Second, I'm just giving you an update regarding Oak Vinson's road. That project is was to start July or June one. It was pushed 00:13:33
back to June 17th. Harrison County REMC has finished their relocation of the utilities, but AT&T Charter and Mainstream still are 00:13:40
in various processes of moving their lines and burying their lines. 00:13:48
We have, we've been communicated and I have Bill Hawkins here with Strand if you have any specific questions. But we've been 00:13:58
communicating that we're looking at an additional six weeks before we can close the road and get started. That was two weeks ago. 00:14:05
So we're looking at definitely at least probably 4 weeks, but. 00:14:12
Possibly up to six in terms of getting the utilities relocated. 00:14:20
I will say that the utilities were given notice to proceed in October 23 and so there's. 00:14:26

There are two funds, 12:37 and 12:38. 00:23:25
That have been ordered by the commissioners. In 2021-2022 there were two major lawsuits settled, one for 26 billion and one for 00:23:29
13.8 and these were both connected to the opioid crisis. As most of you know, over the years there's been allegations that the 00:23:35
pharmaceutical companies suppress knowledge of the addictive quality of certain opioids which cause normal people on these pills 00:23:41
become addicted. 00:23:48
So in a settlement of that. 00:23:55
Approximately 50 billion was distributed to states all over the US and Floyd County being a county municipality benefited from 00:23:56
that. We have two separate funds that you created, 12371238, which will distribute over the next 15 years, six and a half million 00:24:04
dollars. One will be in an abatement funnel which is for treatment that's about 2/3. One is in another funnel to be used more 00:24:11
generously in opioid and that's why we're here tonight. 00:24:18
I'll let Judge Siller go first and then. 00:24:26
Sheriff Bush and I'll go next. She'll be dealing with the 12:30 second seven restricted funds. But before I get started. 00:24:29
The impact to our communities. 00:24:39
Cannot be judged by 6 1/2 billion dollars or six and a half million dollars. 00:24:42

I would dare say that everyone has a family or friend who has dealt with addiction. I can say I have multiple family and friends. 00:24:48
And I bet if I ask this whole room, including the commissioners and the attorney here, I bet everyone of us will raise our hand, 00:24:54

So this won't solve the problem, but we're going to make a start. 00:25:05
Probably one of the biggest things any county's done. Indiana, my knowledge, the most determined, visionary effort of this council 00:25:08
and commissioners to put this in safe funds for the next 15 years to be used to combat drugs through treatment and interdiction. 00:25:17
I'm just really impressed by the vision. 00:25:26
And Attorney Fox has developed these ordinances in conjunction with us and the commissioners. But I'm so impressed by this vision, 00:25:29
and I hope we can do it to stop future addiction and help those who are in the throes of addiction. So I'll turn it over to Judge 00:25:34

Yes, I'm Judge Kerry Stiller, Floyd's Peer Court One. I'm here today as the chair of our Floyd County J Rack and that stands for 00:25:48
the Justice Reinvestment Advisory Council. I know you all are very familiar with it for, but just for those who may be here in the 00:25:56
meeting or watching the meeting that are not. This is a statutory group created by our legislature or governor and it is actually 00:26:05
we have about 38 members on our J Rack, the large majority of whom are. 00:26:14
Stakeholders in our community, such as you know, John Schellenberger is a on the committee as a representative from the 00:26:23
commissioners. We have two council persons, all of the judges, the sheriff, the chief deputy. 00:26:31
Prosecutor. 00:26:41
Public defender on and on and on. There's 38 people I won't belabor, um. 00:26:43
You with all of their names, but we do have Floyd County website. But I will take you back to last year February 2023. And if you 00:26:48
will recall this was at the beginning of when the funds had been started coming in with the first deposit I think last year from 00:26:56
the settlement and the commissioners made the decision to. 00:27:04
Utilize J Rack as a mechanism for. 00:27:14
Making recommendations to the commissioners as to how these funds ought to be spent in order to really fight the opioid epidemic 00:27:18
and. 00:27:24
The. 00:27:31
The lawsuit and sort of the strings attached to that from the state do have certain requirements and reporting. There are certain 00:27:32
expectations for how this money is to be spent and we call it Exhibit E, but there is a very lengthy multi page list of acceptable 00:27:40
opioid repeat remediation uses is the language of that exhibit. And so that's sort of the directive of Jreck and what we've been 00:27:48
following and so last year. 00:27:57
The Commissioners voted that first allotment of money which included both restricted and unrestricted funds of about $846,000 was 00:28:05
assigned to J Rex sort of make recommendations and several of them you had already approved. And we have been working on marching 00:28:13
down that road and I would say more recently just as an update as well. And also this was a directive and request specifically at 00:28:21
the commissioners to open up to our local community for the opportunity for agencies. 00:28:29
Organizations within our community to apply for access to the funds. So sort of like a grant, although not a grant, it would just 00:28:38
be to apply for funding. So we have created an application approved by the commissioners and Mr. Fox and that application went out 00:28:45
to the public and is open and we're accepting applications on that through August. But bringing us to today, there were a couple 00:28:52
issues. First, there was the issue of an additional this vision. 00:28:59
That Chris Lane was talking about that the commissioners have for additional interdiction uses for the money of the unrestricted 00:29:07
funds, some of which were included in that assignment from the first fund, the first funds that came in. And the other thing was 00:29:14
that that that this money is going to continue to come in and wanting to have a plan with what to do with that. And so with that 00:29:22
we worked with Mr. Fox in drafting a proposed ordinance and that ordinance is before you and that's. 00:29:30
Entitled Fund 1237 because that's the name member of the fund opioid restricted funds. And essentially what it would do is it 00:29:38
would name the Floyd County J Rack as the Advisory Board for the expenditure of these funds. And ultimately though it would be at 00:29:47
the commissioners approval. And so that is the first fund and then I'll leave it to the others to explain. 00:29:55

And that's through the drug dealers target teenagers and once they get them, they got an endless supply. 00:31:01
They got an endless economic source because that person has to have it. 00:31:07
We intend to catch the drug dealers and I intend to throw them in jail as long as I can so they don't poison our community because 00:31:13
we want treatment for those addicted. But those who are selling and addicting others and our kids, we want to stop them to the 00:31:17
fullest in the law. 00:31:22
And make sure they don't want to come back here. Nothing makes me happier when I hear a drug leader say I shouldn't have come to 00:32:01
Floyd County. Because you know what? They shouldn't. They should stay where they are. 00:32:06
But they shouldn't come here because Sheriff Bush and I intend to throw him in jail. 00:32:12
That's what we intend to do and that's what we believe this will help. And the prosecutor after me and the sheriff after. 00:32:16
Share Bush. They'll be able to do it too, hopefully. Because this gives us 15 years, 15 years of health. I just can't thank you 00:32:22
enough for the vision, your show. I can't. I mean, it's amazing. 00:32:27

To the federal and state settlement. 00:34:37
And run the language of it, but generally these negotiated settlements, so for the actors for that time period. 00:34:39
Mr. Fox probably speak to that too. That's probably close as that there'd have to be new instances found or other bad actors. I 00:34:46
think that they would have to identify for more settlement. My understanding is Johnson and Johnson. I think Lilies and some 00:34:52
others, this was their way of settling that kind of dispute with the 26 billion, the 13.8 with CVS, Walgreens and some others 00:34:58
retailers more so that was just settled. That complaint doesn't mean that if new things arise, I didn't think that it stops you 00:35:04
from moving forward. 00:35:10
But my my belief is that that settles those claims. Do you have any knowledge of that? It doesn't and. 00:35:17
That means the funds are closed in. In terms of what we get, I think there's still. 00:35:24
Some other bad actors out there that they're going after and in terms of trying to get additional funding, but we'll see. But 00:35:31
we've also been in contact with attorney's office as well and thanking them for their work on that as well, especially Attorney 00:35:37
General Todd Rakita. So we spoke to their office as well as we approach through this process. And also the monies will continue. 00:35:44
So if we don't spend it all, this is not a time frame I'm aware that we have to spend the money so. 00:35:50
I would only just add it's just a reminder, we did get $180,000 to fund our jail transition coordinator in the Sheriff's Office 00:36:01

That have been ordered by the commissioners. In 2021-2022 there were two major lawsuits settled, one for 26 billion and one for 00:23:29
13.8 and these were both connected to the opioid crisis. As most of you know, over the years there's been allegations that the 00:23:35
pharmaceutical companies suppress knowledge of the addictive quality of certain opioids which cause normal people on these pills 00:23:41
become addicted. 00:23:48
So in a settlement of that. 00:23:55
Approximately 50 billion was distributed to states all over the US and Floyd County being a county municipality benefited from 00:23:56
that. We have two separate funds that you created, 12371238, which will distribute over the next 15 years, six and a half million 00:24:04
dollars. One will be in an abatement funnel which is for treatment that's about 2/3. One is in another funnel to be used more 00:24:11
generously in opioid and that's why we're here tonight. 00:24:18

Sheriff Bush and I'll go next. She'll be dealing with the 12:30 second seven restricted funds. But before I get started. 00:24:29

Probably one of the biggest things any county's done. Indiana, my knowledge, the most determined, visionary effort of this council 00:25:08
and commissioners to put this in safe funds for the next 15 years to be used to combat drugs through treatment and interdiction. 00:25:17
I'm just really impressed by the vision. 00:25:26
And Attorney Fox has developed these ordinances in conjunction with us and the commissioners. But I'm so impressed by this vision, 00:25:29
and I hope we can do it to stop future addiction and help those who are in the throes of addiction. So I'll turn it over to Judge 00:25:34

Yes, I'm Judge Kerry Stiller, Floyd's Peer Court One. I'm here today as the chair of our Floyd County J Rack and that stands for 00:25:48
the Justice Reinvestment Advisory Council. I know you all are very familiar with it for, but just for those who may be here in the 00:25:56
meeting or watching the meeting that are not. This is a statutory group created by our legislature or governor and it is actually 00:26:05
we have about 38 members on our J Rack, the large majority of whom are. 00:26:14
Stakeholders in our community, such as you know, John Schellenberger is a on the committee as a representative from the 00:26:23
commissioners. We have two council persons, all of the judges, the sheriff, the chief deputy. 00:26:31
Prosecutor. 00:26:41
Public defender on and on and on. There's 38 people I won't belabor, um. 00:26:43
You with all of their names, but we do have Floyd County website. But I will take you back to last year February 2023. And if you 00:26:48
will recall this was at the beginning of when the funds had been started coming in with the first deposit I think last year from 00:26:56
the settlement and the commissioners made the decision to. 00:27:04
Utilize J Rack as a mechanism for. 00:27:14
Making recommendations to the commissioners as to how these funds ought to be spent in order to really fight the opioid epidemic 00:27:18
and. 00:27:24
The. 00:27:31
The lawsuit and sort of the strings attached to that from the state do have certain requirements and reporting. There are certain 00:27:32
expectations for how this money is to be spent and we call it Exhibit E, but there is a very lengthy multi page list of acceptable 00:27:40
opioid repeat remediation uses is the language of that exhibit. And so that's sort of the directive of Jreck and what we've been 00:27:48
following and so last year. 00:27:57
The Commissioners voted that first allotment of money which included both restricted and unrestricted funds of about $846,000 was 00:28:05
assigned to J Rex sort of make recommendations and several of them you had already approved. And we have been working on marching 00:28:13
down that road and I would say more recently just as an update as well. And also this was a directive and request specifically at 00:28:21
the commissioners to open up to our local community for the opportunity for agencies. 00:28:29
Organizations within our community to apply for access to the funds. So sort of like a grant, although not a grant, it would just 00:28:38
be to apply for funding. So we have created an application approved by the commissioners and Mr. Fox and that application went out 00:28:45
to the public and is open and we're accepting applications on that through August. But bringing us to today, there were a couple 00:28:52
issues. First, there was the issue of an additional this vision. 00:28:59
That Chris Lane was talking about that the commissioners have for additional interdiction uses for the money of the unrestricted 00:29:07
funds, some of which were included in that assignment from the first fund, the first funds that came in. And the other thing was 00:29:14
that that that this money is going to continue to come in and wanting to have a plan with what to do with that. And so with that 00:29:22
we worked with Mr. Fox in drafting a proposed ordinance and that ordinance is before you and that's. 00:29:30
Entitled Fund 1237 because that's the name member of the fund opioid restricted funds. And essentially what it would do is it 00:29:38
would name the Floyd County J Rack as the Advisory Board for the expenditure of these funds. And ultimately though it would be at 00:29:47
the commissioners approval. And so that is the first fund and then I'll leave it to the others to explain. 00:29:55

And that's through the drug dealers target teenagers and once they get them, they got an endless supply. 00:31:01
They got an endless economic source because that person has to have it. 00:31:07
We intend to catch the drug dealers and I intend to throw them in jail as long as I can so they don't poison our community because 00:31:13
we want treatment for those addicted. But those who are selling and addicting others and our kids, we want to stop them to the 00:31:17
fullest in the law. 00:31:22
And make sure they don't want to come back here. Nothing makes me happier when I hear a drug leader say I shouldn't have come to 00:32:01
Floyd County. Because you know what? They shouldn't. They should stay where they are. 00:32:06
But they shouldn't come here because Sheriff Bush and I intend to throw him in jail. 00:32:12
That's what we intend to do and that's what we believe this will help. And the prosecutor after me and the sheriff after. 00:32:16
