of Georgetown. | 00:08:33
So just a more of an FYI, that is the really the last water project that isn't. | 00:08:41
Near completion and they expect to start sometime in July. So that would be the that's our we had 21 water projects back in 20 | 00:08:48
2021-2022 22 so that's we'll have a formal document for you at your next meeting. OK good. | 00:08:58
Next time this is State Board of Accounts compliance report, I've briefed you on as the storm water board on that report. But to | 00:09:12
briefly go through that again, we submitted that compliance report in January. We had it approved then we had a a contact at the | 00:09:22
end of January saying that that process was approved in error after some communications with State Board of accounts. | 00:09:32
And then communications internally with the auditor and the Department of Hwy. Public Works and we are. | 00:09:42
Submitting that this back to you, we did send that as a draft SBOA and they did say that that was appropriate. | 00:09:51
That they would, they would sign off on that. So tonight it would be to prove that compliance which basically. | 00:09:59
How this will work is there's three tranches of funds that Highway and public works deploys are paid out of. They'll be paid out | 00:10:06
on a percentage basis. On a monthly basis. They are reviewed then at the end of the month by myself and and this topic to make any | 00:10:12
type of. | 00:10:19 | |
Corrections, Payroll corrections at the end of each, at the end of each month, and so. | 00:10:28
That's the process instead of just the reimbursement process, which the state board account said that they they would not, they | 00:10:35
could not agree. | 00:10:39
Or shouldn't approve? They approved. Then they said no. So. | 00:10:46
So you need a motion to a motion to accept the SBLA compliance. So moved and I'll 2nd I have a motion and a second. All in favor, | 00:10:51
aye? | 00:10:57 | |
Next time Paola Pike corridor say just give you an update. We received $100,000 grant through Kipta. So reimbursable grant to | 00:11:05
study the Paoli Pike corridor from off the wood to the post office on Paley Pike for a. | 00:11:14
Really the first step conceptually in terms of either a trail or a some type of sidewalk system to allow for pedestrian travel | 00:11:23
along that door. So that was approved through KEPTA. I would be remiss saying that a lot of that work was done by Mr. Craving and | 00:11:31
so we gave him another task and he and he got some more money for the county. So that's a 7525 reimbursement. So we pay the | 00:11:39
upfront cost and then we get reimbursed 75%. | 00:11:47
Where, roughly, are the beginning end points of the sidewalks contemplated? | 00:11:56
They are going to review from Buffalo Trail subdivision there at the very end and then the United States Post Office. | 00:12:02
Is the 2 two Terminus points it's on both sides down or zone? We're developing that scope. I would say we were going to probably | 00:12:12
look at both sides, but then they'll come back with recommendations if we think they'd have a series of different alternatives to | 00:12:18
look at in terms of. | 00:12:23
Is there trails of sidewalk with side one, side two sides? Is there a mid block cross where folks can cross mid? | 00:12:29
Midway through the corridor, so. | 00:12:40
A lot of investigation to do also right away. | 00:12:42
OK. | 00:12:46 | |
Give you an update on the Aboriginal school real quick. State Road 62, the traffic light is approximately about 3 weeks to | 00:12:50
completion. Today they were trying to get a hold of the at the end of the day for the electrical permit inspection for the traffic | 00:12:58
lights. So that project should be complete and operational. I would say end of May. | 00:13:05
I guess what the next project oh Vincents Rd. give you an update real quick on that. That's going to start June 1st. RMC has | 00:13:16
started their work, signs of signage has went out also notifications along the corridor went out so and we are directing folks to | 00:13:22
the website. | 00:13:27 | |
For more information on the construction plans and updates on that. | 00:13:34
I think this one is the then the real quick. | 00:13:41
I've got two slides, so I'm under my minimum of five. | 00:13:45
And we've already got. | 00:13:51
Was this is something what we're going to try to do at least once a month? This kind of got pushed back for some other things that | 00:13:54
you had on the agenda. But this is part of the operations staff and we have 4 individuals that serve our maintenance in custodial | 00:13:59
staff. | 00:14:04 | |
And this kind of gives you kind of a breakdown of what they do. | 00:14:11
Our facilities budget is 420 four $102,000 salary and benefits 202,000. They they maintenance has five buildings. They also have | 00:14:16
20 acres that they mow during the summer. Custodians have 5 buildings as well. The total square footage that each of those. | 00:14:26
Including the grounds is somewhere over 1,000,000 square feet. | 00:14:37
Either under the grounds or the buildings. | 00:14:42
And so and that's just a list of the, the, the facilities that they're in charge of. So Pine View, they were just last week | 00:14:45
changing the boilers over to chiller. So it's a little bit more cooler in the room than it has been. We set those for May for | 00:14:53
chillers and November for a boiler and that round just makes try to extend. | 00:15:02
Being as cost effective as possible in terms of when we change over things. | 00:15:11
Rice Building is is the same way they also deal with the Highway Garage, Nova Park North Annex. | 00:15:16
The custodians clean the health department and the digital libraries mode by staff as well. | 00:15:23
So as you can see, four people total. They have a lot on their plate. | 00:15:28
But just wanted to give you a brief. | 00:15:35
There's some, you know, general maintenance and from time to time though, that's that building shuttered. | 00:16:12
But just like letting you know what portion of the staff does also allows you to kind of get an idea in terms of. | 00:16:20
Of staffing and facilities and. | 00:16:29
The man is involved for the square footage that is sometimes down. You've been on a mower up there too at Nova Park, have you not? | 00:16:34
Yeah, good job. I didn't. I didn't count that. | 00:16:43
Just acknowledge it. Thank you. | 00:16:48
Next item is Town of Georgetown. This is informational as well. I spoke with Mr. Fox this afternoon. You received a letter from | 00:16:50
the town. They are requesting property at the end the West End. | 00:16:57
Of a develop a project they're doing for their town park. | 00:17:05
At the Georgetown Greenville. | 00:17:11
Property line and it's 1650 Georgetown. I'm sorry, Georgetown, Lanesville. | 00:17:14
I misspoke. | 00:17:21 | |
So they will be getting together a deed in a process with Mr. Fox regarding. | 00:17:25
That transfer of land that would then close out their entire project. | 00:17:31
And allow them to start work on it. | 00:17:35
And then the next item is the envoy contract. I believe you have that in front of you. | 00:17:39
The changes there I believe are some. | 00:17:46
Changes for engineering, additional engineering work and structural engineering cost. | 00:17:50
Believe that's on Page 3. | 00:17:56
I may be mistaken on the page. | 00:18:00
Yeah. I think we were also briefed on that with our one of our. | 00:18:05
Every other week meeting so, so we just need a motion to approve that amendment. | 00:18:09
So moved. | 00:18:16 | |
Second. All right. Motion is second All in favor, aye? | 00:18:17
And then Jay is. | 00:18:24
We approve the a non reverting for capital for Edwardsville school. This is debt service. This was requested as an additional item | 00:18:28
that from the auditor's office and State Board of accounts for the debt service funds for both Red Wire and it was just good. | 00:18:36
All right. | 00:18:46 | |
1st I'll look for a motion for the non reverting fund for the Edwardsville School tip motion to approve with unanimous consent | 00:18:48
Floyd County Orders 2024-10. | 00:18:53
I'll say, all right, a motion and a second to approve by unanimous consent. All in favor, aye, aye. | 00:18:59
And then also for the non recurring fund for Redmond Motion to to approve with unanimous consent Flint County Ordinance, 2024 Dash | 00:19:08
11/2. | 00:19:12 | |
Established an unreverted fund for the Red Water Tip Debt Service fund and I'll second that as well. | 00:19:18
All in favor, aye. | 00:19:24
All right. Thank you. Thank you. Thank you, Don. All right. County Attorney Rick Fox, Will County Ordinance 2024-12 addendum to | 00:19:27
ordinance establishing Consolidated Fire Protection District, Philadelphia and Greenville Townships, Floyd County, Indiana, and | 00:19:34
providing for the appointment of fire district trustees for the Highlander Fire Protection District, Floyd County Ordinance | 00:19:42
2022-41. And the Highlander Fire District was farmed in 2022 as a fire district and this ordinance gives them authorization. | 00:19:50
To conduct emergency medical services, including ambulance services, in their territory. | 00:19:58
All right. So any further discussion on that? | 00:20:07
And I will look for a motion to approve by unanimous Consent Motion to approve by Unanimous Consent, Floyd County Orders 2024-12. | 00:20:14
I'll second a motion second. All in favor? Aye. All right. Thank you. | 00:20:24
All right, Board and committee reports, Jason. Yeah, I'll start. So April 25th, I attended the open house, the Floyd County Public | 00:20:30
Defender's Office. It was nice to see how, what, how that space had come along for them. They went from the basement up to the | 00:20:37
third floor, I believe, But they did a real nice job. April 29th attended the frequent Township trustees meeting. We discussed a | 00:20:44
multitude of issues, everything from fire and EMS to roads out there in Franklin Township. | 00:20:52
May 2nd I attended the Animal Care and Control Board meeting and immediately after the meeting they held a workshop and was able | 00:21:00
to kind of sit together and and kind of brainstorm a little bit about what the future kind of looked like for animal care and | 00:21:06
control in Floyd County and the possibility of bringing that that shelter back to Floyd County as well. So and even throughout a | 00:21:13
few ways to possibly make it self funding. So that's what I got. | 00:21:19
Yeah, on April 25th I attended the Kip, the meeting where we took a vote to approve the 100,075 from the Kipton 25 from the county | 00:21:28
for the Paoli Pike corridor study on the 27th attended Pollinator day at Purdue. We had a really good turn out. Gina was expecting | 00:21:37
like 1400. We had 2200 people and we had like 1200 the first two hours of the event. So it was it was really, really good. The | 00:21:45
kids enjoyed looking at our observation. I have trying to find a queen and all that but it was it was a lot of fun. | 00:21:54
And then on April 30th, I met with Don and some other people talking about sheriff, talking about Edwardsville School, trying to | 00:22:03
determine, you know, the allocation of the rooms and all that. So that's basically it. Oh, and then we had several joint meetings | 00:22:10
about the EMS, so don't forget the joint meetings. So I think we're all of those. | 00:22:18
I did Pollinator Day as well. Public Defender's office as well. 17 Indiana had their every other. | 00:22:27
A month leading quarterly meeting actually out at Ivy Tech attended that. We had our kickoff with Andrea as they start to look at | 00:22:36
space needs and start to interview our stakeholders on that. | 00:22:42
On the 2nd. | 00:22:50 | |
Presented A proclamation to the Indiana Supreme Court for the problem solving courts over at the Foundry later that day, National | 00:22:53
Day of Prayer, and then later that day. | 00:22:57
Parks and Recreation Steering Committee. | 00:23:03
Met for few hours here. Hopefully we'll have some exciting news to present to the public in the short term on that. So everybody's | 00:23:05
been busy. Stay busy, that's good. | 00:23:10
Any public comment from government officials present today? | 00:23:18
All right. Any public comment from anyone else tonight, Mr. Mann? | 00:23:24
We will limit this to two to three minutes. | 00:23:30
Yeah, I don't have that much to talk about. | 00:23:33
I want to thank Y'all for accepting me on the Impact Fee Committee. | 00:23:36
Hope we can get some money that should have been been coming a long time ago to this county instead of charging the current | 00:23:40
taxpayers. And I noticed I've been studying up on the day ARP money were given to the water companies that could have been impact | 00:23:45
these. | 00:23:49 | |
We could use that money for something else to pay for fire. | 00:23:54
There's a whole lot of things I've been starting to reach and I think Nick's got it wrong. It should be 60, forty 60% for. | 00:23:58
Citizens and 40% for developers. I think that's what I read, but I wouldn't put my life on it. | 00:24:06
But anyway, thanks again and we'll see if we can't get some money coming into this county that should be coming in a long time | 00:24:13
ago. Thank you. Thank you being part of the solution we hope. | 00:24:17
Or anyone else from the public who would like to comment tonight? | 00:24:22
Linda Russell. | 00:24:34
Reason why I'm here and asked to be put on the agenda is this. Floyd County had a shutdown for years for a COVID. OK, now I have | 00:24:36
and have had for a very long period of time, decades, all that information prior to the shutdown. OK, Floyd County cannot say that | 00:24:45
it was a state mandate. | 00:24:54
That we shut down for a pandemic because again, I'm 64 years vested in the pandemic that you had in 2020. | 00:25:04
OK, Now what I did do was this, and I was at a meeting and you were there. Mr. Schellenberger, when I asked this prior to you | 00:25:16
shutting things down, I did sit there and say this, where do you stand in separation of church and state? | 00:25:24
And you made a comment and then you turned around and what was it? He couldn't go anywhere. You couldn't do this. You had to wear | 00:25:32
your mask and everything else. Now I do have those numbers and can prove beyond a shadow of a doubt. Frontwards backwards, | 00:25:41
crisscross sideways, upside down, standing on your head that that information is more than 64 years old. | 00:25:50
Now Floyd County cannot say again. The state mandated it because of the age of the information. We cannot say that Eric, the | 00:25:59
governor. | 00:26:05 | |
IS is in charge of doing the state mandate of shutting things down because what he did will say Floyd County, everything on the | 00:26:12
primary is Floyd County. Everything on 3rd party is everyone else that was involved. | 00:26:20
Now the announcement was made on 360. Well, you did it. 316 already had that information. | 00:26:30
OK, because 316 did I not know they were going to say 316? Yes, that's my birthday. Then you're going to do 3 days later, do an | 00:26:38
update, then after that you're going to do a 511 update. Eric's on the phone. Got it. Right Now with the 511, well, I have the 511 | 00:26:44
information also. | 00:26:50
OK. | 00:26:57 | |
Had all that? | 00:26:58 | |
Now I have Kentucky's information. Before Kentucky even came out there and said anything, I had all of that. Every little step you | 00:27:00
took, every store. | 00:27:05
Every business I have that information. | 00:27:11
OK. | 00:27:16 | |
Now when I was here last time. | 00:27:18
I sit there and you gave. OK. I came down 423. So what I did was this. I'll go straight to Kroger. | 00:27:22
Who I have their 511, I go straight to Kroger and Kroger gives me this telephone number and you got to hear this one because this | 00:27:31
is pretty good. | 00:27:35
I go there and I sit there and said this. How is it you having the 1:50 and if you the 150 thirty that you had this past weekend, | 00:27:39
how is it that you're having that when if you take one you take 2024 from 1875 when you said you had it and what to come out to be | 00:27:48
OK and they said 149 so I said which I knew I was going to hear that. | 00:27:57
OK, we're worth 150. Add a penny to it and you get 150. And that is from the Kroger distribution center and their number was | 00:28:08
423-4800. OK. I was here on 423. You knew I was going to get that from them. That takes us at 3 1/2 minutes, so. | 00:28:17
No, because I'm being black. Well, I asked to be on the agenda anyway, not in public comments. Has to be put on the agenda because | 00:28:29
the bottom line is this. If you sit when I went and you go to Krogers, you got to pay $44.04 for some Febreze Okay. I called | 00:28:37
Churchill Downs who I sent a hand sanitizer e-mail to prior to the shutdown and when I called back over there they turned around | 00:28:45
and said this. I had to talk to Kathy Cope. | 00:28:53
And that'll be the end of the comments for tonight. But you're welcome to come back. Oh, I will. I'll. I'll keep coming and keep | 00:29:01
coming and keep coming. You're more than welcome to do so, ma'am. You don't want your information, You can leave it at the podium | 00:29:07
and we'll get that. I'll be more than happy to. | 00:29:13
All right. Thank you. Do we have any other public comment tonight? | 00:29:20
All right. Seeing no more public comments, can I say one more thing? You didn't have enough for a quorum? | 00:29:28
Yes, there are three Commissioners and we have all three present tonight. | 00:29:36
Approval. I'm seeking approval for the Commission meeting minutes for April 16, 2024. So moved. I'll second all in favor, aye and | 00:29:40
approval of payroll and claims. | 00:29:46
So those. | 00:29:53 | |
All right, Motion is second. All in favor? Aye. All right. close with any comments from the commissioners this evening. Just real | 00:29:55
