Yeah. What? I was going to have him for the public hearing. Yeah, yeah. | 00:00:07
Well, is it? | 00:00:12 | |
For the public hearing. | 00:00:18
OK. We do have a sign in sheet for the public hearing which will begin as soon as we can get one more person on line. | 00:00:20
Thomas Everett. | 00:00:29
It looks like areas right there. There he is. | 00:00:30
Is there any number wishes to sign in to speak at the public meeting? | 00:00:33
Here. | 00:00:39 | |
Public hearing, yeah. | 00:00:43
All right, I'll go grab that momentarily then. | 00:00:46
Hi, Sheriff. Thanks, Sheriff. Thank you. | 00:00:51
All right. We'll call to order this public hearing on proposed lease between the Floyd County, Indiana Building Corporation, Floyd | 00:00:56
County, Indiana. | 00:01:00
I do have two people signed in to speak on that and then. | 00:01:05
Let's say the Pledge of Allegiance for the commissioner's paintings. | 00:01:10
All right, so we'll begin. | 00:01:15
What? We asked Mr. Everett if he was. | 00:01:18
Opening comments, Yeah, we've got you here tonight and you're looking good. So, Mr. Everett, you have any opening comments with | 00:01:20
regards to this item before we open it up, Public comment. | 00:01:25
Yes. Thank you, Commissioners and good evening. | 00:01:32
So this, this public hearing is on at least as you said, between the Floyd County, Indiana Building Corporation and Floyd County. | 00:01:35
This lease was preliminary, preliminarily approved by the Board of Commissioners at your meeting on September 3rd. A notice of | 00:01:42
public hearing on the lease was then published and the statute requires that before taking final action to approve the lease, the | 00:01:49
Board of Commissioners hold a public hearing on that lease. | 00:01:56
And as you know from the preliminary approvals at the meeting earlier this month, this lease is to finance the acquisition, | 00:02:04
construction and renovation of a building. | 00:02:10
Purchased a building and renovated to serve as the county's public offices for certain departments. | 00:02:18
All right. | 00:02:27 | |
Any questions from the Board for Mr. Eckerd at this point? | 00:02:31
OK, we do have two people who signed up to speak, Mr. George Mauser. | 00:02:35
Answer. | 00:02:42 | |
George Mauser. | 00:03:03
If there's any drama. | 00:03:06
Involved in my appearance here. | 00:03:08
Tonight on a special occasion for me. | 00:03:11
It was not of my making. | 00:03:15
Age had something to do with it. | 00:03:19
I'm reading this tonight to you Commissioners. | 00:03:23
I have strong objections. | 00:03:27
To the encryption. | 00:03:29
Floyd County taxpayers for 30 years. | 00:03:31
A Three Floyd County commissioners. | 00:03:36
Who have demonstrated a lack. | 00:03:38
Of due diligence. | 00:03:42
And their official responsibilities. | 00:03:44
These men signed into ordinance. | 00:03:51
No Ordinance 24. | 00:03:55
2024 days 21. | 00:03:58 | |
That states under definitions. | 00:04:01
That it applies to the citizens of the city. | 00:04:05
City of Fishers. | 00:04:07
This FCO was published on August 14th, 2024. | 00:04:11
And again on August 21st, 2024. | 00:04:17
I have not heard of an excuse for this action. | 00:04:23
Obviously, because there is not. | 00:04:27
The commissioner's legal counsel, Rick Fox. | 00:04:33
Appears to be complicit in this. | 00:04:37
Fiat Co. | 00:04:41 | |
If he approved the FCO. | 00:04:42
But he did not sign. | 00:04:45
If this complicated and inexact 30 year obligation is established. | 00:04:49
Taxpayers who are not yet born. | 00:04:56
Will be paying for this through no fault of their own. | 00:04:59
And in harsight, in hindsight. | 00:05:05
In their hands. | 00:05:09
Could see it as foolish or worse. | 00:05:11
There will be a history of this action for the next generation to review. | 00:05:16
And names of the principal actors will be shown. | 00:05:21
I have a neighbor whose 1st birthday was celebrated a week ago. | 00:05:26
And another neighbor who is 7 years old. | 00:05:33
I have an obligation to urge extreme caution. | 00:05:38
And imposing this sort of handicap. | 00:05:42
On their future if they own property in Florida County. | 00:05:45
To spend 1.5 million. | 00:05:51
In tax dollars per year. | 00:05:54
For 30 years. | 00:05:57 | |
And then take ownership from a third party. | 00:05:59
Of a building that will probably be called obsolete. | 00:06:03
And unusual by then. | 00:06:08
Is short sighted. | 00:06:10
Meantime, Floyd County would share the occupancy. | 00:06:13
Of this building. | 00:06:17
To get other tenants out is a long term goal with. | 00:06:19
Maybe the exception of change? | 00:06:24
This third party, Smoke County, Indiana had a building corporation is a mystery. | 00:06:27
An unelected and as yet unnamed group. | 00:06:35
With loosely defined salaries and duties. | 00:06:38
It is not necessary to be involved in such an indirect and. | 00:06:43
Convoluted purchase. | 00:06:47
Better options are available with the use of huge diligence. | 00:06:50
I wrote this myself. I didn't have anybody dictating anything to me. | 00:06:56
I brought it myself because I feel very strongly about this. | 00:07:02
And I wrote it. | 00:07:06
Because it's not mental agility is is. | 00:07:09
Pretty much shot. | 00:07:11
I think that. | 00:07:14 | |
Mental acuity is dependable. | 00:07:16
If I can sit down and say. | 00:07:19
And work through something. | 00:07:21
I believe my mental acuity is still solid. | 00:07:23
Amount of agility. | 00:07:27
Ain't what it used to be. Thank you, thank you, thank you. For the record, we have named the members of the Commission correct at | 00:07:29
a public meeting. | 00:07:33
And and there is no salary for that position either, correct? | 00:07:39
OK. | 00:07:45 | |
For the record. | 00:07:47
I mean, those members, again, are Tom Jones. | 00:07:50
The white and. | 00:07:53
Rosenbaum, you're talking about building incorporate, yes, Yes. | 00:07:56
And I'm sorry, yeah, with no salary. | 00:08:00
Mr. Moore. | 00:08:04 | |
Joseph Moore, Georgetown Township Unlike him, I can't vouch for my own mental acuity, and I anyhow, I was two things I want to | 00:08:12
discuss. | 00:08:17 | |
One, George had reminded me. | 00:08:22
About due diligence, I've been attending these meetings for a long time where some of you were on the board. | 00:08:24
I have noticed that far more often than not. | 00:08:33
The elected officials up here. | 00:08:36
Will sign or approve of something based primarily if not solely upon the say so of one of our paid consultants being counsel | 00:08:39
director. | 00:08:45 | |
Auditor's office. And what you still want me was I only knew 1 Commissioner. | 00:08:52
That personally reviewed all the payroll and claims. Now some may have, but normally they would go look over there and as long as | 00:08:58
it said nothing extraordinary, unusual bang. | 00:09:03
These kind of things. | 00:09:09
Actually need to be reviewed. I think the worst example was when they sold the hospital a joint board up here. I had looked the | 00:09:11
stuff up and done my due diligence. | 00:09:16
The members were so hurried to sign this thing. | 00:09:22
At a fire sale rate, because we had budget deficits, there was a possibility DRGF action and it was election year. | 00:09:26
The contract had not even been drafted yet and they were voting to approve it. They didn't know any of the major provisions about | 00:09:34
it. They didn't even know what the value of the hospital was until I asked about this Rep. So he is right about due diligence. | 00:09:40
It's you really have to read everything you're considering or ask the questions. I know some of you do, but by and large for the | 00:09:46
history, my history here has been the exception. | 00:09:52
The other thing I want to speak on was. | 00:10:00
This is the first step and maybe a two-part plan for the. | 00:10:02
Possibility of reconstruction wherever new city, county building. | 00:10:08
If my memory of all these last two years of meetings is our. | 00:10:12
It's correct. I would ask because at the one meeting whether it was presentations. | 00:10:16
Bowling boards and everything. The one consultant when asked about the referendum. | 00:10:23
You're putting on a referendum that said that he was suggesting creative financing. | 00:10:30
Creative financing to get a major project under the trigger amount for referendum. It's corruption, it's not creative. It's taken | 00:10:36
the power of the people away, the voice of the people away. And I'm asking that I know this project is not in the referendum law, | 00:10:44
but I'm asking if there's another phase of this that requires over 18 million or whatever the trigger man is. | 00:10:53
I'm asking for honesty and transparency and that that matter be put up a referendum, not for creative finance. | 00:11:02
Thank you. | 00:11:09 | |
All right. Couple comments before those were the only two speakers we had. So a couple comments on that. | 00:11:11
At a previous joint meeting, I think a strong majority of those present council and commissioners were in favor of new | 00:11:17
construction for a judicial center. And I believe many of us, and I believe I was on the record of that, as well as saying if | 00:11:23
there's a referendum that's going to need to be happening, then it shall happen. | 00:11:29
And you know, we'll run up the flagpole, we'll see what happens. | 00:11:36
So I'm of a mind that the building is going to have to be replaced one way or the other. | 00:11:41
But to reference a. | 00:11:45
Of necessary. | 00:11:47
Part of that with regards to. | 00:11:50
Review and due diligence. | 00:11:55
What you see us doing up here? | 00:11:57
Is but a fraction of the review that takes place. You're probably aware of the fact that we give these documents several days in | 00:12:00
advance and they're reviewed. | 00:12:05
Separately, and then there's some joint communication back and forth. | 00:12:11
So I'm confident that the majority of these are reviewed in detail. | 00:12:15
With regards to why no excuse has been rendered for the fishers IN ordinance, it's because I have no excuse. I read through that | 00:12:19
ordinance, I did not catch it and therefore I'm not going to try to make an excuse where it was just an error on my part. So. | 00:12:26
My wife were here. She would tell you very loudly and clearly that I am not infallible. We have. | 00:12:33
Probably she catches me on one or two things per day and is kind enough to only mention them. | 00:12:40
Perhaps once a month or something like that, but no excuse given because no excuse exists for it. | 00:12:44
I just did not catch it on the review. | 00:12:51
Well, and I'd like to make one comment and that is that I drafted that ordinance and I was using an ordinance from that location | 00:12:53
and I missed it. And you know that in terms of catching that, I had caught that and redrafted it before anybody else even knew | 00:13:02
about it and had it on the table to be passed again at the next meeting. | 00:13:11
And you know, I've been drafting ordinances for 18 years now. | 00:13:21
And so that's one that got by me. I didn't see that it was in the very top part of the ordinance. And so but I take full | 00:13:25
responsibility for that. | 00:13:31
Any other public comment on the public hearing? | 00:13:41
If not, I'll make a motion to adjourn. | 00:13:45
Motion to adjourn Second. | 00:13:48
And I'd like to call to order the Floyd County Commissioners meet for September 17th, 2024, 6:00 PM. If you'll please join me in | 00:13:51
the Pledge of Allegiance. | 00:13:55
I pledge allegiance to the flag of the United States of America and to the Republic for which it stands, one nation under God, | 00:14:03
indivisible, with liberty and justice for all. | 00:14:08
All right, everyone will please join me in a brief moment of silence, your individual prayer, meditation or reflection as we | 00:14:17
prepare for tonight's. | 00:14:21
Discussion meeting. | 00:14:26
All right. Thank you very much. And reminder on cell phones, if you have one, please just to silence that, if you will. | 00:14:43
We'll begin with new business parks in Thornburg and Mr. Thomas Everett. | 00:14:50
And Floyd County Resolution 2424-15. | 00:14:54
Good evening again, Commissioners. | 00:15:02
Having held the public hearings and release. | 00:15:04
This resolution takes final action to approve the lease and authorizes the commissioners to execute the lease. | 00:15:07
It also approves. | 00:15:15
The project. | 00:15:18 | |
It also approves. | 00:15:22
The issuance of bonds by the building Corporation to finance the purchase of the building and renovations to the building in an | 00:15:24
amount not to exceed $12,500,000. | 00:15:30
It also authorizes the building corporation to issue bond anticipation notes prior to the issuance of the bonds in an amount not | 00:15:37
to exceed $10,500,000. | 00:15:43
And finally, in Section 6, it authorizes any member of the board. | 00:15:51
And core of the County Council to. | 00:15:56
Take any actions to. | 00:15:59
Complete the execution and delivery of the lease and the issuance of the bonds by the building. | 00:16:01
I'm happy to answer any questions that you may have on resolution. | 00:16:08
Alright, then I will look for a motion to approve. | 00:16:23
All right, I'll make a motion to approve Floyd County Resolution 2024, Dash 15, the approving of an executive lease. | 00:16:26
Motion a second. All in favor, aye. | 00:16:34
All right, that carries and item 1B approval Eastern new county government Center. | 00:16:37
Mr. Everett, that's also under your bailiwick, but. | 00:16:47
You can also have UN present that joint. | 00:16:51
Yes. So the resolution the. | 00:16:56
Commission just approved authorizes the execution of police and it approves the form of police. So from our perspective, no | 00:17:00
additional approval is required to approve the lease. | 00:17:06
But we would ask that the commissioners sign and execute the lease at the end of the meeting here tonight. | 00:17:14
OK. | 00:17:21 | |
Do I have the original on this glory? | 00:17:24
I know that you had the originals on some paperwork tonight and I was holding some of the others. | 00:17:27
In the meantime, I'll seek approval to move forward with this. | 00:17:39
Police motion so moved I'll second motion is second all in favor, aye. | 00:17:42
All right, just let me know Glory, and I'll hold on to the copy that I have. | 00:17:50
All right. Thank you. Any other questions or business for Mr. Everett? | 00:17:58
We can hang around if you want. | 00:18:05
Thank you, Commissioners. Thank you, Sir. | 00:18:09
All right, do business #2 County Attorney Rick Fox. | 00:18:12
You have in front of you the McClure encroachment agreement. That was an encroachment on an easement that the county has for storm | 00:18:17
water, and storm water board approved the encroachment. | 00:18:25
And so that has been drafted and executed by Mcclure's and is here for your approval. | 00:18:33
All right. I think we've been through this two times at stormwater meetings for a motion to approve. So moved like what or a | 00:18:43
second OK, motion to approve in a second. I'd like to compliment the Mcclure's outlook. I don't think they're here tonight. I'd | 00:18:49
like to compliment you guys on. | 00:18:54
Your approach to this whole thing. I know it can be trying and. | 00:19:01
You come here and it's kind of like the Wizard of Oz Tony will help you, but you have to bring us to the broomstick of the Wicked | 00:19:05
Witch of the West. And then you do that and then we try to get you to do something else. So I really appreciate your approach to | 00:19:11
this and I hope this you can get your garage up and running through your workshop OK. | 00:19:17
All right, a motion a second. All in favor. Aye. All right. | 00:19:23
Thank you guys and I have the original on that. | 00:19:27
OK, so item 2B. | 00:19:32
And that is an independent contractor contract for an inspector for our building department. | 00:19:35
And. | 00:19:43 | |
I forget his name but he has credentials in Jeffersonville doing work for them. | 00:19:45
Larry Wallace. | 00:19:51
Larry Wallace yes, and so. | 00:19:52
That is really consist of two parts, just the contract itself and then we also have. | 00:19:57
An independent contractor form that will ask him to sign that's part of Indiana Workers Compensation Act. | 00:20:03
And his signature there verifies that he's an independent contractor and if anybody from his. | 00:20:11
Either him or his company is injured that he's responsible for that, not the county. | 00:20:19
Motion to approve Yes, the contract for the inspector. | 00:20:25
For I before I get. | 00:20:30
For Floyd County. | 00:20:32
I'll second. OK, I have a motion in a second. Any further discussion? | 00:20:34
Just a comment. I mean the whole impetus for this is to hopefully speed up the process for builders and developers. | 00:20:39
We've gotten behind through I believe either an illness or an injury in one of our our folks so. | 00:20:48
An interim step to keep keep things moving. So motion second all in favor, aye? | 00:20:54
Right. That passes and then I would like unanimous consent to add an item C to Mr. Foxes agenda tonight specifically. | 00:21:01
To allow Jason to sign a permit. | 00:21:10
That's a proposed permit. | 00:21:16
Far the Clarke Floyd landfill. | 00:21:18
Continues to chug along and the rationale for that is I'm going to be leaving town tomorrow on Thursday morning and John's little. | 00:21:23
Leg strong. | 00:21:33 | |
Not able to Friday so. | 00:21:36
Motion to approve. I'll second. OK, All in favor, Aye. All right. | 00:21:39
Agenda item 3 A bid opening for the old Vincennes Rd. slide. | 00:21:46
We have how many jobs? I believe we have three of them. Do you have anybody else who would like to? | 00:21:52
Submit a bid or proposal tonight. | 00:21:56
OK. | 00:22:02 | |
First one is CNR construction. | 00:22:03
Thank you. | 00:22:19 | |
All right. C&R construction. | 00:22:27
3,257,000. | 00:22:30 | |
$747 even. | 00:22:32 | |
2nd 2nd bid is Mac construction. | 00:22:46
Right Mac Construction $2,823,000. | 00:23:13
There's even 282-3000. | 00:23:17
And the final bid is E&B paving. | 00:23:22
Take a moment to try to find it here. | 00:23:47
When she looked through that one about what 3 weeks were. | 00:23:50
All right, E&B paving $3,225,000 even. | 00:24:19
322-5000. | 00:24:24 | |
And that's all we have. | 00:24:28
Make a motion to take these under advisement, Horatio. Is that correct? | 00:24:31
All right. Motion a second to take those bids under advisement. All in favor, aye? | 00:24:35
Thank you. Thank you. | 00:24:41
Mr. Don Loft, Director of operations and Planning. | 00:24:44
I. | 00:24:52 | |
Good evening. First item I have is a building is a contract amendment for the red wire building that's for an additional $129,403 | 00:24:57
dealing with electrical conduit. | 00:25:02
That means we run throughout the park. | 00:25:08
That is being paid through a $38,000 deduction. Regarding that we were able to do the savings on the contract and then 70,000 is | 00:25:11
going to be on investments that we are investing in the bond proceeds and we have that funds and then 21,000 will be from shift | 00:25:17
revenue. | 00:25:23 | |
So you need a motion and Don, I'm sorry, I was just needing motion to if you. | 00:25:37
So choose to approve that amendment. Motion to approve red wire building amendment as outlined by Don Loft a few minutes ago. I'll | 00:25:41
say our motion is second. Any further questions discussion. | 00:25:48
Any other change orders coming down the pipe that we know we hope to have some actual some deductions on the side and so that that | 00:25:56
should be forthcoming probably the next month or so. OK, the motion is second all in favor, aye. | 00:26:03
Motion carries. The second item is just an approval for staff to send a letter to INDOT regarding State Road 64. This is the | 00:26:10
second. This is a permit being requested by Nob Hill and basically as part of their permit request, a letter from the local | 00:26:18
authority noting their intent to take over the maintenance of the public roads required now. | 00:26:26
And so they are going to be. | 00:26:35
Building an intersection, obviously State Road 64 and we would since that is a platted subdivision, we are going to take over that | 00:26:38
road that's already been planted in. | 00:26:42
But in that needs a letter stating that we intend to do so. | 00:26:47
And financing is already in place on that. That's going to be 100% on the developer. | 00:26:53
So it's just basically again stating what was stated in the plat, that they want a letter from the authority, from the local | 00:26:58
authority. | 00:27:02 | |
That's what I thought. Have that stated publicly. All right, look for a motion for approval. So moved second. | 00:27:06
Motion and 2nd all in favor, aye. | 00:27:14
3rd item I have is an amendment to 24. | 00:27:18
202425 The Arkansas American Rescue Plan. | 00:27:22
This is amendment amendment to allocate $160,000 in Charlestown Rd. Trail for construction inspection. That's a 9010 and dot | 00:27:26
reimbursement so that just cash flows the. | 00:27:32
Contract for that project which my understanding is about ready to start so pre construction. | 00:27:39
Motion to approve with unanimous consent Floyd County Ordinance 2024-25, our Plan amendment. | 00:27:48
Motion in a second. All in favor, aye? | 00:27:57
Anything else? Just a little bit of update regarding open since Rd. Highlander Point project. | 00:28:01
There are still 2 utilities that have they're finishing up being getting off right away for the project. We're going to send out | 00:28:08
an update letter. We're looking for a March 1st start date and actually having that road close for March 1st, July into July to | 00:28:15
get that project completed. | 00:28:21
Which two utilities are they done? I still waiting to hear from AT&T and Crown. Which? | 00:28:30
I think a fiber provider OK, but mainstream is complete. Is that correct? My understanding mainstream and charter are both | 00:28:36
complete and off and. | 00:28:39
Have gotten off good deal, so AT&T has yet to respond. | 00:28:44
They haven't responded back to the e-mail I think you all received on maybe a week or so ago saying that. | 00:28:50
Their contacts was get back to me, they last communications I had, they had 80 hours of work left to do for splicing. | 00:28:57
OK. All right. Thank you very much. Thank you. Appreciate it. | 00:29:07
All right, Sheriff Bush. | 00:29:12
Thank you. You have two eyes before you this evening. | 00:29:17
Corrections contract is the first item, so back in August you ought to prove the negotiated contract. | 00:29:21
Then they went to the council on three different times and the third time they approved the contract. | 00:29:28
On that third time there was a slight language clarification and I believe you all have had that updated and so it's before you | 00:29:34
tonight for pre approval if you will. | 00:29:39
Steve, let me ask you. | 00:29:47
And I think I read it in the newspaper. | 00:29:50
So the. | 00:29:54 | |
Those that are on a 12 hour work day, they're they're getting 12 hour sick days, is that correct? | 00:29:55
It's 96 hours, 96 hours, 812 hour days. The clarification language was before when you all approved it, it was 96 hours for | 00:30:02
everybody. So there were, there were some folks working eight hours ago getting 96 hours. So some of the Councilman Striegel has | 00:30:09
some issues with that and want some clarification. And then if we ever would change a schedule down the road that we would go back | 00:30:17
safely, went back to 8 hours for everybody and it would go back to the hours of 64. So 8-6 days to 8 hours. | 00:30:24
If that was to happen, though, that would be something that we'd have to come back and renegotiate anyway because it's in the | 00:30:32
contract, correct? Absolutely. OK. | 00:30:36
Let me ask you, does? | 00:30:40
Is the right stuff? Is that our? | 00:30:43
Does write stuff. | 00:30:45
Which is specific to law enforcement. So is that an hours or days? | 00:30:48
Accurately. OK, so. | 00:30:56
This gets approved and whatever days, the fact that people before that that have accumulated a sick time. | 00:30:58
They would be in in hours. Is that correct? | 00:31:04
So then going forward and they would add that to that then so at the end so that I just make sure there's. | 00:31:08
There's a proper way to keep things segregated so you don't get. | 00:31:14
Standard Bill, take care of that, OK. I just want to make sure, yeah. | 00:31:20
All right. Any other questions for the sheriff? | 00:31:28
No, no. For a motion to approve the revision, I'll make the motion to approve the revised contract for the corrections department. | 00:31:31
I'll second the motion. Is second all in favor, Aye. | 00:31:37
The second item you have is. | 00:31:43
We're transferring a vehicle to Prosser. | 00:31:46
So you should have a. | 00:31:49
Resolution 2024. I'm not sure the number, there are numbers been signed to it. | 00:31:52
Says 16/20/24 Dash 16. | 00:31:58
So we're nice to transfer in that vehicle to processor for the for the usage. | 00:32:03
So I have it with me tonight, a resolution unless you have a copy and then I. | 00:32:07
Indeed as well. | 00:32:11
I just want to say that I think that is a great use of that vehicle to pass on to these these kids that are interested in becoming | 00:32:14
law enforcement officers, processors, just a wonderful resource that we have around here. And they have a lot of great programs. | 00:32:20
They have a we donated a fire truck to them last year. So, yeah, yeah. So we thought it was a great reuse of the vehicle. | 00:32:26
And I think Mr. Fox had dropped up a resolution as well for the school board, I believe. So we're in communication with them once | 00:32:34
you all approve it this evening, and then either all people for them or the attorney will handle it. | 00:32:39
And then we'll have them approve it as well, so we have all of our ducks in a row. | 00:32:45
Rick, is this required for all assets that we transfer to another entity outside of Floyd County? Well, there's different ways to | 00:32:50
handle it and we thought this is the best way to handle for the automobile, OK. | 00:32:56
And that is, you know. | 00:33:05
Dealing with two. | 00:33:07
Government agencies like we have going ahead and having basically mirror resolutions where each of the boards pass, one agrees to | 00:33:11
pass the asset, the other receives to receive the asset, OK. | 00:33:17
The reason I bring this up is because, you know, a lot of times we get audited in SBOA and. | 00:33:24
I think this is a. | 00:33:29
A good paper trail. You know, and I hate to bring this up, but you know, we had a command center. | 00:33:31
Was purchased a couple years ago and that I understand was was given to Washington County and I don't remember seeing any kind of | 00:33:36
resolution. | 00:33:40 | |
You know to you know, to do that it just here it is. And so I applaud you for doing this that way. We've got a paper trail and I | 00:33:45
think we should have done the same thing when we got rid of the old command center and bought the new command center. | 00:33:51
So thank you. | 00:33:58 | |
You're welcome. | 00:33:59
All right, look for a motion to approve. I'll make a motion to approve. Floyd County Resolution 2024, Dash 16, the transferring of | 00:34:02
property, Prosper Career Education Center. | 00:34:06
Second, all right, motion. Second. All in favor, aye. | 00:34:12
I do have one clarification for Mr. Fox in terms of the deeds, so I'll wait till after meeting for you to sign it out as | 00:34:16
President. But as far as the deed goes, you want that to go with the resolution to the scoreboard once we determine. | 00:34:21
How that gets there? You mean the title? I'm sorry, the title. | 00:34:27
Yeah, yeah. | 00:34:30 | |
Who however they want it titled. | 00:34:34
So that just asked John Woodard. | 00:34:37
Gotcha. Thank you very much. | 00:34:39
Thank you. | 00:34:41 | |
All right, board and committee reports. | 00:34:43
Well, it's been easy two weeks as far as that's concerned. | 00:34:48
Now we had a redevelopment meeting this morning and then we had an executive meeting about a week ago along with our solid waste, | 00:34:53
but. | 00:34:57 | |
And pretty quiet so. | 00:35:01
I just got a few things here, just want to. | 00:35:04
Point out the negotiations negotiations with the collective bargaining unit for the road department is still ongoing and then. | 00:35:07
You know we will be having an EMS Task Force meeting on September 25th at 1:00 PM. It is a public meeting and if you are able to | 00:35:15
are able to attend, I'd encourage you to be there. If you're not able to attend then it will be streams. One other piece of | 00:35:21
business I have is I'd like to read into the record. | 00:35:27
Piece of information that we got today from our EMA that all three commissioners have signed. It's a situation assessment for | 00:35:35
emergency and the declaration of fire emergency. | 00:35:40
Significant fire risk in Floyd County for Fall of 2024 Dated today at September 17th, 2024, The Board of the Floyd County | 00:35:45
Commissioners declares a state of emergency specifically concerning open burning and fireworks for Floyd County to be renewed | 00:35:51
every seven days, continuing until a date to be determined in the future. | 00:35:57
NOW, therefore, we, the Floyd County Board of Commissioners, declared that a state of emergency exists in the County and that we | 00:36:03
hereby invoke and declare those portions of the Indiana Code which are applicable to the conditions and have caused the issuance | 00:36:09
of this proclamation to be in full force and affected in the County. For the exercise of all necessary emergency authority for the | 00:36:14
protection of the lives and property of the people of Floyd County and the restoration of local government with a minimum of | 00:36:20
interruption. | 00:36:25
References hereby made to all appropriate laws, statutes, ordinances, resolutions, and particularly Section 10-4-1, Dash 23 of the | 00:36:31
Indiana Code. | 00:36:35
All public offices and employees of Floyd County are hereby directed to exercise the utmost diligence and the discharge of duties | 00:36:40
required for of them and the duration of the emergency and execution of emergency laws, regulations and directives, state and | 00:36:45
local. | 00:36:50 | |
All citizens are called upon and directed to comply with the necessary emergency measures, to cooperate with the public officials | 00:36:55
and disaster services forces in executing emergency operations plans, and to obeying completely comply with the laws of properly | 00:37:01
identified officers. All operating forces will direct their communications, a request for assistance and operations directly to | 00:37:07
the Floyd County Emergency Management Operations Center at Witness Warehouse. We have to set our hand the 17th day of September, | 00:37:12
2024. | 00:37:18 | |
Alcanable John Shellenberger and myself. | 00:37:25
And can borrow our EMA director. | 00:37:28
Anything else? | 00:37:32
OK, I. | 00:37:34 | |
And that'll be posted. | 00:37:36
Through EMA as well, yes. | 00:37:39
Their communication. | 00:37:41
9/11 Went to the Caesars Foundation meeting the foundation. | 00:37:44
Executive director announced his resignation at that time, effective early October I believe is Josh Cornwaller. So we're looking. | 00:37:50
To replace that internally we're. | 00:37:58
With the board out there a 912, Sheriff Bush and Chief Perkins gave me a nice detailed tour of the Denzinger Building and other | 00:38:00
adjacent structures. | 00:38:05
Like the eighth time I've been through there, but I think the third time with you so. | 00:38:11
Brainstorm about possibilities down there as space becomes available. | 00:38:15
From there went to a ribbon cutting for a new local business, Associates of Pediatrics. | 00:38:21
Out on Charleston Rd. in the old. | 00:38:27
Of Grant Line Rd. up in Mount Tabor out the old DMV building out there. | 00:38:29
At 3:00 on 9/12 we had a Floyd County Health Department executive session to discuss. | 00:38:35
Possible purchase of a new home for them? Umm. | 00:38:39
And I believe that's going to be discussed in further detail at the joint meeting this Friday. Danny Short was there, so he'll be | 00:38:44
leaving that that communication. I've transferred some of those materials over to John as well. | 00:38:50
And then from that meeting went to 4:00 over at the Floyd County Open Door Youth Shelter. | 00:38:57
And. | 00:39:03 | |
It's interesting they have a. | 00:39:06
Access to a fairly sizable matching grant for capital projects. | 00:39:09
That would expire in 2028, so we probably need to bring that into communication with regards to upgrades or movement. For that it | 00:39:14
was through. | 00:39:18 | |
Metro United Way, I want to say it was for close to a half, $1,000,000 so. | 00:39:23
And that's what I have. | 00:39:28
So. | 00:39:31 | |
Moving forward, the Marine Corps League requests a roadblock on October 12, 2024, from 0900 to 1400. | 00:39:33
Pike and Scottsville Rd. collecting donations for Toys for Tots. | 00:39:40
Motion to approve and I'll second. | 00:39:45
All in favor, aye. I'll look for approval of the Commissioners meeting minutes for September 3rd, 2024. Motion to approve and I'll | 00:39:47
second. | 00:39:52 | |
All in favor aye and approval of payroll and claims for September 17, 2024. | 00:39:57
Motion to approve and I'll second. OK, All in favor, aye. | 00:40:04
A public comment momentarily. The next Commissioners meeting is Tuesday, October 1st, 2024 at 6:00 PM. | 00:40:10
We also did have a solid waste meeting today at 4:30. | 00:40:15
And I think I saw our current director, Scott Stewart, exiting the building. | 00:40:20
He's announced his. | 00:40:26
Resignation and so that body is also. | 00:40:28
Looking into transition for that and Scott's left us in good shape on. | 00:40:31
Possible transition? | 00:40:35
So can't speak high enough about the way he's comported himself during all of this. | 00:40:38
All right, public comment. | 00:40:43
Yes. | 00:40:47 | |
Oh, Steve, you want? | 00:40:50
OK, I have him down second tonight, but that's that's OK. | 00:40:54
Firstly, I'd like to apologize to the Board of Commissioners of the public here. I have an out of State College student that is | 00:40:59
programmed to ring through no matter what my phone is set on, so my apologies. | 00:41:04
Secondly, just for clarification and transparency. | 00:41:09
You would be amazed at the questions that I get from the Board of Commissioners concerning claims and payroll that they review, | 00:41:14
and they do actively review it. | 00:41:18
I get. | 00:41:23 | |
I get some very interesting questions concerning purchases and validation, so please be rest assured they pay attention to what | 00:41:24
comes across. | 00:41:28
I'm well aware, but the ones that we currently have do an excellent job. | 00:41:39
Thank you. What college is that? | 00:41:44
Intern program. | 00:41:47
I'm sorry, what college is that intern from? | 00:41:49
Did you say you got a dollar? Came through? Oh, my college student. My out-of-state college student, Yes. University of | 00:41:52
Cincinnati, OK. | 00:41:55
BearCat Yeah, we'll take that. | 00:41:59
Wasn't was it UK? | 00:42:02
All right, Sheriff Bush. | 00:42:05
I wasn't asking he's a UFK fan. | 00:42:07
I know my audience just don't bring up the Cowboys right? Public comment. | 00:42:13
Mr. Moore Yeah. | 00:42:18
Joseph Morgan. | 00:42:26
The burn ban. Understandable. Good idea. I got a suggestion and question. | 00:42:27
One I might suggest, if it's not already, perhaps putting notice in the newspaper because a lot of people I know that burn. | 00:42:34
Stopped in the yard. They don't bother looking on the county page for this. | 00:42:43
And if you put it in the paper, you reduce the chance of neighbor versus neighbor being upset to burning. I say this last year | 00:42:48
when my neighbors burned so many green leaves and a stinking little campfire ring. The wind was blowing it in. That's a choking me | 00:42:55
out of the house. I asked him to stop. He wouldn't actually have to call the fire the Township fire official. | 00:43:03
But if there's a burn ban and it's publicized, it might be due satisfaction. | 00:43:12
My second question is. | 00:43:17
Does that include the burned barrels that are popular? Is that considered an open burn? | 00:43:20
And a lot of people do that. Anything that's not used for cooking is considered OK. All right, all right. Because some of my | 00:43:27
neighbors ask me these things. My third thing is if there is somebody, we had some renters up the street not two weeks ago | 00:43:32
shooting all fireworks on a weeknight kind of late. If there is so many violation in the evening, who can people notify Sheriff's | 00:43:38
Department? | 00:43:43 | |
Sheriff's Department. | 00:43:49
Yeah, I just seem that you hate to call 911 because something's. | 00:43:51
They have a non-emergency line as well. 24/7 They did all right. Thank you. 945-8400 or 7. | 00:43:57
Search for. | 00:44:08 | |
Yes, Sir. | 00:44:12 | |
We'll have to look into a portable microphone. | 00:44:17
Since it's on the record, we'll have to come over there. Sorry. | 00:44:21
Public. | 00:44:31 | |
Was there a publication? | 00:44:32
Made of this meeting. | 00:44:34
Comments. | 00:44:37 | |
On on the leaves. | 00:44:38
Bill. The lease was advertised pursuant to statute. | 00:44:41
Was there any public? | 00:44:48
Publication of this me. | 00:44:50
This meeting or the public hearing? | 00:44:54
I'm surprised there's only two people concerned that. | 00:45:00
I spoke up in turn that. | 00:45:04
Well, not only did we have advertisement that were pursuant to state statute, but we also had multiple other meetings that have | 00:45:08
addressed this. | 00:45:12
So we have had other, we have had other public comment along the way with regards to commissioners meetings, perhaps council | 00:45:16
meetings. Denise Compton was there, she might answer that. But certainly at the joint meetings as well, they've all been | 00:45:22
publicized. We've discussed those and we'll continue to do so. | 00:45:27
Now, the meeting wasn't the hearing was the hearing. The hearing was and the hearing was advertised. Was that publicly advertised? | 00:45:34
That's what I said. The hearing was publicly advertised. | 00:45:40
It was published, yes. | 00:45:47
That's what he's saying is it was publicly advertised, yes. | 00:45:49
You've had you've had years filled up. | 00:46:00
And there's such a thing as a county going bankrupt. | 00:46:05
Is that right? | 00:46:08
Is that possible? | 00:46:10
We can't meet. We can't meet our. | 00:46:14
Our budget. We have trouble meeting our budget. We have to. | 00:46:18
Found all kinds of ends and else. | 00:46:21
Pass a budget. | 00:46:23
And and then we spend. | 00:46:26
Millions and millions of dollars on something like Nova Nova Park. | 00:46:28
Having trouble making their damn budget? | 00:46:34
That I could stand here and complain all night, but I. | 00:46:37
To be disadvantaged much good. | 00:46:43
Stopping there. | 00:46:46
Thank you. Thank you, Sir. | 00:46:48
Yes. | 00:46:51 | |
The old Man Georgetown. | 00:46:57
We've been asking you keep raising our taxes, raising our taxes, raising. | 00:47:00
We've asked for efficiency study for years and years and years. | 00:47:04
What reassures does the public have that were we run efficient government? | 00:47:07
You don't have one. | 00:47:13
And we've asked and asked and asked. | 00:47:16
One time we was given 30, it was given $30,000 to do. Efficiency never was done. | 00:47:18
But you spend money. You all spend money on everything to try to get more money, but you never spend no money trying to save | 00:47:24
money. | 00:47:27 | |
And that's the question I'm asking. Why don't you do something to try to save money instead of keep raising our taxes? | 00:47:31
Because this, this, the whole group is tax, tax, tax. | 00:47:38
And that's why your history will go down. | 00:47:42
Biggest tax increases we've had in this county forever. Thank you. | 00:47:44
Thank you. | 00:47:48 | |
Any other public comment this evening? | 00:47:51
If not, I will look for a motion to adjourn. Motion to adjourn. | 00:47:54 |

Yeah.
