Call to order a meeting of Floyd County Commissioners. 00:00:03
April 15th, Happy Tax Day 2025. 00:00:07
If you have cell phones, please silence them. If you need a conversation, the hallway is there. 00:00:11
And he'll join me for the Pledge of Allegiance, please. 00:00:16
I pledge allegiance to the flag of the United States of America and to the Republic for which it stands, one nation under God. 00:00:20
Indivisible with liberty and justice for all. 00:00:29
All right. Thank you all for attending. If you'll please join me. 00:00:35
For a moment of silence, for individual prayer, meditation, reflection as we prepare for tonight's meeting. 00:00:39
All right. Thank you very much. We have a busy agenda tonight. We have no additions. We have nothing at the moment. 00:01:06
To be tabled. 00:01:15
We'll start with new Business 17 in Indiana. We have Melissa Sprigler tonight and for the annual review. 00:01:17
And financial report. 00:01:23
Oh yeah. 00:01:26
Thank you. 00:01:29
I was going to say Nitis. 00:01:31
For the last name but. 00:01:33
OK. Sorry about that. 00:01:35
I had a landscaping business as a kid and I've told everybody called Lawn us, so that'll that'll help you. 00:01:40
Again, John Milanis, vice president of economic development at 1 Southern Indiana, have the awesome privilege of leading the. 00:01:46
Economic development services. 00:01:55
Prepared a short presentation tonight. 00:01:57
And we'll start off just with acknowledging kind of what the scope. 00:02:00
Of our contract and our services are and they're oversimplified of. 00:02:04
New business attraction, existing business retention and existing business expansion. So. 00:02:08
In your packet there on that first slide you'll see the little. 00:02:15
Colorful will there to the right that gives you, I think some color to to. 00:02:18
What it really takes to get into a position to be able to attract new investment, to be able to retain or expand an existing 00:02:24
company, those include. 00:02:28
Everything from kind of community engagement and education. 00:02:33
Small business services revolving loan programs. 00:02:37
Regional, domestic, international marketing, all of those things really kind of go together. 00:02:40
To put our region in a position to win on the next slide. 00:02:46
I've got a clicker here. 00:02:52
Yeah, on the next slide here. 00:02:53
Just kind of an overview from 2024 would be we had right at 100 new projects come into our office that. 00:02:56
We responded to on behalf of the region. 00:03:04
We had 352 company visits. 00:03:07
I always kind of clarify because we are also the Chamber of Commerce, so those are not chamber LED. 00:03:10
Meetings for membership or investment, These are performed by the economic development team. We really go in there asking a couple 00:03:16
simple questions. How's business? Any impediments to growth? Any plans to grow? 00:03:22
From those three questions and a lot of listening, typically we can develop a pretty robust. 00:03:28
Plan to either remove a barrier or accelerate growth. Those are really our two drivers in our work. 00:03:33
When you think about that attraction work. 00:03:40
It really comes from. 00:03:43
Leads out of market and those are based. 00:03:45
Some of which are through the state of Indiana, some of which are through consultants that we have relationships with. 00:03:48
And then we also have active participation in a couple of regional groups, and regional groups are important in economic 00:03:53
development because they allow us to. 00:03:58
Leverage some shared resources. 00:04:02
To be more efficient, but then also to. 00:04:04
Leverage a shared story. So a couple of them that I would identify as the South Central IN economic development group. That's 10 00:04:08
counties along the I-65 corridor. 00:04:12
We share that 65 corridor and the kind of opportunities from Indianapolis down here to Southern Indiana. So we regularly do some 00:04:17
outreach and travel marketing with that group you'll see there in the photo. 00:04:24
This is a partnership with the newly formed. 00:04:31
Louisville Economic Development Alliance, that is Mayor Greenberg. Louisville mayor's new economic development structure, LEDA as 00:04:34
it is kind of more commonly being referred to. 00:04:40
In the infancy stages as they were creating that. 00:04:46
We joined together to partner around Bourbon and beyond. So we were able to bring 5 national site consultants in the market, a 00:04:49
couple of which we had done business with previously. Some are brand new relationships, but. 00:04:55
We we collaborated on the invite. 00:05:01
We shared the experience over 3 days and in that photo you can see we were at the rooftop of Bolton Thai. 00:05:03
Including Mayor Greenberg staff in addition to. 00:05:09
You can see Rob and Don Lop and Tammy and other representatives from around the region there in that photo. So just an example of 00:05:12
the type of kind of proactive marketing. 00:05:17
In site consultant engagement that we do in collaboration. 00:05:22
With our local communities and even more broadly throughout the region. 00:05:26
The IDC strategic site identification program. 00:05:31
That is a state program where they hired a third party consultant. 00:05:35
To come in and do some evaluation. 00:05:39
Different sites. 00:05:41
Some already identified, some not identified. 00:05:43
And so we did three separate workshops with each of the counties that we serve, including Clark, Floyd and Scott, and partnered 00:05:46
with Don and other members of kind of utility partners and service partners. 00:05:52
On 1/2 day exercises to evaluate highest best use of available land in Floyd County. 00:05:58
Also want to note the Ida, the Indiana Economic Development Association honored to serve on the board there representing our 00:06:04
region. We were awarded a small grant this past year in which we did a childcare access study. We said we had a bias for action. 00:06:10
We weren't really looking for the problems, we were looking for solutions. 00:06:16
We did put a two page overview of that the findings in your packet there, but what I would note is that instead of just having 00:06:22
another report. 00:06:27
We decided to think a little bit out-of-the-box and we partnered with Extolled Media. So this past Saturday it actually premiered. 00:06:31
It will air the next two Saturdays on their The CW. 00:06:35
And then we'll have it for social media and other available but. 00:06:41
They ended up wrapping the project around with a 30 minute broadcast. 00:06:44
The first five minute talks about the actual boring report. 00:06:48
The next 25 minutes talks about projects throughout. 00:06:52
Outreach and including Floyd, Clark and Scott County that really align with what the survey says the community needs and what they 00:06:55
think would have impact. 00:06:59
In our community as it relates to child care. So I did put that report in your packet. There's some additional relevant data. 00:07:03
But happy to. 00:07:10
Answer questions on that or have a further conversations as helpful. 00:07:11
This at lunchtime day we had our elected officials luncheon. It's an annual. 00:07:15
Free exclusive event for elected officials. Glad to say we had. 00:07:20
Elected officials from all three of our representative counties in attendance. 00:07:24
And then lastly, our Metro manufacturing alliance. 00:07:29
This is kind of a chamber within the chamber for manufacturers, but something that is managed by our economic development team. We 00:07:32
selfishly use it to stay pretty close to manufacturers to again, remove barriers or accelerate growth. 00:07:38
The next page here really highlights our small business services. 00:07:45
I would just note we engaged with 103 unique businesses with over 600 follow up visits with them again. 00:07:49
Furthering some of their business development planning. 00:07:56
Financing Supports. 00:07:59
31 of those 103 were Floyd County. 00:08:01
Businesses here representing 30% of the. 00:08:04
Small business services. 00:08:07
Our revolving loan programs continue to stay active. We operate both the One Fund and the Caesars revolving loan program in 00:08:09
collaboration with the Caesars Foundation. 00:08:14
You can see listed there on the right. Sorry, I'll click along. 00:08:19
The small businesses that were supported 10 companies totaling totaling over $400,000 in 2024. 00:08:23
We still have just under $200,000 available in the one Fund. So if you know any small businesses, this is a lender of last resort. 00:08:32
So for those that can engage with traditional financing mechanisms. 00:08:38
The next two slides I want to highlight just something that we're really excited about. We launched a three-year partnership with 00:08:44
Livability Media. This is a kind of a national leader in data and information sourcing for folks. 00:08:50
Considering a relocation. You guys have a really robust Make my Move program here. This is a compliment to that. 00:08:56
We typically use the Sewing Tourism magazine for a lot of our site visits and different things. 00:09:03
This is a little different in that it talks really about the long term. 00:09:07
Kind of the truncated return of the quality of life, the arts and culture, the vibrancy of the community. So excited to have that 00:09:10
three-year partnership and to feature. 00:09:14
New Albany on the cover of this year's magazine. 00:09:19
In the spirit of sometimes it's difficult, we have again 3 counties that we represent all in with different geographies, different 00:09:22
landmass, different. 00:09:26
Target Industries even, right, River Ridge is much different than Inova Park. I think one of the things that keeps me up at night 00:09:32
is sometimes when we have a win, I think about, well, how are we going to leverage that win into other parts of our region and how 00:09:38
can we do that in a more sophisticated way. So in the next two months, you'll have a fresh look. We're going to be launching a 00:09:43
more of a regional brand around, it's called the Four Door. 00:09:49
The four door is a kind of a tongue in cheek playoff of the term corridor, but the four door represents our 4RS being the rivers, 00:09:54
rails, roads and runways. 00:09:59
Sometimes whenever I'm marketing, I spend a lot of time talking about horse racing in bourbon before I can get to really 00:10:03
articulating a pretty complex value proposition that our region has, both natural and now a built environment with a lot of the 00:10:09
amenities that we have. So for me, this feels like a great way and a great tool to be able to crosswalk some of the large 00:10:15
industrial projects that we know are going to have contractors and suppliers in the market. How does. 00:10:22
You know, being able to market some of the smaller technology in the innovation sector, crosswalk over to some of the large scale 00:10:28
projects. So really excited about being able to more concisely articulate our regions value proposition. 00:10:34
And hopefully be able to get more targeted on different types of projects that we know that our community is a good. 00:10:41
Fit for SO. 00:10:47
With that, I will take a breath and happy to answer any questions. But we come here tonight obviously to provide an update of 00:10:49
2024, a little bit of a look into what our strategies are. 00:10:54
Looking ahead but would humbly request a continuation. 00:11:00
The support that Floyd County has offered. 00:11:03
With a $15,000 request for support this year. 00:11:06
All right. Any questions for Mr. I don't have any questions. 00:11:18
No, OK. 00:11:23
And I don't think we had it on our agenda to. 00:11:25
Vote on that line item tonight so. 00:11:30
It was like last year we did that same thing. It kind of came up during the budget session. 00:11:33
Yeah. I think we were trying to time it a little bit better this year, but. 00:11:36
Yeah. So you know, again, we, we appreciate the great value that you do for the work. 00:11:41
People are going to have to get used to hearing this with everything that came out of Indianapolis last night, we're having to 00:11:48
look at everything through a different set of classes this year and. 00:11:52
We'll see where that comes up with it with regards to the discussion. 00:11:57
We have to also have that with the Council. 00:12:00
You put that on the. 00:12:03
The joint meeting agenda for the 22nd. 00:12:05
As well. 00:12:10
And then umm. 00:12:11
I don't know if there's a great debate about it. We can also invite you back in there to discuss that for Q&A. 00:12:13
Again, thank you for the time and your community support. 00:12:22
Thank you. 00:12:25
Thanks. 00:12:26
All right, County Sheriff. 00:12:29
Steve Bush. 00:12:31
Wow, great presentation. A lot going on with Once in Indiana so kudos to them. 00:12:33
So, umm. 00:12:37
Before I get to what's on the agenda for me. 00:12:38
I have our proclamation for the next 3 or 4. 00:12:41
One is for National Public safety Telecommunications Week is this week, April. 00:12:44
13th through the 19th. 00:12:49
May 4th through the 10th is National Correction Officers Week. 00:12:52
And then? 00:12:57
May 15th is designated by Congress and your president United States as. 00:12:58
Peace officers Memorial Day and then. 00:13:04
That week of May 11th to celebrate. For this, we just want to. 00:13:06
By doing these and you sign off support for the for those 3 divisions within the Sheriff's Office and the work they do in the 00:13:09
vital. 00:13:12
An important service they provide the community, so I have those here. 00:13:15
OK. 00:13:19
We don't need any formal motion to acknowledge that, do we? I mean, it's great that you're doing that. So I think we'd all be 00:13:21
happy to support that. 00:13:24
I don't know. I don't know if we need a formal motion on that or not to do so. So I don't think so. I think we're all, have you 00:13:32
signed these So we're good there. Perfect. 00:13:36
So then first, I have two contracts before you. One is through TLO Services. It's basically a search engine that we use in our 00:13:40
investigations. 00:13:44
And so spaces of amendment, I think. 00:13:48
Over to Mr. Fox. He's had a chance to look at. I don't think he had any issues. 00:13:51
With that contract. 00:13:54
The the only thing we did add Steve is on above the signature line it says Floyd County. 00:13:57
It actually said Police Department for some reason. 00:14:02
But I put Floyd County Indiana 4 above it and Susanna has that version for signature. 00:14:04
If you're gonna, if they're gonna approve and then allow you sign or if they sign, she has that version. 00:14:10
Ready for signature, so that's good. 00:14:15
OK. 00:14:20
I'll second motion is second for acceptance that contract all in favor. 00:14:22
Aye, aye, aye. 00:14:26
It wasn't on. 00:14:30
Oh, OK. 00:14:32
The next contract before you and I have a little bit of information beyond what's before you. It's a new fee schedule. 00:14:34
So about every five years, we want to make sure we're analyzing our pension. 00:14:41
Fun. And so we did that. We just did RFP's. 00:14:45
And went through that process and last night the mayor board meeting. 00:14:48
The mayor board approved to stay with. 00:14:51
And so we. 00:14:54
Basically narrowed down, I think we had. 00:14:55
3 or 4 initially narrowed down to 2 and then they went end up going with Gelser and the big portion, as Commissioner Luke would 00:14:57
understand, is Elaine. Betty does a great job with them. 00:15:01
And the services they provide, but through that process as well, they came down their fees. So this is a new fee schedule. 00:15:06
Coincidentally, they did that, but it's good. So I think other I haven't gotten the other 31. Thank you, Carson. The other shares 00:15:12
around the state that they provide because there's their fees came down as well. Coincidence, I don't know, but anyways. 00:15:17
So what's before you for signature and approval is a new fee schedule. So we'll save money there in terms of that. 00:15:23
And then we're going to have another meeting, of course, and keep analyzing the pension fund and how we can. 00:15:30
You know, keep doing the investing and making sure it's solvent basically so. 00:15:34
OK. 00:15:39
You need a motion on that. 00:15:40
I make a motion to accept the contract for Gelson. 00:15:42
Thank you. 00:15:45
I'll second. OK, Motion is second all in favor, aye. 00:15:46
Christy, I asked you this one. So Rick, I asked before. 00:15:50
Just has my name for signatures. We would probably. 00:15:53
Commission the president of the As long as they approve it, you can sign off on it. Office holder can sign it as long as they put 00:15:56
their blessing on and prove it. 00:16:00
Contracts, you all do that then? 00:16:05
Thank you. Thank you very much. 00:16:07
All right. Director of Building and Development Services Nick Creevy. 00:16:09
Good evening. 00:16:16
The first item I have for you tonight is. 00:16:17
Professional service agreement. 00:16:21
With Oh. Hmm. 00:16:23
This is to build. 00:16:25
A permit. 00:16:27
Processing platform. 00:16:29
To replace central square which will be happening. 00:16:31
The total for the contract is $38,000. 00:16:37
We have the 38,000. Yes, we had it appropriated. 00:16:42
At the last Council. 00:16:46
Make a motion to accept. 00:16:48
Oh. Hmm. Professional services agreement. 00:16:50
I'll second. 00:16:53
All right. I have a motion and a second. Any further discussion? 00:16:55
All in favor. 00:17:00
Aye. 00:17:02
Thank you. 00:17:05
The next item. 00:17:05
Is the service agreement for the road impact fee study? 00:17:07
As you recall. 00:17:13
We formed their. 00:17:14
Commissioners, you all formed. 00:17:16
Advisory Committee. 00:17:18
To investigate impact fees. 00:17:20
The committee did an RFP selected United. 00:17:24
Requested that they put together a contract and a scope. 00:17:28
So we have that before you today. 00:17:32
For some direction. 00:17:34
To move forward. 00:17:36
We would still need to find the. 00:17:38
116,900. 00:17:41
Which was the amount of that contract. 00:17:45
The scope of this would be just the Highlander point in Edwardsville. 00:17:47
Growth Districts. 00:17:53
Slightly larger than that. 00:17:56
But that is what we have before you. 00:17:59
Bob Stein, a representative from United, is here and can pass answer some questions if you have any for him. 00:18:02
Regarding this. 00:18:10
My my only concern is that it does have jurisdiction in Marion County, Indiana and I would ask that. 00:18:11
The United reps that are here, if they would agree to change that to Floyd County, Indiana. 00:18:17
OK, so and I would. 00:18:23
Not approve this contract tonight exactly if you're if you're considering approving it. 00:18:26
Yeah, we'll probably need to formally table it or take it out of your advisement. 00:18:30
Something you're saying that this smaller box in the lower corner? 00:18:35
It's now slightly larger than, so it's the blue box that you. 00:18:39
OK, the red boxes are the. 00:18:44
Growth areas and. 00:18:46
Blue boxes, that kind of slightly expanded area that we looked at doing. Yeah. The other two options were the entire county, the 00:18:48
entire county and then. 00:18:52
You know, probably halfway between that. 00:18:56
What we have and. 00:18:58
They were substantially. 00:19:00
More expensive. 00:19:02
So I think the decision was to put together a contract for the. 00:19:04
Smallest amount. 00:19:09
Where we expect. 00:19:11
The most amount of growth. 00:19:12
In the near future. 00:19:14
So that that's what they have done. That makes sense. 00:19:15
Well, I mean, Mr. Stein's made himself very available for. 00:19:20
Questions along the way, which is commendable. Do you have any comments tonight? 00:19:24
Or does anyone else? I know Mr. Mann was on that committee. Is there anyone else that was on the committee that's here tonight? 00:19:29
And whether or not they would like to make any comment on it, I mean, I thank everybody for their efforts, but at this point in 00:19:34
time. 00:19:37
Again. 00:19:41
Finding a source for that is. 00:19:42
Going to be a rate limiting step. 00:19:44
Government, I was on that committee. We did push for the whole county. 00:19:47
And it sort of worked down. We didn't know the cost. 00:19:50
The cost is about second or third time I've heard the cost. 00:19:53
And how much we would accomplish by getting to pay for this cost? 00:19:57
Through the years I know this contract is impact free. Contracts are only good for five years. 00:20:01
So will we recoup enough money? 00:20:07
With our empathy with this small area. 00:20:09
Pay the fee. 00:20:12
The charge they want for impact fees and that's why I'm pushing for. 00:20:14
State statutes change everything. 00:20:17
We can charge. In fact pays for. 00:20:19
Services. 00:20:22
Weeks right now we can. 00:20:23
Show this up you. I still don't know how much. 00:20:25
There's no estimate how much we would recruit. 00:20:27
With this amount of money, we're spending 116,000. 00:20:30
I believe that's what the study would give us some insight on, correct? 00:20:33
I mean, that's what I'm getting the nod from Mr. Creevy. 00:20:38
Mm-hmm. And Mr. Stein is joining you at the podium. 00:20:41
I think that the main thing to consider is. 00:20:45
It's not in place. 00:20:47
You can't recoup anything. 00:20:49
So development comes along. 00:20:50
And you need to add eternally and to get into the new development. 00:20:53
This could help pay for that. 00:20:57
Allow for the growth in that area. 00:21:05
Yeah. 00:21:08
And just for public dissemination, the cost for the entire county if it were to be studied was about 3 * 3 times. I don't know. 00:21:09
OK, so just want everybody to know what we're. 00:21:14
And we're trying to get our toe in the water, as Mr. Mann said. 00:21:21
Given the caps that Indiana has on what we can recoup? 00:21:25
You know we're not going to be able to sure. 00:21:31
Sure that we can get our return on investment right out of the gate on this so. 00:21:33
Further discussion I think is warranted on it. 00:21:39
Dale, did you get any luck with any of the? 00:21:42
People up in Indianapolis. 00:21:45
Regarding your. 00:21:47
I need. 00:21:49
Need you guys to turn it into the leaders of that be because? 00:21:51
The state leaders, they don't hardly talk to me. They don't talk to us either. 00:21:56
But anyway, I actually when it. 00:22:00
Farm Bureau may occur and all of them were supposed to be there. Every certain would be. I want to present it to them then. 00:22:03
But that's what needs to be done. How many signatures do you have? 00:22:11
How many signatures do you have? I don't really know. I still got a bunch of them out. 00:22:15
I've got Cheryl, we're here, and once you're ready, I will. 00:22:19
The hands of. 00:22:24
At least a couple of the state senators. 00:22:26
Where it goes from there, you know I don't know. 00:22:28
And another thing on the impact study. 00:22:32
It seemed to me that the developers. 00:22:35
Weren't against it. 00:22:37
And then I sort of got the feeling. 00:22:39
That I know when they go to the Planning Commission, then you have to turn your. 00:22:42
There's things they they make them do to get accepted. 00:22:45
And it just I got the feeling that maybe they would be using instead of them spending their money. 00:22:49
To get accepted that when you've got our impact, we use. 00:22:54
So I sort of got that deal. 00:22:57
Typically it would be 1 project that would be. 00:23:00
Have $1,000,000 to have. 00:23:07
Internally and in the passing will Strong Rd. 00:23:08
The MI fees would. 00:23:12
More to cover that. 00:23:13
OK, yeah, Do what you have to do to keep the discussion alive. You know, keep. 00:23:16
Keep putting it on. 00:23:21
Our agenda or as new information comes to light, and I think the next step is probably for Mr. Mann to get. 00:23:24
A final. 00:23:31
Packaged together that we can deliver to some of the state. 00:23:33
Representatives and senators, and then see if there's any traction in Indianapolis on it. 00:23:36
Do I need to make motion to? 00:23:41
Table Yeah, so that's what I'll do. I'll make a motion to table the service agreement for the road impacts fee study. 00:23:42
I'll second. 00:23:49
All right, have a motion and a second. 00:23:50
I don't want this to just go away, so maybe we can schedule an update for. 00:23:54
July. 00:23:59
Or August. 00:24:00
And see where we are on that and this. 00:24:02
Mister man, the ball will be in your court with regards to whenever you have a a package together that you want to stick to 00:24:07
forward, then let me know. 00:24:11
OK. 00:24:15
All right. 00:24:17
The next item is a. 00:24:19
Preliminary engineering contract for the Highway 150. 00:24:23
Intersection project. 00:24:28
Is a federally funded project. 00:24:31
So there's a. 00:24:34
Boilerplate and dot contract form that has been reviewed by our attorney. The total contract amount is. 00:24:35
393,443. 00:24:44
And $0.50. 00:24:47
That is an 8020. 00:24:49
Match project. 00:24:51
So our share will be 78,750. 00:24:52
Of that project. 00:24:57
And can you just speak to it publicly as to what? 00:25:00
The contractors, yes. So this is the the engineering for. 00:25:03
The intersection that would be. 00:25:08
Place between Luther Road and the old man's. 00:25:10
To connect either side. 00:25:14
Of 150. 00:25:16
Eventually with a connector route to Shriver. 00:25:18
And then? 00:25:21
On the other side to Lafayette station, OK. 00:25:22
OK. Any questions for Nick on that? 00:25:30
Nope. All right, look for a motion to approve. 00:25:33
Make a motion to approve. 00:25:36
I'll second motion and 2nd all in favor, aye? 00:25:38
Aye, aye. 00:25:44
All right, you have a. 00:25:46
Unanimous 330 on that so. 00:25:49
3D or DLZ Indiana. 00:25:52
Yes. The next is similarly preliminary engineering contract. 00:25:55
Boilerplate and. 00:26:00
From. 00:26:02
Reviewed by the attorney for $215,675. 00:26:04
This is for. 00:26:11
Baylor Weissman Rd. from the. 00:26:13
A hilltop to. 00:26:16
Bridgestone Subdivision. 00:26:18
This will. 00:26:20
Reconstruct that roadway. 00:26:22
A little safer for traffic. It's kind of. 00:26:24
The other part of the bridge replacement project, which will be forthcoming here in just a moment. 00:26:29
38 so to improve. 00:26:35
That corridor for travel. 00:26:38
Our share of that one will be. 00:26:43
54,194. 00:26:45
I'm pretty sure that's a sharp playing basketball just. 00:26:50
We have out there. 00:26:52
All right. 00:26:56
And uh. 00:26:57
Funding sources for this has been identified. 00:26:59
Yes. 00:27:01
All right, we'll look for a motion for improvement. So much talk about Bridge 51, we forget that we've got plenty in. 00:27:04
That's including Bridge 38. 00:27:11
Separate. Separate one for that. 00:27:15
Yes. 00:27:17
We do have as part of this and as part of all of these, we have additional funding for future phases for not just the preliminary 00:27:21
engineering, but for. 00:27:25
OK. 00:27:30
Make a motion for the DLZ Indiana Baylor Whitman Rd. Reconstruction. 00:27:31
Project. 00:27:35
A motion and a second all in favor, aye? 00:27:37
Aye, all right. And then finally of these we have a contract with HMB. 00:27:40
For the Bridge 38 replacement. 00:27:49
And approaches. 00:27:52
That contract amount is 400 and 52140. 00:27:54
Dollars our shares 90,240. 00:27:58
Federal. 00:28:02
Funds make up the other portion. 00:28:03
In boilerplate contract review by the attorney. 00:28:07
Make a motion to approve HMV Bridge 38 project. 00:28:14
I'll second the motion is second. All in favors. Aye aye. 00:28:18
And then the last item I have. 00:28:24
Blue River Services. 00:28:27
Reached out to requests to be on the agenda. 00:28:29
For their 5311. 00:28:32
Rural Transportation grant. 00:28:35
I believe they have a representative. 00:28:38
Roland Leonis is here to speak on that. 00:28:40
They have a resolution. 00:28:44
I I'll let him describe what they're needing for this. 00:28:48
If you would like to come on. 00:28:53
53 miles. 00:28:56
Yes. 00:28:58
Good evening. My name is Royal Lemus. I'm the regional transportation. 00:29:04
Director with Southern Indiana Transit and Blue River Services. 00:29:07
And today we're requesting for a couple things. 00:29:10
There's a 53 eleven 2026 grant cycle which is coming up and we have 5 counties in our system, including Floyd County. 00:29:16
Rural public transportation and what we have in front is. 00:29:26
Each county has an authorizing resolution that's part of the grant that has to be signed or doesn't have to be signed, but. 00:29:29
Basically what it boils down to is that's the commitment to say that, OK, yes, we're going to serve. 00:29:35
Floyd County with. 00:29:41
Public transportation services. 00:29:43
And they since we've changed. 00:29:45
The requirements for how we do things with Harrison County. 00:29:48
There's no longer a particular. 00:29:53
OK. Thank you. 00:29:57
So this is just an example what we have for our vehicles, we serve the public with multiple types of vehicles and these are all 00:30:01
ADA compliant. And what you have is just a sample of. 00:30:06
You know, one of the particular areas that we go to to serve the public, and it's just a sample. I mean, we talk about everything, 00:30:11
but it's nice to be able to take a picture and see that we have action out there that's serving the public for the transportation. 00:30:17
For all the counties that we serve. 00:30:23
So for tonight, excuse me. 00:30:30
We're requesting also. 00:30:33
In regards with this authorization, a resolution really speaks to is the local match participation for. 00:30:35
The grant, so when we came here last year, it's part of the intergovernment signing. 00:30:43
Of what? 00:30:50
Every county has to participate. 00:30:52
Some type of local match in order to keep the county inside the system. 00:30:54
So that helps the FGA subsidy? 00:30:58
Come down from the from. 00:31:00
Basically, the FDA. 00:31:03
And in that process is that it recognizes that OK? 00:31:05
Each county that supports this is is providing. 00:31:08
Some financial commitment and it's actually. 00:31:12
What the FDA in that requires that what Blue River requires or Southern Union transit just helps us. 00:31:15
Maintain our operational costs. We are just. 00:31:21
Facilitating. 00:31:23
The process and in order to get the grant. 00:31:25
Approved. 00:31:28
Each county had its authorization resolution and basically states here and. 00:31:29
If you do not have that in front of you, I can put that in front. 00:31:34
We have a copy of a resolution, but it doesn't indicate any need for a match. 00:31:40
Well, we was request, it was asked, you know, what does that mean? What is this, you know, if we sign this, what does that mean? 00:31:45
Basically it's just it's goes hand in hand and. 00:31:49
It is part of the process. 00:31:55
I mean, in order for us to commit to something, I would have to have a cash amount on here. 00:31:57
Well, the cash amount is really what? 00:32:01
The county decides we don't make a mandate for what the exact amount has to be. You know, the initial ask last year was $20,000. 00:32:03
That helps operational costs. So that brings down the subsidy. It's almost a double 2.5 almost. 00:32:09
Coming back down from the FDA. 00:32:15
That we can use stuff. 00:32:17
Cover the operational costs. 00:32:18
So you know, give an example. Harrison County puts in 100K. 00:32:20
They get almost $300,000 back. 00:32:24
And we use all that to help pay the claims. So when we service the public, that goes into operational costs to pay. 00:32:26
Gas, insurance and coverage. 00:32:32
And all the stuff that makes takes to run a system. 00:32:35
So that's part of the process. 00:32:38
So what we do is we have each county segmented out and each county gets their. 00:32:40
Their contribution on what they do, that's all segue out and then the doc receives that and they say OK. 00:32:44
So you're doing X amount of operational costs and that's what we put in the claim. 00:32:51
So that's how that that's how that works basically. 00:32:55
So the ask is actually, you know. 00:33:01
Last year we came with 20,000. 00:33:03
And we we did not invoice you. 00:33:06
And that's our fault. But you know, basically, you know, it's determined that we haven't received any funding yet from Floyd 00:33:09
County, but. 00:33:12
You know, we're we're working with the. 00:33:15
A process that does take a little time. 00:33:17
Very little about at first, but now we've almost doubled. 00:33:20
Almost triple the amount of ridership. 00:33:23
Inflow County for the rural public transportation system. 00:33:25
So once it gets gets going, it's actually already. 00:33:28
Serving serving Floyd County residents in the rural public transportation area. 00:33:32
So what we're basically stating is. 00:33:37
Is that we need some type of local magic? 00:33:39
Ensure that there's a continuation. 00:33:42
For the 53 labor program for Floyd County. 00:33:44
That's that's the process. 00:33:48
And I don't know what's in your next slides, but do you have? 00:33:50
Number for. 00:33:53
Our Floyd County ridership not only overall numbers, but also unique drivers. 00:33:54
Unique, yes. So what we have here the next slide shows. 00:33:59
What we did for 2024 and it's an increase, if you look at Floyd County last last year, we did 220. 00:34:02
And we're already at 641. 00:34:09
One way trips which is a. 00:34:11
A bigger increase and it's just basically. 00:34:14
Reflecting that our process is working, we're putting you know, marketing out there we're. 00:34:16
Advertising. We're putting pamphlets out at, you know, in these areas to help. 00:34:20
Increase the ridership. 00:34:25
And it's just a process where more people are taking advantage of public transportation in Row County for Floyd County. 00:34:26
And you can see across the board. 00:34:33
All the other one way trips that we're performing there for our system. 00:34:36
What what's the boundaries look like for? 00:34:41
World now I know at one point. 00:34:43
There was some discussion of what was rural, what was urban, who was going to be serviced, who wasn't going to be serviced. 00:34:45
Has those boundaries changed since last year or? 00:34:51
The batteries have been relaxed so we are able to do more for rural public transportation. 00:34:54
So you know for instance. 00:35:00
The census said that, by the way, and that doesn't even set that. They just follow what the census provides. So at one time, 00:35:02
Galena. 00:35:06
In Georgetown was. 00:35:09
Not. 00:35:11
Not available for the world and now it is so we count them in as the rural public transportation portion. 00:35:13
So all those folks that request the main request man response requests for a ride? 00:35:19
Actually fall into the rural public transport. 00:35:24
Mutation system. 00:35:27
Not the urban. 00:35:29
And they're they're really. 00:35:30
It's pretty strict about N dot. 00:35:32
Will not let us use any urban vehicles that we have for the other contract to go into the rural areas. They will not let us. 00:35:34
We're not able to claim that. 00:35:42
So that's why. 00:35:44
It's really important that we, you know. 00:35:45
Try to maintain a world. 00:35:47
Public transportation. 00:35:49
Identity and presence, so. 00:35:50
You know, with the authorizing resolution, what it basically does is it allows us to use the funding and the subsidy from the FDA 00:35:53
to support that operational cost. 00:35:57
So. 00:36:02
Just so I'm clear, it shows the number of people in Floyd County. 00:36:03
Like 160 people rode. 00:36:08
Last year. 00:36:11
Correct. 00:36:12
For $20,000. 00:36:13
Well, I mean. 00:36:15
That's what we, that's what we would put towards it. 00:36:18
It just keeps carrying on, so we'll carry over whatever we. 00:36:21
To keep going on with that and. 00:36:24
Yes, that's the answer. So are these people. 00:36:26
Medicaid or they you just don't have glue. 00:36:33
Oh, I have a clue. 00:36:36
There's nothing's in Medicaid or Medicaid. This is purely demand response. So for instance, somebody calls the disparity says I 00:36:38
want to go from my home. 00:36:41
To go to Walmart or want to go to a medical appointment? 00:36:45
Just because they're going to a medical appointment doesn't mean it's a cover under Medicaid or medical. 00:36:48
Care is purely public transportation, Yeah. I'm just wondering if any of them or Medicaid. 00:36:52
And if you took Medicaid payments or whatever, no, we don't. We don't do anything with Medicaid. It's pure. Well, we're 00:36:58
subsidized. So for instance. 00:37:02
A zero to 10 miles is $2.00 each way. 00:37:07
That's extremely subsidized, so you can't even touch that with an Uber or Lyft. It's. 00:37:09
30 bucks or some some it's. 00:37:15
Pretty high. So our folks that were serving in Floyd County should literally go for $4. 00:37:17
And go to downtown State Street of 19 19th St. or go to Optimum or on Charleston Rd. or wherever. 00:37:23
And they can get serviced and. 00:37:30
It's like Azalea Hills and a few other folks. They really do count on us and they're. 00:37:32
Using the system quite a lot and it's it's just. 00:37:37
It's very cost effective and it's very, well not really. It's $125.00 a ride. 00:37:41
Four people. 00:37:47
How many of those people total 64 people? That's even worse. 00:37:49
Well. 00:37:52
We bring down only what we use for the claim. We don't necessarily charge under 20. 00:37:55
That's $312.00 per person per. 00:38:00
And I was curious. 00:38:07
And just bear with me. Sure, OK. 00:38:08
That did law enforcement for. 00:38:12
A career. I didn't do transportation, but. 00:38:15
How is that doubling coming back to Floyd County? 00:38:18
Because I'm going to have to answer Mr. Main when he asked me, and I don't know that I can explain it. 00:38:22
OK, what? 00:38:28
I'm explaining it's just that what the opportunity is to get them. 00:38:30
When you put in a local match. 00:38:34
The FDA. 00:38:36
Allows a subsidy to come back at double what you put into it. So Crawford County puts on let's say 7 or 14,000. 00:38:37
The Scott County they get. 00:38:45
They get that 2.5 almost back. 00:38:47
What they we can do for operational costs? 00:38:50
It's great we cover the cost sometimes, you know, Blue River. 00:38:53
You know, covers it just depends on what we have but. 00:38:57
All that is in gas. I mean when we do the claim, a simple claim, I mean we, we cover all of that stuff. 00:39:00
And it goes in every quarter, every quarter, it's all. 00:39:07
Tallied up and we got to Harrison County. We. 00:39:11
Were requested and so. 00:39:15
Right now we're we're doing OK, I mean. 00:39:16
But some years we have not. So it really depends on what we get from the formulas from if Jake is there's public mass transit 00:39:19
funding that's also involved and it's all calculated. 00:39:24
And it just depends on how much usage we get. Some years we do. 00:39:29
What the ridership is quite up, but since? 00:39:33
The pandemic. 00:39:36
We took a big hit and we also have, you know, we had to find drivers and we're. 00:39:37
Trying to get the system going back up to where it was. 00:39:41
And we are getting there. We're already climbing back up. 00:39:44
Just takes more drivers they have, the more people we can serve and those funds are are utilized. 00:39:46
I have one final question SO. 00:39:53
Out of these 64 people who have written, how many of these people are from extended care facilities, do you know? 00:39:55
No, no, no. I've talked to my head, but I would say a large amount or. 00:40:02
I mean, it just depends 75%. 00:40:05
I don't know about that. 00:40:08
I would say maybe. 00:40:11
40%. 00:40:12
40% it's we don't. 00:40:13
We don't tally that. What we tally is what in that requires us, which is, you know, we have to do age, we have to do whether 00:40:17
disabled or not. And that goes back. Those are the numbers that we that we require to to tally. 00:40:23
Well, the only reason I ask is because there used to be a date and time that these extended care facilities would provide these 00:40:29
transportation services for their residents, and it seems like now they want to pass the buck on to some of these. 00:40:35
You know contracted, you know, Grant Fed. 00:40:40
Services and it just seems to me that they're kicking the responsibility to the taxpayer so. 00:40:44
Well, a lot of those places also sort of charge $60.00, like in Harrison County, Spring, Spring Hill, I'll give you an example. 00:40:50
They charge $60.00 for one way, not just two way, one way. That's a disaster because as much as what they're paying for services, 00:40:55
they should be given around for free. 00:41:01
So. 00:41:06
Anything. 00:41:15
Else with your presentation. 00:41:16
No, I just basically wanted, wanted to state that, you know, what we're trying to do is ensure that, you know, while we grow the 00:41:19
system, it does take a little bit of time to do that and right now. 00:41:24
We're in year 2 for world public transportation, so it. 00:41:30
You know, going from 2:20 to six, 600 plus and we're going to. 00:41:33
If we maintain Floyd County and rural public transit system, it also enables the folks who are using. 00:41:37
Using it. 00:41:43
To get around. I mean, it's not just a little thing. I know it's, it sounds like these places, you know, should use their own 00:41:44
thing, but they can't even find drivers for some of their folks. 00:41:48
That's part of the problem is they have these vehicles and some of them don't even have vehicles. 00:41:53
So it's basically just public transportation and we don't really. 00:41:58
Designate who is from where we designate, you know. 00:42:03
Can we meet, can we do it? Can we get them back and we can give them a safe ride and can we handle the? 00:42:06
Whatever if they have a disability or if they need ADA requirements, we were able to do that effectively within the indirect 00:42:11
regulations and safety. 00:42:15
Those are our goals, so. 00:42:21
That's what we try to do. 00:42:24
So. 00:42:26
It basically is the authorizing resolution is going to the other. 00:42:28
4 counties is exact same thing except for Harrison County which is the one that basically is the applicant grant. 00:42:31
And they sign it and they have their own commitment for their own local match. Each county does what they can. 00:42:37
So it basically boils down to I know you want an exact dollar figure, but if you don't want to do 20K. 00:42:43
You know what you put into is what you get out of it in regards to how much ridership we have, so once we run out of operational 00:42:49
costs then we can't do anymore. 00:42:53
So that's basically what a bull sounds, you being that. 00:42:57
Float County is one of the most. 00:43:00
Populated areas, counties that we serve. 00:43:01
We're trying to ensure that we have enough to cover the operational costs. So that's what it basically boils down to. 00:43:04
And are you able to apply for your grant? 00:43:11
If we don't pass this resolution. 00:43:14
Are you able to continue to service the other 5 counties? 00:43:17
We can't serve the world public transportation area for any much longer. With being employed, we can, we're going to continue to 00:43:20
do the rest because they're they're contributing to the system, right? I'm saying that. 00:43:25
Our participation is not essential for your success. 00:43:31
For your ability to apply for the grant. 00:43:34
No, but it would mean that Floyd County is not getting served in the rural areas. 00:43:38
And then that's. 00:43:42
That's just basically OK. 00:43:43
And what's your deadline for submission on this? 00:43:46
Middle of May when? The middle of May May? I think May 16th is the submission day. 00:43:49
OK. 00:43:54
So we would have time to discuss it at our next meeting. Yeah, in my recommendation, if you're inclined to consider the resolution 00:43:55
for adoption is that we add some sort of. 00:44:00
Qualifying language about what you're willing to contribute, because right now it's open-ended and says that it does impose. 00:44:05
Certain obligations upon us, including the provision for a local share project costs. 00:44:12
So if you're inclined to consider it, the same issue we had last year with language and everything. So it needs to be a not to 00:44:17
exceed or. 00:44:20
I would recommend that. 00:44:24
We look towards tabling this tonight and then let our attorneys look it over and then let us look at the numbers that were served 00:44:26
last year and come up with a number that would be more. 00:44:30
In line with. 00:44:34
X / 63. 00:44:37
Yeah. 00:44:40
So, well, I would be in favor of tabling it just for further discussion, but as it sits right now, I wouldn't be favored. 00:44:42
Of the resolution at this point. 00:44:48
But I'll make a motion that we table it to the next meeting. 00:44:50
Make a second for the tabling. 00:44:54
All right, a motion and a second. All in favor, aye? 00:44:56
Aye. 00:45:00
Listen, I think. 00:45:01
All right. Thank you for your time. We could at least consider some numbers that would be. 00:45:03
Would be more reasonable for the population and serve with employed county. 00:45:06
Thank you. 00:45:10
And was someone left Roland? I'm sorry, your last name, Roland. 00:45:14
Let him know when that's gonna be back on the agenda. 00:45:19
Thank you. 00:45:23
All right. County engineer ratio you reach at. 00:45:26
And by the way, while Horatio is coming. 00:45:35
Up to the podium, I want to apologize to Sheriff Bush. I was kind of abrupt with you and those noises were going and I had no 00:45:37
intention of doing that. So thank you for going over there and checking that out. 00:45:42
All right. Just eye contact. Yeah, sorry about that. 00:45:47
All right, Horatio. 00:45:52
Good afternoon. 00:45:55
I'm just here to report that. 00:45:57
Spring of all Georgetown subdivision located between general wine. 00:46:00
Lane and Old Georgia. 00:46:05
They is going to be building 2 phases. Phase one is completed. 00:46:07
And the owner of. 00:46:13
The developer. 00:46:16
Is requesting the performance. 00:46:17
To be. 00:46:21
Return it to him which is 158,000. 00:46:22
75. 00:46:27
And then he also. 00:46:28
Turn in and maintenance. 00:46:30
Or 71. 00:46:33
1475. 00:46:35
I think we don't have any issue with that. We review all the items of drainage. 00:46:39
Payment curve and all that. So it is completed and that's what is a big question. 00:46:45
They. 00:46:51
Return it to them so. 00:46:53
I recommend that. 00:46:55
It can be. 00:46:58
So the top coat. 00:47:00
Paving has been done, yes. OK. 00:47:02
Yes. 00:47:04
And I think they sold all the houses already. 00:47:06
I think I've seen only one lot that doesn't have been built but. 00:47:09
The rest of them? 00:47:13
They're all gone. 00:47:14
OK, so this would be returning 158075 and there's another 71475 out there. 00:47:17
Yes, OK. 00:47:23
We have the day. 00:47:24
This is just. 00:47:32
Releasing the bond. 00:47:34
OK. All right. Thank you. 00:47:37
I'll make the motion for the. 00:47:40
Are you done? I'm sorry. 00:47:42
Have any questions for ratio? 00:47:43
Have you there? 00:47:47
That's OK. 00:47:49
Well, now I'll make a motion. Yeah, I'll make the motion to release the performance bond for the. 00:47:52
Spring of old or Georgetown subdivision. 00:47:57
I'll second whatever Jason said. Yeah, thanks. 00:48:01
Motion, second release of that, all in favor. 00:48:04
Time for the legal team. 00:48:09
Please bring us home. 00:48:15
OK, the first. 00:48:17
The first thing on the agenda is Floyd County Ordinance 2025, thirteen construction and review of county contracts. 00:48:20
We've drafted an ordinance for Floyd County with regards to. 00:48:29
How to handle all the contracts that we have coming through? 00:48:34
We've basically broken down. 00:48:37
The ordinance into two different areas. 00:48:40
One area is what is in the content of the contract itself. 00:48:44
And then secondly, how that's to be handled procedurally? 00:48:49
Items 1-2 and three. 00:48:53
Are basically content provisions with regards to the contract. 00:48:57
And. 00:49:03
Basically, umm. 00:49:04
What's in here is what the new state statute requires. 00:49:06
That all county contracts be in the name of Floyd County, Indiana and if they're being executed on behalf of one of the offices in 00:49:10
Floyd County, that. 00:49:15
It it'll show the that the contracts with Floyd County executed. 00:49:21
In the name of Floyd County far and then put in the office that. 00:49:29
Being executed far. 00:49:34
The item number 3. 00:49:42
Umm. 00:49:46
Deals with. 00:49:50
That the contract state. 00:49:54
If we're going to be involved in litigation, where the venue is in the litigation. 00:49:57
Of course the Commissioners have a right to. 00:50:02
To vote. 00:50:06
Another way. 00:50:08
And not follow the the venue requirement if need be. 00:50:10
We get a lot of contracts in from all kinds of different places. 00:50:15
Sizes from minute contracts to gigantic contracts, and of course the scrutiny you give these contracts is different. 00:50:22
The parties are different in terms of where they're located and how we're doing business with them. 00:50:30
And so there needs to be flexibility with regards to the evaluation and approval of these contracts. 00:50:35
But we do if there's going to be. 00:50:43
We want the venue to be here in Floyd County if there is going to be litigation. 00:50:45
And so that's one of the areas. 00:50:50
That we've included in the ordinance. 00:50:53
A second provision that we included has to do with notification. 00:50:58
For example, notification if there's a breach of contract, who do you notify? 00:51:04
And so. 00:51:09
We've put in our ordinance that we want the Floyd County Commissioners to be notified with regards to anything that's required 00:51:10
within regards to the contract. 00:51:15
And as well as if there is. 00:51:21
An officer in Floyd County, like Diana Topping with the auditor's office. 00:51:24
Is the contracts with something that her office is doing? 00:51:31
We would want her to be named with regards to any notice provision also, so we've learned both. 00:51:35
Party's name. 00:51:43
The good thing about that is, is that. 00:51:44
It's going through two different hands that we don't have, you know, an issue that goes to one place and. 00:51:47
And it doesn't get addressed at least. 00:51:57
Notice wise to. 00:52:00
The county commissioners who have actually entered into the contract. 00:52:02
The the contract ordinance also requires that. 00:52:09
Floyd County be named as an additional insured. 00:52:17
Contract for services contracts. 00:52:22
On the contractors liability insurance policy. 00:52:26
And for example, the the state contracts the ones you just three of them you you approved today. 00:52:29
That's an automatic provision that's in there. 00:52:35
And so. 00:52:39
And in a good deal of our contracts that is there, but. 00:52:42
We're asking that that be in. 00:52:46
In all the contracts. 00:52:49
And then lastly, you've got a provision with regards to. 00:52:53
ACH payments and. 00:52:58
And you have. 00:53:01
An ordinance that has that in there. 00:53:03
In an ordinance that doesn't have that in there. 00:53:06
And that was a request from Diana at the auditor's office. 00:53:09
Because I know they're wanting to move towards getting everybody on ACH. 00:53:15
Payment because. 00:53:20
It's more efficient. 00:53:21
And saves a lot of money. 00:53:25
That what we're dealing with is is. 00:53:27
A payment provision. 00:53:30
And so. 00:53:32
The question is, is. 00:53:34
You know, do we provide that in? 00:53:36
The ordinance itself as a requirement within. 00:53:39
The. 00:53:44
Within the contract itself, I can tell you up front. 00:53:46
None of the contracts that we have with anybody has that type of a provision in there so. 00:53:51
You know that would be. 00:53:57
Something down the road that we. 00:53:58
Would really have to work hard on. 00:54:01
In terms of getting changed. 00:54:03
You know, I don't, I don't think the state contract has anything in there. 00:54:06
That developed from a conversation with. 00:54:12
Operations where they were. 00:54:15
Making suggestions about potential suggestions and they asked if I thought it would be a good idea and I said it would be helpful 00:54:17
for my office. 00:54:21
With that, but it is not by any means a big *** or a massive requirement from me. 00:54:25
OK. 00:54:32
That's one it is. 00:54:33
I didn't know it was going to turn into this big of a deal. 00:54:36
Operations Department. 00:54:40
No, no, no. 00:54:45
No, I think it's important that we layout. Layout what? 00:54:47
Where your office is headed and the type of things that you're doing technologically, that's important for everybody to know. 00:54:54
And so I think that, you know, we can probably get our. 00:55:01
Offices that are tendering contracts to get information. 00:55:05
2. 00:55:09
OK, OK. 00:55:11
There you go. 00:55:12
All right. Sure, if you have comment on that. 00:55:13
Yeah, it's OK. Real quick, I think the first part, I must have been sleeping. The definition of a contract. So sometimes we do 00:55:15
agreements. 00:55:18
They're not necessarily a contract, but it's an agreement. Is that a contract? Sure is. We do amendments. It's like I did tonight, 00:55:21
so. 00:55:24
Just want to make sure I didn't hear the first. They're all contracts. 00:55:27
And that might be good for a definition. Just saying. 00:55:30
Yeah, because it can be confusing sometimes. 00:55:32
Thank you. 00:55:36
Anything further, Rick? 00:55:36
Yes. Umm. 00:55:38
OK. 00:55:39
We we talked about the content of the contracts then also procedurally how, how it's handled. 00:55:41
The the county officer wishes to enter into a contract must submit the contract. 00:55:49
With a copy to the county auditor. 00:55:55
As well as a secretary for the Floyd County Commissioners and the County Attorney. 00:55:59
The Floyd County Auditor shall immediately date. 00:56:06
The contract and forward a copy to the commissioner, secretary and the County Attorney. 00:56:09
If the county officer has not received notice of the. 00:56:14
Review of the contract the county officer shall e-mail. 00:56:18
And contact the secretary for the Floyd County Commissioners and the County Attorney that a response has not been received. 00:56:23
And request a response on the proposed contract. 00:56:30
The notice by e-mail, contacting the secretary for the Floyd County Commissioners and the County Attorney is required before the 00:56:34
county officer. 00:56:38
Can take action pursuant to Indiana Code 36. 00:56:42
Dash 2. Dash 2.9. Dash 11. 00:56:46
After review by the commissioners and county. 00:56:50
Attorney, the contract should be placed on the next regular agenda. The Commissioners for approval or denial. 00:56:54
Of the contract. 00:56:59
That whole process is laid out statutorily, so we. 00:57:02
We implemented that. 00:57:06
The the one good thing about it is that it makes sure that it gets in front of everybody. 00:57:09
And is addressed. 00:57:17
In a somewhat immediate fashion, as well as going through the process, there's follow-up steps to make sure it doesn't get lost in 00:57:19
the process. 00:57:23
And an Ave. for. 00:57:28
Each of the. 00:57:31
County officers to follow up with regards to what the status of. 00:57:33
Their contract is. 00:57:38
One point is that this ordinance in no way modifies or changes the statutory requirements for quoting or bidding on certain 00:57:42
contracts. 00:57:46
The county officer shall comply with all such statutes. The commissioners reserve the right to request. 00:57:51
Copies of any quoting done by the county officer. 00:57:56
Any competitive sealed bidding required under the statute shall be opened at the Commissioners meeting. 00:58:01
So that's the essence of the contract. 00:58:07
And ordinance for? 00:58:10
Review and contemplation. 00:58:14
And 13. 00:58:17
Yes. 00:58:18
All right, on 36-2 Dash 2.9 Dash 13, it talks about presentation or submission to the county auditor not more than 10 days after 00:58:22
the contract is executed, unless otherwise specified. Is that 10 calendar days? 00:58:28
Is that OK? All right. 00:58:36
Make a motion to accept Floyd County ordinance 20/25/13. 00:58:41
With unanimous approval. 00:58:46
Using correct, correct. I have both versions, so if you can direct us which one, I'll pass that one down for signature. And then 00:58:48
also I assume you want to do it by unanimously. Are they both? 00:58:53
Enumerated the same, they are OK, so you just tell me which one to pass down with or without a version without ACH correct? 00:58:57
Yes. 00:59:05
I was a little lost there for a second. 00:59:06
By unanimous consent. 00:59:09
I'll say I have a motion to approve. 00:59:12
The non AC requiring version of this. 00:59:15
And a second all in favor. 00:59:18
Aye, aye. 00:59:20
Alright, thank you and thank you. And yeah. 00:59:22
I'd like to revisit this down the road. 00:59:25
Obviously as time goes on. 00:59:28
It might be 5 years from now that. 00:59:31
98% of people are. 00:59:33
Using ACH and not, so if we ever need to amend this to make that a requirement. 00:59:36
We can entertain this. 00:59:40
And what I spoke to Mrs. Hopping about was encouraging the office holders to try to get. 00:59:44
The person we're contracting with to sign up for it as soon as it comes back into her office, she also can reach out with those 00:59:51
forms and ask that they sign up that that would be our request. 00:59:55
All right. Thank you. 01:00:00
5B. 01:00:03
SEO 20/25/14. 01:00:04
So this next one is actually going to clean up. We you all passed an ordinance last month. 01:00:06
Establishing that solicitation permit fund, unfortunately the fund number we had was incorrect. 01:00:13
So we are repealing that ordinance which was 2025 Dash 12 and implementing a new one with the correct fund number which is 4020 01:00:18
for that solicitation fund. Happy to answer any questions I'm going to assume. 01:00:25
We didn't take in a huge amount of money in the interim. 01:00:33
No, I don't think we've received anything and it was just the number came in and. 01:00:36
It had already been used. 01:00:41
For it was for a. 01:00:43
Golfers. 01:00:46
So do we have any money in the Solution Solicitation Permit Fund? 01:00:49
Just deposited, we had two solicitors. 01:00:54
A year permit. 01:01:04
So there's about. 01:01:05
$800, OK. 01:01:08
Wouldn't what can we use that for? 01:01:09
It'll be used to do any sort of background checks or anything else that needs to be done. 01:01:13
Oh, the review process, all that kind of stuff. 01:01:19
Also make IDs. 01:01:22
Yeah, because they're receiving IDs if they get approved for that permit. 01:01:25
So again, apologize, the phone number ended up being something we could not use when. 01:01:31
Went over to the auditor's office, so we are cleaning that up. 01:01:35
All right, need a motion to approve FCO 2025-14 by unanimous consent, so moved. I'll second all in favor. 01:01:40
OK, the next one you have is a resolution. 01:01:51
On the solid waste moratorium that was passed at the solid waste board at 4:30 this afternoon, this evening. 01:01:55
And with the recommendation to come over to you all for approval. 01:02:03
Happy to answer any questions. That was passed 7 to 0 by that board, correct? It was OK. 01:02:07
So. 01:02:14
Today we did have a meeting of solid waste at 4:30 PM as. 01:02:18
Miss Fox indicated. 01:02:22
And uh. 01:02:23
Jason, would you like a background on this, the Chief Chair of that committee or? 01:02:25
And actually, I apologize for clarification. There were six members. There was 1 member, not president that meeting. So it was 60. 01:02:28
Mr. Kahan was gone at the meeting. OK 60. 01:02:35
Yeah, I'll just give a little bit of background, so. 01:02:38
This. 01:02:42
This year or towards the end of last year? 01:02:45
The solid waste. 01:02:49
Kind of changed hands from underneath. 01:02:52
Of Mr. Stewart to Mr. Massengill, I think he's done a phenomenal job. 01:02:54
Since he's been in there, he's tried to streamline things very well. 01:02:59
Is as routes employees even some of the services they provide? 01:03:04
But you know one of the things that we've had. 01:03:10
Had discussions about us about this pending. 01:03:12
Senate Bill One and what this may look like. 01:03:15
And quite honestly? 01:03:18
After it was kind of passed yesterday. 01:03:21
This morning, or yes, this morning, I guess it's to say. 01:03:24
You know, I think that's going to have a direct impact not just for us here in Floyd County and some of the the, the services that 01:03:28
we provide, but through counties and and municipalities throughout the state of Indiana. 01:03:34
But obviously solid waste is one of those. 01:03:40
Entities within that. 01:03:44
You know they they have a small amount of full time employees they have. 01:03:47
Several part time employees, but. 01:03:51
You know, as we're starting to look going forward, I don't want to dive too far ahead of you on this one. 01:03:55
But as far as solid waste goes, you know you know. 01:04:00
As we look at. 01:04:05
You know the services that we would offer. 01:04:06
Going forward. 01:04:09
And what's going to be a priority And what's? 01:04:11
Not necessarily required by statute, you know, obviously. 01:04:15
Solid waste is one of those that. 01:04:18
We have to look at and until we get the final numbers, I'm not I'm not very comfortable with bringing on anybody. 01:04:20
Into solid waste and to be quite honest with you there. 01:04:28
Probably needs to be some discussion whether or not that. 01:04:31
We need to. 01:04:34
Maybe look at a moratorium? 01:04:35
Through a broader scope until we get some. 01:04:37
Ideas of what this is going to look like on us? 01:04:40
More locally here in Floyd County, but. 01:04:45
I'm just going to turn it over to you. 01:04:47
Comment No, I I agree. I think that we need to look at what the statute requires us to deliver and what the cost is. 01:04:49
And right now I'm not sure that that's reasonable. 01:05:01
And. 01:05:05
I don't really know. 01:05:07
What Senate Bill 1 is going to do to us yet? 01:05:09
Once we get that information, we'll be able to move forward. But. 01:05:13
I hate to hire somebody and then tell them they don't have a job. 01:05:16
A month or two later. 01:05:20
So that's why we did. 01:05:22
So the passenger that bill shortly after midnight last night, this might be the first direct. 01:05:24
Repercussion of that. 01:05:30
In the state, who knows? 01:05:33
But umm. 01:05:35
You know, we're in very uncertain times with regards to. 01:05:36
Exactly how this gonna shake out on 20262728 budgets. 01:05:39
And so all we know is that it's going to be a reduction over what had been projected and as such. 01:05:44
The way they have to be revenue made-up or services. 01:05:50
Eliminated or reduced? 01:05:54
And so. 01:05:56
We thought that it would be unwise for someone to be. 01:05:58
Hired in now. Right now they are fully staffed. 01:06:01
We were reassured that this evening. 01:06:06
But. 01:06:09
If uh. 01:06:11
If an employee. 01:06:12
Leaves the team then. At this point in time they're not going to be replaced. 01:06:14
And at some point services will probably have to be reduced, reflecting that reduced manpower so. 01:06:18
Any further discussion or comment? 01:06:25
Look for a motion to approve. 01:06:28
The only thing I'm going to add is that that that is an entity that. 01:06:30
Does see quite a bit of turnover just because of the nature of the business part timers generally a lot of retired people out 01:06:34
there that are that are helping to work. 01:06:39
Looking for something to kind of give back and maybe. 01:06:44
Put a little extra money in your pocket, but. 01:06:46
You know, I think this is. 01:06:49
Important. And like I said, I think. 01:06:51
We're probably gonna have to have a discussion more. 01:06:53
Broadly, umm. 01:06:56
On this topic. 01:06:57
Until we get a better idea. 01:06:59
Of what this looks like because. 01:07:01
Like Frank said, I don't like the thought of giving someone a job that I can't promise is going to be here. 01:07:03
Next week, next month, next year, whatever it may be, but. 01:07:10
With that, I'll make a motion to. 01:07:15
Approved Floyd County Resolution 2025-07, the solid waste hiring moratorium. 01:07:17
I'll second the motion and a second all in favor. 01:07:24
Aye. 01:07:28
All right. 01:07:29
Resolution 2025-08. Approval of a purchase. 01:07:31
3317 Grant Line Rd. 01:07:35
So this is a resolution to move forward the purchase of that property into. 01:07:38
Enter into the purchase agreement for the purchase of the property on Grant Line Rd. This is the property that's intended to be 01:07:42
used for the Health department and a few other county offices. 01:07:48
So the County Council has put their blessing on it. 01:07:54
This would allow the resolution would allow. 01:07:58
To enter into the purchase agreement to allow Doctor Kanable to sign that as well as any and all other reasonable documents 01:08:02
amendments there too if they become necessary. Don't expect that's pretty. 01:08:07
In-depth purchase agreement. 01:08:13
But also to allow Doctor Kneel to attend the closing and sign any closing documents necessary to allow us to move forward that 01:08:15
closing. 01:08:19
OK. And this is for the Health department? 01:08:23
That is correct. Health department's new home. 01:08:26
OK. Any questions or discussion? 01:08:28
Look for a motion to approve. 01:08:33
I'll make a motion to approve to approve Floyd County Resolution 2025-08, which is the approval of purchase for 3317. 01:08:35
Grant Line Rd. and the purchase Agreement. 01:08:44
I'll second that motion. Is second all in favor, aye? 01:08:48
All right. Thank you. Notice of intent on site wastewater district. 01:08:54
OK. We have two items. We have the notice of intent as well as we have the Floyd County on site Wastewater District hearing 01:08:59
officer appointment. 01:09:04
Those two. 01:09:09
Basically go together. 01:09:10
Give you a little history. 01:09:12
The state law has recently changed with regards to. 01:09:15
Using different types of technologies for wastewater disposal. 01:09:21
And. 01:09:27
Also filters down to the counties because it's the Floyd County Health Department that actually issues the permits for septic 01:09:29
systems. 01:09:33
And those type items so. 01:09:38
One of the things that. 01:09:42
Counties have run into is the fact that. 01:09:44
The septic systems that are out there and that have been approved in the past. 01:09:48
I don't meet all the needs of the residents that we have. 01:09:54
That are out there. 01:09:58
Currently, we've identified 5 to 7 properties here in Floyd County. 01:09:59
That. 01:10:04
No septic system. 01:10:06
Can be approved for that property because it can't be functional on the property that. 01:10:08
Is is there to to use? 01:10:14
So. 01:10:18
This is basically setting up a. 01:10:19
A district. 01:10:22
Solely for the approval of what we'll call rescue systems. 01:10:24
So that. 01:10:28
When nothing else works and we go through the checklist in terms of. 01:10:31
Septic Systems. 01:10:37
When nothing else works, then we take a look at this rescue system which is an above ground system. 01:10:39
And uh. 01:10:45
It will have discharge from that rescue system into. 01:10:47
Specifically identified areas, typically. 01:10:52
Where water flows. 01:10:55
In order to take care of. 01:10:57
The the removal of. 01:11:00
The flow from the property. 01:11:04
Are a. 01:11:07
A Creek or a river, a water system that it can go into, and that's an exception in the state statute. 01:11:10
So in order to. 01:11:18
To move forward with this process. 01:11:20
To get. 01:11:23
The properties identified. 01:11:25
There's what's called a Notice of Intent, which is a State Farm. 01:11:29
It requires the commissioners. 01:11:34
Under. 01:11:38
Indiana Code 3611. 01:11:40
To be the governing body for for the. 01:11:42
Setting up of the district. 01:11:47
So, umm. 01:11:51
There's a notice of intent in front of you, which. 01:11:53
I've completed and. 01:11:56
That is. 01:12:00
Move us into the process of evaluating. 01:12:02
Getting a district set up. 01:12:06
The next step? 01:12:09
If you approve the notice of intent. 01:12:10
Is that? 01:12:14
We are required to have a hearing. 01:12:15
So I also have a resolution in front of you. 01:12:18
To appoint Scott Walters. 01:12:22
As the hearing officer for the establishment of the Floyd County on. 01:12:26
Waste management management district. 01:12:31
And so the the resolution includes appointing him. 01:12:35
And he'll conduct the hearing. 01:12:41
And, umm. 01:12:44
He will. 01:12:46
Report back. 01:12:48
To the Commissioners. 01:12:49
Basically his findings of fact and recommendations with regards to the district itself. 01:12:52
And I have included. 01:13:00
That the hearing officer be paid $500 a day or $250. 01:13:02
For part of a day up to 1/2 a day. 01:13:08
Plus expenses. 01:13:11
And the state statute provides for a per diem. 01:13:12
Expenses for the hearing officer. 01:13:18
Once you get that, the next step. 01:13:24
Will be. 01:13:26
An ordinance. 01:13:29
To be presented to the Commissioners to establish the district. 01:13:31
So. 01:13:35
In terms of the public weighing in on this, the there's going to be a hearing. 01:13:37
That'll be. 01:13:42
Publicized according to Indiana statute. 01:13:43
And. 01:13:46
So individuals will be able to weigh in. 01:13:48
That time and then also you'll have. 01:13:51
The ability to listen to the public. 01:13:56
When it comes time for you all to evaluate. 01:13:59
The ordinance itself. 01:14:03
And I expect that there's, you know, most certainly there will be people here speaking for it and. 01:14:05
Those those individuals that have homes that. 01:14:11
Aren't habitable at this point in time because they don't have a system. 01:14:15
You'll probably hear from them. 01:14:20
And then? 01:14:22
If there's anybody out there that. 01:14:24
Is. 01:14:27
Not far. 01:14:28
A district to take care of that. I'm sure you'll hear from those folks too. 01:14:30
OK, so if I'm a member of the public, I've got a couple of questions that come to my mind right away #1 how? 01:14:34
Large and comprehensive is such a district. Is it? 01:14:39
The whole county. 01:14:42
One home, Is it everything in between? 01:14:44
Well, that was a discussion. We had a. 01:14:47
Small gathering, if you will. 01:14:51
Of members of the health department. 01:14:53
Commissioner Loop and myself attended. 01:14:57
And so the we decided the unincorporated county we had, we had. 01:15:00
In the discussion, do we take the? 01:15:06
The whole county. 01:15:09
Do we take the county less the incorporated areas? 01:15:10
Or something to that effect and then. 01:15:16
Or do we narrow it all all the way down to the district just being? 01:15:19
That piece of property, that piece of property, right? So you can do anything in between. 01:15:23
Yes. 01:15:28
And so, So what do you think is going to be proposed? Well, keep in mind it's only going to affect. 01:15:28
Failed systems that are more than 300 feet from. 01:15:35
An active sewer launched it. 01:15:41
I'm just trying to get this out. 01:15:43
Yeah, no. 01:15:44
It's only going to affect those failed systems. 01:15:46
That statutorily if they fail and there's no other remedy. 01:15:49
And there's a sewer line within 300 feet. 01:15:54
They are required to hook on. 01:15:58
But this would cover. 01:16:01
In all failures that we can't. 01:16:03
I have a resolution to. 01:16:07
Then it comes to here. So there may be. 01:16:09
A piece of property that's not within 300 feet. 01:16:13
I can't think of any around the city. 01:16:17
Or Georgetown. Or the committee's recommendation. 01:16:21
Yes, yes. And the next question arises is in terms of fees and statutorily. 01:16:27
The district has a. 01:16:36
A right to charge fees to. 01:16:39
To run the district. 01:16:43
We discuss it at the committee and so we don't believe that we need any fees to run the district because we already have the 01:16:46
commissioners in place and we have the Floyd County Health Department to do the investigation for the properties. 01:16:52
And submit that investigation to the Floyd County Health Department. 01:16:59
Who will then evaluate it and send it to the commissioners. 01:17:03
For their review. 01:17:07
And potential approval, I was totally against any fees being associated with this at all. So the only fees assault that will be. 01:17:09
Out there will be fees charged to the individual homeowner. 01:17:21
And they're very small fees that would be charged. 01:17:26
For the permitting process. 01:17:30
Yes. And is there any? 01:17:32
Ongoing. 01:17:35
Certification every five years or inspection. 01:17:37
There is ongoing inspection with regards to. 01:17:40
The unit itself. 01:17:44
Requires annual inspections. 01:17:47
And. 01:17:49
And and so as a certified person to do the inspection. 01:17:51
And that'll all be managed by the Floyd County Health Department. And that's all within their purview. 01:17:58
With regards to what they already do. 01:18:03
In terms of the permitting process, OK. And at the hearing, the public hearing, there will be a presentation of the science behind 01:18:07
all of this. You will. 01:18:11
OK. And is one public hearing going to be sufficient? 01:18:16
I. 01:18:19
Well, I mean, sometimes people can't. 01:18:22
Make it As long as it's recorded, we should be following up with. Objections can be made as part of the record. 01:18:24
So that's. 01:18:30
You know, one of the things that we'll be looking for is. 01:18:32
Obviously not everybody can make hearings right So. 01:18:35
You have the ability to object and make that part of the record. 01:18:41
And I can tell you that any of the objections that we get will be evaluated. 01:18:46
In the overall context of what we're doing, the only people that it should affect. 01:18:52
Is. 01:18:57
Those contiguous around that piece of property. 01:18:58
It shouldn't involve the whole. 01:19:04
Community. 01:19:07
You should only affect those people that neighbor that problem. 01:19:08
Well, contiguous or not, I mean. 01:19:12
So long as there's not a. 01:19:15
A water hazard that brings mosquitoes or something like that. 01:19:16
Could become a. 01:19:20
A bird vector born vehicle. So whatever whatever this subcommittee comes up with is subject to massage and change. 01:19:22
And during the ordinance phase by all the full body of commissioner and I can tell you one of the things that the Floyd County 01:19:29
Health Department. 01:19:33
Manages. 01:19:37
Is the mosquito issue. 01:19:38
And they specifically? 01:19:41
Have gone on to properties because they're a vector for mosquitoes and everything and. 01:19:44
And they? 01:19:49
They have the ability and jurisdiction to remove. 01:19:51
The issues that. 01:19:54
You have with mosquitoes, so that's. 01:19:56
That's right up their alley. In the process will also involve stormwater. 01:19:58
So 1. 01:20:05
Question for me, you know, just thinking of what the public might have to say. 01:20:06
I'd like it on the record, just really clear that. 01:20:12
Floyd County is not interested in getting into the wastewater treatment business. This is. 01:20:14
Simply. 01:20:19
People whose septics have failed. 01:20:21
We're not looking at expanding sewers or creating wastewater treatment. Yes, only rescue systems, correct. I just want to make 01:20:24
sure that the public very clearly understands what we're trying to accomplish today. So this is not an option for someone who's 01:20:28
building the new home. 01:20:33
No, who doesn't have sick sewer availability? No, they would have to go with the standard septic. This is to. 01:20:38
Like there's a piece of property out there that I'm familiar with that it. 01:20:46
These people don't get this. 01:20:50
The house is not livable and they would have to tear it down. 01:20:52
And that's just not right. 01:20:56
Yeah, so. 01:20:58
There's a apparently five to seven of those out there that we know of. 01:21:01
And Anthony Lieber will be here on behalf of the Floyd County Health Department with regard. 01:21:06
Regards to laying out the science at the hearing. 01:21:11
Doctor Harris. 01:21:17
Has indicated to me that he will be in attendance also so. 01:21:19
We will have individuals there to to lay out the. 01:21:25
How the process is going to work? 01:21:32
And, umm. 01:21:34
I think I've and I've talked to them. 01:21:37
In depth about this and I think that. 01:21:40
It's very, very positive. 01:21:43
In terms of yeah. 01:21:45
OK. We'll look for a motion to approve and move on to the public. Do we need a motion to approve on the notice of intent? 01:21:47
That's correct. 01:21:53
OK, make a motion to approve. 01:21:54
On the notice of intent for Floyd County on site Wastewater District. 01:21:57
I'll second. 01:22:01
All in favor, aye aye. I look for the same on Resolution 2025-09, appointing Scott Waters as hearing officer. I'll make a motion 01:22:03
for Floyd County Resolution 20/25/09. 01:22:09
Resolution for the Floyd County Commissioners appoint Scott Waters as the hearing officer for the establishment. 01:22:16
Of the Floyd County on site Waste Management District. 01:22:22
And I will just add one thing, Scott. 01:22:26
Was the Floyd Memorial Hospital's attorney for a number of years, so he's well versed in. 01:22:29
Health law also. 01:22:36
I'll second. 01:22:38
Of a motion and 2nd all in favor, aye aye aye. 01:22:39
All right, boarding committee reports. 01:22:42
What? I don't have anything today. 01:22:48
What I'm gonna wait for Closing comment for some. 01:22:50
OK, well, I was trying to keep up with Jason so. 01:22:53
April 2nd I attended State Board of Accounts annual training in Madison. 01:22:57
Umm, that was geared toward Township trustees, but they still covered. 01:23:03
Quite a bit of. 01:23:09
New law, umm. 01:23:11
April 4th I was with the Health department meeting reference to the new Floyd County Management Wastewater Management District. 01:23:13
April 5th I attended the NRA Banquet. For those who didn't make it, you missed a good time. 01:23:22
April 9th. 01:23:28
I was the guest at Southern Indiana. 01:23:30
Building and development association. 01:23:33
At Hubers I spent a couple hours listening to builders and developers. 01:23:36
About what their issues were at Floyd County. 01:23:42
And April 10th? 01:23:46
I met with Aaron Houchins, field Rep. 01:23:49
We discussed issues about county government. 01:23:53
I had lunch with the Windsor group that day. 01:23:57
And that's always interesting. 01:24:00
And then? 01:24:02
I was invited to dinner. 01:24:04
At Floyd County Farm Bureau. 01:24:06
That evening. 01:24:09
April 11th I supported Casa at their auction and dinner at Hubers. 01:24:11
And the 14th? 01:24:17
I was at the quarterly Board meeting of our. 01:24:19
J Rack. 01:24:22
And that's always interesting, too. 01:24:24
All right, wonderful. 01:24:27
You had nothing at the moment. 01:24:29
Now I'm gonna wait till. All right. Well, I left my list in the car from what I can remember. 01:24:31
I was at castle with you, I believe, and. 01:24:36
Senator Banks's new aides last week to try to get some. 01:24:41
Movement on a couple of our. 01:24:44
Stubborn projects and we had a redevelopment meeting this morning. 01:24:46
And then the usual fare so. 01:24:50
I'll look for approval of commissioners meetings. 01:24:53
For April 1st, 2025. 01:24:56
Motion to approve. 01:24:58
Second, all in favor, aye and approval of payroll and claims. 01:25:00
All is in order, and I'm doubly sure of that after my conversation. 01:25:05
Mr. Luke yesterday, All right. 01:25:09
Let's just approve. 01:25:11
A motion to. 01:25:12
Approved. Second. Second. OK, All in favor, aye. 01:25:14
Right public comment from any government officials. 01:25:18
I would just like to commend the commissioners for being aware of the massive impact that SB 1 is going to have on local 01:25:26
government. 01:25:30
And starting to put some. 01:25:35
Wagons in the circle because we'll have to. The council is going to have a large job ahead of them this year. 01:25:38
Our levees. 01:25:44
We're already going to have to be. 01:25:45
Reviewed and potentially redistributed to the levee driven funds. 01:25:47
SV 1 is going to be. 01:25:51
It's going to be interesting to deal with this year, so the public will definitely need to be ready for. 01:25:53
Something to change, Something will have to change. 01:25:59
You're not wrong that. 01:26:02
It will be services or it will be the way things are taxed, because if you want to keep your services. 01:26:04
Those finances have to be in place. 01:26:12
So it's. 01:26:14
It's going to be a very bumpy year, I believe when it comes to budgets and our financial plans, especially with all of the large 01:26:17
projects that our county has in motion right now. 01:26:21
So and I look at it. 01:26:26
As Floyd County is. 01:26:29
Small but mighty. But there's a lot of other larger counties that have even more. 01:26:31
Of an impact that they're going to feel from this so. 01:26:36
I think that even us as taxpayers need to be ready to see what happens. 01:26:38
I'm glad that you all are. 01:26:43
Already watching for it. 01:26:45
Thank you. 01:26:47
We're gonna need everybody's help on that. 01:26:48
Or another. 01:26:52
Go. 01:26:55
I County Council. 01:27:01
I just want to publicly. 01:27:03
Talk about my utter disappointment for. 01:27:06
SP1 passing last night and. 01:27:08
And its impact on all local units of government. 01:27:11
Not just counties. 01:27:14
Cities libraries. 01:27:15
Off this week in some areas. 01:27:17
Sometimes I wonder if they really understood what they did. 01:27:20
No, just a comment. I thought maybe I said this body that you all serve on. 01:27:24
And the body on which I serve. 01:27:28
Is considered a part time position. 01:27:30
Well, we're going to earn our part time salary this year going. 01:27:32
And going forward after that? 01:27:35
So. 01:27:38
And clothing as oh cliche buckle for the ride. 01:27:39
All right. Thank you. 01:27:43
All right, public comment. 01:27:47
Mr. 01:27:51
The old man George John. 01:27:56
Solid waste to me is is a lot of recycling. 01:28:00
Right. And that the biggest part. 01:28:03
See, we was on that. I went to a lot of those meetings and we just, we couldn't get nothing done. 01:28:05
Before when you all guys wasn't there. 01:28:10
We had Debbie Hall come down from Jackson County. They got one of the best programs in the country. 01:28:13
They have curbside recycling. 01:28:18
We talked to John Sweet one that he usually does most of the pickup in the county. 01:28:20
If you would talk to him, he does recycle. 01:28:25
There's ways to get we we can actually almost get rid of the whole program. 01:28:29
If we work, but if we got turned down there, we've been in the state. 01:28:34
Actually went to Annapolis. 01:28:37
On it. 01:28:39
There's things out there you can do, but we were. 01:28:41
The county just wouldn't do it. 01:28:44
The people on the county wouldn't do it. They wouldn't even look at. 01:28:46
Again, again, that's on top that, but it is available. Debbie Hall is her name. Jackson County, she runs. 01:28:50
Recycling up there. 01:28:55
She's been down here speak to us twice. 01:28:57
And we couldn't get nothing done. 01:28:59
Force nursing on the septic. 01:29:01
I guess another form of government to me. I know it's needed. 01:29:04
Because you could see it that septic tanks were found in some places and frankly. 01:29:08
You probably know more than I do where they are. 01:29:12
But also I'm worried about I think we have brought up. 01:29:15
When it was brought up, some person coming here. 01:29:18
They couldn't build their house. 01:29:20
And that's when this new system. 01:29:23
Was coming up the house wouldn't perk. 01:29:25
If it won't perk. 01:29:27
Can't build a house. 01:29:28
But if this is kind of where you can build a house, like you said, it wasn't for new, but I'm sure it's going to be used for new. 01:29:30
There's a lot of places in this county you can't build a house because it won't perk. 01:29:35
Well, it's not. 01:29:40
Just so you understand that's that statute is not to help people build offs where the land won't perk. 01:29:41
It's only for failed systems only. 01:29:49
That there's no remedy. 01:29:52
The house is already there. 01:29:54
I understand, but that's the first time I heard of when somebody come in one to build a house. Yeah. And she, I can't remember the 01:29:56
way it's been a while, but she come in and wouldn't do it. 01:30:00
And let's see, that's what it was, wasn't it? 01:30:06
But you could, they wouldn't do it, and she's the one introduced this system. 01:30:10
I don't know much about it. 01:30:14
Being asset thought had something else but I forgot about it. 01:30:16
Thank you. All right, thanks. Any other public comment tonight? 01:30:20
Closing remarks. 01:30:25
Yeah. 01:30:27
Yeah, I got a few. 01:30:29
So. 01:30:31
Since the weather event that started. 01:30:32
Around April 2nd as kind of. 01:30:35
Starting to wind down a little bit, You know, we had the the severe storms. 01:30:38
The tornado, you know, the floods. 01:30:43
You know, 1 area that was heavily impacted was. 01:30:46
Everywhere along the Ohio River, especially the 111 S corridor. 01:30:49
And I have received a lot of stories of some of. 01:30:53
Just good neighbors being neighbors, helping each other out, you know that were. 01:30:58
Checking up on one another, giving each other boat rides and having cars parked so they could get to work and stuff, you know? 01:31:03
A lot of times these these events happen, people are really hesitant to leave their homes because they don't want to be. 01:31:10
Looted. They don't want to see everything they work for. 01:31:17
Disappear, you know, so a lot of people shelter in place and. 01:31:21
You know, I was just, I was really glad to hear that. 01:31:24
These neighbors really kind of came together to to check on each other. 01:31:28
I know that I have been in contact a lot with. 01:31:32
Charlie Moon, who is the Franklin Township trustee. 01:31:36
He was extremely grateful for. 01:31:39
Floyd County EMA, especially Deputy Director Mock, who has. 01:31:42
Kind of went out of his way to make sure that communications were. 01:31:47
Were given to him on a daily basis so that could be disseminated to the people in that area. 01:31:50
So I just want to say thank you with that. 01:31:57
Regarding. 01:31:59
The passage this morning of Senate Bill 1, you know. 01:32:00
I think we're going to hear a lot about. 01:32:06
About this. 01:32:07
Over the coming days, weeks, months. 01:32:09
About how this is going to look like, yeah, even years. 01:32:12
I can tell you. 01:32:16
I'm very not very. 01:32:18
Pleased with it. I think a lot of people were hoping for some very meaningful property tax relief. 01:32:19
I don't think it hits those benchmarks at the same time. 01:32:25
It obviously has a negative effect on. 01:32:29
Several areas of public safety schools. 01:32:31
Libraries, whatever, you know, there's, there's just a lot of different districts out there. It's going to be hurt, but. 01:32:37
You know, as a leader, I just, I don't ever believe in putting people. 01:32:42
In a position of failure, and I think that's exactly. 01:32:46
What Senate Bill One does. 01:32:50
And it just seems to me here at the local level. 01:32:52
There's not been a whole lot of conversation, not a lot of dialogue. 01:32:56
About what our thoughts were, It just seemed like more. 01:33:00
Of an infliction of will and I'm extremely disappointed of everywhere from the. 01:33:03
Governor's office to the State Senate to the State House of Representatives. 01:33:08
Especially regarding public safety, you know, I've been in. 01:33:13
And public safety for 31 years and I can assure you. 01:33:17
For the people sitting those seats, I've never once seen them on anyone of my scenes so. 01:33:20
You would think a little bit of consulting would have gone a long way, but. 01:33:24
That's all. 01:33:28
Well said. 01:33:30
Right. No, Sir. 01:33:32
I said all I can. 01:33:34
All right. 01:33:35
Yeah, I agree with Jason and your thoughts on that the. 01:33:38
The coffee meetings that I did have with the state reps and Senate senators were very, very brief and to the point. Well, if you 01:33:43
need to make it up, you can raise the local income tax. 01:33:47
So. 01:33:53
My suggestion was if you want to. 01:33:53
Take care of. 01:33:55
Senior Hoosiers. 01:33:57
You know, uh. 01:33:59
And give them meaningful property tax relief. 01:34:00
You know, but nobody took me up on this, but if you lived in Indiana for 1015, whatever number of years it is, and. 01:34:03
You paid into the system, then maybe when you're 70 your property tax goes down by 10% per year, and by the time you're 80, you're 01:34:09
a golden Hoosier. You don't have to pay any property taxes ever again. 01:34:14
But. 01:34:19
I was thinking like 65 1/2. How old are you Frank? 01:34:20
60 Yeah, that's what I thought. OK All right, Well, maybe you'll get a new septic system Sunday. 01:34:25
Well, I think everybody agreed that there were some very meaningful ways that this could have been accomplished without the 01:34:32
negative effects that it had, probably more meaningful. 01:34:36
Throughout a few different, you know. 01:34:41
Ways to do it, but it is disappointing. 01:34:43
Nonetheless. 01:34:46
You know, I think it's. 01:34:47
It's insulting to a degree. You know, $300.00 for everything you're getting ready to lose. 01:34:49
I'm here to tell you, you're going to feel it. 01:34:54
Yeah, alright. 01:34:56
Well, our next meeting. 01:34:58
Is May 6th I believe. 01:35:00
That work right? 01:35:03
Tuesday, May 6, 2025, 6:00 PM. 01:35:04
It's been a pleasure, but I'll look for a motion to adjourn. So moved. 01:35:07
Thank you. 01:35:12

So moved. 01:35:07
Thank you. 01:35:12
